HARRIS PLACE BETWEEN HARDIE AVENUE S .W. AND RAINIER AVENUE S . WHEREAS the City. Council authorized the vacation of a portion of S .W. Harris Place between. Hardie Avenue S.W. and Rainiez. . Avenue S . , Renton, King County, Washington, and all of the abutting: Nut tisij property owners have agreed to and joined in the vacation action; and ;'.;`; WHEREAS the City Council by Resolution No . 2136 passed • N and approved on September 26, 1977 and after due investigation, did fix and determine the 17th day of October, 1977 at the hour of 8• 00'. r. WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I : The following described street, to-wit: See Exhibit "A" attached hereto BE AND THE SAME IS HEREBY PARTIALLY VACATED, subject to the payment unto the City by the abutting property owners of $22, 865 . 00, which said amount does not exceed 1/2 of the appraised value of the area herein- above vacated, together with the other terms and conditions as per the Stipulated Agreement signed by said abutting owners , such agreement -1- incorporated herein as if fullyset forth and made a condition hereof. STIPULATED AGREEMENT SOUTHWEST HARRIS PLACE STREET VACATION IT IS HEREBY STIPULATED AND AGREED BY AND AMONG THE OWNERS OF PROPERTIES ABUTTING SOUTHWEST HARRIS PLACE AS FOLLOWS: 1. The property owners agree to the reduction of Southwest Harris Place to a total right-of-way width of twenty-three (23) feet. . 2. The undersigned property owners agree and covenant to indemnify the City of Renton and save it harmless from and against any and all claims, actions, liability and expense in connection with personal damage, including access restriction to property, arising from or out of any occurrence in or upon the subject vacated property and areas adjoining the same, or as may affect the use thereof by the undersigned, as a result of said right-of- way vacation. • 3. Existing utilities including storm drainage which may be located on the property to be vacated shall be permitted to remain in their present location. However, if the abutting property owner desires their relocation to the non-vacated portion of Southwest Harris Place at some time in the future, said costa of relocation will be borne entirely by the abutting owners. 4. In further consideration of the City-initiated vacation of right-of-way, it is understood and agreed that the abutting owners will assume and pay the vacation fee, said fee having been established at the rate of One Dollar and Fifty Cents ($1.50) per square foot for a total of Twenty-Two Thousand Eight Hundred Sixty-Five Dollars ($22,865.00) . This is based on the appraised value of Three Dollars ($3.00) per square foot. The undersigned property owners agree to the allocation of this total cost of Twenty-Two Thousand Eight Hundred Sixty-Five Dollars ($22,865.00) as follows: Gene O.
