successors and assigns, an easement for public utilities (including water and sewer) with
necessary appurtenances over, through, across and upon the foilowing described property

said block, lying Easterly of 91st Place South;
TOGETHER with the South half of that portion of vacated
South 130th Street adjoining said Block 53 on the
North, lying between the Easterly line of 91st Place
South and the East line of said Block 53 produced
North; except that portion, if any, of said vacated
street lying within Primary State Highway No. 5; ,

Said heretofore mentloned grantee� its successors or assigns, shall have
the right� without prior notice or proceeding at l�w. at such times as may be
necessary to enter upon said above described property for the purpose of construct-
iny� maintaining� repalring� altering or reconstructing said uti11t1es� or making
any connections thprewith� without incurring any leyal obligations or 1lability
therefore� provided, that such construction� maintaining� repalring� altering or
reconstructlon ot sald utilitles shall be accompllshed in such e rnanner that the
private ,improvements exlsting in the rlght(s)-of-way shall not be dlsturbed or
damagpd� they will be replaced in as good a condition as they were immediately

before the property was entered upon by the Grantee.
The Grantor shall fully use and en,�oy th� aforedescribed premises� including
the right to retain the right to use the surface of said right-of-way if such use
does not interfere with installation and maintenance of the utilities. However�
the grantor shall not erect buildings or structures over� under or across the
rlght-of-way during the existence of such ut111ties.
Th1s easement� shall be a covenant running with the land and shall be binding
on the Grantor� his successors� heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
rlght o execute thls agreement. ,
