Sa�1d heretofore mentloned grantee, 1ts successors or asslgns� shall have
the rlght� rrithout prlor notice or proceeding at law� at such times as may be
necessary to enter upon said above descrlbed property for the purpose of construct-
1ng� malntelning� repairin9� altering or reconstructing sald uti11t1es� or making
any connections therewith� without incurring any legal obllgations or 1lability
therefore� provided� that such constructlon� malntaining� repalring� altering or
reconstructlon of sald uti11t1es shall be accomplished 1n such e rtuinner that the
prtvate .lmprovements exltting 1n the rlght(s)-of-way shall not be dlsturbed or
damaged� they will be replaced in as good a condltlon as they were lmmediately
before the property was entered upon by the Grantee.
The Grantor shall fully use and en,joy the aforedescribed premises� including
the right to retaln the ri9ht to use the surface of sald right-of-way if such use
does not interfere with installatlon and maintenance of the ut111ties. However,
the grantor shall not erect buildings or structures over� under or across the
rlght-of-way during the existence of such utillties.
Th1s easement, shall be a covenant running wlth the land and shall be binding
on the Grantor, h1s successors, helrs and asslgns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
rlght to execute thls agreement. ,
