DECLARATION OF SEGREGATION OF
SPECIAL UTII.ITY CONNECTION CHARGE !
WHEREAS, the City of Renton, a municipal corporation, by Ordinance No. 4321
amended city code section 8-4-41.B.3.k by adding subsection ii permitting segregation
of large tracts of property for payment of water special utility connection charge, and
city code section 8-5-17.B.3.k by adding subsection ii permitting segregation of large
tracts of property for payment of sanitary sewer special utility connection charge fees;
and
WHEREAS, the property of PACCAR, Inc. qualifies for such segregation and
PACCAR, Inc.wishes to avail itself of the opportunity to segregate; and
WHEREAS, the administration of the City of Renton has determined that such
segregation meets the city code sections cited in this declaration.
NOW, THEREFORE, PACCAR, Inc. as owners of the following described real
property in the Ciry of Renton, King County, Washington, described in E�ibit "A"
�. which is attached hereto and is incorporated by reference herein as if fully set forth,
� wish to segregate its property for purposes of partial payment of the special utility
� connection charge for water and sewer as follows.

The property of PACCAR, Inc. for which the water special utility connection
� charge will be satisfied per Agreement CAG 92-047 between PACCAR and the City of
tV Renton is shown on F�hibit B and identified as parcels A-1 and F. T'he remainder of
� the ownership has not had the water special utility connection charge paid.
The property of PACCAR, Inc. for which the sanitary sewer special utility ,
connection charge will be satisfied per Agreement CAG 92-047 between PACCAR and -
the City of Renton is shown on Exhibit "B" and identified as parcels A 1 and F. The
remainder of the ownership has not had the sanitary sewer special utility connection
;_: charge paid.
See Exhibit "C" attached hereto and incorporated herein for the map showing in
outline the lands affected by the Special Utility Connection Charges.
� For the land for which the special utility connection charge has not been paid, the
` charge will be paid at the rate in effect at the time a formal application is submitted
� which would invoke the charge. The owner of the above-described properry, its
;:� successors, heirs and assigns hereby agree and covenant to pay the special utiliry
�� connection charge at the rate in effect at the time of formal application for the parcel
�� of land for which the application has been submitted.
a This covenant shall run with the land and shall not expire. If at any time the fee is
paid, the portion of the covenants or the portion of the land area for which the fee
has been paid, as required by the Ordinances of the City of Renton, shall terminate by
�� the filing and recording of a partial satisfaction of tap, hook-up or connection charge
�- release form with King County.

Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton or
any property owner adjoining the subject properry who is adversely affected by said
breach. Attorney's fees and costs of litigation shall be paid by the non-prevailing party
to the prevailing parry.
