SPECIAL PRESENTATION Emergency Management Director Needham reported that Ready in Renton is a Fire: Ready in Renton, new public education outreach program for disaster preparedness. The program Employee Promotion follows National Night Out, which occurs on August 7, and runs from August 8 to 10. She explained that the program stresses the importance of being prepared and determines the level of citizen preparedness. Ms. Needham stated that citizens can pre-register to participate in the program, and they will be asked to assess their level of readiness and to then go without power, shelter and/or provisions for one, two or all three days of the program. To follow-up, Ms. Needham stated that participants will complete a post- campaign survey, the results of which will be used to analyze trends and to better focus citizen preparedness education. She indicated that City employees will also complete a survey to identify specific preparedness gaps, and education and resources will be offered so that staff will also be prepared for disasters. Ms. Needham concluded by saying that disaster preparedness education will continue with Renton's participation in the new State program, Map Your Neighborhood, which will begin on September 26. In addition to rating their level of preparedness, Councilmember Clawson recommended that citizens also be invited to submit comments and suggestions. On another topic, Fire Chief Daniels announced the promotion of Firefighter Johnny Bell to the rank of Fire Lieutenant. Lieutenant Bell indicated that he was honored and humbled by the promotion, and expressed his appreciation for the support and encouragement of his family and co-workers. ADMINISTRATIVE Assistant CAO Wine reviewed a written administrative report summarizing the REPORT City's recent progress towards goals and work programs adopted as part of its business plan for 2007 and beyond. Items noted included: * The first session of swim lessons at Henry Moses Aquatic Center filled to 98 percent, with 258 students in 51 classes. This included a new class entitled "Conquer Your Fear" for those 14 years old and above who are fearful of the water. July 16, 2007 Renton City Council Minutes Page 249 * Renton residents may notice an increase in late night and early morning aircraft noise during the coming weeks due to temporary closures of the long runway at King County International Airport(Boeing Field). Ambulance planes will make up much of the air traffic being rerouted to Renton. Because of their location under the flight path, Mercer Island and Kennydale residents will be the most affected by noise associated with the increased air traffic. Planning: The Landing Project Councilman Corman expressed concern that the developer of The Landing project may be scaling back on the architectural features of the project, and that one of the anchor tenants is not who the Council preferred as an anchor tenant. He recommended that The Landing project be discussed as an emerging issue by the Committee of the Whole. Council President Nelson indicated that the item can be discussed during emerging issues at next week's Committee of the Whole meeting. Fire: Sprinkler System Councilmember Corman noted the lawsuit that was filed against the City Requirements for Single- relating to a sprinkler system requirement for a single-family residence and he Family Residences suggested that further discussion is needed on the matter. Discussion ensued regarding the appropriate venue for discussing the lawsuit, the question of when sprinkler systems are required for single-family homes, the importance of educating the public on the requirements, and the interest for more information about sprinkler system requirements for single-family residences. Boeing Field will close for maintenance and repaving of its long runway from 9 p.m. to 4 a.m. July 16-19, August 13-16, and August 20-23. Ambulance planes will make up much of the air traffic being rerouted to Renton. Because of their location under the flight path, Mercer Island and Kennydale residents will be the most affected by noise associated with the increased air traffic. • Burlington Northern Sante Fe Railroad opened construction bids for four railroad bridge replacement projects in Renton: the Cedar River Bridge, the Rainier Avenue Bridge, the Shattuck Avenue Bridge, and the Hardie Avenue Bridge. The first project Rainier Avenue Bridge—will begin August 1 lth. As a result, Rainier Avenue will be closed August 1 lth through August 15th between South 3rd Street and South 7th Street. The adjacent properties to this abandonment proposal serve as parking to the existing 'Old Milwaukee Substation Building'. This building has served Renton for many years as an office building and currently is housing four, Renton based, corporations. These corporations provide a large number of professional jobs in the city. Parking for the Old Milwaukee Substation Building is currently provided by a main parking lot, with vehicular access from Shattuck Ave S. and an auxiliary parking lot with vehicular access from Whitworth Ave S. Other than the Whitworth Ave. S. auxiliary parking lot described above, the main use of this street is for single family residences. A public benefit exists to tie both parking lots of the Old Milwaukee Substation Building together to allow vehicular access only from Shattuck Ave S and blocking access to the auxiliary parking lot from Whitworth Ave. S. A summary of the benefits follows: 1) A reduction in traffic would result on the residential street (Whitworth Ave S.) if all access to the Old Milwaukee Substation Building is from Shattuck Ave S. through the existing entrances and exits to the office building parking. 2) An increase in parking spaces would result after integrating these related properties, decreasing pressure on street parking in this area. 3) The street end is un-maintained by the city and currently attracts garbage, debris, and transients utilizing the railroad corridor. This makes this area an attractive nuisance, intimidating professional office workers accessing the auxiliary parking lot and the residents of this street. Light and Glare Impacts: The site has existing building and parking lot lighting. Although no additional site lighting is proposed, additional light from the building can be expected to impact the surrounding area and possibly other properties in the vicinity. The existing recorded condition requiring landscape screening should alleviate potential negative impacts from this situation. The final landscape plan will be reviewed to ensure sufficient screening prior to approval of building permits. Mitigation Measures: No mitigation recommended. Policy Nexus: N/A 8. Historic and Cultural Preservation Impacts: The project site is in an area of potential archeological significance. If evidence of artifacts becomes apparent during project construction, such construction should cease immediately and the City of Renton must be notified. The Milwaukee Substation is listed on the King County Historic Resources Inventory (#0359). The applicant is advised that King County should be notified of the proposed alteration of the building. Mitigation Measures: No mitigation recommended. Policy Nexus: N/A loorr 9. Transportation Impacts: The project would continue to be accessed from Shattuck Ave S. The before mentioned recorded conditions prohibit access from either the Shattuck/Whitworth alley or Whitworth Ave S, as follows: "All vehicular ingress and egress to the property may be via Shattuck Avenue only. The alley adjacent to the north property line shall be blocked and screened in a manner that prohibits vehicle circulation to and from the property via the alley." Although the project, as proposed, meets the parking requirements of the Renton Municipal Code, there will actually be a decrease in the total number of spaces on the project site. Due to the increase of space at the existing building, it is anticipated that additional parking would be required. This is a public safety issue due to potential additional traffic on local streets and the possibility that excess vehicles, unable to park off-street, might park where emergency vehicle access could be impeded. Therefore it is an issue under the purview of this environmental determination. The applicant, apparently, has arranged for use of a new surface parking lot being constructed on the east side, at the south end of Whitworth Ave S. Staff recommends that the ATS project be conditioned so that use of this parking lot is required, unless a reduction in employees or building space can be demonstrated in the future. An additional recommendation is that the applicant initiate a street vacation of the south portion of Whitworth Ave S, and upon successful vacation, barricade the street so that users of the parking lot on Whitworth use the ATS property for access and egress, to Shattuck Avenue S. Neither shall the alley between Whitworth Ave S and Morris Ave S be accessible from the new parking lot. Transportation Impact Fees would be assessed for the project at the rate of 11.01 trips per average weekday for a general office building for the addition (7,400 sf) only. The Transportation Impact Fee would be $6,110.25. Payment of the fee would be required prior to obtaining building permits. Mitigation Measures: The applicant must record and agreement so that use of the parking lot located on the east side and at the southern terminus of Whitworth Ave S, south of NE 4th St,is required, unless a reduction in employees or building space can be demonstrated in the future. The applicant shall initiate a street vacation of the south portion of Whitworth Ave S, and upon successful vacation, barricade the street so that users of the parking lot on Whitworth use the ATS property for access and egress, to Shattuck Avenue S. The low bid for the project was $84,743.80 (including sales tax) from Clearcreek Contractors. The engineer's estimate for the project construction cost was $56,660.67. The Surface Water Utility has reviewed the low bid for completeness, inclusion of all required forms, bid bond, acknowledgments of addenda, and mathematical correctness of the hid. All the paperwork for the low bid is in order. Nouse The third bidder had several errors in the bid. The bidder did not write in the words for the Unit Bid Prices. In hid item 5 the Unit Price in numbers appears to be $2,200 (instead of$200), and the total for that bid item was corrected to $44,000 (instead of $4000). That changed the total bid amount to 172,334.25 (instead of$128,774.25). The correction does not change the bid order or results. The approved Surface Water Utility 2007 Capital Improvements Program (CIP) budget for the Small Drainage Project's program is $328,000. There is currently $249,273 of unencumbered funds in the project budget (account # 427.000600.018.5960.0038.65.065015). There are sufficient funds in the 2007 Capital Improvements Program (CIP) budget account to fund construction and staff costs for the Maplewood Creek Sediment Basin 2007 Cleaning Project. The low bid meets the following conditions for award: 1. The low bid must be within the total project budget; 2. There must be more than one bidder; and 3. The lowest, responsible, responsive bid contains no significant irregularities. The Surface Water Utility, therefore, recommends that this item be placed on the July 16, 2007, consent agenda for Council concur. The low bid for the project is $175,693.56 (including sales tax) from Northwest Infrastructure, Inc. The engineer's estimate for the project construction cost is $167,550.00. As a matter of practice since Ordinance 5013 passed, this charge has been adjusted off utility accounts under special circumstances. Over the last 5 months an estimated $1,500 was adjusted for the following reasons and frequency: 1. Salvation Army pledge was not received in time (1) 2. Good payment history, credit card system problem, or posting timing problem (4) 3. Customer emergency; customer has a good payment history(2) 4. House removed, paying off account (1) 5. Payment left in the night box, lock box or via the credit card system on same day as shut off(3) 6. Mailing address not correct or customer claims he/she did not get a notice (3) 7. The site is located at 2604 Lynnwood Avenue NE in the very northeast corner of the city in the R-8 zone. It borders King County on the north and east sides of the plat,the Comprehensive Plan Designation is Residential Single-Family. The lot is 21,506 square feet(.49 acres) and is currently vacant. The applicant proposes to subdivide the lot into 2 lots for the eventual construction of 2 single-family homes. The average grade exceeds 20%, therefore this project is being reviewed as a hillside subdivision and is subject to the preliminary rather than short plat process. There are 3,768 square feet of protected slopes,after deductions the net density is 7.31 du/ac, which is within the accepted range for the R-8 designation. There is an existing access and utility easement that runs along the north side and down along the east side onto the abutting lots south. Code further requires that areas or access easement be deducted from the overall buildable areas,therefore,it is recommended that applicant remove the existing access easement prior to final plat recording or re-design the setback requirements in order to comply. Minimum lot size is 5,000 square feet,the lots all comply with the minimum lot size requirements. The front yards for both lots would be oriented towards Lynnwood Avenue NE, setbacks would be measured from the access easement lines. All street improvements are in place including curb with curb cuts, gutters, sidewalks, .,S planting strip and an 8-foot retaining wall. The applicant will need to cut through the retaining wall in order to put in the driveways. The driveway slopes appear to be very close to the allowable 15% slope, applicant will need to redesign those driveways or apply for a variance. The site is currently vegetated with thick brush and seven significant trees. There are plans to retain one of the seven significant trees,to meet code a detailed landscape plan must be submitted indicating that two of the significant trees would be retained and if not feasible,planting up to two trees to fulfill the requirement for tree retention. Due to the extensive grading,new rockeries would be added between the lots and either side of the driveways. The Environmental Review Committee issued a Determination of Non-Significance—Mitigated with three measures. No appeals were filed. Police,Fire,Traffic and Parks Departments indicated that there were sufficient resources to serve the new lots. Traffic and Fire Mitigations Fees were recommended as a condition of approval. Dave Casey, Baima and Holmberg, 100 Front Street South, Issaquah,WA 98027 stated that he has been involved with this project for quite some time. He was, in fact,the engineer that did the entire Honey Creek subdivision in the 1990's. The grading along the west side was part of the work in designing Lynnwood Ave,there were some cuts necessary to drop the road down to meet the continuation road to the north. The access easement benefits the property owner immediately adjacent to the east of this project. They do have NS a driveway to the north of this project. There was no need for setbacks from the slopes as they are very stable,they were not created by any sloughing activity but by actual grading activities. The Examiner inquired about a letter from the Honey Creek Ridge Homeowner's Association regarding re- subdivision of existing lots in the plat,how does that affect this proposal? Mr. Casey stated that when the Homeowner's Association was put together for the Honey Creek Ridge project, this lot was as large as it could be. There were so many slope density requirements and the code has changed so much since then it now allows this lot to be subdivided. When Honey Creek subdivision was done the entire plat was in the Renton School District, so it appears that this plat is entirely within the Renton School District as well. Pao Phung,4816 Lake Place S.,Unit A, Renton,WA. 98055 stated that they had received a letter that approved the short plat with several conditions that must be fulfilled. Kayren Kittrick, Development Services stated that there originally were two driveways on this lot,it was always intended that someday it would be divided. The utilities are available, they were built with the original plat,the road improvements are in, and everything is there. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:26 a.m. None FINDINGS, CONCLUSIONS & RECOMMENDATION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicants,Kiet Phung and Rose Ong, filed a request for a Preliminary Plat. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official issued a Determination of Non-Significance-Mitigated(DNS-M). 4. The subject proposal was reviewed by all depai tinents with an interest in the matter. 5. The subject site is located at 2604 Lynnwood Avenue NE. The subject site is located on the east side of Lynnwood directly east of NE 26th Court. 6. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single-family homes,but does not mandate such development without consideration of other policies of the Plan. 7. The subject site is currently zoned R-8 (Single Family- 8 dwelling units/acre). Now 8. The subject site was annexed to the City with the adoption of Ordinance 4337 enacted in December 1991. The subject site is approximately 150 feet deep(east to west)by 143 feet wide. 10. The subject site slopes downward to the north and contains approximately 3,768 square feet of Protected Slopes with grades in excess of 40%. The average slope across the site exceeds 20% and the site is defined as a Hillside Subdivision. A Hillside Subdivision requires review as a preliminary plat and a public hearing before the Hearing Examiner and approval of the City Council. 11. The site has grasses, shrubs and seven significant trees. The applicant proposes removing most of the vegetation to develop the subject site. The applicant has proposed retaining one significant tree and staff has recommended two be retained or replacements planted to meet code requirements. Streetscape landscaping is required in addition to the preservation of significant trees. 12. The proposed division is actually a re-division of a lot from an earlier preliminary plat. The homeowners association of the underlying plat had originally opposed the division but has since acquiesced. 13. The two proposed lots would be oriented in an east to west direction with Proposed Lot 1 in the north and Proposed Lot 2 in the south. Both homes would have their own driveways. 14. Lynnwood Avenue was developed with the original plat and no additional improvements are needed. 15. The proposed driveway grade may require a variance if it exceeds 15%. Staff has recommended that the . + driveway be redesigned to have grades of less then 20% and require a variance if it continues to exceed 15%. 16. An access easement benefiting neighboring property runs along the north and east margins of the subject site. 20. There is a rockery on the site and additional rockeries may be required when the property is graded. 21. The subject site is located in Aquifer Protection Zone 2. Imported fill materials will be subject to its regulations. 22. The density for the plat of two lots would be 4.88 dwelling units per acre after subtracting sensitive areas. The density for the property if it were part of the original plat would be 7.31 dwelling units per acre. 23. The subject site is located within the Renton School District. The project is expected to generate approximately 1 or 2 school age children. These students would be spread across the grades and would be assigned on a space available basis. 24. The development will increase traffic approximately 10 trips per unit or approximately 20 trips. 25. Stormwater systems were part of the original plat and will continue to serve this new plat. 26. The proposed plat,physically a short plat, appears to serve the public use and interest. The large, almost half-acre lot, can easily be divided to provide additional housing opportunities in the City and in an area with available urban services. 2. The creation of one additional lot will not unduly tax the City's infrastructure. The additional lot will add to the tax base of the City. 3. It appears that the two steeper areas on the subject site will not unduly restrict redevelopment with single-family homes. There is concern about the potential grade of driveways serving the lots. The applicant should attempt to create driveways that are not unduly steep but if they exceed requirements then a variance will be necessary. 4. The applicant will have to address the access easement that may affect their design either by redesign or removing the easement restrictions. 5. In summary, the proposed plat is a modest addition to the neighborhood that takes advantage of the large lot that was created when initially platted. RECOMMENDATION: The City Council should approve the proposed Preliminary Plat subject to the following conditions: ',gore 1. The applicant shall comply with the Mitigation Measures required by the Environmental Review Committee Threshold Determination. 2. The applicant shall remove the existing access easement prior to final plan recording or redesign the buildings to comply with setback measurements from the access easement. 3. Prior to final plan approval, the applicant shall submit a detailed landscape plan to the Development Services project manager indicating the two conifers to be saved. If the two trees cannot be retained,the applicant must submit a proposal to plant two new conifers. 4. The applicant shall redesign driveway slopes to be less than 15%or apply for a variance. 5. Prior to the recording of the plat, the applicant shall be required to pay a Fire Mitigation Fee of $946.00 for two new single-family lots. 6. RECOMMENDATION: Authorize the Mayor and City Clerk to sign the Letter of Agreement between the City of Renton and Burlington Northern Santa Fe (BNSF) regarding construction of railroad bridges in the City. BACKGROUND: Over the last four months the City and BNSF have been developing an agreement for the replacement of the Hardie Avenue S. and Rainier Avenue S. railroad bridges. Included in this would be replacement of the Shattuck Avenue S. Railroad Bridge because of the impacts of raising the Rainier Avenue S. Bridge. BNSF will be constructing these bridges during the second half of 2007, while no rail traffic utilizes the bridges. The City agrees to pay the costs up to $6.75 million, with the costs above that amount to be equally split between the City and BNSF. The City Council has been informed of the terms of this agreement as they have been developed, and has provided input on these terms most recently on April 9, 2007. • Toni Nelson, Council President • Members of the Renton City Council Page 2 of 2 April 23, 2007 The project costs have been included in the Six-Year Transportation Improvement Program (TIP projects #9 and #11) and in the 2007 budget. There are no additional impacts because of this agreement. BNSF has fast tracked the design of the bridge replacement, including the ordering of steel so that the work can be done in the second half of this year. The terms of this agreement have been presented to the City Council before and the letter is a formalization of these terms. These terms are enumerated below: 1. Overpass Reconstruction. Working with the city of Renton,BNSF intends to reconstruct the bridges over Rainier Avenue and Hardie Avenue in the second half of 2007. BNSF will manage the design and construction of these structures, and Renton will provide funding for the reconstruction as follows: (i) Renton will provide funding up to a total project expenditure level of$6,750,000.00. (ii) BNSF and Renton agree to split evenly any costs exceeding $6,750,000.00 associated with the Rainier Avenue and Hardie Avenue overpass reconstruction projects. 2. Right-of-Way Sale Contingencies. Through January I, 2020, BNSF will not sell, lease, rent, donate or otherwise convey all or any part of its main line right-of-way(ROW) between milepost 5.0 at Scopa and milepost 12.2Z just east of the Renton depot to any party other than King County, Washington Department of Transportation(WDoT)or the city of Renton for at least one calendar year after receiving formal STB permission to abandon that same portion of ROW. It may also exclude other trackside properties to be determined. Recipient must agree to rail bank the property so conveyed. (We define the Main Line ROW as all property supporting main and non-industrial siding tracks within these milepost limits up to at least fifteen feet from the center of the main line track. It specifically excludes the Renton depot grounds between MP 1 1.7Z and 12.1Z.) 3. Abandonment Guarantee. Through January 1, 2020, BNSF will accept no Offers of Financial Assistance (OFA's) in response to any abandonment filings BNSF may undertake between mileposts 5.0 and 12.2Z if King County, WDoT or the city of Renton submits an OFA to BNSF that substantially matches the best competing OFA. • 4. Abandonment Support from Renton. Through January 1, 2012, the city of Renton will not oppose BNSF's efforts to abandon all or any portion of its Woodinville Subdivision line between Scopa (Milepost 5.0) and Woodinville (Milepost23.7). 5. Renton Depot Contingency. BNSF anticipates making no further use of the Renton Depot. Should the Spirit of Washington discontinue use of the depot before January 1, 2012, BNSF will provide the city of Renton the right of first refusal to either purchase or lease the depot. If these terms are acceptable to the city of Renton, please sign as designated below. BNSF appreciates the support and assistance of the city of Renton as we move forward with the transformation of the Eastside Corridor. We will hold this offer open until April 30, 2007.
