WHEREAS, the owner of said described property desires to impose the following restrictive covenants running with the land as to use, present and future, of the above described real property. NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes restrictions and covenants running with the land hereinabove described with respect to the use by the undersigned, their successors, heirs, and assigns as follows: BESTRICTIVE COVENANTS Development of an apartment pro3ect on the Property shall be pursuant to that certain site plan (the "Site Plan") prepared by JohnsonBraund design group, inc. and David Evans and Associates, Inc. , dated January 20, 1989 and revised March 24, 1989, consisting of pages Pl to P5, copies of which � are attached hereto as Exhibit B, submitted to the Office of the Hearing Examiner, City of Renton at a public hearing on May 9, 1989, as described � in the Report and Recommendation of the Hearing Examiner dated May 23, � 1989, sub�ect to the conditions of Site Plan approval as set forth in said ,� Report and Recommendation and sub3ect to the following: c"d �, 1. In order to mitigate sesthetic impacts to the site and the �� ad�acent community, Owner shall not construct more than 82 dwelling C� units on the Property. � � 2. In order to mitigate storm water run-off impacts to the site and � � neighboring properties, Owner shall develop a storm water management/erosion control plan sub�ect to approval by the City of Renton Public Works Department. 3. In order to mitigate impacts to the natural environment, aesthetic impacts, noise impacts and light and glare impacts, Owner shall develop a landscape plan and on-site lighting plan, sub�ect to approval by the landscape planner of the City of Renton. 4. In order to mitigate aesthetic impacts and recreation impacts, Owner shall develop a plan for open space/recreation areas on the Property, sub�ect to approval by the landscape planner of the City of Renton. 5. In order to address on-site and off-site traffic impacts on S.E. 76th Street and Lake Washington Boulevard in a manner which ' protects vehicular and pedestrian traffic from hazards/inconvenience � created by limited sight distance, steep grade at ingress/egress ' points and limited levels of service at access routes to the Property, Owner shall: a. Provide a regular driveway entrance and exit onto Lake Washington Boulevard N.E. conforming to the City of Renton standards for width, slope and sight distance, provided that such ,_ �- . driveway access to Lake, Washington Boulevard N.E. shall be � �� ,, - limited to right-in/right-out turning maneuvers. y r .- b. Owner shall pay its proportional costs of signalization of both I-405 ramp intersections at the NE 44th Street exchange, equal to $4,000. 6. In order to mitigate construction related impacts, Owner shall provide a) an erosion control plan; b) a plan for wheel-washing of construction vehicles on site to minimize tracking of dirt and debris off-site; c) a plan for periodic wetting down of the construction site to minimize dust and debris; d) a plan for hours of operation and haul routes to minimize traffic impacts, sub�ect to approval by the Public Works Department of the City of Renton; and e) a bond in the amount of $3,000.00 to the City of Renton for street clean-up. EFFECTIVE DATB AND DIIRATION These covenants shall be effective upon the effective date of the ordinance as approved by the City of Renton City Council annexing the Property into the City of Renton. These covenants shall run with the land and expire on December 31, 2025. If at any time improvements are installed pursuant to these covenants, the portion of the covenant pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation .
