� DECLARATION OF RESTRICTIVE COVENANT
WHEREAS, James G Routos is the owner(s) of the following real property in the
, city of Renton, County of King, State of Washington, described as E�ibit "A" attached
hereto. �
WHEREAS, the Owner(s) of said described property agree to impose the
following restrictive covenant running with the land as to use, present and future, of the
property described in Exhibit "A". '
NOW, THEREFORE, the aforesaid Owner(s) hereby establish, grant and impose
, restrictions and covenants running with the land hereinabove described with respect to the
use by the undersign, their successors, heirs, and assigns as follows:
RESTRICTIVE COVENANT �
Landscape Maintenance Conditions & Restrictions. The Owner is responsible
� for on-going routine maintenance/replacement of the trees, shrubs and other
� landscaping plant materials shown on the approved site plan and�or Landscape
_ Plan of the Site Plan Approval Decision dated March 3, 1993.
C� a) Maintenance Defined: Routine landscape maintenance shall be done in
� accordance with principals and standards as established by the American
�� Association of Landscape Architects. Routine maintenance includes the
�-; replacement of trees, shrubs and other landscaping plant materials that have
died through natural causes, neglect or improper maintenance(excessive
pruning or cutting). Replacement of trees, shrubs and other landscaping
plant materials is also required where through improper maintenance, such
material no longer conforms with the spirit and/or intent of the approved
Site Plan and/or Landscaping Plan.
b) Citation and Enforcement: Should the Owner(s) fail to perform
maintenance in accordance with this covenant, the City of Renton has the
authority to issue a Correction Notice requiring compliance within 30 days
(or longer if warranted by seasonal planting considerations, subject to
approval by the City). Failure to comply with the Correction Notice shall
be subject to penalties as specified in the Renton Municipal Code.
DURATION
These covenants shall run with the land and shall expire on December 31, 2040. If at any
time improvements [not maintenance or replacement] are installed pursuant to these
covenants, the portion of the covenants pertaining to the specific installed improvements
as required by the Ordinance of the city of Renton shall terminate without necessity of
further documentation.

Any violation or breach of these restrictive covenants may be enforced by proper legal
procedures in the Superior Court of King County by either the City of Renton or any
property owners adjoining subject property who are adversely affected by said breach.
