DECLARATION OF RESTRICTIVE COVENANTS

WHEREAS, Paul A. Butrim, G. Harlan Lewis, and Arne R.
Mortensen, are the owners of the following real property in the
City of Renton, County of King, State of Washington, described
as Exhibit 'A' attached hereto. #11097 E

WHEREAS, the owner (s ) of said described property desire
to impose the following restrictive covenants running with the
) land as to use, present and future, of the above described real

VIOD WHEREAS, the City of Renton, in coordination with the
owners of said property has determined that the existing combined
storm water retention capacity of Parcel 'A' , Parcel 'B' and the
adjoining right-of-way is 100 , 000 cubic feet; and
WHEREAS, the owners of said property wish to redistribute
said capacity and establish separate requirements for retention
capacity for Parcel 'A' and for Parcel ' B" and
WHEREAS, the City of Renton wishes the owners of said
property to participate in future installation of storm drainage
pipe that will eventually reduce the need for said storm drainage
retention requirements ;
NOW, THEREFORE, the aforesaid owner( s ) hereby establish,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors, heirs, and assigns as follows :

STORM WATER RETENTION REQUIREMENTS
1. The owners of said Parcel 'A' , their successors , heirs
and/or assigns, and the City of Renton hereby agree

and covenant that any and all development of Parcel
'A' and the adjoining right-of-way shall provide
37 , 500 cubic feet of storm water drainage retention
capacity and provisions for said capacity shall be
installed to City standards in conjunction with said

junction with said development at no expense to the

The owners of said Parcel ' B' , their successors, heirs and/or

required by the City3of all effected property owners bet een '
said Parcels 'A' and 'B' and Lake Washington to increase storm ,!-
drainage flow from said Parcels 'A' and ' B' to Lake Washington,'
that said owners of Parcel ' B' , their successors , heirs and/or
assigns shall install, at no expense to the city, a maximum
of seventy feet of 48-inch diameter storm drainage pipe across
Lake Washington Boulevard N.E. right-of-way adjoining said
Parcels and shall install in said right-of-way, at no cost
to the City, open ditches or conduit constructed to City stan-
dards , along frontage of said Parcels so that storm water will
flow to said 48-inch diameter storm drainage pipe.
DURATION
These covenants shall run with the land in perpetuity. Upon
installation of said storm drainage pipe across Lake Washing-
ton Boulevard N.E. right-of-way adjoining said Parcel ' B' ,
