THIS INDENTURE Made and entered into this _40./-da y of
August, A. D. 1910, by and between EDWIN M. SMITHERS, FRED G.
SMITHERS and ADA THORNE, parties of the first part, and the City

s of Renton, a municipal corporation of the third class organized
and existing under and by virtue of the general laws of the State
of 17ashington, the parties of the second part;
WITNESSETH: That the parties of the first part for and
in consideration of the sum of One Dollar in hand paid, receipt
of which is hereby acknowledged, do by these presents grant,
bargain and sell unto the said party of the second part and its
successors , twig o construct , operate and maintain a trunk
sewer with all necessary attachments , including such purifica-
tion works as may be necessary for the proper operation of saia

trunk sewer in, upon and along a strip of land ,J.J2.ii (74q-
feet
wide , the center line of which said strip of land is de-
scribed as follows , to-wit:
Beginning at a point thirty ( 30) feet south of the south-
west corner of Bloc.ii Five ( 5) in Smithers' Third Addition to the
Town of Renton, according to the recorded plat thereof, said
point being at the center of Sixth Street as platted and shown
in Smithers' Fifth, Smithers' Third and Smithers' First Additions
to the Town of Renton, said Sixth Street being now by ordinance of
said city named and designated as Sixth Avenue, and from saia
point running west on the center line of saia Sixth Street , now
Sixth Avenue produced west to the intersection of said line with
the easterly boundary of Black River. Together with a piece
parcel of land on the bank of Black River forty (40feet squerH,
the east and west center line of ,:hich parcel shall be the line
herein first above described, with the right to enter and go upon
said strip and parcel of lard for the purpose of excavating for,
laying down, constructing, operating, maintaining and repairing
said trunk sewer ana purification works .

Thin con-cyance is made upon and subject to the following
express conditions :
a. Said sewer shall be so laid down and constricted
that the top thereof shall be at all points not less than three
feet below the natural surface of the ground as the same now
exists .
b . The party of the second part in the exercise of the
rights and privileges hereby granted over and along said strip
and parcel shall do no damage to the adjoining lands of the par-
ties of the first part.
c . The parties of the first part shall have and hereby
reserve the right to the use of said strip and parcel of land
for all purposes not inconsistent with or in interference with
the use of the same by the party of the second part hereunder.
d. This grant and the rights hereby conveyed to the
party of the second part shall exist and continue only so long
as the party of the second part , or its successors , shall main-
tain, operate and use said trunk sewer and attachments and puri--
f ication works . If the party of the second part shallA cease to
use the same for sewerage purposes and such abandonment and
cessation of suc<i use shall continue for a period of three
months , then this agreement and all rights hereby granted and
conveyed shall cease and determine .
IN WITNESS WHEREOF The first parties hereto have hereunto
set their hands and seals the day and year in this instrument
first above written.
