That portion of the below described parcel lying northeasterly of a line beginning at a point on the west
line thereof 80 feet south of the northwest corner of said parcel; thence easterly to a point 10 feet opposite
� a point on the northeasterly line 120 feet southeast of said northwest corner; thence southeasterly along a
� line parallel with and 10 feet southwesterly of the northeasterly line of said parcel to the east line of said
� parcel and the end of this line description;

Grantee,a perpetuai and assignabie rignt and easement in tue ianci ciescribed anove to construct, maintain,
repair,operate, patrol and replace a flood protection levee, including all appurtenances thereto; reserving,
however,to the owners,their heirs and assigns,all such rights and privileges in the land as may be used without
interfering with or abridging the rights and easement hereby acquired subject to the following conditions:
1.The City of Renton holds the Renton Housing Authority harmless from liability in the construction and
operation of the flood protection berm.
2. The easement shall terminate if the berm is not constructed and not used within a ten(10)year period.
3.The existing sidewalk on the Housing Authority property will be preserved except where the berm crosses
any sidewalk and in such cases the walkway will be elevated to accommodate access over the berm.
4. The City of Renton shall maintain the berm.
