RESERVING TO the United States of America and its assigns: The right to span said right of way with electric power transmission conductors in any manner whatsoever that will not interfere with or endanger the use of said right of way for road purposes. The right, in connection with the maintenance of its adjoining ownership, to grade, cultivate, and plant grass and shrubs and to maintain such plantings upon that part of said right of way not being utilized by the City of Renton or its assigns. The perpetual and unrestricted right to use the right of way, or any road constructed thereon, for access, said right to include the hauling of unlimited loads. The perpetual right to dispose of drainage on the south side of the road, and that drainage from the switch-yard which is fed into the road-crossing culvert. The perpetual right to maintain the existing grade and turning radius of the substation access road located within said right of way. Grantee hereby covenants and agrees that in the event the right of way conveyed hereby is no longer used for road purposes the United States of America will be given the first right to reacquire said right of way at the current fair market value. The right of way is over property acquired by the United States of America by Declaration of Taking, Civil No. 4858 filed July 22, 1959 in the United States District Court, Western District of Washington, Northern Division, aid by deed dated June 16, 1960 from Puget Sound Power & Light Company. The right of way was both duly determined to be surplus to the needs and requirements of the United States of America and assigned to General Services - 2 - .. 5172 166 Administration for disposal pursuant to authority contained in the said Federal Property and Administrative Services Act as amended, and applicable orders and regulations promulgated thereunder. The Grantee covenants for itself, its heirs, successors, and assigns and every successor in interest to the property hereby conveyed, or any part rte. p thereof, that the said Grantee and such heirs, successors, and assigns shall not C.% discriminate upon the basis of race, color, religion, or national origin in the use, ..7 occupancy, sale, or lease of the property, or in their employment practices conducted thereon. This covenant shall not apply, however, to the lease or rental of a room or rooms within a family dwelling unit; nor shall it apply with respect to religion to premises used primarily for religious purposes. The United States of America shall be deemed a beneficiary of this covenant without regard to whether it remains the owner of any land or interest therein in the locality of the property hereby conveyed and shall have the sole right to enforce this covenant in any court of competent jurisdiction.
