R. Co. right-of-way in the City of Renton. When easement has been signed by the City, will you please return the duplicate copy, bearing the approvals of our various officials, to us for our records. Yours Ove y uly, Pk- Age 0 • • EASEMENT KNOW ALL LIEN BY THESE PRESENTS, that the grantor, Pacific Coast R. R. Co . , a corporation, for and in consideration of the sum of One Dollar ($1.00) , does hereby give and grant un- to the City of Renton, a municipal corporation, an easement for a pedestrian sidewalk, in the City of Renton over and across portions of grantor' s right-of-way, said portions being described as follows, to-wit: A strip of land uniformly five feet in width, the southerly boundary of which coincides with the south boundary line of the right-of-way of the Pacific Coast R. R. Co. , and extending from the west line of Burnett Street, City of Renton, produced north, to the west line of the Northern Pacific Railway Company' s right-of-way, and containing 400 square feet of land, more or less. All situated within the corporate limits of the City of Renton, King County, State of Washington, and as shown outlined in yellow on print attached here- to and which is made by reference a part of the ease- ment. The foregoing grant of easement for a pedestrian side- walk is made subject to the following exceptions, conditions and reservations, which shall be covenants running with the land and binding upon the grantee , its successors and assigns, to-wit: (1) The above described premises shall be used solely for the purpose of a right-of-way for a pedestrian sidewalk in the City of Renton, Washington, and for no other purpose. (2) If any part of the said premises shall be abandoned or shall cease to be used or maintained as a pedestrian sidewalk then all right granted under this easement to such portion of said premises abandoned or not used, shall immediately cease and de- termine and all easement as to such abandoned portion shall be of no further force or effect, and such portion of said right-of- way so abandoned or not used shall automatically without notice revert to the grantor, its successors or assigns. (3) The grantee hereby agrees to indemnify, protect and save harmless the grantor its licensees and any of its or their agents, servants or employees from any property damage sustained by them or any of them on account of the construction, maintenance or use of said pedestrian sidewalk, and further agrees to indemnify, protect and save harmless the said grantor, its licensees and any of its or their agents, servants and employees from any claim for damages for any injury to any person or persons whomsoever, aris- (1) • ing from or on account of the construction, maintenance or use of said pedestrian sidewalk, and further agrees to protect and save harmless the said grantor, its licensees and its or their officers, agents and employees from any and all claims for injury to any employee or employees of the said grantee while working on the right-of-way of grantor in connection with the construction or maintenance of said pedestrian sidewalk, and grantee further agrees that it will protect and save harmless the grantor and its licensees from any and all expense of litigation connected with any of the above mentioned claims. (4) If at any time hereafter the said pedestrian side- walk at the points herein described, shall be paved or otherwise improved, the cost and expense of such paving or other improving, and thereafter the cost and expense of maintaining the same, shall be paid and borne by the grantee.
