BETWEEN
SHARON RIGGINS and the CITY OF RENTON
I. RECITALS
A. This is a Separation and Release of Claims Agreement("Agreement") between you,
Sharon Riggins, and the City of Renton ("the City").
B. You are desirous of not continuing your employment with the City. Your last day of
employment will be November 12, 2004.
C. Both you and the City are desirous of resolving all matters known or unknown arising out
of your employment with and separation from the City according to the terms, conditions and
consideration included in this Agreement.
II. AGREEMENT
This Agreement represents the entire understanding and agreement between you and the
City and supersedes any prior oral or written understandings, agreements or representations,
including but not limited to, the City's personnel and operating policies that might otherwise
control the terms of your employment with or separation from the City.
A. The City's Obligations.
In consideration for the commitments you have made herein:
1. The City will pay you as a total settlement, which shall include your agreement
with a release of claims, the sum of $150,000 as general damages. No part of this settlement
payment will be withheld as taxes because the settlement payment does not represent payment of
wages. This amount will be paid out in three installments, three checks will be made payable to
Sharon Riggins in the amounts and dates that follow: $25,000 will be paid upon execution of thisbs„
Agreement, and receipt is hereby acknowledged; $62,500 will be paid and postmarked. It‘ :

reflecting each payment as "Other Income." You shall be responsible for any tax consequences
of this settlement. You indemnify and hold harmless the City against any claim, assessment,
liens or judgments that may be asserted against the City for liability for unpaid taxes associated
with these payments to you.
2. At the end of the current pay period, the City will pay out to you your accrued
salary, sick leave, and vacation, accrued through November 15, 2004. As this is compensation,
federal income taxes, FICA, and other withholding will apply.
3. The City will state to the City's Human Resources employees that you have
resigned your employment effective November 12, 2004.
4. In response to any request for reference information from a prospective employer,
the City will state that its policy is to provide only confirmation of employment dates,job title,
and salary. If you provide the prospective employer with an acceptable release for information,
you agree that the City may provide and will only provide, in addition to the preceding, your
performance evaluations in response to such request. The foregoing provision does not preclude
you from giving prospective employers any complimentary letters received during your
employment with the City.
5. Your rights under any pension benefit plans in which you may have participated
will be determined in accordance with the written plan documents governing those plans.
6. Your rights to continuation of any medical benefits shall be in accord with current
COBRA provisions, at your expense.
7. The City will not contest your application for unemployment benefits as long as
the reasons stated are in accord with the terms of this Agreement.
B. Your Obligations.
In consideration for the commitments the City has made herein:
1. You expressly acknowledge that you have no claims or entitlement to additional
pay or compensation or payment for benefits including any vacation and sick leave accruals from
the City, past, present or future, except as set out in this Agreement, and you expressly waive
claims for such additional compensation or pay not set forth in this Agreement.
2. You agree that you will not apply for re-employment with the City and shall not
be eligible for re-hire.
3. You agree that you have been informed of all rights and options pertaining to
other benefits, entitlements or continuation, such as pension programs.
4. You shall not ask any other employees, attorneys or administrators of the City to
provide a reference nor shall you direct prospective employers to directly contact other
employees, administrators of the City, or other agents of the City for reference purposes. You
will instruct all prospective employers to direct reference requests to the Human Resources
Director for the City who will comply with the obligations stated above in Section IIA4. Any
inquiries directed to someone other that the Human Resource Director will not be governed by
this Agreement.
5. You agree that you will not retain any property of the City, including any
documents or copies thereof, whether in hard copy or electronic form. You will immediately
arrange to return all City property, not on City premises but within your possession, including,

but not limited to, keys, key cards, and equipment. This shall include any information whether
stored in traditional files or any electronic or digital media form. You will immediately provide
to the Human Resources Director, or his designee, all confidential information within your
possession which cannot be easily retrieved, including, but not limited to, computer passwords or
other passwords, notes or other documentation regarding any on going recruitments.
6. You represent that as of the execution of this Agreement, you have not filed and
will not file thereafter, any charges, complaints, or lawsuits against the City or any of its agents
in any forum (except as may be needed to enforce this Agreement), including any federal, state,
or local administrative agency, professional organization, or court of law arising out of your
employment with and separation from employment with the City, and any actions taken or not
taken by the City through the effective date of this Agreement.
C. Waiver and Release of Claims and Extinguishment.
1. In consideration for the benefits described in this Agreement, you hereby release
(a)the City and its benefit plans, (b) each of its past and present elected officials, administrators,
employees, agents, representatives, fiduciaries and attorneys, and (c)the predecessors,
successors, transferees and assigns of each of the persons and entities described in this sentence,
from any and all claims of any kind, known or unknown, that arose on or before the date you
signed this Agreement.
2. The claims you are releasing include,without limitation, claims of wrongful
termination, claims of constructive discharge,claims arising out of agreements,representations or
policies related to your employment, claims arising under federal, state or local laws or ordinances
prohibiting discrimination or harassment or requiring accommodation on the basis of age,race,
color,national origin,political ideology,religion, sex, disability,marital status, sexual orientation or
any other status, claims of failure to accommodate a disability or religious practice,claims for
violation of public policy, claims of retaliation, claims of failure to assist you in applying for future
position openings, claims of failure to hire you for future position openings, claims for wages or
compensation of any kind(including overtime claims), claims of tortious interference with contract
or expectancy, claims of fraud or negligent misrepresentation,claims of breach of privacy,
defamation claims,claims of intentional or negligent infliction of emotional distress,claims for
attorneys' fees or costs (except as provided by the terms of this Agreement),and any other claims
that are based on any legal obligations that arise out of or are related to your employment _

3. You are specifically waiving any rights or claims that you may have under the
Washington Law Against Discrimination(RCW 49.60),the Washington Minimum Wage Act
(RCW 49.46), the Civil Rights Act of 1964 (including Title VII of that Act),the Americans with
Disabilities Act of 1990 (ADA),the Fair Labor Standards Act of 1938 (FLSA),the Family and
Medical Leave Act of 1993 (FMLA),the Employee Retirement Income Security Act of 1974
(ERISA)and all similar federal, state and local laws.

4. You represent and warrant that you have all necessary authority to enter into this
agreement(including on behalf of any marital community) and that you have not transferred any
interest in any claims to your spouse or to any third party. You intend this Agreement to bind your
heirs, successors, or assigns.
5. This Agreement does not affect your rights, if any,to receive pension plan benefits,
medical plan benefits, and unemployment compensation benefits or workers' compensation
benefits.
6. You understand that you are releasing potentially unknown claims, and that you
have limited knowledge with respect to some of the claims being released. You acknowledge that
there is a risk that, after signing this Agreement,you may learn information that might have affected
your decision to enter into this Agreement. You assume this risk and all other risks of any mistake
in entering into this Agreement. You agree that this release is fairly and knowingly made.
D. Nonadmission.
This Agreement shall not be construed as an admission by the City of any liability to you,
breach of any agreement between the City and you, or violation by the City of any statute, law or
regulation. And this Agreement shall not be construed as an admission by you of any deficient
performance or violation of any statute, law or regulation or professional obligation.
E. Confidentiality.
As further specific consideration for the City's obligations to you under the terms of this
Agreement, you acknowledge that the terms of this Agreement are intended to be confidential.
Except in response to lawful court or governmental administrative request, you will not discuss
the terms of this Agreement with any third party or with any employees or elected officials of the
City, except for direct members of your family or any medical, legal or tax counselors, or your
lawyer or personal advisor who has assisted you throughout this settlement process. You will
advise said family members, lawyers, counselors, or advisors of this Confidentiality provision
and direct him/her to maintain the confidences bargained for herein.
F. Breach and Enforcement.
1. Any dispute, controversy or claim arising out of or in connection with, or relating
to this Agreement which shall specifically include those terms related to Confidentiality, or any
breach or alleged breach, will be subject to binding arbitration as the sole forum. Either party
may seek specific performance of the terms of this Agreement or damages for breach hereof.
Except as otherwise provided herein, the breach of any provision of this Agreement shall not
rescind any provision of this Agreement.
2. The Confidentiality provision of this Agreement is unique and was bargained for
consideration. Therefore, in the event an arbitrator determines there has been a violation of the

Confidentiality provision, the arbitrator must award as liquidated damages the amount of the
final installment due pursuant to paragraph IIA1, above, or if there be no outstanding payments,
the amount of the last installment paid.
3. In the event of an alleged breach of this Agreement, the party believing it is
aggrieved shall send a written notice to the other by regular mail, setting out the alleged breach,
with sufficient specificity to permit a response. If the parties are not able to resolve the dispute
through mediation, or other means, they shall initiate a binding arbitration.
4. The parties may use any arbitration service in the Seattle area, and agree to be
bound by the procedure and discovery rules as set out in the King County Local Rules for
Mandatory Arbitration. Appended hereto as Attachment A, is a copy of the King County Local
Rules for Mandatory Arbitration. The arbitration service will be selected by mutual agreement
between you and the City or, in the absence of agreement, by the Presiding Judge of the King
County Superior Court. Such arbitration will be held in Seattle, Washington, You and the City
agree that judgment upon the arbitration award may be entered in the King County Superior
Court and will have the full force of any judgment in that court.
G. Contacts.
The mailing address for Sharon Riggins for purposes set out in Paragraph IIA(1), above
is: Sharon Riggins, 10924 Forest Avenue S., Seattle, WA 98178. In the event this address
changes at any time prior to the third and final payment, you must provide notice to the City by
sending notice to: Human Resources Director, City of Renton, 1055 South Grady Way, Renton,
WA 98055. Absent such notice having been received by the City prior to the City's having
made any payment required herein,payments sent to the last known address will be compliance

H. Complete Agreement. +-
This Agreement represents and contains the entire understanding between you and the
City in connection with the subject matter of this Agreement. Paragraph headings used in this
Agreement are for reference convenience only and have no independent meaning.
I. Reliance.
You represent and acknowledge that in executing this Agreement, you do not rely and
have not relied upon any representation or statement not set forth in this Agreement, or made by
the City or by any of the City's agents, representatives or attorneys with regard to the subject
matter, basis or effect of this Agreement. You have been advised by the City's agent that you
should consult with an attorney or advisor regarding your rights and obligations under this
Agreement prior to signing it.
