WHEREAS the City of Renton and the RENTON HOUSING AUTHORITY each �
own portions of the real property in the City of Renton, County of King, State of � ,
Washington, as described in 'Exhibits "A" and "B" attached hereto, and z

WHEREAS the Building/Plan Review #8789 for the RENTON SENIOR HOUSING �
PROJECT requires a Restrictive Covenant for Proposed Lot No. 1 of the Senior �
Housing Short Plat, �

NOW, THEREFORE the aforesaid owners do hereby establish, grant and impose �
this restriction and covenant running with the land as to the use of the land
described in Exhibits "A" and "B" hereto, with respect to the use by the under-
signed, their successors, heirs and assigns as follows: �.

EXTENSION OF SANITARY SEWER "
;` In the event that the adjacent Lot #2 of the Senior Housing Short Plat should be
� developed, the owner(s) of Lot #1 will extend the Senior Housing Sanitary Sewer
� easterly to the west properry line of Lot#2.

� This covenant shall run in perpetuity with the land hereinabove described.
� Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton
or any property owners adjoining subject property who are adversely affected by
said breach. Reasonable attorneys' fees mcurred during an enforcement pro-
ceeding will be borne by the parties whom the court determines are in error and
shall be entered as a judgment in such action.
