Dahlby are the owners of the ' following real property in the C� ty of Renton, County of King, State of Washington , �'7 described as follows: __.. � Lot 22, Block 21 , C. D. Hillman's Earlington Gardens Addition Ok � to the City of Seattle, Division No. l , according to plat �, recorded in Volume 17 of Plats, Page 74, in King County, Q Washington, except that portion thereof condemned in King � County Superior Court Cause #588861 . � WHEREAS, the owners of said described property, hereinafter "the property," I desire to impose the following restrictive covenants running with the land as to use, present and future, of the property; NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns, as follows: LANDSCAPE REQUIREMENTS A ten (10) foot landscaped buffer shall be required along the northern property line adjacent to FAI-405. A twenty (20) foot buffer shall be required along the western property line along Maple Avenue S.W. in which no structure or building may be constructed, and of which the westerly ten (10) feet is landscaped. A six (6) foot high sight-obscuring fence shall be required along the southern property 1 i ne. ADJACENT DEVELOPMENT If the subject lot is developed in conjunction with any adjoining lot, the setback and landscaping requirements of the Manufacturing Park (M-P) zone of the City of Renton shall apply to the property. This condition is not intended to include the state-owned parcel north of the subject lot if that is acquired and developed with the subject lot. DURATION These covenants shall run with the land and expire on December 31 , 2025. If at any time improvements are installed pursuant to these covenants , the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining subject property who are adversely affected by any violation or breach of these restrictive covenants.
