WHEREAS, PUGET SOUND POWER & LIGHT COMPANY, a Washington Corporation,
is the owner of the following real property in the City of Renton, County
of King, Stare of Washington, described in Exhibit 'A' att-azhed and made a
part hereto.
WHEREAS, the owner of said described property agrees to impose the fol-
lowing restrictive covenant running with the land as to use, present and future, i
of the above described real property.
WHEREAS, this covenant is a condition of issuance of' a building permit
for the Talbot Hill Switching Station Microwave Tower Communications Building.
0 NOW, THEREFORE, the aforesaid owner hereby establishes, grants and im-
� poses a covenant running with the land' hereinabove described, which shall
� become effective only after the aforesaid building permit has been issued,

heirs and assigns, hereby agrees and covenants to participate `��''��St� ��i���

in, sign a petition in support of, and accept any future Local
Improvement District (LID) or city initiated proposal, and pay
their fair share therefore, for the purposes of providing the
necessary off-site improvements required by the the Renton Sub-
division Ordinance in conjunction with their application for a
building permit to construct a microwave tower communications
building within the existing Talbot Hill Switching Station.
Provided, however that the owner, its successors, heirs and
assigz�s, does,not waive the right to object to or protest the
�;�,�o13�wing aspects of any such LID or city initiated proposal:

paving, sanitary sewers, storm sewers, undergrounding of util-
ities, and street lighting.
This covenant is imposed in lieu of Section 9-1105(6) of Title
IX or Ordinance 4i1628 of the City of Renton.
DURATION
This covenant shall run with the land and expire on December 31, 2025. �
If at any time improvements are installed pursuant to this covenant,
the portion of the covenant pertaining to the specific installed
improvements as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation.

Any violation or breach of this restrictive covenant may be enforced by
proper legal proce_dures in the Superior Court of King County by either
the City of Renton or any property owners adjoining subject property
who are adversely affected by said breach.

523.7 feet and south 45°07' 05" east 283 .0 feet from the
