WHEREAS, Robert F. Greenwell Company, L.P. , a D.e�:aware limited
partnership ("Owner") is the owner of the following real property +

WHEREAS, Owner has agreed to impose the following restrictive r;;

NOW, THEREFORE, Owner hereby establishes, grants and imposes
restrictions and covenants running with the land with respect to
the use of the Property by Owner and its successors, heirs, and =
assigns as follows:

C� Owner is responsible for replacing any and all landscaping
� improvements that were installed on the Property under the
4 landscaping requirements of both Site Plan approvals No. SA-064-88
� and LUA-920113-ECF; SA that have died or been severely damaged
� through improper maintenance (e.g. improper or excessive pruning,
f�rtilizing, snrayinn, etc. ) by Owner's direct action or inaction.
This covenant does not cover damages created by improper pruning of
other parties that have easements on the Property at the time that
this covenant is filed, or the action of qovernmental agencies.
This covenant also does not cover any damages as a result of (1)
environmental degradation, (2) acts of God such as wind storms,
droughts, etc. and (3) acts of war or civil disobedience.
DURAT I013
These covenants shall run with the Property. These covenants
shall also expire if the Property is redeveloped as part of either
a revision or another project that is permitted by the municipal
jurisdiction having land use authority over the Property. At that
time Owner can modify or replace these covenants.
Any violation or breach of these reszrictiz� cc:�enants may be
enforced by proper legal procedures in the Superior Court of King
