Said heretofore mentioned grantee, its successors or assigns , shall
have the right, without prior notice or proceEding at law, at such times as
may be necessary to enter upon sa�d above described property for the purpose
of constructing, maintaining, repairing, alteri�g or reconstructing said
utility, or making any connecticns therewith, without incurring any legal
obligations or liability therefore°, provided, that such construction, main- -
taining, repairing, altering or� reconstruction of such utility shall be
accomplished in such a manner that the private improvement� existing in the right
right(s)-of-way shall not be disturbed or damaged, or ir the event they are
disturbed or damaged, they will be replaced in as goo� a condition as they were
imrnediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises,
including the right to re tain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility
line. However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement, shall be a covenant running with the land and shall be bin�- '
ing on the urantor, his success�rs , heirs 3t'ld assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have � g�od and
lawfu +ght to eke te this a reer�ent. ' '
