Said heretofore mentioned grantee, ita succeasora or assigna, shall have
the right, without prior notice or proceedinq at law, at euch timea aa may be
neceasary to enter upon said above described property for the purpose of
conetructing, maintaining, repairing, altering or reconetructing esid roadway
and utilities, or making any connectiona therewith, without incurring any
legal obligations or liability therefore, provided, that such conatruction,
maintaining, repairing, altering or reconstruction of eaid WATER LINE ehall be
accomplished in such a manner that the private improvementa existing in the
right(a)-of-way ahall not be disturbed or damaged, they will be replaced in aa
good a condition as they were immediately before the property was entered upon
by the Grantee.
The Grantor ahall fully use and enjoy the aforedescribed premises,
including the right to retain the rig}�t to uae the eurface of aaid right-of-
way if such use does not interfere with inatallation and maintenance of the
WATER LINE. However, the Grantor ehall not erect buildinga or structures
over, under or across the right-of-way during the existence of auch WATER
LINE.
This easement, shall be a covenant running with the land and ahall be
binding on the Grantor, his successor, heirs and asaigns. Grantors covenant
that hey are the lawful owners of the abova propertiea and that they have a
good nd lawfu right to execute thia agreement.
