CITY OF RENTON , WASHINGTON ORDINANCE NO. 3201 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON VACATING A PORTION OF TALBOT ROAD SOUTH , & 100TH AVENUE ..S .E. , RENTON, KING COUNTY, WASHINGTON WHEREAS a proper petition for vacating a portion of Talbot Road South, lying Southerly of SR #405 , westerly of State 4:19 Highway No. 5-C and NEly of the NEly R/W of Bonneville Power Administraiton Diablo-Seattle Relocation Easement and portion N- of 100th Avenue S .E. , lying Sly of SR #405 ; Wly of State Highway NO 5-C and NEly of the NEly R/W margin of Puget Drive, Renton, CO King County, Washington, was duly filed with the City Clerk on or about April 22 , 1977 , and said petition having been signed by owners representing more than two-thirdsof the property abutting upon such streets sought to be vacated; and WHEREAS the City Council by Resolution No. 2108 passed and approved on May 2 , 1977 and after due investigation, did fix and determine the 23rd day of May, 1977 , at the hour of 8 : 00 P.M. in the City Council Chambers of the City of Renton to he the time and place for a public hearing thereon, and the City Clerk having given due notice of such hearing in the manner provided by law, and all persons having been heard appearing in favor or in opposition thereto; and WHEREAS the Department of Public Works and the Planning Department of the City of Renton having duly considered said petition for said vacation, and having found same to be in the public interest and for the public benefit, and no injury or damage to any person or properties will result from such vacation; NOW THEREFORE , THE CITY COUNCIL OF THE CITY OF RENTON , WASHINGTON, DO ORDAIN AS FOLLOWS : SECTION I : The following described portion of Street, to-wit: -1- All that portion of street right-of-way , having a width of 60 feet , known as 100th Avenue S .E . (H.H . Beerman Road)lying Sly of SR #1105 ; Wly of State Hwy . No. 5-C and NE1y of the NEly R/W margin of Puget Drive. As situated within the NE l/4 of Section 19 and the NW 1/4 of Section 20 , Twp. 23 N . ,Rng 5 E. ,W .M. All that portion of street right-of-way , having a width of 60 feet, known as Talbot Road South, C'.3, lying Southerly of SR #1105, Westerly of STate L`-- Highway No. 5-C and NEly of the NEly R/W of CS3 Bonneville Power Administration Diablo-Seattle C) Relocation Easement; all situated within the NE 1/4 of Section 19 and the NW 1/4 of Section 20 , Township 23 N. , Range 5 E . ,W.M. CD OD BE AND THE SAME IS HEREBY VACATED, SUBJECT TO easement in fa/or of the City, described as follows : over, across, under and on all of the aforedescribed property in favor of the City for utility and related purposes . AND FURTHER SUBJECT to payment unto the City by Petitioner-owners of the amount of $ 25 , 900.00 which said amount does not exceed 1/2 of the appraised value of the area hereinabove vacated. SECTION II: This Ordinance shall be effective upon its passage, approval and five days after its publication. A certified copy of this Ordinance shall be filed with the Office of Records and Elections , King County, and as otherwise provided by law.
