No. � 4415. � � ' WHEREAS, United Christian Church , � d , � � � � x are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: � Beginning at the east quarter corner of Section 20, Township 23 North, Range 5 � NEast, W.M., in King County, Washington; thence south 01 degrees 50 minutes 38 , N seconds west 655.10 feet along the east line of said Section 20; thence north 88 O degrees 09 minutes 22 seconds west, 30 feet to the true point of beginning; thence � south O1 degrees 50 minutes 38 seconds west, 759.19 feet; thence on a curve to � the right with a radius of 20 feet, a distance of 32.02 feet; thence north 89 degrees � 53 minutes 55 seconds west, 361.16 feet; thence on a curve to the right with a radius of 100 feet, a distance of 81.58 feet; thence north 43 degrees 09 minutes 22 seconds west, 202.94 feet; thence on a curve to the right with a radius of 20 feet, a distance of 31.42 feet; thence north 46 degrees 50 minutes 38 seconds east, 838•45 feet; thence on a curve to the right with a radius of 20 feet, a distance of 15.71 feet to the true point of beginning; EXCEPT that portion conveyed to the City of Renton for road by deed recorded under Recording No. 633�723• WHEREAS, the owner(s) of said described properry desire to impose the following restrictive covenants running with the land as a condition placed on the title of the remaining undeveloped property regarding the requirement, obligation and promise to pay the Water and Sanitary Sewer Special Utility Connection Charge (SUCG7 when that portion of the properry is developed. The Special Utiliry Connection Charge (SUCG� for water and sanitaiy sewer shall be at the rates in effect at the time a formal application is submitted which would invoke the SUCC charge. NOW, THEREFORE, the aforesaid owner(s) hereby establish, grant and impose restrictions and covenants running with the land hereinabove described with respect to the partial payment of the Water and Sewer SUCC charge as described as follows: 32% of the Water Special Utility connection Charge has been paid, with 68%owing upon future development. 32% of the Sanitary Sewer Special Utility Connection charge is considered to have been paid to Soos Creek Sewer District, with 68% owing to the City of Renton upon future development. � �`�f"- o� I�-�- �-�-c�-�000����ol��, �3�. a3,�-9,��- ,' ` �A. > _, • - • . • • � Y�� � ; The owner(s) of the above described property, their successors, heirs and assigns, hereby agree and covenant to pay the Water Special Utility Connection Charge, at the rate in effect at the time of formal application for the 32% owing on the above described parcel. DURATTON These covenants shall run with the land and shall not expire. If at any time the Water and Sanitary Sewer SUCC fees are paid on the exempted area pursuant to these covenants, the pottion of the covenants pertauung to the specific exempted area as required by the Ordinances of the City of Renton shall terminate by the filing and recording of a Partial Satisfaction of Water and Sanitary Sewer Tap, Hook- up, or Connection Charge Release form with King County. Any violation or breach of these restrictive covenants may be enforced by proper legal procedutes in the Superior Court of King county by either the City of Renton or any property owners adjoining subject property who are adversely affectec+ by s�id b:each.
