DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Jack A. Benaroya Company is the owner of the following real property
in the City of Renton, County of King, State of Washington, described as follows:
(See attached legal description - Exhibit "A")
N WHEREAS, the owner of said described property, hereinafter "the property,"
� desixes to impose the following restrictive covenants running with the land as to

� use, present and future, of the property;

--r- NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes

(�- restrictions and covenants running with the land as to the use of the land
hereinabove described with respect to the use by the undersigned, their successors,
heirs and assigns, as follows:
ROADWAY IMPROVEMENT
Upon request of the City of Renton Land Use Hearing Examiner, a street is to be
constructed from S.W. 41st Street to what is to be S.W. 39th Street. Said street
shall be required by the City of Renton Land Use Hearing Examiner only in the event
said street is required in the final plat of Orillia lndustrial Park. Furthermore,
said street shall conform to the requirements of the final plat of Orillia
Industrial Park and conform with the concept and the location specified in the
approved site plan (File No. SA-216-78; Exhibit "B") for development of the
buildings on the property. Construction of said street shall occur coincidentally
with construction of what is to be s.w. 39th Street including that portion of the
connector street lying north of the Burlington Northern right-of-way.
DURATION
These covenants shall run with the land and expire at such time as the aforesaid
street has either been completed or certified by the City of Renton Land Use Hearing
Examiner as not required pursuant to the final plat of Orillia lndustrial Park.
