hereinafter called "Grantor(s)," and the CITY OF RENTON, a Municipal Corporation of
King County, Washington, hereinafter called "Grantee."
WITNESSETH:
That said Grantor(s), for and in consideration of the sum of One Thousand Nine
Hundred Ten and No/100 Dollars ($1,910.00) paid by Grantee, and other valuable
consideration, do by these presents, grant, bargain, sell, convey, and warrant unto the said ',
Grantee, its successors and assigns, an easement for public utilities (including water and sewer) ',
with necessary appurtenances over, through, across and upon the following described property
in King County, Washington, more particularly described as follows: ,
Parcel "A" Permanent Easement I
.� A strip of land, 15 feet wide, situated within the City of Renton and being described in the
� northwest quarter of Section 5, Township 23 North, Range 5 East, Willamette Meridian, lying '�
� within the following described parcel of land: 'I
O Lots 7 and 8, Eldon Acres, according to the plat thereof recorded in Volume I1 of Palts, I,
� Page 86, in King County, Washington; EXCEPT the North 120 feet of the East 130 feet
� of Lot 7; AND EXCEPT the South 64 feet of Lot 8.

Said 15-foot strip of land being 10 feet westerly of and 5 feet easterly of the following
described line:
Commencing at the southeast corner of said Tract 9; thence North 88° 36' 23" West,
243.72 feet, along the south line of said Tract to the True Point of Beginning; thence
North 15° 45' 37" West, 67.25 feet, more or less, to the north line of the above described
property and the Terminus Point of the said 15-foot wide strip of land.
Containing an area of 2,944 square feet, more or less.
Parcel "B" Temporary Construction Easement
A strip of land, 10 feet wide, lying westerly of and coincident with the westerly line of
the above-described, 15-foot strip of land, Parcel "A".
Containing an area of 1,743 square feet, more or less.
Parcel "C" Temporary Construction Easement
A strip of land, 5 feet wide, lying easterly of and coincident with the easterly line of
the above-described, 15-foot strip of land, Parcel "A".
Containing an area of 1,069 square feet, more or less.
Note:Side lines for Parcels "A", "B", and "C" to be lengthened or shor����o,��d at the #04?4 �

Said temporary construction easements are to be in full force and effect for a continuous
one-hundred twenty day period to be chosen by the City which period shall be sometime
between July 1, 1990 and September 30, 1992.

Said heretofore mentioned grantee, its successors or assigns, shall have the right, without
prior notice or proceeding at law, at such times as may be necessary to enter upon said above
described property for the purpose of constructing, maintaining, repairing, altering or
reconstructing said utilities, or making any connections, therewith, without incurring any legal
obligations or liability therefore, provided, that such construction, maintaining, repairing,
altering or reconstruction of said utilities shall be accomplished in such a manner that the
private improvements existing in the right(s}-of-way shall not be disturbed or damaged, they
will be replaced in as good a condition as they were immediately before the property was
entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises, including the right to
retain the right to use the surface of said right-of-way if such use does not interfere with
installation and maintenance of the utilities. However, the grantor shall not erect buildings or
structures over, under or across the right-of-way during the existence of such utilities, except
upon written approval by the Director of Public Works.
This easement, shall be a covenant running with the land and shall be binding on the
Grantor, his successors, heirs and assigns. Grantors covenant that they are the lawful owners of
the above properties and that they have a good and lawful right to execute this�greement.
