WHEREAS, Service Corporation Washington, a Washington
Corporation, is the owner of the Greenwood Memorial Park in
Renton, Washington, the legal description of which is hereinafter

N WHEREAS, application has been made for the issuance of a
ppermit to excavate or continue excavation and refilling of a

°� portion of the described property; and
WHEREAS, as a condition of issuance of excavation and
refilling permits, the City of Renton has required th�t the
Declaration and Recording of these Covenants; it is
HEREBY DECLARED, STATEB AND COVENANTED as follows:

applies to the excavated, to be excavated and filled and to be
refilled portion of the following described property:
The Northwest quarter of the Northeast quarter of
Section 16 Township 23 Noith Ran�e 4 East W:M.
EXCEPT the North 45 ' thereof;
EXCEPT the South 15 ' thereof;
EXCEPT the North 330 ' of the West 230 ' thereof (also
known as the North 300' of the West 200 ' of Tract A of
the P1at of Greenwood Cemetery, �ccording to the Plat
thereof recorded in Volume 22 of Plats, page 35,
records of King County, Washington. )
2. More specifically the area excavated and refilled is as
set forth in the engineering drawings prepared by John R. Ewing
and Associates, dated August 6, 1987�, and which are attached
hereto as Exhibits "A" and "B" and incorporated herein by
reference.

3 . This Declaratian of Covenants shall be appurtenant �a
the praperty; shall run with the land; and shall be binding upon
I the Declarant, Service Corporation Washington, its successors or '
assigns.
4. While excavation and refilling a� portions of the
foregaing described property is pursuan�. to permits issued by the
City of Renton, which permits limit ta some extent the kinds of
material that can be used for refilling, it is declared,
recognized and acknowledged that even i£ excavated areas are
refilled in camplete compliance with City permit requirements
that the property once refilled might not be suitable tor any
future uses or uses.
5. It is declared, recognized and acknowledged that any use
or uses to which the present or subsequent owner, successar or
assigns migh�. wish to put the praperty might require geotechn.ical
' review to determine conditians existing under the surface and i
whether such soils and conditions are suitable for the intended �
use.
i 6. The gresent cantemx�lated use of the por�ian af the
subject property which is to be excavated and re£illed is for
cemetery purposes, and a certified geotechnical con:sultant has
formulated a method for refill in the excavated area so as to be
I suitable for use for ceme�ery purposes, and absent monitoring or
supervision of such refilling or absent refilling of the
excavated area in the prescribed manner, the excavated and

� refilled area shall be subject �o a comple�e geotechnical survey
