HomeMy WebLinkAboutTHAI JUSTIFICATION Please submit a written statement addressing and justifying how the modification request complies with each of the following issues to be considered by the Administrator: a. Substantially implements the policy direction of the policies and objectives of the Comprehensive Plan Land Use Element and the Community Design Element and the proposed modification is the minimum adjustment necessary to implement these policies and objectives; At the current time- the landscape rockery/slope protrudes several feet into the ROW. This project will completely clear the ROW of structures and impediments as well as create “proper” width for off street side parallel parking b. Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment; The project will improve appearances with the CIP Wall instead of the failing rockery, as well as allow room on the ROW for potential improvements/utilities projects by the city, while maintaining/improving, slope/erosion control from the private property. The CIP wall will be built in accordance with standard practices and to within the confines of the code. c. Will not be injurious to other property(ies) in the vicinity; The south side of wall between property lines will improve erosion and aesthetics for the south neighbor. Otherwise, there will be zero impact on neighboring properties. d. Conforms to the intent and purpose of the Code; The project clears the ROW of the existing structure (rock wall) and allows space for the city space for any future work while still remaining inside the confines of the structure's height/material code. e. Can be shown to be justified and required for the use and situation intended; The existing rockery was failing and additionally, had moderate erosion issues with sediment/dirt on the ROW/street. It was also grossly encroaching onto the ROW. This project will 100%mitigate these issues while allowing the property owner to have a nicer, more useable front yard and entry, as well as provide for safer parking and f. Will not create adverse impacts to other property(ies) in the vicinity. There will be ZERO adverse impacts on neighboring properties by virtue and the nature of the project.
