drainage facilities sha{I be maintained in compliance ravith the operation and main#enance

facilities include pipes, channels, flow control facmlities, rr�ater quality facilities, on-site best
management practices (BMiPs) and other engineered structures desi�ned to manage and/or

treat s#armwa4er on the Property. On-site BMPs include dispersion and infiltration devices,
bioreterati�n, permeable pavements, rainwater harvesting systems, tree ret�nt6on credit,
reduc�d impensious surfac�footprint,vegetated roofs ared other rr�easures designed ta rrairr�ic
pre-develop�d hydrolt�gy and rnin6mize stormwater runaff on the Prcrperty.
2. City of Renton shaBl have the right to ingr�ss and egress �ver those p�rtions of the Property
necessary to perfarrn inspections of the stormwater faciliti�s and 6NiPs and conduct
maintenance activiti�s specified ira this Declaration of Covenant and in accordance with the
Renton Municipal Code. Clty of Renton shali provide at feast thirty(30) days' writt�n notice to
the Owners that entry on th� Property is planned for the inspection of drairaage facilities.After
the thirty(30) days,the�wraers shall allow the Coty r�f Rentan to enter for the sole purpose of ,
inspecting draonage facilities. In lieu of inspection by the City,the Owners may elect to engage '
a licensed civil engine�r regestered in the state of W�shingtan who i�as expertise in drainage to ,
ir�spect the drainag� facilities and provide a avritten report describing their condition. if the '
engineer option is chosen,the O�nrners shall pr�vide written notice to the City��Renton within ',
fifteen(15j d�ys of reeeiving the City's notice of inspectian.Within thirty(30)days of giving this '
notice,the Owners,ar engineer on behalf of the Owners,shall pravide the engineer's report to ,
the City of Renton. If the report is not provided in a timely manner as specified abov�,the City '
of Renton may inspect the drainage faciliti�s without further notice.
3. If City c�f Renton determines frarr� its inspection, or fram an engine�r°s report provided in
accordance with Paragraph 2,that maint�narace, repair, restoration, and/or mitigation work is
r�quired ta be done to any of the drainage facilities, City of Renton shall natify the Owrrers af
the specefic maintenance, repair, restmration, andfor mitigatian work {"Work") required
pursuant to the Renton Municipal �ode. The City shall �Iso set a reasonable deadline for the
Owr�ers#o complete the iNtark, or to pravide an engineer's report that verifies corozpletion of
the Wc�rk. After the deadline has passed, the Usnrners shall a91ow the City access to re-inspect
the drainage facilities unless an engineer's repart has been pr�vid�d verifying cornpletion of ,
the Wark. If the Vllork is not complet�d within the tirr�e frame set by the C6ty, the City magr
initiate an enforcerrient acti�n and/or perform the Work and hereby is glven access to the
Property for such purposes. Written notice wili b� sent to th� O+nrners stating the City's
intention to perform such lNark.This Work will not commence urrotil at least seven(7)days after
such notice is mailed. If, within the sole discretion of the City, there exists an imrriinent or '
present danger, the seve� (7) day notice period will be waived and VVork will begin
immediately.
4. The(7wners shall ass�rr�e all r�sponsibility for the cost of any Work, or any measures taken by
the City to address conditioe�s as described in Par�graph 3. Such resp�r�sebiloty shali inc(ude
reirr�bursemer�t to the City vvithir�thirty(30)days of the receipt of the invoice for any such Wark
performed. Overdue payments will require payrnent �f inter�st at the maximum legal rate
allowed by RCV!/ 19.52.020(currently twelve percent(12%)). If the City initiates legal action to '
enforce this agreement, th� prevailin� party in such action is entitled to recover reasonable
litigation costs and at#orney's fees. ,
5o The Owners are required tn�btain written approval from City o�Renton prior to filling, pipin�, '
cutting, ar removirag vegetation (except in routine landscape maintenance) in open vegetated
stormvvater faciiities (such as swales, eh�nnels, ditehes, ponds, etc.j, or performing any
alteratians ar modificati�r�s to the drainage facilities referenced iro this Declaration of Coven�nt.

6. Any notice or c�nsent req�aired ta be giv�n or�therwise provid�d for by th� provisions of this
Agreerr�ent shall be effectiv�upan persona!delivery,or�hree(3)days after mailing by Certi�fed
fVlail, return receept requested.
7. 1Nith regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements
whatsoever whether oral ar writ�ken.
8. This Declaration of Covenant is intended to pro#ect the value and desirability and promote
efficient and effective management of surface water drain��e of the real property described
above, �nd shall inure ta the benefit of all the citiz�ns af the City of Rentan and its successors
and assigns. This Declaration of Cauen�nt shall run with the land and be binding upon '
Grantor(s),and Grantor`s(s'} succ�ssors in inter�st,ared assigns. ',
9. This DecBaratia� nf Ca�enan# may be terminated by executian of a writt�n agreement by the ',

MAINTENANCE INSTRUCTIONS FOR BASIC DISPERSION
Your property contains an on-site BMP(best management practice)called"basic dispersion,"which
was installed to mitigate the stormwater quantity and quality impacts of some or all of the impervious
surfaces or non-native pervious surfaces on your property.
Basic dis�ersio��is a strategy for utilizi��g a��y available ca�acity of o��site vegetated areas to retai��,
absorb,and filter the runoff from developed surfaces. This on-site BMP has two priinary components
that must be maintained:
(1)The devices that disperse runoff from the developed surfaces and
(2)The vegetated area over which runoff is dispersed.
Dispersion Devices
The dispersion devices used on your property include the following as indicated on the site
plan(CHECK THE BOX(ES)THAT APPLY):
❑ splash blocks, ❑rock pads, ❑ gravel filled trenches, ❑ sheet flow.
MAINTENANCE RESTRICTIONS
The size,placement,composition,and downstream flowpaths of these devices as depicted by the site
plan and design details must be maintained and may not be changed without written approval from the
City of Renton or through a future development permit from the City of Renton.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
This on-site BMP has two primary components that must be maintained per Appendix A of the City of
Renton's Surface Water Design Manual:
(1)The devices that disperse runoff from the developed surfaces and
(2)The vegetated flowpath area over which runoff is dispersed.
Maintenance of Dispersion Devices
• Dispersion devices must be inspected annually and after major storm events to identify and
repair any physical defects.
• When native soil is exposed or erosion channels are present,the sources of the erosion or
concentrated flow need to be identified and mitigated.
• Concentrated flow can be mitigated by leveling the edge of the pervious area and/or realigning
or replenishing the rocks in the dispersion device, such as in rock pads and gravel filled
trenches.
Maintenance of Vegetated Flowpaths
• The vegetated area over which runoff is dispersed must be maintained in good condition free
of bare spots and obstructions that would concentrate flows.
