MODIFICATION OF
DECLARATION OF RESTRYCTIVE COVENANTS
WHEREAS, Clayton Smith and Ruth Smith, husband and
wife, �.he former owners of that real praperty ("Property")
�r located in the City of Renton, County of Iiing, State af
� Washington, fully described in Exhibit �'A" attached hereto,
� entered into a Declaration of Restrictive Covenant�
Q (�'Declaration") in an undated document recorded on July 1,
LA 1968 as Document No. 6370351; and

�'"� WHEREAS, the former ownars o� said Praperty desired to
•�"r impose a series of restrictive cavenants running with the
� land as to the use, present and future, of the Property; and
�
WHEREAS, as recited in said Declaration, "Any violation
or breach of any of these restrictive covenants may be
enfarced by proper legal pracedures in the Superior Court of
King County by either the City af Renton or any property
owners adjoining the subject property who are adversely
affected by said breach�' ; and
WHEREAS, WILLIAM M. BEGHTOLD and DUANE A. BLAND
("B&B") , the current owners of the Property wish to have the
original Declaration modified in arder to construct a multi-
unit real estate deveZopment project on the Property; and
WHEREAS, B&8 has proposed ta the City of Renton and the
five (5} current landawriers ad�oining the Praperty that the
original Declaration be modified as described below; and
WHEREAS, the City of Renton and the five (5} current
landowners adjoining the Property have a31 agreed to the
modification af the original Declaration as described below;
NOWTHEREFORE, the ariginal Declaration is modified as
follaws with a11 changes noted by underlining:
1. SETBACKS - No buildings or structures shall be
located within eighty (80} feet of the north property 1ine.
2 . HEIGHT LZMIT - On2y two t2} buildings shall be

constructed within the eighty (80) to one hundred (100) foot
property lines running parallel to the north property line
at an average building height limited to thirty (30) feet.
3 . LANDSCAPING - The initial (4) feet adjacent to the
north property line shall be appropriately landscaped and
maintained continuously in a neat and clean manner. The
remainder of the setback area not required to be landscaped
may be utilized for off-street parking purposes as provided
in the ordinances of the Cit of Renton. An future

include a landscape plan to the satisfaction of the City of
Renton which provides for the obscuring of automobile and
truck headlights of vehicles entering any parking areas
I nearest to the north property line.
All other terms and conditions contained in the
original Declaration, except those modifications noted
� above, shall remain in full force and effect.

SCREENING

LANDSCAPING
The initial four (4) feet adjacent to the

north property line shall be appropriately
landscaped and maintained continuously in
a neat and c1Ean manner. The remainder of
the setback area not required to be land-
scaped may be utilized for off-street parking
purposes as provided by the laws and ordinances
of the City of Renton.
Any violation or breach of any of these restrictive covenants may
be enforced by proper legal procedures in the Superior Court of
King County by either the City of Renton or any property owners
adjoining subject property who are adversely affected by said
breach.
