6. CONSENT AGENDA
The following items are distributed to Councilmembers in advance for study and review, and the

a. Approval of Council meeting minutes of 6/9/2008. Council concur.
b. Administrative, Judicial, and Legal Services Department recommends acceptance of the 2009-
2014 City of Renton Business Plan. Council concur. (See 8.a. for resolution.)
c. City Clerk reports bid opening on 5/28/2008 for CAG-08-068,North Highlands Neighborhood
Center Roof Replacement project; eight bids; engineer's estimate $139,000; and submits staff
recommendation to award the contract to the low bidder, Olympic Roofing & Remodel, LLC, in
the amount of$74,556. Council concur.
d. City Clerk reports bid opening on 5/28/2008 for CAG-08-071, City Shops Buildings A-2, B, and
C Roof Replacement project; seven bids; engineer's estimate $220,000; and submits staff
recommendation to award the contract to the low bidder, Krueger Sheet Metal Co., in the amount
of$246.810.88. Refer to Finance Committee for discussion of funding.
e. Community Services Department requests authorization to apply for a$500,000 matching grant
from the Washington Wildlife Recreation Program for capital improvements at Ron Regis Park.

f. Human Resources and Risk Management Department requests approval to hire a new
Administrative Assistant position, and approval of the related 2008 Budget amendment. Refer to

g. Transportation Systems Division recommends approval of a memorandum of understanding with
the Washington State Department of Transportation regarding the cooperative operation of traffic

SPECIAL PRESENTATION Fire Chief/Emergency Services Administrator Daniels announced the Fire
Fire: Employee Promotions Department promotions, as follows:
• Firefighter Tom Curtis,promoted to Lieutenant;
• Lieutenant Greg Hartman,promoted to Captain;
• Captain Karl Rufener,promoted to Battalion Chief/Safety Officer;
• Battalion Chief/Safety Officer Bill Flora,promoted to Deputy Chief
Each promoted employee was presented with a badge of position by his spouse.
Mayor Law thanked the promotees for their service.
ADMINISTRATIVE Chief Administrative Officer Covington reviewed a written administrative
REPORT report summarizing the City's recent progress towards goals and work programs
adopted as part of its business plan for 2008 and beyond. Items noted included:
* Everyone is welcome to attend the Benson Hill Community Celebration and
Neighborhood Picnic at Cascade Elementary School on Saturday,June 21,
from 11:00 a.m. to 2:00 p.m. Hot dogs, lemonade, and ice cream will be
provided. For more information about the picnic, contact Norma McQuiller
at 425-430-6595.
AUDIENCE COMMENT Stanley Marczewski (Renton) stated that he is the spokesperson for the Falcon
Citizen Comment: Marczewski Ridge Homeowners' Association. He submitted a letter via the City Clerk
- Private Road Maintenance concerning the maintenance of a private road(Cedar Ridge Dr. SE)that leads
(Cedar Ridge Dr SE) into the Falcon Ridge subdivision.
Citizen Comment: McOmber- Howard McOmber(Renton) announced that the emergency preparedness event
Emergency Preparedness held on June 12 by the Highlands Community Association was a tremendous
Event success. He thanked City officials and staff who attended and participated.
CONSENT AGENDA Items on the consent agenda are adopted by one motion which follows the
listing. At the request of Councilmember Persson, item 6.d. was removed for
separate consideration.

Plan, 2009-2014 acceptance of the 2009-2014 City of Renton Business Plan. Council concur.

CAG: 08-068,North City Clerk reported bid opening on 5/28/2008 for CAG-08-068,North
Highlands Neighborhood Highlands Neighborhood Center Roof Replacement project; eight bids;
Center Roof Replacement, engineer's estimate $139,000; and submitted staff recommendation to award the
Olympic Roofing&Remodel contract to low bidder, Olympic Roof&Remodel, LLC, in the amount of
$74,556. Council concur.
Community Services: Ron Community Services Department requested authorization to apply for a
Regis Park, Washington $500,000 matching grant from the Washington Wildlife Recreation Program for

CAG: 08-071, City Shops estimate $220,000; and submitted staff recommendation to award the contract to
Buildings A-2, B, & C Roof low bidder,Krueger Sheet Metal, Co., in the amount of$246,810.88. Refer to

Metal Noting that the contract amount is approximately $1,800 over budget,

UNFINISHED BUSINESS Transportation (Aviation) Committee Vice-Chair Persson presented a report
Transportation (Aviation) recommending concurrence in the staff recommendation to authorize the Mayor
Committee and City Clerk to execute the proposed construction agreement with Puget
Transportation: Duvall Ave Sound Energy in the amount of$170,240, to provide underground utility
NE Reconstruction Utility conversion on the Duvall Ave. NE Widening Project. MOVED BY PERSSON,
Conversion, Puget Sound SECONDED BY ZWICKER, COUNCIL CONCUR IN THE COMMITTEE
Energy REPORT. CARRIED.
Planning& Development Planning and Development Committee Chair Parker presented a report
Committee recommending concurrence in the staff recommendation to adopt a resolution
Planning: 2007 Buildable ratifying the Growth Management Planning Council Motion 07-03. Motion 07-
Lands Amendment, 03 amends the Countywide Planning Policies by including the Buildable Lands
Countywide Planning Policies Report as an appendix, recognizes the completion of the 2007 King County
Buildable Lands Report, and notes its findings. MOVED BY PARKER,
SECONDED BY ZWICKER, COUNCIL CONCUR IN THE COMMITTEE
REPORT. CARRIED. (See page 202 for resolution.)

Planning: Restrictive Planning and Development Committee Chair Parker presented a report
Covenants Removal, Althoff, recommending concurrence in the staff recommendation to authorize the
NE Sunset Blvd removal of restrictive covenants that were required as a condition to rezone the
subject property in 1986 from Residence 3 (R-3)to Office Park(O-P). The
covenants required:
1. Zoning of the subject site will revert from O-P back to R-3 if specific
development plans in the form of a building permit application, or other
land use permit representing an intention to utilize the O-P zoning, such as
an application for site plan review or conditional use permit, is not
submitted within two (2)years of final approval on this zoning action.
2. The existing homes on the subject site are not to be utilized for any
commercial endeavor.
The covenants are no longer relevant as they have either been satisfied or have
been supplanted by subsequent rezoning of the property. MOVED BY
PARKER, SECONDED BY ZWICKER, COUNCIL CONCUR IN THE
COMMITTEE REPORT. CARRIED.
Planning: Development Planning and Development Committee Chair Parker presented a report
Regulations (Title IV) 2006 recommending concurrence in the staff recommendation to approve File#06-14
Docket Review Itinerant Vendors addressing the farmers markets, and temporary merchant
vendor portions of this docket item with modifications from the
recommendations made by the Planning Commission. The proposed
amendment will make the following changes:
Farmers Markets
• Allow farmers markets only in the CD zone
• Add a definition for farmers markets
Temporary Merchant Vendors
• Allow temporary merchant vendors subject to peddlers license
requirements (Title V)
• Revise Title V to reflect amended zones
• Provide exemptions from permitting requirements for City sponsored
events and produce stands
• Revise the definition of outdoor retail sales to remove"produce stands"
from the definition
The Committee recommended that allowing farmers markets in other areas of
the City be reviewed through the current Business District Overlay work
program. The Committee also recommended that an ordinance addressing
amendments for farmers market in the CD zone and temporary merchant
vendors be forwarded to City Council for first reading. The Committee further
recommended that the issue of mobile food vendors remain in Committee for
additional research and discussion relating to the nature of these types of uses
and restrictions imposed by adjacent jurisdictions. MOVED BY PARKER,
SECONDED BY ZWICKER, COUNCIL CONCUR IN THE COMMITTEE
REPORT.*

Responding to an inquiry by Councilmember Briere, Community and Economic
Development Administrator Pietsch stated that produce sales are specifically
exempted from local zoning by the State legislature, cannot be regulated at the
local level, and are allowed throughout the City.

Community Services Community Services Committee Chair Briere presented a report recommending
Committee concurrence in the staff recommendation to approve Mayor Law's appointment
Appointment: Knickerbocker, of Jennifer Knickerbocker to the Advisory Commission on Diversity to fill an
Advisory Commission on unexpired term expiring on 12/31/2009 (position previously held by Erica
Diversity Rehberg).*
Councilmember Briere introduced Ms. Knickerbocker, who was present in the
audience,noted her impressive résumé, and remarked that all Advisory
Commission on Diversity positions are filled. Mayor Law thanked Ms.
Knickerbocker for her willingness to serve on the commission.

AUDIENCE COMMENT Arland"Buzz"Johnson (Renton)presented photos comparing hanging flower
Citizen Comment: Johnson- baskets in Lake Oswego, Oregon to those in Renton. He encouraged the City,
Hanging Flower Baskets the Chamber of Commerce, and local businesses to work together to fund and
continue the flower program.

Citizen Comment: Schmidt- Joseph Schmidt(Renton)reported loud noises (music) occurring during early
Noise Ordinance morning hours in his neighborhood. He inquired about the City's noise
ordinance regulations.

In addition to our day-to-day activities,the following is worthy of note for this week:
• The Renton Fire and Emergency Services Depth tnient will be conducting training exercises
that will include actual live-fire drills for firefighters. This training will occur over the
course of three days beginning on June 17 and concluding on June 19, from approximately 9
a.m. to 5 p.m. each day. The residential structure to be used for this drill is located at 4518
Talbot Road South and was donated by John C. Radovich Development Company. Every
effort is being made to reduce any concerns or disruptions to neighboring residents.
Permission has been granted for this exercise by Puget Sound Clean Air Agency, which
monitors such trainings and requires extra precautions to minimize the impact on the
environment.
• Everyone is welcome to attend the Benson Hill Community Celebration and Neighborhood
Picnic at Cascade Elementary School on Saturday, June 21, from 11 a.m. to 2 p.m. Hot dogs,

SUBJECT: MAINTENANCE OF CEDAR RIDGE DRIVE SE
QUESTION:
Should the Renton City Council amend City Ordinance No.3554 passed in June 1981 to share in the
maintenance costs with the 137 homeowners of Falcon Ridge Residential Park or should the City of Renton
maintain Cedar Ridge Drive SE as a city street(road)?
FACTS:
1. All copies of the Renton City documents were obtained through the most helpful staff of the City
Clerk's Office.
2. The plat of land now know as Falcon Ridge Residential Park,formerly Cedar Ridge Residential Park,
was land locked and had been for a number of years.Renton City Ordinance No 1871 was passed by
the Renton City Council on February 28, 1961 annexing the property to the city.
3. The regular meeting of the Renton City Council was held on April 21, 1980 and of the many items
discussed was the Cedar Ridge Residential Park.
4. Belterra Development Corporation was able to persuade the City of Renton to negotiate with the
Bonneville Power Administration for a right-of-way so that Belterra Development Corporation could
have access to develop their land locked property to be known as Cedar Ridge Residential Park.
5. Renton City Ordinance No.3554 was written by Belterra Development Corporation's lawyer and
approved by the City Council with minor recommended changes of the City Attorney on June 15,
1981.The City Council approved many concessions to Belterra Development Corporation to build
Cedar Ridge Residential Park.
6. Cedar Ridge Drive SE is over 3/10 of a mile and the longest entrance street(road)to a gated
community in the City Of Renton.The Renton City Council approved that the developer did not have
to build the street(road)to Renton City Code nor did the Renton City Council envision heavy trucks
using the street(road)or the potential costs to the future city residents.
7. There is no sign indicating that Cedar Ridge Drive SE is a private street(road).The only sign below
the street(road)sign is a diamond shape sign stating DEAD END.The street(mad)is open to the
public and the public has used the street(road)and traveled the length until encountering the gate to
Residential Park.It was necessaryin 1989 or 1990 for the Falcon Ridge Residential Park
Falcon Ridge
Association to build a turn around so that cars and trucks would be able to turn around and not back
out to oncoming vehicles and cause an accident.
8. Belterra Development Corporation defaulted on their loan to Old Stone Mortgage Corporation,
formerly Sherwood&Roberts,Inc.,in June 1982.Between June 1982 and February 1983,the property
was in foreclosure and work ceased on Cedar Ridge Residential Park until the property was sold to a
new developer.
9. The date that the new developer purchased the property known as Cedar Ridge Residential Park is
difficult to obtain:however,King County Recorder's Office Instrument Number 198403140013 list
lien against John McNestry,Norcon Developments,LTD ET ALL on 03/14/1984.
10. The third amendment to the restated Declaration and Covenants,Conditions,Restrictions and
Reservations for the development now known as Falcon Ridge Residential Park was made by John
McNestry,President of Norcon Developments,LTD,a Canadian Corporation on November 14, 1985.
11. Renton City Ordinance No.3554 was amended by City of Renton Ordinance No.3960 on December 9,
1985 extending Cedar Ridge Drive SE franchise to June 15,2016.

12. Reference is made to Falcon Ridge Residential Park CC&Rs'Article 10.27 Assessment for Private
Road and Landscaping.
13. Since the establishment of Falcon Ridge Residential Park Association in the mid 1988,approximately
$150,000.00 has been spent maintaining Cedar Ridge Drive SE as well as the inner streets known as
SE 8th Drive and SE 8th Place.
14. Approximately$1,000.00 is spent monthly by the Falcon Ridge Residential Park Association to
maintain the grassy areas along Cedar Ridge Drive SE as well as the communal grassy areas.
15. Over$500,000.00 is collected yearly for city,county and state property taxes from the homeowners of
Falcon Ridge Residential Park.
16. There is an average of two or more vehicles per homeowner in the Falcon Ridge Residential Park and
it is difficult to estimate the motor vehicle fees and the federal and state gasoline taxes.
17. Letters written to State Senator Margarita Prentice and State Representatives Zack Hudgins and Bob
Hasegawa requesting a state grant to help repair Cedar Ridge Drive SE.
18. Telephone call made to Representative Adam Smith requesting a federal grant to help repair Cedar
Ridge Drive SE.
19. Letter received from Mr.Zimmerman,Administrator Renton Public Works Department in response to
the inquiries from State Senator Prentice and Representatives Hudgins and Hasegawa.
20. Numerous e-mails and letters to and from Mr.Zimmerman,Administrator,Renton Public Works
Department pertaining to Cedar Ridge Drive SE.
21. Several e-mails and letters were sent to State Representative Hudgins who was concerned with the
problem of Falcon Ridge Residential Park Association in trying to obtain the necessary funds for the
repair and maintenance of Cedar Ridge Drive SE.
22. At the suggestion of Representative Hudgins,an e-mail was sent to Mr. Steve Gorecaster,Director
Transportation Improvement Board seeking a grant to help repair Cedar Ridge Drive SE.
23. Letters were sent by certified mail on February 1,2008 to Administrator Bonneville Power
Administration and President Puget Sound Energy and Superintendent Seattle City Light.
24. Response from Mr.Wright,Administrator,Bonneville Power Administration.Dated April 1,2008.
25. Response from Mr.Cody Olson,Puget Sound Energy,dated February 12,2008.
DISCUSSION:
1. All copies of the Renton City documents were obtained by numerous visits to the City Clerk's Office
and research done by their most helpful staff.A few documents were provided in correspondence
from Mr.Zimmerman,Administrator Renton Public Works Department.Mr.Zimmerman was kind
enough to include an aerial view(Attachment 1)of Falcon Residential Park and the entrance street
(road)Cedar Ridge Drive SE.
2. Copy of Renton City Ordinance No. 1871 (Attachment 2)passed by the Renton City Council on
February 28, 1961 annexed certain territory to the City of Renton.A brief history/background of
this plat of land is as follows:The current SR-1 zoning was adopted by Ordinance No.2059 of
October 21, 1963.The Hearing Examiner granted a preliminary plat approval for 101 lots on
November 15, 1978,and concurred in by the City Council on December 4, 1978.An extension to
June 4, 1980 was granted by the Hearing Examiner on May 25, 1979.The preliminary plat and

planned unit development were reviewed by the Hearing examiner on March 4, 1980,and
approved subject to seven conditions.
3. At the regular meeting of the Renton City Council held on April 21, 1980(Attachment 3)and of
the many items discussed was Cedar Ridge Residential Park and the Planning and Development
Committee Report which stated:"The Planning and Development Committee report noted
consideration of appeal of Examiner's decision dated 3/18/80 as amended by the Examiner's letter
or reconsideration of 4/1/80 and appeals of the developer Belterra Development Corp.(Cedar Ridge
Assoc.)dated 3/28/80 and appeal of Renton Hill Community Assoc.dated 4/14/80.*The Committee
Report recommended Council delete conditions 1 (development of access street to city standards)
and delete condition 2(dedication of internal road system to City)based on law and fact;that
Council approve Examiner's recommendation as modified including condition 8 set forth in

4. Reference is made to Board of Public Works Meeting(Attachment 4),May 6, 1981,page 2,
paragraph e.REQUEST FOR FRANCHISE PERMIT,BELTERRA DEVELOPMENT CO.,
CEDAR RIDGE ACCESS ROAD—Planning Department report noted the access to the proposed
Cedar Ridge P.U.D.has become very complicated as result of who the Bonneville Power
Administration can grant easements and dedications to.It appears that the only option is to grant the
franchise to allow the project to continue.However,this means that the City Council will have to
change their policy concerning franchises.The Board should be careful to make sure that the city
transfers all liabilities and that the developer transfers all liabilities to the home owners association
and this should be clearly stated in the franchise,hold harmless agreement and the homeowners
articles of incorporation and by-laws.The report recommended approval to the City Council upon
preparation of appropriate documents by applicant and City Attorney.Mr.Houghton noted that the
City is asking the developer for a 22 ft.asphalt roadway,an 8 ft.shoulder and open ditches with a
paved pathwayalongthe side,and it will essentially be a private road.Chief Geissler said it should
be a public street and maintained by the city.Mr.Smith noted that the convenants will assure police
and fire access.MOVED BY NELSON,SECONDED BY WEBLEY,TO CONCUR IN THE
FRANCHISE PERMIT TO BELTERRA THAT WILL BE DRAWN UP BY THE CITY
ATTORNEY AND SUCH CONCURRENCE BE RECOMMENDED TO THE CITY COUNCIL.
MOTION CARRIED.Mr.Norris noted that the concerns of the Fire Chief should be taken into
consideration.Chief Geissler was advised that he should contact the City Attorney with his
concerns.

8. In June 1982,Belterra Development Corporation defaulted on their loan to Old Stone Mortgage
Corporation,formerly Sherwood&Roberts,Inc.(Attachment 8).Between June 1982 and February
1983,the property was in foreclosure and I presume work ceased on Cedar Ridge Residential Park
until the property was sold to a new developer.
9. The date that the new developer purchased to complete Cedar Ridge Residential Park is difficult to
obtain because the letter from Old Stone Mortgage Corporation(Attachment 8)indicates that they
have a purchase agreement with Tri-Power Industries,Inc.and Cascade Pacific Corporation who are
forming a joint venture to purchase and develop the property;however,King County Recorder's
lists a lien against John McNestry,Norcon Development and it is number 198403140013
(Attachment 9)on 03/14/1984.But there is document(Attachment 10)entitled:
INDEMNIFICATION AND HOLD HARMLESS AGREEMENT sworn before a Notary Public on
April 10, 1984 by Kathie A.Siswick,Senior Vice President and R.F.Pascal,Vice President of BS&T
Investments,LTD.
10. The third amendment(Attachment 11)to the restated Declaration and Convenants,Conditions,
Restrictions and Reservations for the development now known as Falcon Ridge Residential Park
was made by John McNestry,President of Norcon Developments,LTD,a Canadian Corporation
on November 14, 1985.
11. John McNestry,President of Norcon Developments requested an extension of the franchise for an
additional ten year period of time and the City Council finding such extension time is in the public
interest and benefit,Renton City Ordinance No.3554 was amended by City Ordinance No.3960
(Attachment 12)on December 9, 1985 extending Cedar Ridge Drive SE franchise to June 15,2016.
12. Falcon Ridge Residential Park Declaration and Convenants,Conditions,Restrictions and Reservations
Article 10.27 is stated as follows:
10.27 ASSESSMENT FOR PRIVATE ROAD AND LANDSCAPING MAINTENANCE
(a) Access to the project is across a private roadway established to a City of Renton franchise
(Ordinance#3554)set forth in Exhibit C.This franchise is for a period of twenty-five(25)
and requires the Owners'Association to maintain and repair the private roadway and
landscaping within the franchise area.
(b) There shall be included in the Association budget a special maintenance fund or funds,
the purpose of which shall be to maintain the private roadway and landscaping.. Each
regular assessment shall include a charge of Two Dollars($2.00)per month per unit,with
said amount earmarked for the maintenance of said roadway.The Board shall also include
an additional sum in each regular assessment to cover the cost of said landscaping
maintenance.The amount of said assessment shall be determined from time to time,but at
least annually by the Board.
(c) In the event that said franchise agreement is not renewed at the end of its term,all monies
accumulated within said special funds shall be used by the Board to hire a private
contractor who will upgrade and improve the street. After such work is completed, the
roadway shall be turned over to the City of Renton.
13. Since the establishment of Falcon Ridge Residential Park Association in the mid 1988,approximately
$150,000.00 has been spent by the association to maintain Cedar Ridge Drive SE as well as the inner
streets known as SE 8th Place and SE 8th Drive. This sum of money was spent on surface coating and
repair damaged sections on Cedar Ridge Drive SE and SE 8th Place and SE 8th Drive several times
because of the car and truck traffic. The sum of money also was spent on speed bumps, traffic signs
and necessary striping of the streets (road). The sum of money spent can be verified since the
association books are audited yearly since hiring a property management firm.

14. Approximately$1,000.00 is spent monthly by the Falcon Ridge Residential Park Association for
landscaping which includes the grass areas along Cedar Ridge Drive SE and the communal
grounds in the community. In addition the association pays for five streets lights along Cedar Ridge
Drive SE.
15. It is estimated that over$500,000.00 is collected yearly from the homeowners of Falcon Ridge
Residential Park for city,county and state property taxes.
16. There is an average of two or more vehicles per residents of Falcon Ridge Residential Park and it is
difficult to estimate how much is paid for motor license fees,federal and state gasoline taxes.It is
further difficult to estimate how many other vehicles use Cedar Ridge Drive SE?It is well known that:
(1)Every Monday morning three waste management trucks service the community,(2)Everyday
except Sunday and holidays,the U.S.postal service delivers mail,(3)Deliveries are made by UPS,
Federal Express and DHL to residents of Falcon Ridge Residential Park as well as other vehicles such
as moving vans,contractor's trucks,etc.,(4)Renton City Utility truck on a routine basis to check the
pump lift station,(5)Heavy trucks of the power companies do significant damage to Cedar Ridge
Drive SE.Actually,the power companies subcontract almost all the work in their areas so it is the
subcontractor's trucks that are damaging the street(road).All of these vehicles using Cedar Ridge
Drive SE pay federal and state gasoline taxes as well as vehicle license fees which go toward
necessary roads repairs but none of these taxes go toward the maintenance of Cedar Ridge Drive SE
because the burden and liability as agreed to by the Renton City Council was to put on the future
residents of Falcon Ridge Residential Park the potential high maintenance costs by allowing the
developer not to build Cedar Ridge Drive SE to city standards.NOTE:An engineer hired by the
association has pointed out that Cedar Ridge Drive SE is suffering far more damage than can be
attributed to automobile traffic.
17. On February 22,2007,letters were sent on behalf of the Falcon Ridge Residential Park to State
Senator Margarita Prentice(Attachment 13)and State Respresentatives Zack Hudgins
(Attachment 14)and Bob Hasegawa(Attachment 15)requesting a state grant to help repair
Cedar Ridge Drive SE. Since no responses were received,a follow up letter was sent to State
Senator Prentice(Attachment 13a)and State Representatives Hudgins(Attachment 14a)and
Hasegawa(Attachment 15a)on October 2,2007.
18. A telephone call was made to Representative Adam Smith's office on December 5,2007 requesting
information on a matching federal grant of$55,000.00 to repair Cedar Ridge Drive SE.I talked with
Debra,a staff member,and she informed me that the association problem was not a federal problem so
no federal grant money is available.She said it is a local and state issue and Representative Smith will
not get involved.She suggested going through the grant program by the City of Renton.She also told
me that Representative Smith and Senators Murray and Cantwell had a meeting three days ago
(December 2,2007)and agreed how thefederal grant money should be allocated in Washington State.

clarification and documents who owns Cedar Ridge Drive SE(City of Renton hold title to the right-of-
way and it can not be transferred),how Cedar Ridge Drive SE was constructed and about the many
concessions granted to the original developer,Belterra Development Corporation and then Norcon
Development,LTD to complete what is known as Falcon Ridge Residential Park

Response to my e-mail(Attachment 17)requesting Representative Hudgins introduce legislation
for a grant of matching funds for repairing Cedar Ridge Drive SE so that the street(road)could be
be turned back to the City of Renton
22. At the suggestion of Representative Hudgins an e-mail was sent to Mr.Steve Gorecaster,Director,
Transportation Improvement Board seeking a grant to repair Cedar Ridge Drive SE and his response
(Attachment 18).
23. Similar letters were sent by certified mail to Mr_Stephen J.Wright,Administrator,Bonneville Power
Administrator(Attachment 19),Mr.Steve Reynolds,President and CEO,Puget Sound Energy
(Attachment 20)and Mr.Jorge Carrasco,Superintendant,Seattle City Light(Attachment 21)
requesting funds for the repair of Cedar Ridge Drive SE.
24. The response from Mr_Wright,Administrator,Bonneville Power Administration (Attachment 22).
In his letter,Mr.Wright acknowledged that their vehicles use Cedar Ridge Drive SE but only once or
twice a year but we value cooperative relationship with our neighbors along our transmission line
right-of-way.Because we do use Cedar Ridge Drive SE,we are willing to contribute the share of the
cost that a homeowner would.
25. The response from Mr.Cody Olson,Puget Sound Energy(Attachment 23)and the requested meeting
requested by Mr.Olson took place on March 13,2008 and a subsequent meeting took place on April
24, 2008. On March 13, 2008, I attended the meeting with Mr. Dwight Potter, treasurer of Falcon
Ridge Residential Park Association and we discussed with Mr.Olson the pictures Mr_Potter took of
the damage done to grassy areas and cutting down of the blackberry brushes along the east side of
Cedar Ridge Drive SE by the heavy equipment of ASPLUNDH under contract to Puget Sound
Energy. Mr.Olson said that Puget Sound Energy does not have an obligation to help in the repair of
the street(road)since their power station entrance is off Beacon Way SE.Mr_Olson informed us that
his organization does contract out to cut down brushes and trees that might be a fire hazard because if
a fire occurs and there is damage to the electrical supply the fine is in six figures.He took the pictures
of the damage done by the heavy equipment of ASPLUNDH and would show them to the head of the
Vegetation Department.
The second meeting with Mr.Olson took place on April 24,2008 and Mr.Olson was accompanied by
Mr. Kelly McGill, Puget Sound Energy Rght-Of-Way Easement Department_ Mr. McGill explained
that Puget Sound Energy does not have any obligation to help in the repair of the street(road).He also
said that Puget Sound energy has an easement to cut across Cedar Ridge Drive SE to cut down the
vegetation so it is not a fire hazard to the power lines or towers,He showed me a document(which)I
requested a copy and will send me)that Cedar Ridge Drive SE is over land divided into three parts
with 1/3 near the entrance gate Puget Sound Energy,the middle part Bonneville Power Administration
and the rest Seattle City Light.Mr.McGill agreed that there is damage to the grassy areas done by the
hired contractors and as a gesture Puget Sound Energy is willing to pay a homeowners share like
Bonneville Administratior suggested since they do use Cedar Ridge Drive SE. Mr_ McGill further
suggested that the association continue to follow up with letters to Seattle City light since they have
not responded to the original letter.
Mr.McGill has not sent me the requested document even after several telephone calls to his office.
I tried obtaining the document from the records maintained at the Renton City Clerk's Office but the
staff was unable to locate such a document(Attachment 24).
Mr.McGill's suggestion was taken and a follow up letter(Attachment 25)was sent to Mr.Jorge
Carrasco,Superintendent Seattle City Light on May 14,2008.

SUMMARY:
In answer to the question at the beginning of this paper which provides the background/history of
Cedar Ridge Drive SE which clearly shows that the past Renton City Council did not fully consider
what their decision would have on the future city residents by shifting what would be normally be a
city financial responsibility on the maintenance of Cedar Ridge Drive SE on to the homeowners
association(not yet formed)of Cedar Ridge Residential Park and now known as Falcon Ridge
Residential Park.
The past Renton City Council voted that the original developer,Belterra Development Corporation
did not have to construct Cedar Ridge Drive SE to city standards,but at the same time when the
franchise expires in the year 2016,the City of Renton requires that if Cedar Ridge Drive SE is turned
over to the City of Renton it would have to be 32 feet wide(instead of 22 feet),have concrete curbs,
gutters and sidewalks on both sides,city street lights,and would have a pavement cross-section of 4
inches of compacted asphalt concrete over 6 inches of crushed base course(instead of 2 inches)of
compacted asphalt concrete over 5 inches of crushed base courses.
The past Renton City Council assumed that the assessment of$2.00 a month per homeowner as
indicated in Article 10.27(b)of the Falcon Ridge Residential Park CC&Rs'which should amount to
$67,000.00 since the association was formed in the mid 1988 when in reality a total of$150,000.00
have been spent by the association to maintain Cedar Ridge Drive SE as well as the inner streets of
SE 8th Place and SE Std Drive.
Approximately$1,000.00 is spent by the Falcon Ridge Residential Park Association for landscaping
which includes the grass areas along Cedar Ridge Drive SE and the communal grounds in the
community.In addition,the association pays for five street lights along Cedar Ridge Drive SE.
Falcon Ridge Residential Park Association does not own Cedar Ridge Drive SE but has an
non-exclusive franchise which means the association has no control who uses the street(road)
and this street(road)is open to the public but the cost of maintenance and liability is the
responsibility of the association.In the past garbage and trash has been dumped along the side of
Cedar Ridge Drive SE.
The present Renton City Council has the legislative authority to adopt a new ordinance that would
rescind and/or supersede City Ordinance Number 3554 passed on June 15, 1981 and establish new
conditions and responsibilities for the maintenance of Cedar Ridge Drive SE.
The public benefits from Cedar Ridge Drive SE because the street(mad)provides a quick access for
the various power utilities to service their power lines and towers for continuous electrical power to
the many neighborhoods.
After reading this report,a majority of Renton City taxpayers would not object in having the City of
Renton pay for the maintenance of Cedar Ridge Drive SE because of the following:
(1) Falcon Ridge Residential Park increased the tax base for the City of Renton.
(2) The past Renton City Council unfairly put the burden of the potential high maintenance costs
of Cedar Ridge Drive SE to a homeowners association which did not even exist.Cedar Ridge
Drive SE is extraordinary long for only 137 homeowners to support it.
(3) The past Renton City Council voted that the developer did not have to build Cedar Ridge Drive
SE to city standards but unfairly requires that if the street(road)is turned over to the City of
Renton,the street(road)must be built to the present city standards.

(4) The past Renton City Council by making Cedar Ridge Drive SE a franchised street(road)
unfairly prevented any chance of the association in obtaining any grant funds to help in the
maintenance of the sti eet(road).
(5) The Renton City taxpayers would view the action of the past Renton City Council in granting
many concessions to the developers as favoritism.
The motto of the City of Renton reads, "AHEAD OF THE CURVE"and mostly recently a
suggestion was made by one of the Council members as a co-motto,"PEOPLE HELPING
PEOPLE"

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ANNEXING
CERTAIN TERRITORY TO THE CITY OF RENTON.
WIEREAS, under the provisions of Chapter 128 of the 191:5 Session Laws
of the State of Washington, as amended, a petition in writing requesting that
certain territory continguous to the city limits of the City of Renton, as
hereinafter more particularly described, be annexed to the City, was filed with
the City Clerk of the City of Renton on or about January 17, 1961, bearing the
signatures of the owners of more than seventy-five per cent (75%) in value
according to the assessed valuation for general taxation of the territory for
which annexation is petitioned herein, which petition sets forth the legal des-
cription of the property according to governmental legal subdivision or plats, and
was accompanied by a plat or drawing outlining the boundaries of the territory
petitioned to be annexed; and the Planning Commission of the City of Renton having
heretofore considered and recommended the annexing of said property to the City,
and
MEREAS, the City Council of the City of Renton fixed Tuesday, Feb-
ruary 14, 1961, at 8:00 P.M., at the City Council Chambers in the City Hall of
the City of Renton, as the time and place for public hearing upon said petition,
and notice of said hearing specifying the time and place thereof, inviting all
interested persons to appear thereat and voice approval or disapproval of or
objections to the proposed annexation, has been duly published and posted as
provided by law, and such publication and posting having taken place more than
ten (10) days prior to the date of said hearing, and the Council having been
advised in the premises and having heard all matters in connection therewith and
the granting of said petition being deemed proper and advisable and in the
public interest, NOW THEREFORE,
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON
AS FOLLOWS:
SECTION I: Pursuant to the provisions of Chapter 128 of the 19115
Session Laws of the State of Washington, as amended, it is determined that the
above mentioned petition for annexation to the City of Renton of the property
and territory hereinbelow described be and it is hereby approved and granted,
and the following described property being contiguous to the city limits of the
City of Renton situated in King County, State of Washington, be and the same is

hereby annexed to the City of Renton, effective on and after the passage, approval
and publication of this Ordinance; and on and after said date said territory
shall constitute a part of the City of Renton and shall be subject to all the
laws and ordinances then thereafter enforced; said property being described as
follows:
All of that portion of Section 20, Township 23'North, Range 5
E. W.M. lying outside the corporate limits of the City of Renton,
all situate in King County, State of Washington. Said City limits
were established by Ordinance No. 1547 effective May 24, 1956.
SECTION II: The above described annexed property contiguous to
Precinct No. 26 of the City of Renton shall be and constitute a part of Precinct
No. 26 of the City of Renton.
SECTION III: This Ordinance shall be in full force and effect from and
after its passage, approval and legal publication as provided by law. Certified
copies of this Ordinance shall be filed with.the Board of County Commissioners of
King County, State of Washington, and such other governmental agencies as
provided by law.

AUDIENCE COMMENT Rosalie Lobe, 2709 Talbot Road S., reported flooding and damage
Flooding of her yard and two homes to the South 4/19/80. Mrs. Lobe
Talbot Road South explained history of flooding and precautionary measures taken.
Mrs. Lobe claimed error in Public Works Director Gonnason's
letter of 1/21/80 regarding 1/11/80 flooding. Mrs. Lobe dis-
tributed photographs showing water crossing Talbot Rd. S. from
Victoria Park Entrances No. 1 and No. 4 and spill (ng over 8"
berm placed by City flooding properties to the West. Councilman
Hughes recalled flood problems of Lobe, Krebs, Go and Magleitto
properties with water knee deep and still drying out and expressed
concern. Tom Volland, 2540 Talbot Crest, also submitted photos
showing water trails of "beauty bark" from Victoria Park and
explained pulling grates with Mr. Wallace, his ; ghbor, to
attempt flood prevention; explaining ditch on it 'e of Talbot
Road prior to Victoria Park No. 1 that had handle-. ;he water;
also noting water damage to Schott residence. Councilman
Stredicke inquired re street sweeping for area flood debris-and
also requested street sweeping schedule for the City.
Cedar Ridge Kathy Koelker, 532 Cedar Ave. S. , representing Renton Hill
Residential Community Assoc., requested Agenda Item 6.a. be presented.

PPUD-009-80 CARRIED. Cedar Ridge Residential Park Preliminary Planned Unit
PP-010-80 Development 009-80 and Preliminary Plat 010-80, single- family
Appeal attached housing project of approximately 138 dwelling units
located on the east side of the Seattle-Cedar River Pipeline
adjacent to Philip Arnold Park and 2,000 feet north of Royal
Hills Drive; Cedar Ridge Associates. Hearing Examiner Kaufman
recommended approval with restrictive covenants. Appeal was filed
by Cedar Ridge Associates and Renton Hill Community Association;
also request for reconsideration. The Planning and Development
Committee report noted consideration of appeal of Examiner's
decision dated 3/18/80 as amended by the Examiner's letter or
reconsideration of 4/1/80 and appeals of the developer Belterra
Development Corp. (Cedar Ridge Assoc.) dated 3/28/80 and appeal
of Renton Hill Community Assoc. dated 4/14/80.(*The Committee
report recommended Council delete conditions 1 (development of
access street to city standards) and delete condition 2 (dedication
of internal road system to City)based upon error of law and fact;
that Council approve Examiner's recommendation as modified includ-
ing condition 8 set forth in the Examiner's letter of 4/1/80
(reconsideration),+) Committee Chairman Rockhill presented second
committee report noted emergency access to the proposed Cedar
Ridge PUD is anticipated to be over the pipeline road and con-
trolled by gates. The Planning and Development Committee recom-
mended the subject of the location of gates be referred to the
Public Safety Committee for resolution; and the committee report

Cedar Ridge also recommended that the matter of renewal of the permit for use
Residential of the pipeline road (not renewed since 1976) be referred to the

Continued Kathy Koelker expressed concern re additional traffic and access
for Renton Hill, also requested reduction of building size from
five to three units as more acceptable. Ruth Larson, 714 High S.,
questioned access to the development. Del Bennett, 18004 SE 147th,
explained access and planned density. John Julian, 1400 SE 7th,
presented traffic map and explained critical situation asking no
added traffic for Renton Hill area. Lori Johnson, P.O. Box 161,
represented Rolling Hills Home Owners, expressed concern for traffic
impact on Puget Drive. MOVED BY CLYMER, SECOND ROCKHILL,
that emergency access for Cedar Ridge PUD be referred to the
Public Safety Committee for resolution as to location of gate or
gates. SUBSTITUTE MOTION BY STREDICKE, SECOND BY CLYMER, THAT

Talbot Road Fred Krebs, 2703 Talbot Rd. S., recalled his appearance before
Flood Conditions the City Council wherein the Public Works Director was asked
to make decision and report back to Council regarding flood
damage and necessary action; Mr. Krebs expressed his dissatifac-
tion with 1/21/80 letter and that no contact of witnesses was
made by any of the Public Works Department and asked that Council 's
prior request be carried out for full investigation of drainage
problem. MOVED BY STREDICKE, SECOND REED, THAT THE TALBOT ROAD
WATER AND ROADWAY IMPROVEMENTS BE REFERRED TO COUNCIL'S TRANS-

CONSENT AGENDA The following items are adopted by one motion which follows the

Project Completion Letter from Public Works Department recommended acceptance of
Fire Station #11 Fire State No. 11 project completion 4/21/80 and release of
retained amount of $72,847.95 after thrity days with proof of
payment of tax liabilities and claims dismissed to contractor
John Maples Construction Co. Council concur.
Liberty Park Call for Bids 4/9/80 Concession stand at Liberty Park; one bid
Concessions recieved from Renton Concessions, Auburn, WA - 10% of monthly
gross receipts not including sales tax. Refer to Park Board.
Police Officer Letter from Mayor Shinpoch appointed Donald F. Gustine and
Appointments Stephen A. Higgins to positions of Police Officers effective
5/1/80 subject to customary six-month probationary period.
Council concur.
Interest Rate Finance Director Marshall requested amendment to Ordinance #3182
Amended regarding LID No. 307 for change of interest rate from 8% to 12%
per annum as recommended by Seattle Northwest Securities Corp.

Police Travel Police Chief Darby requested authorization for Police Officer
to attend Crime Conference in Sitka, Alaska 5/4-7/80; advance

Dear Mr. Clymer:
The attorney for Belterra Development Corporation has
provided a form Ordinance for us to grant a franchise
to Belterra to use certain City streets,- This method
has been approved through my office and the Board of
Public Works .
With respect to the Ordinance itself, the same appears
to be in appropriate legal form. I might note that the
words in Section 3 of City Engineer should be -changed
to Public Works Director.
On Section 5 of the Ordinance, there is a three year period
of time for abandonment. I think that period of time is too
long and should be changed to one year.
Section 6 should have additional language as follows :
"as approved and accepted by. the Public Works
Director of the City of Renton, whose approval
shall not be unreasonably withheld."
Section 13 may be eliminated if the council wishes, although
I do not believe it is of any real. consequence,

1. ?Addresses and contact person for the Bonneville Power Administration, Seattle City Light and Puget Sound
Energy because I have been informed?by a Falcon Ridge Residential Park Association (FRRPA) board member
that one of the power company is proposing to do major construction in erecting some new power?lines and
towers which means that heavy construction equipment will again use Cedar Ridge Drive SE to gain access to
their property since there are three gates off Cedar Ridge Drive SE.?
Response: Contact names and phone numbers of representatives of the power companies have been provided
to you by Rep. Hudgins.
11 2.? (?would like information how?Cedar Ridge Drive SE was constructed.The packet of information you sent me
included the city of Renton Ordinances No. 3554 and 3960 and the Third Amendment to Related Declaration
grants the developer a franchise to build a road over the City of Renton's right-of-way for the developer to
complete Falcon Ridge. The franchise is?not an exclusive franchise when you read the ordinances.?
Response: You are correct. The road was built by the developer of Falcon Ridge on top of City right of way
under a franchise agreement between the developer and the City. The franchise is not an exclusive franchise,
which means that other entities can use the right of way for access, utility routing, etc. The effect of the franchise
is somewhat like having a private road on a public right of way, in that the owner of the private road is responsible
for maintenance, but cannot prevent use by other entities such as the power companies. This is a fairly singular
situation-I am not aware of another similar situation in the City.
??? FRRP Declarations and Convenants, Conditions, Restrictions and Reservation Article 10.27c states:"In the
event that said franchise agreement is not renewed at the end of its term, all monies accumulated within said
special funds shall hire a private contractor who will upgrade and improve the street.After such work is
completed,the roadway shall be turned over to the City of Renton".??
Response: This is correct, I have also read CR&R Article 10.27.c. As you know, Ordinance#3960 dated
12/09/85 extended the termination date of the franchise to June 15, 2016.
????My question is why when?Cedar Ridge Drive SE was built by the developer why wasn't it turned over to the
City of Renton?Did the City of Renton allow the developer to build a road not according to the City of Renton
code? I have been under the impression that if a development is built, the city usually has the builder build roads
that are turned over to the city.
Response: The Falcon Ridge development was built as a Planned Unit Development(PUD). There is a special
land use code for PUD's in Renton's City Code. The current PUD code is quite a bit different than the PUD code
was in the 1980's. The purpose of the PUD code is to allow innovative approaches to a development that
recognize special conditions and needs, and allow the PUD to serve as a sort of test project to establish how well
these approaches work. PUD's can have different development standards than neighboring projects, including
density, setbacks, road and access standards, etc. One significant difference of the Falcon Ridge development is-
that it is a gated community with private internal roads. In other parts of the City private roads are not allowed to
serve more than 5 lots. These are the kinds of standards that can be established for PUD projects. One of the
unique elements of the Falcon Ridge PUD development is the franchised privately maintained access road in the
Cedar Ridge Drive SE right of way. You are correct that in projects not covered by the PUD code, the developer
is required to build the road to City of Renton public street standards and then dedicate the road to the City,which

takes over and maintains the road. You are also correct that the construction standards between private roads
and public roads differ-more in the 1980's than now. Had this road been built to current City standards, it would
be 32-feet wide (instead of 22-feet), have concrete curbs, gutters and sidewalks on both sides, city street lights,
and would have a pavement cross section of 4-inches of compacted asphalt concrete over 6 inches of crushed
base course (instead of 2-inches of compacted asphalt concrete over 5-inches of crushed base course). So in
the 1980's this road was allowed to be built to private road rather than public road standards. That is one of the
factors in its current condition. So these differences that you have noted were permitted because the project was
a PUD. I have not researched as to why this project was a PUD, but suspect that the desire to create a private
gated community was at least one consideration.
??? I would like to?know how I can view the minutes of the proceedings of?ordinances numbers 3554 and 3960.?

roadway, including any injury to persons or property, except
where such liability or injury arises as the sole and proximate
result of the negligence of the City of Renton or of its

SUBJECT: MAINTENANCE OF CEDAR RIDGE DRIVE SE
Dear Mr.Marczewski:
As you know,members of the Renton state legislative delegation have shared with us letters you
have written on behalf of the Falcon Ridge Residential Park Association requesting financial
assistance for the maintenance of the private access road known as Cedar Ridge Drive SE.
Pursuant to their requests,we have researched our files regarding the Falcon Ridge Development
to verify the status of Cedar Ridge Drive SE. Falcon Ridge was built as a Planned Unit,
Development(PUD),whichmeans that certain standards and features of the development were '
reviewed and approved that differ from standards applied at the time to other residential
developments in the City. One of those standards was that the access road,Cedar Ridge Drive
SE,was built as a private road to be owned and maintained by the homeowners' association(the
Falcon Ridge Residential Park Association). The attached City Council Ordinance verifies the
status of Cedar Ridge Drive SE as a private road.
Given this information,I verified with our Maintenance Services Division that in fact the City has
not provided maintenance services on this road since it was built. Based upon the fact that this is
a private road,the City is not legally permitted to maintain the roadway.
I asked our Maintenance Services Division director to inspect Cedar Ridge Drive SE and advise
me on the condition of the roadway and to put together a very rough estimate of costs to provide
the needed maintenance. They determined that the road is in a deteriorated condition and needs
to be rehabilitated and.repaved. Patching the road and installing a 2-inch asphalt overlay was
estimated to cost approximately$109,000. I have attached for your use photos that they took of
sections of the roadway.
I understand that the City's Economic Development Director, Suzanne Dale Estey,spoke with
you and indicated that we explored many potential funding scenarios for this project. However,
as Ms.Dale Estey explained,with the City's established policy of not being able to fund repair of
private roads,we have not found a solution using City resources. When this information was
provided to you, it is my understanding that you asked the City to provide you with an official
letter indicating that according to our records,Cedar Ridge Drive SE is a private road. This letter,
with the attached Council Ordinance, is intended to serve as the official letter that you have
requested."T have also attached for your use a copy of the City's aerial maps that show Cedar
Ridge Drive SE.

This is a tough request for$55,000. It is not impossible, but tough because of a few reasons.
The first is that this session is for supplemental budgets, smaller changes than last year or next year. So there is
less flexibility. Also, our transportation budgets are under enormous pressure. After no increases in gas tax for
13 years -despite growth-we passed two gas taxes in 2003 and 2005, and attached the money to a specific list
of projects. (This is all online or we can send you a list if you would like to see them.) Increases in fuel costs and
construction costs(largely concrete and steel costs driven by Chinese demand) have put the a number of projects
in jeopardy of being completed on time. We have also had new costs (the 7.5 million repair of the culvert under
1405 in Renton for example and the ferry boats that have to be pulled out of the water).
I will check in with staff and Bob and Margarita to see what we can do.
My first thought is that there may be some opportunity for a grant from the CRAB or TIB funds,which are for
county roads and city roads respectively. I will have staff look into the process there.
Good luck talking to one of the contractors. It will be a bit of a detective hunt to see who works for who and then
who, but I am sure you can find out. Might want to call ASPLUNDH to see who sent them out to your
neighborhood - I bet you can find a phone number on the web,then you won't have to catch them on their time.
I would follow up with whoever hired them to complain about the damage done, and I bet the city can help as well
with that one too.

Dear Representative Hudgins-Thank you for all the emails and information. I would like to particularly reference
your email of 16 Jan 2008.
On Jan 18, 2008 at 12:50 PM while leaving Falcon Ridge and driving on Cedar Ridge Drive SE, I noticed a crew
from ASPLUNDH removing some cut trees on the north side of Cedar Ridge Drive SE. Since I was going to a
doctor appointment, I didn't stop to question the crew on who contracted for the work. When I returned the crew
was gone but the grass near the road was damaged with mud over the road.
This has happened numerous times in the past with heavy trucks using Cedar Ridge Drive SE and our
association has no recourse since this is a public road and our association by City of Renton Ordinances has a
franchise and is responsible for the maintenance of the road and liability in case of any accidents.This protects
the city but is highly unfair to the 137 homeowners who pay well over a half a million dollars in total property
taxes.
Falcon Ridge Declarations, Covenants, Conditions, Restrictions and Reservation Article 10.27c states:"In the
event that said franchise agreement is not renewed to the end of its term, all monies accumulated within said
special funds shall hire a private contractor who will upgrade and improve the street.After such work is
completed, the roadway shall be turned over to the City of Renton".

a public road but as a private road to a lesser construction. I am trying to determine from the City of Renton

I would like to be able to help you Mr. Marczewski, but TIB funds are restricted by law to public arterial streets
(47.26.090 RCW). Cedar Ridge Drive SE is not a public street because it has not be accepted for maintenance
by the city of Renton and it does not appear on the subdivision map of Falcon Ridge as a public street. It is not
an arterial street because it does not carry a federal functional classification, nor would it qualify for functional
classification. Maintenance of the street is the responsibility of the homeowners association, a fact that you
should find indicated in either the CCRs for the neighborhood,or on the plat map for Falcon Ridge, or in a right-of-

Thank you for your letter of February 1,on behalf of the Falcon Ridge Homeowners
Association,asking the Bonneville Power Administration(BPA)to share in the cost of repairing
Cedar Ridge Drive. You reasoned that BPA should contribute to the cost of repairs because our
vehicles use the road for access to maintain our transmission line right-of-way.
We considered your request by looking at two issues;how frequently our vehicles use Cedar
Ridge Drive, and whether the condition of the road is affected by that use. We determined that
our-vehicles use a portion of the road only once or twice a year. Having visited the road to
compare whether the condition of the section we use is worse than the section we do not use,
we did not see a difference in the condition of the two sections. •
We value cooperative relationships with our neighbors along our transmission line rights-of-way.
Because we do use Cedar Ridge Drive, we are willing to contribute the share of the cost that
a homeowner would. We understand there are 126 homeowners in the homeowners association
and,based on your estimated repair cost of$110,000,a homeowner's share would be between
$800 and$900.

Council's annual strategic planning workshop was held on March 6-7, 2008, where Council offered
guidance and direction on a range of goals, objectives and actions for the six-year period 2009-2014.
The Administration has developed a draft Business Plan reflective of City Council's direction for
Renton's future. Changes to the Business Plan, and the resulting adopted plan, will guide Department
actions, budget,planning and outcome management, and other future City initiatives. New this year
is a second page of 2009-2014 actions that the City intends to carry out to meet the goals and
objectives in the business plan.

WHEREAS,the City council annually adopts a Six-Year Business Plan; and
WHEREAS, at the City Council-Staff Retreat held March 6 and 7, 2008, the Council
reviewed the 2009-2014 Business Plan; and
WHEREAS, the Council reviewed the Administration's objectives to carry out the
Business Plan at its May 22, 2008 Council Workshop; and
WHEREAS, the Council made the changes it believed were advisable in that Business

SUMMARY OF ACTION:
A Resolution authorizing assisted funding from the Washington Wildlife Recreation Program(WWRP) will
provide up to$500,000 in matching funds for capital improvements to Ron Regis Park, including converting one
existing lighted all-weather soccer field to synthetic turf, one new lighted synthetic turf soccer field,restrooms,
picnic shelter,playground,additional parking and potable water.
Providing these improvements will establish a more complete Ron Regis Park. The Master Plan
was adopted in 1994, and Phase I improvements were completed in 1999.
The 2008 - 2013 Capital Improvement Document identifies $2,500,000 for improvements in 2009 for
the Ron Regis Athletic Field project (Fund 316). Should the City be awarded the $500,000 grant,
Parks recommends utilizing$1,300,000 from the Parks Mitigation Fund (Fund 303) to provide for the
improvements in this phase of work. The remaining $100,000 balance would be funded from a King
County Youth Sports Facility Grant ($25,000 from the Greater Renton Junior Soccer Association and
$75,000 from King County).
STAFF RECOMMENDATION:
• Authorize the Mayor and City Clerk to execute the Resolution authorizing the City to apply
for funding assistance for a$500,000 WWRP grant administered by the Recreation and
Conservation Office.

ISSUE:
Should the City Council authorize the application for funding assistance for a
Washington Wildlife Recreation Program grant (WWRP) with the Recreation and
Conservation Office (RCO)?
RECOMMENDATION:
• Authorize the Mayor and City Clerk to accept the Resolution authorizing
application for funding assistance for a $500,000 matching grant.
BACKGROUND SUMMARY:
The adopted 1994 Ron Regis Park Master Plan calls for two lighted soccer fields, a
restroom, play area, two picnic shelters, two lighted softball fields, basketball court,
and parking. Phase I improvements, completed in 1999, constructed one lighted
soccer field, one lighted softball field, basketball court, landscaping and parking.
Parks would like to proceed with the Phase II construction of one new lighted
synthetic turf soccer field, converting one lighted all-weather field to synthetic turf,
restrooms, picnic shelter, play area, additional parking and potable water.
The Community Services Department, Parks Division, would like to apply for a
$500,000 matching grant from the Washington Wildlife Recreation Program,
administered by State Resource and Conservation Office (RCO). The grant requires
a fifty percent match and the RCO requires a Resolution from the City authorizing
application for this grant.
If the City qualifies for the grant, prior to acceptance, staff will return to Council for

grant would commit the City to funding $2,500,000 for the Ron Regis Park Phase II
Project, as identified in the 2008—2013 CIP Plan (Fund 316).
Accepting this grant would also commit the City to funding the remaining $1,400,000
balance. If the decision is made to accept the grant, staff will also request that Council
appropriate $1,300,000 from the Parks Mitigation Fund (Fund 303) for the additional
funding of$1,300,000 for this project, in 2009.
The remaining $100,000 project balance would be funded from a King County Youth
Sports Facility Grant, for which the City is applying. If recommended for award,
King County would fund $75,000, the Greater Renton Junior Soccer Association
would fund $25,000 and the City would fund $50,000 (already identified as part of
the $2,500,000 from fund 316).
Total City funding for the Ron Regis Park project will be $3,800,000.
CONCLUSION:
Approval of this Resolution will authorize assisted funding from the WWRP for
$500,000 in grant matching funds for capital improvements to Ron Regis Park,
including one new lighted synthetic turf soccer field, replacing one lighted all-
weather soccer field with synthetic turf, restrooms, picnic shelter, playground,
additional parking, and potable water.
Approval of this Resolution would obligate the City to fund the remaining $3,800,000
for construction, should the City be awarded this grant. Funding would be derived
from the 316 Capital Improvement Fund, the 303 Parks Impact Fee Fund, and the
King County Youth Sports Facility Grant.
Prior to final acceptance of the grant, the Council will have an opportunity to
determine whether or not to obligate the City for the remaining $3.8 million.

WHEREAS, the City of Renton has approved a comprehensive plan that includes this
project area; and
WHEREAS, under the provisions of WWRP, state funding assistance is requested to aid
in financing the cost of land acquisition and/or facility development; and

Should the Council approve an additional full time Administrative Assistant (1.0 FTE) for the
Human Resources and Risk Management Department?
BACKGROUD:
As the new HR &RM Administrator, I have been with the Department for almost two months.
During this time I have had the opportunity to review the workload of all staff members and
make some assessments regarding the distribution of work and efficiency of the operation. The
Department is staffed by talented and creative employees. However, I believe that due to a lack
of administrative/clerical support, it has been difficult to devote time to process improvement or
new and innovative programs.
Managers and analysts spend much of their time processing the necessary paper that comes with
any HR department. Due to the lack of an Administrative Assistant the HR Manager spends
much of her time organizing research data and doing the clerical updating of the collective
bargaining agreements. The three HR Analysts are highly educated, skilled professionals yet I
hesitate assigning any additional projects due to the clerical work they are required to process
each day. An example of this is the most recent firefighter exam process. At the end of the
application period we had over 450 candidates that moved forward in the process. After review
of each applicant it was decided to interview 70 candidates. Because we have such limited
support staff, the analyst spent almost an entire day contacting the 70 individuals and then a half
day answering return calls and setting appointments.

My long term goal for the department is to look at our processes to see where we can streamline
the current work either through process improvement efforts or the introduction of new
technologies. We would also like to develop more training programs for employees that provide
both career development and personal growth.

"Employer of Choice."
FISCAL IMPACT
In the calendar year 2008 there will be no fiscal impact to the general fund. The Risk Manager
position was budgeted for a full year. Since our candidate of choice will not be starting until
June 16th we have a savings of approximately$53,000. If we are able to fill the Administrative
Assistant position by July 16th our cost for the remainder of the year will be $35,776.
CONCLUSION
Approve a new Administrative Assistant(1.0 FTE) for the Human Resources and Risk
Management Department.

MEMORANDUM OF
UNDERSTANDING BETWEEN
STATE OF WASHINGTON AND CITY OF RENTON
This Memorandum of Understanding (MOU) is made and entered into by and between
the Washington State of Department of Transportation,hereinafter referred to as
WSDOT, and the City of Renton,hereinafter called the CITY, each of which entity may
be referred to hereinafter as"PARTY"or collectively as"PARTIES".
I. PURPOSE
The intent of this MOU is to document the mutual understanding WSDOT and CITY
have reached regarding the cooperative operation of the traffic signals shown on
Exhibit A. The PARTIES have a vested interest in providing the safest and the most
efficient traffic flow through CITY and STATE intersections to serve the traveling
public. This MOU establishes the procedures for developing, reviewing, implementing
and assessing performance, and refining traffic signal coordination plans between the
WSDOT owned traffic signals and CITY owned traffic signals shown on Exhibit A.
II. DEVELOPMENT OF COORDINATION PLANS
The PARTIES will cooperatively develop coordination plans using current traffic data.
The PARTIES will develop clear goals and measures of success when developing these
plans. Scenarios, such as major incidents, construction activity, and roadway closures
will be addressed. PARTIES will be responsible for providing the most current traffic
data for their respective intersections.
III. PERFORMANCE MONITORING
The PARTIES will cooperatively collect data necessary to assess the success of the
coordination plans.
IV. IMPLEMENTING THE COORDINATION PLANS
The PARTIES will be responsible for implementing the coordination plans into their
signal control systems. WSDOT will provide the ability for the CITY to monitor,
review, and implement coordination plans on WSDOT signals remotely through the
I2TMS Central System. The CITY will provide the ability for WSDOT to monitor,
review, and implement coordination plans on CITY signals remotely though the
ACTRA Central System. The PARTIES goal is to develop fully functioning center to
center operations.
If a PARTY needs to turn on a coordination plan to respond to a change in the traffic
demand,the initiating PARTY will contact the agency designee through the telephone
to initiate the change. PARTY designees are listed below in priority order. The
contacted PARTY will review the request and make the appropriate change. If the
initiating PARTY is unable to reach one of the agency designees through the telephone,

an electronic mail will be sent to the designees before the change is made. The
initiating PARTY will send an electronic mail to the other PARTY stating the
coordination plan that was implemented,the time it was implemented, and the reason
for the timing change. The initiating PARTY will also send an electronic mail to the
agency designee notifying when the coordination plan was terminated. The PARTIES
will keep an up to date log of initiated plan changes and jointly review the logs.

The coordination plans that are implemented will be limited to those plans developed
and agreed to in section II of this document. The PARTIES will develop measurable
scenarios to initiate a coordination plan. PARTIES will not modify any timing
parameters, such as pedestrian and vehicle clearance intervals, on the other PARTY'S
traffic signals.
V. REFINING THE COORDINATION PLANS
The PARTIES will meet quarterly to discuss and refine the operation of the signal
systems.

VI. DATA AVAILABILITY AND INFORMATION EXCHANGE
The PARTIES will provide information and data, if available,that may be useful in
coordinating the operation and maintenance of the traffic signals. The information
and/or data includes, but is not limited to,traffic counts, signal status, detector
occupancy,timing plans, and video signals. The PARTIES recognize that certain
information and/or data may be time sensitive and should be provided as quickly as
practicable to the other PARTY.
The PARTIES will agree upon how to configure the communication and central control
system to provide the necessary information needed by each PARTY. The PARTIES
agree that all data should be made available to each PARTY,unless there is a legal,
operational, or proprietary reason for withholding the data or information.
Release of data to third parties shall be the responsibility of the PARTY whose signal
system it originated from.
VII. MODIFICATION,AMENDMENTS,AND TERMINATION
This MEMORANDUM OF UNDERSTANDING can be modified and amended only
by an instrument in writing, duly executed by authorized personnel of both PARTIES.
Either party may terminate this MEMORANDUM OF UNDERSTANDING for any
reason by providing sixty(60) days written notice to the other PARTY.

Roof Replacement for City Shops A-2, B and C Buildings, the bid opening was held
on May 28, 2008, at 2:30 PM. Seven (7)bids were submitted. The bids ranged from a
low of$246,810.88 to a high of$403,300.00.
The low bid for the project was $ 246,810.88.,including WSST from Krueger Sheet
Metal Co. Our staff has reviewed the low bid for completeness, inclusion of all required
forms, acknowledgments of addenda and mathematical correctness of the bid. All of the
paper work is in order.
• The low bid of$246,810.88 including WSST is slightly above the amount
Facilities budgeted for the project. Funding for the project is under account
number 316.000000.020.5940.0076.63.000000 Capital Improvement Program,
Major Maintenance/Operational Facilities.
• The 316 Account CIP Operational Facilities budget has sufficient funds through
other project savings to cover the shortfall of$ 1,810.88.
• The approved 2008 CIP budget for the project is $245,000. The project estimate
was established last year at $ 220,000.00. Associated material costs have risen
considerably, that coupled with a change of scope addendum required by
conditions that were discovered during the pre-bid walkthrough has affected the
bids.
The Facilities Division, therefore recommends that this item be placed on the June 16,
2008, consent agenda for referral to Finance Committee to discuss funding. Staff further
recommends that Council award the contract to the low bidder, Krueger Sheet Metal Co.,
for the amount of$246,810.88.

The Planning and Development Committee recommends concurrence in the staff ,
recommendation to adopt a resolution ratifying the Growth Management Planning Council
Motion 07-03- Motion 07-03 amends the Countywide Planning Policies by including the
Buildable Lands Report as an appendix, recognizes the 'com'pletion of the 2007 King County
Buildable Lands Report and„notes-its findings.

The Planning and Development Committee recommends concurrence with the staff
recommendation to authorize the removal of.restrictive,covenants that were,required 'as a
condition to .rezone the subject property in 1986 from Residence 3 (R-3) to Off ce;Park(O-P).
The covenants;require:

and temporary merchant vendor portions of,this docket_item with modifications from from the
recommendations made by the Planning Commission: The proposed amendment would make " -
the following changes:
Farmers Markets
• Allow farmers markets only in the CD zone
•` Add a definition. for farmers markets
Temporary Merchant Vendors
• Allow temporary merchant vendors subject to peddlers license-requirements(Title AO -
• Revise Title V to reflect amended zones'
• Provide exemptions from permitting requirements for City sponsored events and produce
stands
• Revise the definition of,outdoor retailsales:to remove".produce,stands"from the definition
_The Committee further recommends that'"-allowing farmers markets "in:,other areas of the City be, •
reviewed thorugh the current Business.'District Overlay work program„ a'
The Committee recommends that an ordinance addressing amendments for farmers market in.the CD
zone and temporary merchant vendors be'forvarded to City CournciYfor first reading.
The Committee further recommends that the'.issue•A;ofmobile''food vendors retrain in Committee for
additional research-and discussion relating to the nature of these types of`uses and restrictions
