WHEREAS. G�INDELL CORPORATION are owners of the following real property
in the City of Renton, County of King, State of Washington, described as Exhibit "A"
attached here.
WHEREAS. the owners of said described property desire to impose the following
restrictive covenants running with the land as to use, present and future, of the above

� NOW, THEREFORE, the aforesaid owners hereby establish. grant, and impose

,..,�� restrictions and covenants running with the land hereinabove described with respect to the
� use by the undersigned, their successors, heirs, and assigns as follows:

BALES/DENTON REZONE
1. All parties shall agree not to protest the Formation nf or participation in a
Local Improvement District (L.I.D.) for road improvements along N.E. 4th
Street (S.E. 128th 5treet) if and when such an L.I.D. is proposed by the City
of Renton or adjacent benefiting property owners.
2. All of the subject properties shall retain all established accesses for
existing uses until such time as they desire to develop or redevelop.
3. Site Plan approval shall be required for any subsequent development or
redevelopment af all subject properties.

4. At the time of any future development or redevelopment all parcels along
N.E. 4th Street (S.E. 128th Street) shall contribute on a front footage basis
their fair share of the costs of making necessary road improvements
including signalization. channelization. and restriping. All those property
owners with frontage along 136th Avenue S.E. shall also contribute on a
front footage basis their fair share of the costs to whatever range of
improvements is deemed appropriate thefe by the City of Renton.
5. At the time of future development or redevelopment access to Parcel ��1
shall be by 136th Avenue S.E. only.
6. At the time of future development or redevelopment Parcel i�2 shall be
required to access primarily off of 136th Avenue S.E.; and if secondary
access is desired off of N.E. 4th Street (S.E. 128th Street). Parcel ��2 must
conclude a joint (common) access agreement with Parcel ��3.
7. Dedication of the easterly thirty (30) feet of Parcel ��4 for the widening of
Duvall Avenue N.E.

These covenants shall run with the land and expire on December 31, 2025. If at any time
improvements are installed pursuant to these covenants, the portion of the covenants pertaining
to the specific installed improvements as required by the Ordinances of the City of Renton shall
terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may be enforced by proper legal
procedures in the Superior Court of King County by either the City of Renton or any
property owners adjoining subject property who are adversely affected by said breach.
