THIS DECLARATION OF COVENANTS , CONDITIONS & RESTRICTIONS ,
(This "Declaration" ) is made by FIRST CITY DEVELOPMENTS CORP . ,
referred to as "Declarant" .
WHEREAS , Declarant is the owner of certain property (the
"Property" ) in King County , Washington , more particularly
described in Attachment l , which by this reference is incor-
porated in this Declaration . The City of Renton , within whose
jurisdiction the Property is located , approved a Final PUD
for the Property as Phase II of the Victoria Hills PUD (City
�`' of Renton File No . FPUD-042-85) . The City of Renton conditioned
� that approval upon the execution of certain restrictive co-
Ovenants , which this Declaration hereby establishes .
`tj�j The Declarant declares that the property shall be held ,
Ocouveyed , developed and occupied subject to this Declaration .

ARTICLE I
DEFINITIONS
SECTION l . l . Words Defined . For the purpose of this
Declaration and any amendments hereto , the following terms
shall have the following meanings :
1 . 1 . 1 . "Declarant" shall mean FIRST CITY DEVELOPMENTS
CORP . , its successors and assigns .
1 . 1 . 2 . "Declaration" shall mean this Declaration of
Covenants , Conditions and Restrictions for Phase II , Victoria
Hills PUD , as it may be from time to time amended .
1 . 1 . 3 . "Property" shall mean the area legally described
in attachment l , which area constitutes the territorial extent
of Phase II , Victoria Hills PUD .
ARTICLE II
COVENANTS , CONDITIONS & RESTRICTIONS
2 . 1 All buildings within or on the Property shall be con-
structed with an exterior finish of cedar siding or approved
equal wood siding serving the same purpose as cedar siding ,
but not T-111 siding or plywood siding . Roofs of all buildings
shall be constructed with the surface being cedar shake or
composition roofs heavily textured to visibly resemble cedar .

2 . 2 Landscaping , including possibly view-obstructing plant
materials shall be installed and maintained , especially in
those areas between the proposed development and the single
family units in Phase I of Victoria Hills PUD , such install-
ation and maintenance to be approved by the City of Renton .
2 . 3 Natural slopes and landscaping shall be preserved
in those areas of the site not subject to the proposed develop-
ment of roads or building pads in accordance with the plans
approved by the City of Renton .
ARTICLE III
DURATION
�' The covenants , conditions and restrictions of this Declar-
pation shall run with and bind the Property and shall inure
, � to the benefit of and be enforceable by the City of Renton .

� SEVERABILITY

The provisions of this Declaration shall be independent
and severable , and the uninforceability of any one provision
shall not effect the enforceability of any other provision .
ARTICLE V
EFFECTIVE DATE
This Declaration shall be effective upon recording .
ARTICLE VI
ASSIGNMENT OR TRANSFER BY DECLARANT
Declarant reserves the right to assign , transfer , sell ,
lease or rent all or any portion of the Property and reserves
the right to assign or transfer at any time all or any of
its rights , duties and obligations created under this Declar-
ation .
