CONSENT AGENDA The following items are distributed to Councilmembers in advance for study and review, and the recommended actions will be accepted in a single motion. Any item may be removed for further discussion if requested by a Councilmember. a. Approval of Council meeting minutes of 5/12/2008_ Council concur. b. Administrative, Judicial and Legal Services Department requests approval of a contract with Doug Pedersen and Associates in the amount of$28,000 to continue providing economic review and forecasting services for the City. Refer to Finance Committee. c. Community and Economic Development Department recommends approval of an agreement in the amount of$51,800 with Doug Levy for legislative consulting services for 2008-2009. Refer to Finance Committee. d. Development Services Division recommends acceptance of a deed of dedication for additional right-of-way on NE 23rd St. to fulfill a requirement of the Varma Short Plat(SHP-06-040). Council concur. e. Planning Division recommends approval to remove restrictive covenants imposed in 1986 (R-85- 092) on Anton Althoff property located at 4409 NE Sunset Blvd., as the covenants are outdated and in conflict with City land use goals. Refer to Planning and Development Committee. f Police Department recommends approval to continue the Visitor Information and Downtown Assistance (VIDA)program at the Renton Transit Center, and approval of the related contract in the amount of$65,258 with Dotson Security Services, Inc. to provide the security and ambassador services. Council concur. g. Transportation Systems Division recommends approval to revise the dates of the temporary closure of Duvall Ave. NE/Coal Creek Parkway SE, from NE Sunset Blvd. to SE 95th Way, to 6/2/2008 through 7/1/2009. Council concur. (See 9. for resolution.) h. Utility Systems Division requests authorization to establish the White Fence Ranch Sanitary Sewer Special Assessment District in the estimated amount of$1,300,556.39 to ensure that project costs are equitably distributed to those who benefit. Refer to Utilities Committee. i. Utility Systems Division submits CAG-07-155, Monroe Ave. NE Storm System Overflow; and • requests approval of the project, authorization for final pay estimate in the amount of$2,828.73, commencement of 60-day lien period, and release of retained amount of$3,465.86 to Cornerstone Earth Work, Inc., contractor, if all required releases are obtained. SPECIAL PRESENTATION Recreation Director Rerecich explained that Renton Technical College(RTC) Community Event: invited the City to be a co-sponsor of the 2008 CommUNITY Festival;thus the CommUNITY Festival, library,the Renton History Museum, and the Advisory Commission on Renton Technical College Diversity will have a presence at the event. He introduced the festival chairperson, RTC Curriculum and Technology Specialist Jenna Pollack, who stated that the goal of the festival is to celebrate diversity. She reported that the event will be held at RTC on June 5, and the activities include booths and exhibits, food, children's activities, and entertainment. Commenting that they have attended the festival in years past, Councilmembers Parker and Zwicker encouraged people to take part in this exciting event. PUBLIC HEARING This being the date set and proper notices having been posted and published in Fire: 2006 International Fire accordance with local and State laws,Mayor Law opened the public hearing to Code Adoption consider the adoption of the 2006 International Fire Code with local amendments. Reporting that the State adopted the fire code in July 2007, Fire Chief/Emergency Services Administrator Daniels explained that local jurisdictions are allowed to amend the fire code. He reviewed the proposed amendments as follows: • Fire sprinkler systems are required for all new structures over 5,000 square feet in size, except for single-family dwellings. • Fire alarm systems that cover the entire building are required for any new structure 3,000 square feet or greater, except for single-family dwellings. • Fire sprinkler riser rooms must be directly accessible from the outside, except for single-family dwellings. • High-rise building emergency equipment rooms are required with fixed-air replenishment system, and fire equipment and storage cabinet. • Addressable alarm systems are required to provide quicker location of problem areas in large structures. • Special event permits are required for any special event with 300 or more people, except for regular places of assembly with existing permits. • Automatic external defibrillators(AEDs) are required for new assembly occupancies and for special events with more than 300 participants. ti- May 19, 2008 Renton City Council Minutes Page 168 • Fire escapes must be tested annually and load tested every five years. • Kitchen hood suppression systems must comply with the UL(Underwriters Laboratories, Inc.) 300 standard within two years. • Stand-by power is required for new service stations,nursing homes, and assisted living facilities. Councilmember Taylor reported that the Public Safety Committee asked many questions regarding this matter, and he was impressed with the department's thought and understanding of what Renton needs to move forward with enhancing public safety. In response to Councilmember Parker's concerns regarding AEDs, Chief Daniels explained that AEDs are required for new places of assembly,not for existing locations. Regarding special events, Councilmember Persson stated that organizations such as non-profits will be able to obtain an AED from the Fire and Emergency Services Department. The Fire Chief noted that the department received a bequest for the Fire Memorial Fund that will be used to • purchase AEDs. Councilmember Taylor pointed out that AEDs are easy to use. Public comment was invited. There being none, it was MOVED BY TAYLOR, SECONDED BY CORMAN, COUNCIL CLOSE THE PUBLIC HEARING. CARRIED. MOVED BY TAYLOR, SECONDED BY PERSSON, COUNCIL ADOPT THE 2006 INTERNATIONAL FIRE CODE WITH LOCAL AMENDMENTS. CARRIED. ADMINISTRATIVE Assistant CAO Wine reviewed a written administrative report summarizing the REPORT City's recent progress towards goals and work programs adopted as part of its business plan for 2008 and beyond. Items noted included: * The Renton Farmers Market begins on Tuesday,June 3, and continues every Tuesday at the Piazza until September 16. AUDIENCE COMMENT Howard McOmber(Renton) announced a Highlands Community Association Citizen Comment: McOmber- emergency preparedness event on June 12 at the Highlands Neighborhood Emergency Preparedness Center, at which emergency preparedness kits will be assembled for in-need Event residents. He encouraged people to attend and help assemble the kits. CONSENT AGENDA Items on the consent agenda are adopted by one motion which follows the listing. Council concur. 5/12/2008 AJLS: Economic Review and Administrative,Judicial and Legal Services Department requested approval of a Forecasting, Doug Pedersen contract with Doug Pedersen and Associates in the amount of$28,000 to and Associates continue providing economic review and forecasting services for the City. UNFINISHED BUSINESS Planning and Development Committee Chair Parker presented a report Planning & Development regarding the City Code Title IV (Development Regulations) 2006 docket Committee review. The Committee recommended concurrence in the staff recommendation Planning: Development to approve the following docket items as recommended by the Planning Regulations (Title IV) 2006 Commission: Fast Food and Towing. Docket Review Fast Food. Proposed changes include allowing fast food as a stand-alone use, but with no drive-throughs in the Center Village and Center Downtown zones, and to allow stand-alone fast food with drive-throughs only in the Employment Area Valley in the Light Industrial zone. Definitions are revised for fast food restaurants and drive-in/drive-through retail/service. Towing Operations/Auto Impoundment Yards. Proposed changes include: 1) A new definition for towing operations; 2) In the Light Industrial zone, allow towing operations/auto impoundment yards within a building; 3) In the Commercial Arterial zone, allow as a shared use with auto repair/auto body shops and if the tow truck is garaged. In both zones,tow vehicles will be limited to Class A,B,and E. The Committee further recommended that the ordinance regarding this matter be prepared for reading and adoption. Planning: Development Planning and Development Committee Chair Parker presented a report Regulations (Title IV) 2006 regarding the City Code Title IV (Development Regulations) 2006 docket Docket Review review. The Committee recommended concurrence in the staff recommendation to set a public hearing on 6/2/2008 to consider the mobile vendor docket item. k May 19,2008 Renton City Council Minutes Page 170 The mobile vendor work program would amend the zoning code to make the following changes: • Restrict mobile food vendors and pushcarts in all zones. • Allow for mobile food vendors on a case-by-case basis through the temporary use permit process. • Provide exemptions from permitting requirements for City-sponsored events and produce stands. • Allow farmers markets only in the CD (Center Downtown)zone. • Allow temporary merchant vendors subject to peddlers' license requirements(City Code Title V). • Revise City Code Title V to reflect amended zones. The new edition was published in 2006, adopted by the State of Washington in July 2007 and is now ready for adoption by the City. MAJOR AMENDMENTS: 1. Fire Sprinkler Systems - Sprinklers will be required for all new structures over 5,000 square feet in size, except single-family residential occupancies. 2. Fire Alarm Systems —Any new structure with a size of 3,000 square feet or greater will be required to have a fire alarm system that covers the entire building, except single-family residential occupancies. Additionally, the alarm system should provide the location in the buildingof the event causingthe alarm. • 3. Fire Sprinkler Riser Room Access -The proposed amendment requires the sprinkler riser room to be directly accessible from the outside, except systems serving single-family structures that contain single and duplex dwelling units. 4. High-rise Emergency Equipment Room &Air Replenishing Systems - Requires high-rise buildings to have an enclosed space for the storage of fire hose and related equipment on the third floor and every fourth floor thereafter. It would also require installation of a replenishing system for SCBA breathing air in the same space. 5. Special Event Permit - Event organizers would be required to obtain a permit for any special event that expects to have an attendance of 300 or more participants, except locations already having place of assembly permits. 6. Automatic External Defibrillator-Any new place of assembly or special event with 300 persons or greater would be required to have an automatic external defibrillator (AED). 7. Fire Escapes - Requires testing annually and load tested every five years. 8. Kitchen Hood Suppression Systems - Provides an additional two years for the business owners to comply with the requirement in the IFC to upgrade kitchen hood systems. 9. Two times a year the Consultant shall prepare an economic review and forecast for the City of Renton—a microanalysis of the economic condition and outlook for the Renton economy. Scope of the Contract: The contractor shall prepare two analyses each year. The analyses shall be done in April and October. Economic variables analyzed shall include measures of Boeing commercial airplane operations, Renton population,Renton building permits, and Renton taxable retail sales. The April analysis shall include a comparison of actual figures for the prior year against the previous forecast. The April analysis shall be provided to the City by the end of the month. It will review the prior forecasts against available actuals and provide a revised forecast for the current year. The second analysis to be provided by October 31 shall provide a comparison of year-to-date actuals against the forecasted figures for the current year, as well as an update of the annual forecasts with particular attention paid to the impact of any Boeing announcements on the outlook for retail spending within the City. In all of the analyses, the Consultant shall pay particular attention to the impact that Boeing employment decisions have on the City's economy and note any differences between impacts on the Renton economy compared to the rest of the Puget Sound economy. In addition, other significant business developments within Renton with an impact on its tax base or expected tax revenues shall be noted. • Dates of Completion: The Consultant shall work with the Finance & Information Services Administrator on the actual dates of completion. Information shall be made available for_use by the City of Renton Staff and City Council. The CITY and CONSULTANT agree as set forth below: 1. Scope of Services. The Consultant will provide all labor necessary to perform all work, which is described in the attached Scope of Services (Exhibit A). This Agreement and Exhibit hereto contain the entire agreement of the parties and supersedes all prior oral or written representation or understandings. This Agreement may only be amended by written agreement of the parties. The scope of work may be amended as provided • herein. 2. Changes in Scope of Services. The City, without invalidating the Consultant Agreement, may order changes in the services consisting of additions, deletions or modifications, and adjust the fee accordingly. Such changes in the work shall be authorized by written agreement signed by the City and Consultant. If the project scope requires less time, a lower fee will be charged. If additional work is required, the consultant will not proceed without a written change order from the City. If any provision of this Agreement is held to be invalid, the remainder of the Agreement shall remain in full force and effect to serve the purposes and objectives of this Agreement. 3. Time of Performance. The Consultant shall complete performance of the Consultant Agreement for the items under Consultant's controlin accordance with Exhibit A, May 2008 through May 2009 or the end of the 2009 Session of the Legislature, plus any time necessary for after-session review and reporting. If items not under the Consultant's control impact the time of performance, the Consultant will notify the City. 4. Term of Consultant Agreement. The term of this Agreement shall end at completion of the scope of work identified in Exhibit A and as detailed in Item #3 above. This Agreement may be extended to accomplish change orders, if required, upon mutual written agreement of the City and the Consultant. 5. Consultant Agreement Sum. The City hereby agrees to contract with Consultant, and • Consultant hereby agrees to accept said contract in accordance with the terms and provisions of this Agreement and Exhibit A hereto as hereinafter set forth. The 1 E Consultant shall be compensated at a rate of$3,600 a month for May 2008 through December 2008, then $4,400 a month for January through May 2009, plus monthly • expenses not to exceed $450 a month. 6. Method of Payment. Payment by the City for services rendered will be made after a voucher or invoice is submitted in the form specified by the City. Payment will be made within thirty (30) days after receipt of such voucher or invoice. The City shall have the right to withhold payment to the Consultant for any work not completed in a satisfactory manner until such time as the Consultant modifies such work so that the same is satisfactory. 7. Record Maintenance and Work Product. The Consultant shall maintain accounts and records, which properly reflect all direct and indirect costs expended and services provided in the performance of this Agreement. The Consultant agrees to provide access to any records required by the City. All originals and copies of work product, exclusive of Consultant's proprietary items protected by copyright such as computer programs, methodology, methods, materials, and forms, shall belong to the City, including records, files, computer disks, magnetic media or material which may be produced by Consultant while performing the services. Consultant will grant the City the right to use and copy Consultant copyright materials as an inseparable part of the work product provided. 8. Assignment Agreement. The Consultant shall not assign any portion of this consultant Agreement without express written consent of the City of Renton. 9. Hold Harmless. The Consultant shall indemnify, defend and hold harmless the City, its • officers, agents, employees and volunteers, from and against any and all claims, losses or liability, or any portion thereof, including attorneys fees and costs, arising from injury or death to persons, including injuries, sickness, disease or death of Consultant's own employees, or damage to property caused by a negligent act or omission of the Consultant, except for those acts caused by or resulting from a negligent act or omission by the City and its officers, agents, employees and volunteers. Should a court of competent jurisdiction determine that this agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the contractor and the city, its officers, officials, employees and volunteers, the contractor's liability hereunder shall be only to the extent of the contractor's negligence. It is,further specifically and expressly understood that the indemnification provided herein constitute the contractor's waiver of immunity under the Industrial Insurance Act, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this agreement. 10. Insurance. The Consultant shall secure and maintain commercial liability insurance in the amount of$1,000,000 in full force throughout the duration of this Consultant Agreement. It is agreed that on the CONTRACTOR's policy, the City of Renton will be named as Additional Insured(s) on a non-contributory primary basis. A certificate of insurance and the Primary & Non-Contributory Additional Insurance Endorsement page, properly endorsed, shall be delivered to the City before executing the work of this • agreement. Please note: The cancellation language should read "Should any of the 2 above described policies be cancelled before the expiration date thereof, the issuing • company will mail 45 days written notice to the certificate holder named to the left." 11. Independent Contractor. Any and all employees of the Consultant, while engaged in the performance of any work or services required by the Consultant under this agreement, shall be considered employees of the Consultant only and not of the City. The Consultant's relation to the City shall be at all times as an independent contractor. Any and all claims that may or might arise under the Workman's Compensation Act on behalf of said employees, while so engaged, and any and all claims made by a third party as a consequence of any negligent act or omission on the part of the Consultant's employees, while so engaged on any of the work or services provided to be rendered herein, shall be the sole obligation and responsibility of the Consultant. 12. Compliance with Laws. The Consultant and all of the Consultant's employees shall perform the services in accordance with all applicable federal, state, county and city laws, codes and ordinances. W-3078). The proposed project is located in the 565-water pressure zone and is within the Aquifer Protection Zone 2. Sewer: There is an existing 8-inch sewer main on Edmonds Ave NE. There is also an 8-inch sewer main on NE 23`d Street. Surface: This project drains to the Honey Creek basin.A storm drainage report was provided. Project Description/Background The applicants, Kajal Ram, Kushal Varma, Calvin Soares, and Simonette Soares, have proposed to subdivi a 0.74-acre site into four lots. The property is currently developed with two existing single family residen structures, which are proposed to remain on proposed Lots 2 and 4, and a detached garage that is proposed to be removed. Lots 1 and 3 are intended for the eventual development of detached single family residences. The lots are proposed at the following sizes: 5,068 square feet (Lot 1), 5,039 square feet (Lot 2), 5,037 square feet (Lot 3), and 15,698 square feet (Lot 4). The applicant is proposing to access the lots from NE 23'" Street. 1,400 square feet of right-of-way dedication is proposed along the north property line. The net site area is 30,842 square feet or 0.78 acres. This in turn, equates to a net density of 5.65 dwelling units per acre (2/0.78 = 5.65 du/ac),which is within the density range permitted within the R-8 zone. The topography of the subject site is flat. The subject site is predominately vegetated with grass lawn, ornamental vegetation, and 11 trees (6 Maples, 4 firs, and 1 Holly). One tree is proposed to be removed for the construction of a single family residence on Lot 1. No critical areas were found at the subject site during the review of this application. The applicants have also requested two administrative setback variances. One variance is requested for Lot 2, where the applicant is proposing to shift the rear yard setback from the east side of the existing residence to the south side of the existing residence. The proposal to utilize the rear yard area to the south of the residence as a rear yard would result in a 17-foot rear yard setback, which is a 3-foot protrusion into the 20-foot rear yard setback requirement. The second variance requested is for the front yard of the existing single family residence,which is proposed to remain on Lot 4. The variance is necessary as the existing single family residence cannot maintain the required 20-foot front yard setback required for an attached garage after the dedication of 5 feet of right-of-way. The applicant proposes to reduce the 20-foot front yard setback to 19.53 feet. Approval of two Administrative Setback Variances to reduce the rear yard setback for the existing residence on Lot 2 and the front yard setback for the existing residence on Lot 4 is required in order to approve the proposed four-lot short plat. 2. Environmental Review Except when located on lands covered by water or critical areas, short plats are exempt from SEP Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Staff Review Comments • Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Single Family (RSF) on the Comprehensive Plan Land Use Map. Lands in the RSF designation are intended to be used for quality residential detached development organized into neighborhoods at urban densities. It is intended that larger subdivision, infill development, and rehabilitation of existing housing be carefully designed to enhance and improve the quality of single-family living environments. The proposal is consistent with the following Comprehensive Plan Land Use and Community Design Element policies: Policy LU-147. Net development densities should fall within a range of 4.0 to 8.0 dwelling units per acre in Residential Single Family neighborhoods. The proposed short plat would result in the creation of four lots and would arrive at a net density of 5.65 dwelling units per net acre, which is within the density range required. Policy LU-148. A minimum lot size of 5,000 square feet should be allowed on in-fill parcels of less than one acre (43,560 sq. ft.) in single-family designations. Allow a reduction on lot size to 4,500 square feet on parcels greater than one acre to create an incentive for aggregation of land. The minimum lot size is not intended to set the standard for density in the designation, but to provide 1111 flexibility in subdivision/plat design and facilitate development within the allowed density range. All of the proposed lots equal or exceed the minimum lot size of 5,000 square feet. Policy LU-152. Single-family lot size, lot width, setbacks, and impervious surface should be sufficient to allow private open space, landscaping to provide buffers/privacy without extensive fencing, and sufficient area for maintenance activities. The proposed lots would meet the required lot size, width, and setbacks to create sufficient front, rear, and side yard areas. The existing single family residence proposed to remain on Lot 2 would not comply with the required rear yard setback. The existing residence proposed to remain on Lot 4 would not comply with the required front yard setback. Two Administrative Setback Variances have been requested to allow for the reduced setbacks for the existing residences. Policy LU-154. Interpret development standards to support new plats and infill project designs incorporating street locations, lot configurations, and building envelopes that address privacy and quality of life for existing residents. The proposed lots are rectangular in shape and oriented such that all of the lots would front on a public right-of-way. Approval of this application would not decrease the quality of life for residents in the immediate vicinity. Policy CD-12. Infill development, defined as new short plats of nine or fewer lots, should be encouraged in order to add variety, updated housing stock, and new vitality to neighborhoods. The proposed short plat would subdivide two existing parcels into four lots. Two new residences would be constructed on the Lots 1 and 3, updating the housing stock in the existing neighborhood. b) Compliance with the Underlying Zoning Designation • The subject site is designated Residential —8 Dwelling Units per Acre (R-8) on the City of Renton Zoning Map. The proposed development would allow for the future construction of two new single family dwelling units on proposed Lots 1 and 3. Two existing residences would remain on proposed Lots 2 and 4, and a detached garage is proposed to be removed. shpltrpt.doc City of Renton P/B/PW Department Administrative Land Use Action REPORT AND DECISION DATED May 24,2006;PROJECT LUA-06-040,SHPL-A,V-A Page 5 The allowed density range in the R-8 zone is a minimum of 4.0 to a maximum of 8.0 dwelling AI per acre. Net density is calculated after the deduction of sensitive areas, areas intended for pu right-of-way, and private access easements. The 1,400 square feet of right-of-way dedication required for the project shall be subtracted from the gross lot area for the purpose of calculating net density. After the deduction of the 1,400 square foot right-of-way dedication, the project would arrive at a net density of 5.65 dwelling units per acre (32,242 square feet — 1,400 square feet = 30,842 square feet/43,560 square feet = 0.708 acres, 4 units / 0.708 acres = 5.65 dwelling units per acre(du/ac)), which is within the density range permitted for the R-8 zone. The allowed building lot coverage in the R-8 zone is 35 percent or 2,500 square feet, whichever is greater for lots over 5,000 square feet in size and lots 5,000 square feet or less are allowed a maximum of 50 percent lot coverage. The lot coverage proposed for the existing residence on Lot 2 would be 21% and the lot coverage proposed for the existing residence on Lot 4 would be 13%. Both of the existing residences on Lots 2 and 4 would comply with the lot coverage requirements for the R-8 zone. The lot coverage requirements for proposed Lots 1 and 3 would be verified at the time of building permit review. The required setbacks in the R-8 zone are as follows: front yard is 15 feet for the primary structure and 20 feet for an attached garage, side yard is 5 feet, side yard along a street is 15 feet for the primary structure and 20 feet for an attached garage and the rear yard is 20 feet. Based on the proposed subdivision, the proposed lots would have their front yards facing north towards NE 23rd Street. The existing residence on proposed Lot 2 would comply with the front and side yard setback requirements; however it would not comply with the rear yard setback requirements. An Administrative Setback Variance has been requested to reduce the rear yard setback to 17.49 feet. The existing residence on proposed Lot 4 would comply with the side and rear yard setback requirements; however it would not comply with the front yard setback requirement after the 5-foot right-of-way deduction. An Administrative Setback Variance has been requested to reduce the front yard setback to 19.49 feet. The setbacks for proposed Lots 1 and 3 would be verified at t time of building permit review. The parking regulations required that detached or semi-attached dwellings provide a minimum of 2 off-street parking spaces. As proposed, each lot would have adequate area to provide two off- street parking spaces. In addition, the parking regulations require that driveways be located a minimum of 5 feet from the adjoining property line. Compliance with the parking requirements will be verified at the time of building permit review. The R-8 zone permits accessory structures only when associated with a primary structure located on the same parcel. An existing 1,077 sq. ft single-family residence is proposed to remain on new Lot 2 and an existing 2,116 sq. ft. single family residence is proposed to remain on new Lot 4. A detached garage is proposed to be removed. Staff recommends as a condition of approval that the applicant obtain a demolition permit and complete all inspections and approvals for the demolition of the detached garage prior to the recording of the final short plat. c) c) Community Assets The site is vegetated primarily with grass, ornamental vegetation, and 11 trees (6 Maples, 4 firs, and 1 Holly). One maple tree is proposed to be removed from new Lot 1. The City's landscaping regulations require the installation of landscaping within the public right-of-way. The minimum amount of landscaping required for sites abutting a non-arterial public street (NE 23rd Street and Edmonds Avenue NE) is 5 feet provided that if there is additional undeveloped right-of-way in excess of 5 feet, this shall also be landscaped. A determination has been made that if no additional area is available within the public right-of-way due to required improvements, the 5-foot landscaped strip may be located within private property abutting the public right-of-way. The landscaping proposed shall either consist of drought resistant vegetation or shall be irrigated appropriately. In addition, the applicant will be required to plant two ornamental trees, a minimum caliper of 1-1/2 inches (deciduous) or 6 — 8 feet in height (conifer), within the 15-foot front yard setback area for the proposed lots. 411) A conceptual landscape plan was submitted with the application. The landscape plan proposes a 5-foot planter strip within the Edmonds Avenue NE and NE 23rd Street rights-of-way. The proposed vegetation within the 5-foot planter strip includes rhododendron 'unique' and aguga. Two trees (Red Maple and Sweetgum)are proposed within the front yard areas of Lots 1-3. One existing tree is proposed to remain within the right-of-way fronting Lot 4. The landscape • plan notes indicate that watering would occur within the first year of installation, the City's landscape regulations require irrigation for all landscaping installed unless 100%drought tolerant plants are installed,watering of drought tolerant shall occur for the first two years after installation. Two trees shall also be required within the front yards of each lot; therefore one additional tree is required within the front yard area of Lot 4. Staff recommends as a condition of approval that a revised landscape plan be submitted prior to final plat approval indicating that watering of the planting strip will occur for the first two years after installation and one additional tree shall be identified within the front yard area of Lot 4. Existing trees and other vegetation shall be used to augment new plantings for landscaping where practical per RMC 4-4-070 and RMC 4-7-130 requires that a reasonable effort should be made to preserve existing trees. A Determination was made by the Director of Development Services that the retention or replacement of 25% of the existing trees would achieve these requirements. Replacement trees shall be required to be a minimum caliper of 2 inches. Of the 11 trees existing onsite, 10 or 90% are proposed to be retained, which complies with the requirement for the retention of 25% of existing significant trees. d) Compliance with Subdivision Regulations Streets:No new public streets would be created as part of the proposed short plat. NE 23rd Street is classified as a Residential Access Street and Edmonds Avenue NE is classified as a Minor Arterial on the City's Arterial Street Map. There are no curbs, gutters or sidewalks along the frontage of NE 23rd Street. The City's adopted street standards require the installation of street improvements along the frontage of the short plat unless waived. Street improvements including, but not limited to paving, sidewalks, curb and gutter and storm water system will be required along the site's frontage of Edmonds Ave NE and NE 23rd Street. Dedication of a minimum of 5-foot right-of-way along NE 23rd St will be required. Dedication of a minimum 15-foot radius at the intersection of Edmonds Ave NE and NE 23rd St will be required. • The proposed short plat is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, staff recommends a condition of approval be placed on the project requiring a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project. Two new lots (credit given for the existing residences) is expected to generate approximately 9.57 new average weekday trips. The fee for the proposed short plat is estimated at $1,435.50 ($75.00 x 9.57 trips x 2 lots = $1,435.50) and is payable prior to the recording of the short plat. Blocks:No new blocks will be created as part of the proposed short plat. Lots: The size, shape, orientation, and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. Each lot is rectangular in shape. The front yard areas of the proposed lots are oriented to the north towards NE 23rd Street. Each of the proposed lots provides direct access to a public street (NE 23rd Street). The minimum lot size in the R-8 zone is 5,000 square feet for parcels that total less than 1 acre in area. The proposed lot sizes are 5,068 square feet for Lot 1, 5,039 square feet for Lot 2, 5,032 square feet for Lot 3, and 15,698 square feet for Lot 4, which exceed the minimum lot size requirements. The minimum lot width in the R-8 zone is 60 feet for corner lots and 50 feet for interior lots. The proposed lot widths range from 63 feet to 90 feet. The minimum lot depth in the R-8 zone is 65 feet. Proposed Lots 1-3 would have a lot depth of 80 feet and Lot 4 would have a lot depth of 180 feet. The dimensions of the proposed lots meet the minimum width and depth requirements and are compatible with other existing lots in this area under the same R-8 zoning classification. In addition, the lots appear to contain adequate building areas for the construction of a suitable • single-family residence when taking setbacks and lot coverage requirements into consideration. The property is vegetated with grass lawn, • ornamental vegetation, and 11 trees (6 Maples,4 Firs, and 1 Holly). One maple tree on Lot 1 would be removed as a result of the development of the short plat. Relationship to Existing Uses:The properties surrounding the subject site are single-family residences and are designated Residential—8 Dwelling Units Per Acre (R-8)on the City's zoning map. The proposal is similar to existing development patterns in the area and is consistent with the Comprehensive Plan and Zoning Code, which encourage residential infill development. fl Availability and Impact on Public Services(Timeliness) Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish services to the proposed development, subject to the condition that the applicant provide Code required improvements, and mitigation fees. These fees paid would help offset any additional impacts to emergency services generated from this development. Staff recommends as a condition of approval payment of a Fire Mitigation Fee, based on $488.00 per new single family lot with credit given for the existing single family residences prior to the recording of the final plat. The fee is recommended in order to mitigate the proposal's potential impacts to City emergency services. The fee is estimated at $976.00 ($488 x 2 = $976.00) and is payable prior to the recording of the short plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per single family residential dwelling. Therefore, it is anticipated that the proposed short plat would result in 1 (0.44 X 2 = 0.88) new children to the local schools (Sierra Heights Elementary School, McKnight Middle School, and Hazen High School). The Renton School District has indicated they can accommodate the additional student generated by this proposal. Storm Water. The subject property drains to the Honey Creek basin. A Level 1 Analysis prepared by Touma Engineers, dated March 11, 2006 was submitted with the project application. Accord to the a drainage report, the new development does not triggered water quality neither flow con (based on the 1990 King County Surface Water Manual). The City of Renton's Plan Review Section reviewed the submitted drainage report and concurs that this project is exempt from detention and water quality per the adopted 1990 KCSWM. The Surface Water System Development Charges are based on a rate of $759.00 per new single-family lot. Estimated fee based on the entire site plan is $1,518.00. Payment of this fee will be required prior to issuance of utility construction permit. Water and Sanitary Sewer Utilities: There is an existing 6-inch water main along Edmonds Ave NE that can deliver 1400 gpm. The static pressure at Edmonds Ave NE and NE 23rd St is about 100 psi. There is also an existing 8-inch water main along NE 23rd Street that can deliver 2500 gpm. The proposed project is located in the 565-water pressure zone and is within the Aquifer Protection Zone 2. Fire flow requirement for single-family residences is 1,000 gpm. A hydrant is required within 300 feet of the furthest structure. If the residences exceed 3,600 square feet (including garage area), the required fire flow increases to 1,500 gpm and an additional hydrant will be required. A Stortz quick-disconnect fitting will be required to be installed on all new hydrants. Any existing hydrant counted as fire protection will require installation of a "storz" quick disconnect fitting if not already in place. All short plats shall provide a separate water service stub to each building lot prior to recording of the plat. Separate permits for water meters will be required. Water System Development Charges are based on a rate of$1,956 per new single-family lot. Fee based on the entire site plan is $3,912.00. Payment of fee is required prior to issuance of utility construction permit. There is an existing 8-inch sewer main on Edmonds Ave NE. There is also an 8-inch sewer main on NE 23rd Street. If either of the existing residences is on a septic system, they shall be abandoned according to the Health Department and connected to the sewer. Short plats shall provide separate side sewers stubs to each building lot. No dual side sewers are allowe Locations of existing stubs shall be verified prior to short plat recording. The applicant shall provi additional stubs where needed. This parcel is also subject to the East Kennydale Intercepto Special Assessment District Fee. Fees are $485.00 per connection + interest. This fee accrues interest daily. This parcel is also subject to the East Kennydale Sanitary Sewer Infill Phase II Special Assessment District Fee. This fee is $5,208.87 per connection + interest. This fee is payable at the time the utility construction permit is issued. g) Consistency With Variance Criteria The Administrator shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist. Section 4-9- 250B.5.a. lists 4 criteria that the Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: 9 1. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: Lot 2 Rear Yard Setback The applicant contends that special circumstances do exist as the location of the existing residence on proposed Lot 2 was oriented such that the front yard faced to the west towards Edmonds Avenue NE. The original orientation complied with the required setback areas. The proposed short plat would result in a reorientation of the required yard areas. The proposed front yard area would face to the north towards NE 23rd Street and the rear yard area would face to the south. The reorientation of the rear yard area would result in a rear yard setback of 17.49 feet, which is less than the 20-foot rear yard setback required. Therefore, while the size of the property and the R-8 zoning of the property permits the subdivision of the property, the requirement for a 20-foot rear yard setback from the southern property line would either preclude the subdivision of the property or require the removal of a portion of the existing residence. The applicant is S requesting a variance to permit the existing residence to remain at its present location and to permit the proposed rear property line to be within 17.49 feet of the existing residence. The applicant also appropriately indicated that the remaining development regulations (i.e. front and side yard setbacks, lot coverage and structure height) are not being varied from and the existing structures would be in compliance with all other prescribed development standards associated with the zone the subject lots are located in. It should also be noted that no additional construction on the existing single family residence is planned as part of this proposal; thus the degree of the variance is not increasing as a result of the short plat proposed by the applicant. If the variance were not granted, the subdivision of the property would not be permitted as proposed. Therefore, staff does recognize that special circumstances do exist with respect to this variance application and denying the variance would prohibit infill development on this lot and other similar situations in the City. Lot 4 Front Yard Setback The applicant contends that special circumstances do exist as the location of the existing residence on proposed Lot 4 currently complies with the 20-foot front yard setback requirement for an attached garage, however the City's requirement for a 5-foot right-of-way dedication along NE 23rd Street would reduce the front yard setback such that the existing residence would not comply with the required front yard setback. The right-of-way dedication along NE 23rd Street would result in a front yard setback of 19.53 feet, which is less than the 20-foot front yard setback required for an attached garage. Therefore, while the size of the property and the R-8 zoning of the property permits the subdivision of the property, the requirement for 5 feet of right-of-way dedication along NE 23rd Street would either preclude the subdivision of the property or require the removal of a portion of the existing residence. The applicant is requesting a variance to permit the existing • residence to remain at its present location and to permit the proposed front yard area to be 19.53 feet. Therefore, staff does recognize that special circumstances do exist with respect to this variance application and denying the variance would prohibit infill development on this lot and other similar situations in the City. 2. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: Lot 2 Rear Yard Setback The granting of the variance for the yard areas to be reoriented such that the proposed rear yard area would be 2.51 feet less than the 20-foot required rear yard area would not be materially detrimental to the public welfare. Instead, the granting of the variance would allow for a four-lot short plat, which contains two existing residences. As proposed, the existing structure would meet all required setback and lot coverage requirements except for the non-conforming 17.49-foot rear yard setback. As the building is existing, the proposed short plat would not increase the non- conforming situation; therefore, staff does not anticipate additional impacts to surrounding properties with the granting of this variance. Lot 4 Front Yard Setback The granting of the variance for the reduced front yard setback would not be materially detrimental to the public welfare. Instead, the granting of the variance would allow for a four-lot short plat, which contains two existing residences. As proposed, the existing structure meets all require setback areas, however as a result of the short plat, the applicant will be required to dedicate 5 f of right-of-way along the NE 23`d Street frontage. After the dedication of right-of-way, the existi residence would encroach 0.47 feet into the front yard setback area. All other setbacks and lot coverage requirements would be met. As the building is existing, the proposed short plat would not increase the non-conforming situation; therefore, staff does not anticipate additional impacts to surrounding properties with the granting of this variance. 3. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: Lot 2 Rear Yard Setback Approval of the variance would not be considered a grant of special privilege because, the same variance would be supported under identical circumstances where a property would be short platted to increase the site's density and an existing house would remain on one of the new lots, provided conditions of approval are complied with. In the event the existing residence on new Lot 2 would be removed or demolished, staff recommends a restrictive covenant be placed on Lot 2 stating that the construction of a new single family residence on Lot 2 shall comply with all development standards of the underlying zoning designation at the time of building permit review. This restrictive covenant would be recorded with King County prior to recording of the final short plat. Lot 4 Front Yard Setback Approval of the variance would not be considered a grant of special privilege because, the same variance would be supported under identical circumstances where a property would be sh platted to increase the site's density and an existing house would remain on one of the new lot provided conditions of approval are complied with. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: Lot 2 Rear Yard Setback The applicant is proposing a 17.49-foot rear yard setback for an existing single family residence as a result of the reorientation of yard areas such that the rear yard area is measured from the south property line as opposed to the existing east property line. As all other setback, lot coverage and building height standards are in compliance, and because the applicants are not proposing to increase the existing building footprints, staff considers the reduction of the setback area to 17.49 feet to be the minimum necessary in order to approve the four-lot short plat Lot 4 Front Yard Setback The applicant is proposing a 19.53-foot front yard setback for an existing single family residence as a result of the City's requirement for a 5-foot right-of-way dedication along NE 23`d Street. As all other setback, lot coverage and building height standards are in compliance, and because the applicants are not proposing to increase the existing building footprints, staff considers the reduction of the setback area to 19.53 feet to be the minimum necessary in order to approve the four-lot short plat H, Findings: Having reviewed the written record in the matter, the City now enters the following: • 1. Request: The applicant has requested a four-lot Administrative Short Plat and Administrative Rear Yard Setback Variance and an Administrative Front Yard Setback Variance approval for the Varma Short Plat, File No. LUA-06-040, SHPL-A, V-A. 2. Application: The applicant's short plat and variance application complies with the requirements for information for short plat and variance review. The applicant's short plat and variance plans and other project drawings are contained within the official land use file. 3. Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designations of the Single Family Residential (SFR)land use designation. 4. Zoning: The proposal as presented, complies with the zoning requirements and development standards (contingent upon approval of the variances)of the Residential Single Family-8 (R-8)zoning designation, provided all advisory notes and conditions of approval are complied with. 5. Subdivision Regulations: The proposal complies with the requirements established by the City's Subdivision Regulations for the short platting of 4 lots provided all advisory notes and conditions of approval are complied with. 6. Existing Land Uses: Land uses surrounding the subject site include: North Residential Single Family (zoned R-8); East: Residential Single Family(zoned R-8); South:Residential Single Family(zoned R-8); and West: Residential Single Family(zoned R-8). 7. Setbacks: The setbacks for future development on the proposed lot would be evaluated based on the standards applicable to lots along streets existing as of March 1, 1995. The front yard setbacks of the proposed lots would face to the north towards NE 23`d Street. The existing residences comply with all of the required setbacks provided that an administrative setback variance is granted for the rear yard setback for the residence located on proposed Lot 2 and an administrative setback variance is granted for the front yard setback for the residence located on proposed Lot 4. The setbacks for the proposed new residences on Lots 1 and 3 would • be verified at the time of building permit review. 8. Consistency With Variance Criteria: The proposal meets the criteria established by City code per Staff analysis as noted in the body of the staff report. Conclusion: 1. The subject site is located in the Residential Single Family(RSF)comprehensive plan designation and complies with the goals and policies established with this designation. 2. The subject site is located in the Residential—8 Dwelling Units Per Acre zoning designation and complies with the zoning and development standards (provided the variance is approved)established with this designation (provided all advisory notes and conditions of approval are met). 3. The proposed four lot short plat complies with the subdivision regulations as established by city code and state law. 4. The proposed four lot short plat complies with the street standards as established by city code (provided that 5 feet of right-of-way is dedicated along the NE 23`d Street frontage). 5. The proposal is consistent with the established variance criteria as discussed in the body of the Staff Report. J. The property was rezoned in 1986 from a medium density residential designation, Residence-3 (R-3), to an office designation, Office Park (O-P), subject to the recording of restrictive covenants. Neither the O-P nor R-3 zoning designations currently exist. The covenants are as follows: 1. Zoning of the subject site will revert from O-P back to R-3 if specific development plans in the form of a building permit application, or other land use permit representing an intention to utilize the O-P zoning, such as an application for site plan review or conditional use permit, is not submitted within two (2) years of final approval on this zoning action. 2. The existing homes on the subject site are not to be utilized for any commercial endeavor. RECOMMENDATION: Staff recommends Council approve the request to remove the restrictive covenants. BACKGROUND SUMMARY: Restrictive covenants were required by the City Council in 1986 as a condition of approval to rezone the property from Residence 3 (R-3) to Office Park (0-P), located on the south side of NE Sunset Blvd. just west of Anacortes Ave NE at 4409 NE Sunset Blvd. According to the Hearing Examiner's Report and Recommendation to the City Council, the purpose of the covenant was to create a reversion clause if the applicant didn't make use of the O-P zoning. The property would revert to the R-3 zoning classification as a compliment to the zoning across the street from the site, which at that • Page 2 of 2 May 5,2008 time was Residence 2 (R-2) and Residence 3 (R-3). Subsequently, the two existing • single-family residences were removed and the site has not been redeveloped. The covenants sunset in December of 2025, however, in the twenty-two years that have passed since the placing of the covenants, the City's land use goals have undergone a considerable amount of change. As a result, the motives behind the covenants are no longer justified and run contrary to the goals of the current Comprehensive Plan. As of April of this year, the current zoning of the site is Commercial Arterial (CA). The site is located within the NE Sunset Blvd Business District Overlay and the Comprehensive Plan designation is Commercial Corridor. The owner, ADF Properties LLC, has requested that the restrictive covenants be removed from the property title in order to develop the property to current development standards and trends in the area. The conceptual proposal on the 1.93-acre site is for a 4-story mixed-use building containing 21 residential units and 2,209 square feet of commercial space. The covenants create an unnecessary burden on the property and are inconsistent with the present property development standards adopted by the city. City Policy #400-13 regarding Restrictive Covenants states that the "decision-making" body that approved the restrictive covenant has the authority to release the covenant on behalf of the City. As the Council signed the initial restrictive covenants, Current Planning Staff is now requesting that you authorize the release of Restrictive Covenants. CONCLUSION: 1111 As discussed in the Background Summary above, these Restrictive Covenants are outdated and are in conflict with the City's land use goals. Subsequent changes to the site and its zoning render the restrictive covenants unnecessary. By removing the covenants, both the City staff and the developer would be allowed a greater opportunity for flexibility which would result in a development that would more closely match the desired results of the current Zoning and Comprehensive Plan designations. BACKGROUND: Since its opening, the Renton Transit Center has been a source of concern by the downtown business owners and area residents. Although the crime rate in the area is similar to surrounding areas, crimes that have occurred at the center have drawn significant attention and created a perception of decreased safety. To address these concerns, city departments have worked cooperatively to implement environmental changes, increase surveillance via cameras, and increase city presence at the center. The Police Department received additional funding for overtime in 2006, to provide staffing at the Renton Transit Center. In 2007, the Police Department began using regular duty officers from various assignments to staff the transit center. This method of reassignment has caused a decrease in officer availability to handle calls for service or otherwise perform the duties of their primary assignment. Later in 2007, the City began an ambassador program titled the Visitor Information and Downtown Assistance program (VIDA). The VIDA program included two ambassadors on bicycles, • working Monday through Saturday, eight hours a day. The ambassadors were tasked with monitoring conduct within the Renton Transit Center, dealing with minor behavioral issues and reporting those incidents requiring police intervention. In addition, the • ambassadors were available to assist businesses with escorts to local banks, assist travelers with directions on bus services, and provide access to the Renton Transit Center restroom facilities. The City entered into a three-month contract with Securitas Security Services, USA, Inc., to staff this program, which ended in February 2008. While this program was successful, the program would be more effective if staffed by a local security company. Dotson Security Services is located within the city limits of Renton and the program would be more effectively managed through local contact. A six-month contract with Dotson Security Services would cost $65,258. The funding for a six-month contract would be from the existing 2008 Police Department Budget. Continued funding for the program would be needed in the 2009 budget. Background, Business Opportunity & Customer Needs The City of Renton, Washington is requesting staffing by multiple security personnel that will be integrated into a comprehensive Visitor Information and Downtown Assistance Program plan. This activity will allow the Renton Police Department to meet its desired goals while establishing an integral program and completing an in-depth review of its success. The service provider will provide staffing for the protection and safety of the general public, property, the surrounding critical business functions and services, and the supporting The City of Renton's law enforcement strategies and decisions are based on a viable assumption of deterring and minimizing misconduct that will put Renton Transit Center patrons at risk of their safe passage and experience in the down- town area of the City. This program places trained security staff to help augment the City's Police Department with trained eyes and ears on the ground to com- municate and report to the police any activity that requires their assistance or immediate involvement. Any event that impairs or violates this assumption is a significant occurrence impinging on an ability to fulfill this objective. Risk Management is about establishing solutions that reduce the likelihood of an II) incident or interruption of secured services from occurring and to provide for an appropriate response should such an event occur. The Security Service provider is therefore that part of Risk Management that establishes cost-effective solutions should an incident occur at the Renton Transit Center. As such, it will deal with actual events (assuming one has occurred) and the action required in responding to the event. Specifically, it complements the overall risk management process, which deals primarily with the possibility of risk events occurring, and the analysis and proactive treatment of such events. 1.2. Business Objectives & Success Criteria A review of current staff requirements as well as focused meetings designed to capture support information will be conducted by Contractor immediately after award of the contract. PROPOSAL 2.1. SCOPE 3.1. Officers are tasked to observe and report any suspi- cious activity, and to detect and deter civil infractions and criminal activity. Provide an atmosphere that results in a cordial, courteous, pleasant and respectful interaction with the areas' business owners, general public and visitors as perceived from their point of view as well as present a good image of the City. b. Communicate in a manner honest, open and responsive in all situations, to the extent authorized, provide information regarding the "downtown" Renton and surrounding area as requested by visitors. c. Monitor the alleyways and streets of the assigned post, paying particular attention to unattended boxes, buggies, containers and strollers, as well as `out-of-view' locations that attract homeless and transients. Monitor the movement of people, vehicles and parking in a calm manner and di- rect persons who cause a disturbance to leave the area d. Patrol the assigned site on a bicycle in all but the most severe weather and then will resort to foot patrol until the extreme weather dissipates, checking for unsafe hazardous conditions blocking access or egress to public areas, using authorized equipment and protective gear. • e. Protect crime scenes and incident sites that are the product of accidents, crimes, emergencies, and security incidents employing barriers, signage and direct traffic around area until the situation is resolved. f. Prepare logs and reports as required for the post, type or write reports or enter information in a computer using standard grammar, review security control logs and take actions as described in the post orders. g. Observe and report breaches, incidents or suspicious activity to client representatives and law enforcement, company management and any other public safety representatives as appropriate for the circumstances or post orders. h. Respond quickly to incidents of a bomb threat, fire, flooding, elevator emergencies, inclement weather, medical emergency, pedestrian and traffic accidents, spills of suspected hazardous materials, unexpected water discharge and other conditions or incidents following procedures established for the post, by the company and training received. i. Any employee as- signed must be well proportioned in height and weight, and in good general health without any physical abnormalities or defects that would interfere with the performance of duties. They shall possess binocular vision, correctable to 20/20 and shall not be colorblind. They shall be capable of hearing ordi- nary conversation at 20 feet and whispered conversations at 10 feet without the benefit of artificial hearing devices. 3.1.6 Appearance The City of Renton desires a favorable image and considers it to be a major asset of a security guard service. Contract employee's good appearance, attitude, courtesy and job knowledge are influential in creating a image. No chewing of gum or tobacco, eating, grooming, reading any unauthorized material or smoking shall be permitted while Security Officers are in public view. No personal phone calls will be permitted except in an emergency. 3.1.7 Typical Duties With or without reasonable accommodations, a candidate must have the physical and mental capacity to effectively perform all essential functions described. In addition to other demands, the job requires the following. a. Ability to adjust focus, close vision and distance vision. • b. Basic computer and keyboarding usage and operating various control components and devices. c. Continuous performance of physical exertion as well as the occasional performance of stressful activity. d. Frequent bicycle riding, sitting, standing and/or walking, which may be required for long periods of time and may involve the climbing of stairs and riding or walking up inclines and uneven terrain. e. Frequent lifting and/or moving up to 20 pounds and occasionally lifting up to 40 pounds. f. Hearing, seeing, speaking and writing clearly in order to communicate with clients, employees and the public, observe and report incidents and direct others. g. Mentally and physically able, devoid of all mind-altering medication, in order to obtain and maintain a Guard license from the state of Washing- ton. n. Occasional crawling, crouching, kneeling, reaching with arms and hands, or stooping. o. Regularly demonstrate the ability to handle multiple tasks concurrently. p. Successful passage of background and reference checks, psychological, and controlled substance tests, in addition to any mandatory licensing and testing requirements. 3.1.8 Uniforms • Security personnel shall wear the blue and yellow uniform of the security guard Contractor at all times when on duty. Uniforms shall include a badge or other insignia designating the person as a security officer and the uniform will be subject to the approval by the City. 3.1 .9 Arrest & Detainment The City of Renton prohibits the use of arrest powers by non-commissioned personnel. When necessary, the Renton Police Department authorities shall be summoned. Non-Commissioned security personnel shall always be cooperative with law enforcement and/or authorized emergency personnel. Non-Commissioned security staff powers of arrest are no greater than that of a private citizen. Contractor shall assume full liability and responsibility for its non-commissioned employees in the exercise of any police authority. 3.1.10 Use of Force & Weapons a. Contractor shall assume full liability and responsibility for any use of force by its employees and any other activities not within the best inter- ests of the City. b. Use of weapons by non-commissioned personnel assigned to any City site is strictly prohibited. Possession of weapons by non-commissioned personnel on the site shall be grounds for immediate and permanent removal of the employee • from the site. Repeated offenses may be grounds for the termination of this contract. Use of any force by non-commissioned personnel beyond that necessary for self-defense* shall be grounds for the immediate and permanent removal of the employee. * Guards shall have normal concern for their own physical safety and shall take reasonable precau- tions not to place themselves in situations which would encourage violence or abuse against ei- ther them or other persons in the area. 3.2. SECTION II: GENERAL PROVISIONS 3.2.1 Contract Supervision a. The Contractor shall provide in writing the name, address and telephone number of the Account Manager or equivalent to the Special Operations Commander of the Renton Police Department within seven (7) working days after award of the contract. The term "Account Manager" means a person designated in writing by Contractor who has complete authority to act for the Contractor during the term of the contract. Uniformed staff or employees who are assigned regular Guard duty will not perform the duties of the Account Manager. The Account Manager shall have authority to accept correspondence, • inspection reports and notices of deductions on behalf of the Contractor. In addition, this person will have the authority to act for the Contractor on a day-to-day basis at the work site. b. The Contractor shall have sole responsibility to ensure employees: ✓ Are properly trained to perform all duties as specified in accordance with the contract. ✓ Are properly uniformed and present a neat professional appearance. ✓ Maintain a continued state of properly trained Guards on the contract. ✓ Possess the necessary authority, badges, permits, uniforms, etc. 3.2.2 Work Supervision The Contractor shall: a. Conduct equipment and uniform inspections on security personnel. b. Maintain records as needed or required by the City. c. Schedule and record floating holidays, sick leave, training and vacations. • e. Schedule monthly manpower assignments for the Renton Transit Center complex. f. Work with the City of Renton Police Department and/or other personnel to maintain a harmonious working relationship. g. Work with the Renton Police Department on specific crowd control plans. 3.2.3 Contractor Start-Up Review Immediately after award of this contract and prior to its execution, Both the Contractor's representative and the Special Operations Commander shall make an in-depth on-site review of the total job requirements to include but not be limited to the following: a. A detail of the company's training program and how the company will provide proof of training for all new Guards. b. Area maps of the Renton Transit Center and surrounding area which depict emergency evacuation routes, the location and type of each fire alarm and special instructions pertaining to security controls. c. Guard assignments including specific shift hours total number of hours per month for all Guard personnel. • d. Policy and specific procedures for responding to emergency alarms, bomb threats or suspected incendiary devices in the particular area or facility that is being protected. e. Required forms, logs and reports. 3.2.4 Work Scheduling Procedures The criteria for establishing work schedules and requirements for contract relief, relief periods and for starting and stopping work are contained herein: a. All Guards shall be in uniform and ready to begin work promptly at the start of their shift and shall remain on the job and in full uniform until the end of their full tour of duty. b. Breaks and lunch shall be taken while on duty in designated areas on the premise. c. Contractor will establish the work schedules to be consistent with the shift hours and total hours established pursuant to Section III.2.3.c above. d. (W.A.C. 308.18) 3.2.6 Call List a. Contractor shall be provided with a list of City employees, including the Renton Police Department, to be called in the event of an emergency. b. Contractor shall provide to the Special Operations Commander a list of emergency numbers which include, but not limited to: ✓ A 24-hour business telephone number. ✓ Guard service provider's business number for an area Supervisor. ✓ Off-site Lead/Relief person's cellular and/or home telephone number. ✓ On-site Lead/Relief person's cellular and/or home telephone number. c. It shall be the responsibility of Contractor to notify the Special Operations Commander immediately of any changes in personnel and to confirm that the list provided is current on a monthly basis. 3.2.7 Identification 111 All Guards are required to carry an identification badge to be issued by the Contractor that is clearly visible on their person when on duty. Any expense incurred for badges, throughout the term of the contract, shall be borne by Contractor. 3.2.8 Routine Change in Service (One or Two People) Should there be a change in City's requirement for security guard service; Contractor will adjust the number of personnel when required. The City will make a reasonable attempt to give the Contractor at least twenty-four (24) hours verbal or written notification whenever there is to be a decrease or an increase in personnel. There will be times, however, when an immediate staffing adjustment is necessary. Any change in personnel will not affect the quoted hourly rate to be paid for the service provided. 3.2.9 Emergency Guard Service The City of Renton reserves the right to require additional Guards on the site in a minimum amount of time (i.e. less than a 24-hour notification to Contractor) and Contractor shall be able to supply at least two (2) Guards under such conditions. 3.2.10 Criminal Action Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. Conviction of a crime involving moral turpitude will be sufficient reason for disqualification as to initial and subsequent placement of any Guard personnel by Contractor in any work performed under the Contractor. The arrest for and/or conviction of any crime may also be sufficient cause for disqualification as to initial and subsequent placement of Guard by Contractor in any work performed under this contract at the discretion of the City. b. The Special Operations Commander or his/her designee reserves the right to notify Contractor to remove any security personnel from duty and to have them replace when a Guard's continued employment is deemed by the Special Operations Commander or his/her designee to be con- trary to the public interest or inconsistent with the best interests of the City. 3.2.12 Performance Evaluation Meetings Contractor's representative shall meet weekly with the Special Operations Commander during the first two (2) months of the contract. Thereafter, they will meet as often as necessary at the discretion of the City's representative, but not less than bi-monthly. A mutual effort will be made to resolve each IPproblem identified. The written minutes of these meetings, prepared by the Contractor's representative, shall be signed by the City's representative. 3.2.13 Personnel / Security Clearance a. After award of the proposal, the Contractor shall immediately provide to the City's representative a list of prospective Guards and Supervisors to be assigned to the post. That list shall include at a minimum all of the following information on each prospective employee: ✓ Copy of C.P.R. / First Aid Training Card. i Copy of the permanent (not temporary) individual State Guard License for each prospective guard. ✓ Current residential address. ✓ Date of Birth. ✓ Department of Motor Vehicles Driving Record. • Full legal name and any alias. ✓ One current color photograph (at least 2" by 3" full face front, head and shoulders only) III ✓ Physical description Dotson Security Services, Inc. 1102 Bronson Way North,Suite C;Renton, WA 98058-(425) 271-2113 Contract and Scope for City of Renton Visitor Information and Downtown Assistance Program Page 11 ✓ Washington Drivers License Number • b. Contractor shall provide the same information for each of the prospective employees to be assigned to the City during the term of the contract. c. Each of Contractor's employees assigned to the City shall be subject to a background security investigation prior to receiving written acceptance from the Special Operations Commander. Investigations shall include, but not limited to clearance through Renton Police Department. The City reserves the right to deny a written acceptance to any Guard candidate. 3.2.14 Additional Provisions a. Contractor shall provide an itemized billingshowingbreakdown of charges for each Guard on a monthly basis. b. Contractor shall provide name and resume of each individual assigned to this project and the individual assigned to backup the primary person in her/his absence to the Special Operations Commander for security clearances. c. Contractor shall report directly to the Special Operations Commander or his/her designee. d. Contractor shall submit reports with documentation of all incidents that are considered security breaches, incidents, equipment and/or system • failures. e. Contractor warrants that all security guards shall be bonded, licensed and uniformed. f. Each Guard shall check in daily at the location specified by the Special Operations Commander. 3.3. SECTION III: EQUIPMENT 3.3.1 Bicycles (Patrol) Contractor shall procure and provide three (3) bicycles for service with City of Renton. The cost for the bicycles (2 bicycles plus 1 reserve) including accessories is $268.33 per month. Renton shall reimburse at the cost of three (3) bicycles, accessories and maintenance at the cost of $268.33 per month during the term of the contract. The City of Renton shall provide an area for the three bicycles and other post equipment to be stored. Unless otherwise permitted by the Special Operations Commander, the three patrol bicycles and other post equipment must be stored in the designated area when not in use in fulfillment of this contract. • Dotson Security Services, Inc. 1102 Bronson Way North,Suite C;Renton, WA 98058-(425)271-2113 Contract and Scope for City of Renton Visitor Information and Downtown Assistance Program Page 12 Contractor shall be liable for the replacement cost of any equipment lost or IIIdamaged as a result of misuse or negligence by Contractor personnel. 3.3.2 Communications Contractor shall procure and provide cellular telephones for service for a cost of $51.02 monthly per cellular telephone. Renton will reimburse the Contractor for the cost of two (2) cell phones at $51.00 per month for each phone during the term of the contract. • 3.4. SECTION IV: TERM 3.4.1 Commencement of Agreement This Agreement shall commence on the day of , 2008 and upon completion of a three month evaluation period, the City shall have the option to continue the program for one calendar year thereafter, which will terminate on the day of , 2009 unless extended in writing by both Parties. 3.4.2 Renewal of Contract The City shall have the option to renew this Agreement annually by giving the Contractor notice in writing of such intent to renew not less than thirty (30) days prior to its expiration date. Each renewal shall be for a period of one year, but in no event shall this Agreement be renewed more than four • (4) times. Renewal shall be subject to acceptance in writing by Contractor. 3.4.3 Term Adjustments Prior to exercising renewal option; the Contractor may request adjustments to the fee schedule established in this original contract. Such fee increase request must be made in writing to the City one hundred-twenty (120) days prior to the end of the renewal period. The City reserves the right to accept or reject all requests for fee increases. Any fee increase request must be documented to the satisfaction of the City. 3.5. SECTION V: COST & PAYMENTS 3.5.1 Basic Rate Security officer personnel shall be charged at a rate of $25.50 per hour. 3.5.2 Overtime Rate For purposes of this section, the term "Overtime" shall be defined as the hours in excess of those identified by the Special Operations Commander, pursuant to Section 3.2.3.c. under Contract Start-Up Review above. Over- time shall be charged at one & one-half (1%) times the above basic rate. This overtime shall be at a rate of $38.25 per hour. • Dotson Security Services, Inc. 1102 Bronson Way North,Suite C;Renton, WA 98058-(425)271-2113 Contract and Scope for City of Renton Visitor Information and Downtown Assistance Program Page 13 3.5.3 Payment for Overtime The City agrees to pay the overtime bill rate for any overtime incurred by the Contractor from the time the City provides an official notice of termination to the Contractor until this Agreement is terminated. 3.5.4 Payment of Services For and in consideration of providing the services set forth herein, the City shall pay the Contractor an amount equal to the hourly rates set above and multiplied by the number of hours of service provided each month. The Contractor shall not bill for services in excess of those agreed and pursuant to Section 3.2.3. under Contract Start-Up Review above. Contractor shall submit bills on a monthly basis in arrears setting forth the work completed, amount due and any other information the City may require. 3.5.5 Reimbursements The City will reimburse Contractor for any increase in State Unemployment Insurance taxes and increases in any other charge, cost, fee or tax imposed on Contractor or the services provided under this Agreement. 3.6. SECTION VI: INSURANCE 3.6.1 Compensation • Additional compensation from the City of Renton to the Contractor shall not be provided for insurance policies with coverage that exceeds the above minimum requirements. 3.6.2 Conditions & Terms The Contractor shall provide evidence of an insurance policy or policies that meet all of the terms and conditions listed below prior to the first business day of provision of services under this contract. The insurance policy or pol- icies shall specify the City of Renton, its agents, employees, and officers as additional insured on all coverage with that coverage being primary and non-contributory to any other coverage available to the City. The insurance policy or policies shall provide that they will not be cancelled without forty- five (45) days' written notice to the City of Renton. The insurance policy or policies shall provide coverage for a minimum of $1,000,000.00 per occur- rence, with a minimum of $3,000,000.00 aggregate. Coverage provided shall include at a minimum, completed operations, all discrimination, all ha- rassment, assault and battery, full personal injury and intentional acts. The type of policy or policies shall be commercial general liability providing cov- erage for Bodily Injury, Property Damage, Personal Injury, Errors & Omis- sions and be issued by an insurer that is Washington State Admitted with an A.M. Best Minimum Rating of"A-"or better. 3.6.3 Coverage Any insurance coverage (additional insured or otherwise) the Contractor provides for the City or any third parties will not cover losses or injuries 411 proximately caused solely by the City's or the third party's acts or omissions. The City will also acknowledge that Contractor maintains self-insurance retentions in excess of$25,000.'1(2 and that such retentions are acceptable to the City. 3.6.5 Worker's Compensation Contractor will be solely responsible to maintain proper Worker's Compen- sation protection for Contractor's employees as required by Title 51 of the Revised Code of Washington. 3.7. SECTION VII: RELATIONSHIP OF THE PARTIES 3.7.1 Entitlement Limits The parties' intentions are that an independent contractor relationship will be created by this Agreement. The City of Renton is interested only in the results achieved. The conduct and control of services or work lie solely with the Contractor. No agent, employee, representative, servant or other actor of the Contractor shall be deemed to be an agent, employee, representa- tive, servant or actor of the City for any purpose. Further, the agent, em- • ployee, representative, servant or other actor of the Contractor is not en- titled to any of the benefits that the City provides to the City employees. The Contractor will be entirely and solely responsible for its acts and for the acts of its agents, employees, representatives, servants or others during the delivery and performance of this Agreement. 3.7.2 Guards' Compensation The Contractor shall provide competent personnel necessary to carry out the requirements of this Agreement, shall supervise them in their work and shall pay them for their services at the Contractors sole cost and expense. 3.8. SECTION VIII: NON-DISCRIMINATION Except as set out in Section 3.1.5 under Health & Physical Fitness Requirements above, the Parties hereto specifically agree that no person shall, on the grounds of color, creed, nation origin, race, religion or sex, nor mental, physical or sensory disability be excluded from employment rights and participation in or be denied the benefit of or otherwise be subject to discrimination under any kind of activity, program or service for which the Contractor has received or will receive payment under the provisions of this Agreement. 3.9. SECTION IX: MAINTENANCE OF RECORDS The Contractor shall make available to the City, the Washington State Auditor or 111 their duly authorized representative, at any time during normal operating hours, all books, pertinent information or records that the Contractor shall have kept in Dotson Security Services,Inc. 1102 Bronson Way North,Suite C;Renton, WA 98058-(425)271-2113 Contract and Scope for City of Renton Visitor Information and Downtown Assistance Program Page 15 conjunction with this Agreement and that the City may be required by law to • make part of an audit trail, its auditing procedures or that may be required for the purpose of funding the services contracted for herein. 3.10. SECTION X: COMPLIANCE WITH LAWS The Parties hereto specifically agree to be compliant of all federal, state, and lo- cal laws, ordinances and regulations to the extent that they may have any bear- ing on either providing any money or the services actually provided under the terms of this Agreement. 3.11. SECTION XI: ASSIGNMENT This Agreement is for personal services, and accordingly, the Contractor may not assign or transfer, in part or in whole, its interest in this Agreement without the express written consent of the City. 3.12. SECTION XII: MODIFICATION No amendments or modifications of this Agreement shall be valid until the same is documented in writing and executed with the same formalities as the present Agreement. 3.13. SECTION XIII: VENUE STIPULATION • This Agreement has and shall be construed as having been made and delivered in the State of Washington and the laws of Washington State shall be applicable to its construction and enforcement. Any action at law or suit in equity, or judicial proceeding for the enforcement of this Agreement or any provision hereto shall be instituted only in courts of com- petent jurisdiction within King County, Washington. 3.14. SECTION XIV: WAIVER No agent, employee, officer, representative, servant or other actor of the City has the authority, power, or right to waive any of the conditions of this Agreement. No waiver of any breach of this Agreement shall be held to be a waiver of any other or subsequent breach. All remedies afforded in this Agreement shall be taken and construed as cumulative, that is, in addition to every other remedy provided herein or by law. SECTION XV: INDEMNITY: LIMITATION OF LIABILITY 410 3.15.1 Indemnifying the City The Contractor agrees to indemnify and defend the City from any claim, cost, expense, or loss claimed by third parties for bodily injury, including death, pain and suffering, emotional or mental disdain, civil rights violations, and property damage, (hereinafter collectively referred to as "losses") and any attorneys fees, caused solely by negligence or willful misconduct of an agent, employee, officer, representative, servant or other actor of the Con- tractor in connection with the services to be performed by the Contractor under the terms of this Agreement. 3.15.2 Indemnifying the Contractor The City agrees to indemnify and defend the Contractor from any, claim, cost, expense, or loss claimed by third parties for bodily injury, including death, pain and suffering, emotional or mental disdain, civil rights violations, and property damage, (hereinafter collectively referred to as "losses") and any attorneys fees, caused solely by negligence or willful misconduct of an agent, employee, officer, representative, servant or other actor of the City in connection with the requirements to be performed by the City under the terms of this Agreement. 3.15.3 Liability Shared If the negligence or willful misconduct of both the City and Contractor (or a • person identified above for which each is liable) is a cause of such "Losses", then said "Losses" shall be shared between the City and the Contractor in fair proportion to their relative degree of negligence or willful misconduct and the right of indemnity shall apply to such proportion. Each party shall bear its own attorneys fees. 3.15.4 Limitations In no event will the liability of Contractor (and its insurers) to the City and any person or entity required to be defended or indemnified by Contractor under this Agreement (collectively "City Parties"), exceed $3,000,000.00 Further, in no event will the Contractor (and its insurers) be liable to the City Parties for any: a. Damages arising from acts of war, armed or violent actions or hi-jacking. b. Special, consequential, exemplary, indirect, liquidated, or punitive dam- ages (including, but not limited to, loss of business or profits). c. Environmental damages. 3.15.5 Terrorism Notwithstanding anything to the contrary herein, each Party waives any and all claims against the other Party for damages arising from or related to an • act of terrorism. The Parties intend for this waiver to "flow down" to each of their respective contractors and subcontractors. In no way do they purport to and shall not be deemed to define, extend or limit the intent or scope of the sections to which they pertain. 3.18. SECTION XVIII: TERMINATION 411 Each Party reserves the right to terminate this Agreement at any time without cause or penalty upon thirty (30) days' written notice to the other Party. In the event of termination through no fault of the Contractor, the City agrees to pay the Contractor for all services performed to the date of termination upon receipt of documentation by the Contractor that such services have been performed to the date of termination and acceptance of said documentation by the City. 3.19. BACKGROUND SUMMARY: The White Fence Ranch Sanitary Sewer project will provide direct sanitary sewer service to properties adjacent to portions of 155t' Avenue SE and 156th Avenue SE that are located between SE 128t' Street and SE 120th Street (see attached map). The estimated cost of the new interceptor is $1,300,556.39. The Wastewater Utility has proposed to use a per-connection method of calculating the assessments for the properties within the proposed assessment district. This method divides the cost of the project by-the number of lots within the assessment district. There are 118 lots within the .ro osed assessment district boundary. p p y CONCLUSION: • It has been the policy of the City when sanitary sewer facilities have been installed that the City create a special assessment district in order to ensure that each property that Council/White Fence Ranch SAD May 9,2008 Page 2 of 2 benefits from the new facilitypays its fair share of the costs. This policy helps to ensure • that the existing ratepayers do not pay a disproportionate share of the costs for system expansion or growth. WHEREAS, the City of Renton has adopted regulations for height of structures within the R-1, R-4, and R-8 zones within the City; and WHEREAS, the current standard height for public utility facilities is treated the same as the height standard for other structures in these zones; and WHEREAS, the allowed height is a maximum of 30 feet; and • WHEREAS, the height needed for typical public water utility facilities exceeds 30 feet; and WHEREAS, variances were historically requested to allow construction of facilities q needed to provide needed public water supply; and WHEREAS, the City Hearing Examiner has found that the variance tool is not appropriate in certain instances due to required findings based on the physical constraints of the property rather than characteristics of the use; and WHEREAS, the City Council finds that revisions are needed to height standards for public water utility facilities to insure that reasonable water service can be provided; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: 1 ORDINANCE NO. • SECTION I. Note 9 of subsection 4-2-110D, Conditions Associated with Development Standards Table for Single Family Residential Zoning Designations, of Chapter 2, Zoning Districts—Uses and Standards, of Title IV (Development Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton, Washington" is hereby amended to read as follows: 9. Public facilities are allowed the following height bonus: a. Water towers/reservoirs are permitted up to a maximum height of one hundred and seventy-five feet (175')to the highest point of the reservoir. b. Water treatment facilities and pump stations are allowed up to fifty (50') subject to site plan review. The reviewing official may modify setback standards to increase setbacks as part of the site plan review approval. • c. Public utility facilities exceeding 50 feet in height shall be treated with public art consistent with RMC 4-9-160. Such public art shall be eligible for 1% for art funding and shall be reviewed by the Renton Art Commission d. Structures on Public Suffix (P) properties are permitted an additional fifteen feet (15') in height above that otherwise permitted in the zone if "pitched roofs," as defined herein, are used for at least sixty percent (60%) or more of the roof surface of both primary and accessory structures. In addition, the height of a publicly owned structure may be increased as follows: • 2 a ORDINANCE NO. 1110 i. When abutting a public street, one additional foot of height for each additional one and one-half feet (1-1/2') of perimeter building setback beyond the minimum street setback required; or ii. When abutting a common property line, one additional foot of height for each additional two feet (2') of perimeter building setback beyond the minimum required along a common property line. Subsection 4-2-110A, Development Standards for Single Family Residential Zoning Designations (Primary and Attached Accessory Structures) table is hereby amended to add language to the Building Standards section of the table, column titled "Maximum Building Height and Number of Stories" creating an exemption for public water IIIsystem facilities subject to foot note #9 and to allow the reviewing official to modify the building coverage allowance in the R-1, R-4, and R-8 zones, as shown in Exhibit A.
