CONSENT AGENDA The following items are distributed to Councilmembers in advance for study and review, and the recommended actions will be accepted in a single motion. Any item may be removed for further discussion if requested by a Councilmember. a. Approval of Council meeting minutes of 9/17/2007. Council concur. b. City Clerk reports bid opening on 9/19/2007 for CAG-07-160, Duvall Ave. NE Water and Sanitary Sewer Main Installation; 16 bids; engineer's estimate $1,095,087.23; and submits staff recommendation to award the contract to the low bidder, Shoreline Construction Co., in the amount of$775,296.13. Council concur. c. Community Services Department recommends approval of a service repair order with Hermanson Mechanical for emergency repairs to the HVAC system at the Renton Community Center in the amount of$32,000. Council concur. d. Development Services Division recommends acceptance of a deed of dedication for additional right-of-way to widen Jericho Ave. NE and NE 5th Pl. to fulfill a requirement of the Benner Short Plat(SHP-05-113). Council concur. e. ADMINISTRATIVE Chief Administrative Officer Covington reviewed a written administrative REPORT report summarizing the City's recent progress towards goals and work programs adopted as part of its business plan for 2007 and beyond. Items noted included: * Renton will hold a ribbon cutting ceremony on September 26 to open Logan Ave., the culmination of the largest public works project in the City's history and the next step in the realization of The Landing, a 46-acre retail and residential development scheduled to open in October. * The unveiling of the new activity building at Tiffany Park will occur on September 29. * Over 100 prospective employees attended the first "Ahead of the Curve" Landing Job Fair on September 20 at Renton Technical College. * Washington State Department of Transportation will kick-off the I-405 Renton Stage 1 Project with a "Construction Brown Bag" event on October 4 at Liberty Park. AUDIENCE COMMENT Teresa Lindo (Sammamish) introduced herself as a volunteer and officer of Citizen Comment: Lindo - Eastside Baby Corner, a non-profit organization that provides goods and Eastside Baby Corner Non- services to low income children in east King County, including Renton,which Profit Organization has been operating for 14 years. Noting that the organization has grown substantially resulting in the need for paid staff, Ms. Lindo requested that the City contribute $15,000 to Eastside Baby Corner. MOVED BY NELSON, SECONDED BY CORMAN, COUNCIL REFER THIS MATTER TO THE HUMAN SERVICES ADVISORY COMMITTEE. CARRIED. Citizen Comment: Pergamo - Anna Pergamo (Renton), who lives on S. Tobin St., expressed concerns about Touchdowns Sports Bar& the noise and unruly behavior of patrons of Touchdowns Sports Bar and Grill Grill Noise Problems, Airport (423 Airport Way) that disturbs residents in the area and negatively affects their Way quality of life. Although the Police Department is regularly contacted, she reported that the noise has not decreased and suggested a fence be built in the September 24, 2007 Renton City Council Minutes Page 323 alley between the business and S. Tobin St.,or having the business owner pay a fine each time the police are called. Citizen Comment: Green- Kenneth Green(Renton), stating that he lives next door to the previous speaker, Touchdowns Sports Bar& stressed that he does not want Touchdowns Sports Bar and Grill to shut down, Grill Noise Problems, Airport but to be responsible for the actions of its patrons. He indicated that despite Way numerous conversations with the business's management,the problems persist. Mr. Green expressed his desire for a resolution to the problems. Citizen Comment: Smith - Catherine Pluue Smith(Renton), stating that she lives on S. Tobin St., expressed Touchdowns Sports Bar& concerns about the noise problems and disturbances caused by patrons of Grill Noise Problems, Airport Touchdowns Sports Bar and Grill,which negatively affects area residents. Way Saying that she does not want the business to close down, Ms. Smith asked that the City address this matter. She suggested a greater police presence on the weekends. Mayor Keolker assured that the Police Chief will investigate the matter and provide a report back to Council. Plat: Langley Ridge,NE 26th Mayor Keolker announced that the rest of the speakers signed up to comment St, FP-07-059 on the topic of the Langley Ridge Final Plat, which is listed on the consent agenda. She invited Development Services Director Watts to provide a briefing on the matter. Mr. Watts reported that the issue in question is emergency access. He explained that the driveway from SE May Valley Rd. goes across an old bridge that would not adequately support a fire truck, so the developer either had to replace the bridge or find another way for emergency access. The developer chose an access point that comes through the Stonegate neighborhood across Tract C, and which would only be used for emergency access, drainage facilities maintenance purposes, and access to two existing single-family homes. He noted that two easements go across both Tract C and another property now known as the Holmes property. Continuing, Mr. Watts indicated that the easement types are in dispute. The easements are an older 22-foot-wide private access easement that existed prior to the Stonegate plat, and a 20-foot easement that was created when the plat was recorded. He stated that the City Attorney reviewed the unclear plat language and determined that the easement created in the Stonegate plat is a public access easement. Mr. Watts reported the following: the Langley Ridge plat property owner was unsuccessful in securing clear easement rights from the Stonegate Homeowners Association; the construction vehicles have been using the easement primarily to build the utility facilities, which has caused concern to the neighboring residents; the access is secondary and will be gated off; and the access will serve as secondary for emergency and maintenance purposes,not as primary(residential), to the two lots created as part of this particular plat. City Attorney Warren noted the discord that has developed between the Stonegate residents and the Langley Ridge developer. Mr. Warren reviewed how he arrived at his determination that the easement shown on Tract C of the Stonegate plat is public and therefore allows a secondary means of emergency access to the Langley Ridge plat. Mr. Warren and Mr. Watts responded to questions from Councilmembers on the following issues: the 20-foot easement that provides access to the Holmes property; the placement of the locked gate; the use of the easement by construction vehicles and the related private property trespass issue; the Langley September 24,2007 Renton City Council Minutes Page 324 Ridge plat owner's responsibility to erect the gate and pave the road prior to recording the plat; and confirmation that the secondary access will incur only limited use. Citizen Comment: Navarro - Phillip Navarro (Lynnwood),who represents the Stonegate Homeowners Langley Ridge Final Plat, NE Association (HOA),provided a procedural history of the easement under 26th St, FP-07-059 dispute related to the Langley Ridge Final Plat. Mr. Navarro reviewed three legal points as to why the easement should not be considered a public easement, the first concerning certain findings by the Hearing Examiner. MOVED BY CORMAN, SECONDED BY PALMER, COUNCIL ALLOW THE SPEAKER FIVE ADDITIONAL MINUTES. CARRIED. Mr. Navarro continued with the review of his legal points. His second and third points concerned the intent of the dedicator and the issue of inverse condemnation. He recommended that the matter be sent back to the Hearing Examiner for a closer review. In response to Council inquiry, Mr. Navarro stated that originally, Stonegate HOA just wanted the developer to have asked them for permission to use the property. The issue has now become contentious. He noted that compensation has been discussed, and pointed out that the HOA is willing to work with the developer if the developer is willing to work with the HOA. Citizen Comment: Reamy- Betsy Reamy (Renton), Stonegate neighborhood resident, voiced concerns Langley Ridge Final Plat, NE regarding the emergency access to the Langley Ridge plat. She expressed her 26th St, FP-07-059 unhappiness with the construction truck traffic, saying that the access is on Stonegate's private property and other options are available. Ms. Reamy requested that Council deny the final plat, and require the developer to submit an emergency access that uses Langley Ridge plat property. Citizen Comment: Longfellow Happy Longfellow(Renton), Stonegate neighborhood resident, disagreed with - Langley Ridge Final Plat, NE the Langley Ridge developer's proposal to use Stonegate property for additional 26th St, FP-07-059 uses that were not included in the original Stonegate plat. He said the access should be developed on Langley Ridge plat property. Citizen Comment: Brain - Paul Brain (Tacoma), attorney representing Langley Development, reviewed the Langley Ridge Final Plat,NE dedication provisions on the Stonegate plat map and concluded that public 26th St, FP-07-059 access exists across Tract C. He noted the minimal amount of usage the secondary emergency vehicle access would incur. Discussion ensued regarding the dedication of open space tracts to the public, the pavement maintenance of the emergency access road by Langley Ridge Homeowners Association, and the question of compensation for the property. Citizen Comment: Rogers- Debra Rogers (Renton), Stonegate neighborhood resident, expressed her belief Langley Ridge Final Plat, NE that the easement on the Stonegate plat is private and has not been abandoned. 26th St, FP-07-059 Referring to documents related to the Langley Ridge Preliminary Plat process, she detailed how she came to this conclusion. Ms. Rogers stated that if there is public access on the easement, then it is for City use and not for construction vehicles. She submitted documents and 47 signatures showing support for the Stonegate Homeowners Association. Citizen Comment: Siri Christopherson (Renton), child of Stonegate neighborhood residents, Christopherson - Langley indicated her dislike of Langley Development's construction trucks using the Ridge Final Plat, NE 26th St, easement on Stonegate plat. FP-07-059 September 24, 2007 Renton City Council Minutes Page 325 Citizen Comment: Tyra Christopherson (Renton), child of Stonegate neighborhood residents, Christopherson - Langley expressed concern regarding the increase in traffic in her neighborhood as a Ridge Final Plat,NE 26th St, result of the building of the access road by Langley Development. FP-07-059 Citizen Comment: Bruce Christopherson (Renton), Stonegate neighborhood resident and parent, Christopherson - Langley disagreed that the easement on the Stonegate plat is owned by the public. Ridge Final Plat,NE 26th St, Stating that he does not want Langley Ridge plat to use Stonegate's property as FP-07-059 access,he pointed out that other options are available for Langley Ridge. Mr. Christopherson expressed concern regarding tactics used by the Langley Ridge developer,pointing out that the issue is not about money, it is about recognition of private property rights. He voiced hope for resolution of the legal issues prior to approval of the Langley Ridge Final Plat. Discussion occurred pertaining to concern that the access road will be used for more than emergency and maintenance purposes, and regarding the ownership of the easement area. Citizen Comment: Foster- Thomas Foster(Seattle) introduced himself as the president of Langley Langley Ridge Final Plat, NE Development and commented on the secondary access to and the placement of 26th St, FP-07-059 the houses on Langley Ridge plat. He noted that the access as proposed is for emergency and maintenance use only and not for ingress or egress to the plat. He further noted his effort to limit the construction vehicle traffic and to be considerate of the residents. Mr. Foster stated his belief that the easement is for public use. Discussion ensued regarding the attempts to resolve the matter, the threats of lawsuits, the suggestion to employ a mediator, and the high emotions surrounding the issue. Time: 8:54 p.m. The meeting was reconvened at 9 p.m.; roll was called; all Councilmembers present except Briere, previously excused. Citizen Comment: Holmes - Robert Holmes (Renton), stating that he owns property that is part of the Langley Ridge Final Plat, NE Langley Ridge plat, pointed out that Tract C in the Stonegate plat is currently 26th St, FP-07-059 being used by the City eight to twelve times per year for ingress and egress to the retention pond. He opined that it will not be used for emergency access to the Langley Ridge plat more than once every five years. Mr. Holmes further pointed out that the property will not be used by the general public, except for those coming to the homes on his property. Citizen Comment: Ice- Larry Ice (Renton), Stonegate neighborhood resident, noted that with the Langley Ridge Final Plat, NE emergency access as proposed to the Langley Ridge plat, even with the 26th St, FP-07-059 anticipated limited use, the safety of the children in the Stonegate neighborhood is at risk. He recommended that the bridge over May Creek on the Langley Ridge plat be improved,resulting in the provision of immediate emergency access to the homes. Mr. Ice concluded that the Stonegate plat map language indicates that Stonegate Homeowners Association owns the easement. Citizen Comment: Todderud - John Todderud(Renton), Stonegate neighborhood resident, stated that the Langley Ridge Final Plat,NE easement on the Stonegate plat is not public. He recommended that the Langley 26th St, FP-07-059 Ridge developer spend the additional money to make the emergency access from SE May Valley Rd. Mr. Torrerud expressed support for an emergency access that does not disturb the Stonegate neighborhood. September 24,2007 Renton City Council Minutes Page 326 Citizen Comment: Blayden - Bob Blayden (Renton), who owns property on the Langley Ridge plat, indicated Langley Ridge Final Plat, NE that Langley Development purchased property from him and has been very 26th St, FP-07-059 accommodating to him during the construction. He encouraged the Council to move forward with the approval of the final plat, as the longer the matter is held up, the more money he loses. Mayor Keolker recommended that the matter be held for at least a week in order for the issues to be resolved. September 24, 2007 Renton City Council Minutes Page 327 UNFINISHED BUSINESS Council President Nelson presented a Committee of the Whole report regarding Committee of the Whole the 2008 piped utility rates and System Development Charges. The Committee Utility: Utility Rates & System recommended concurrence in the staff recommendation to approve the proposed Development Charges 2008 revenue increases of 6 percent for water, 6 percent for wastewater, and 6.5 percent for surface water and the proposed 2008 System Development Charges. The Committee further directed staff to prepare an ordinance reflecting the 2008 utility rates and System Development Charges to be processed with the budget ordinance. MOVED BY NELSON, SECONDED BY CLAWSON, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. Council President Nelson noted that staff will explore options to better inform low-income seniors and disabled persons of the available lower rates. Planning& Development Planning and Development Committee Vice Chair Clawson presented a report Committee recommending concurrence with the staff recommendation to approve a multi- EDNSP: Multi-Family family housing property tax exemption agreement that addresses the terms and Housing Property Tax conditions for a partial property tax exemption upon completion of the Exemption, Harrington Square Harrington Square project in the Highlands designated residential targeted area. The Committee further recommended that the Mayor and City Clerk be authorized to execute said agreement in substantially the same form. Vacation: Whitworth Ave S, Planning and Development Committee Vice Chair Clawson presented a report TEAM Properties, VAC-07- recommending concurrence in the staff recommendation to approve the request 002 to vacate a portion of Whitworth Ave. S. right-of-way subject to the following four conditions: • An easement for the City's water, wastewater and surface water utilities be retained over the entire right-of-way; • Sufficient area be provided in the requested vacation area for a boring pit; • Vehicular turnaround access be provided to the Transportation Division's satisfaction; and • Right-of-way revert back to the City should the adjacent BNSF Railway Company right-of-way be abandoned at some point in the future. Utilities Committee Utilities Committee Chair Clawson presented a report regarding the Hazen 565- CAG: 07-141, Hazen 565- Zone Reservoir Construction project. The Committee recommended Zone Reservoir Construction, concurrence in the staff recommendation to approve the additional budget T Bailey appropriation in 2008 to cover project costs, with a total project budget(2007 and 2008) not exceeding$6,500,000. The Committee further recommended concurrence in the staff recommendation to award the construction contract for Hazen 565-Zone Reservoir Construction project to the low bidder, T. Bailey, Inc., in the amount of$5,404,265.96. MOVED BY CLAWSON, SECONDED BY LAW, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. Utility: Hazen 565-Zone Utilities Committee Chair Clawson presented a report recommending Reservoir Construction concurrence in the staff recommendation to approve the consultant agreement Services, RH2 Engineering with RH2 Engineering, Inc. to provide services during construction of the Hazen 565-Zone Reservoir project in the amount of$220,602. The Committee further recommended that the Mayor and City Clerk be authorized to execute September 24,2007 Renton City Council Minutes Page 328 the agreement. Public Safety Committee Public Safety Committee Chair Law presented a report regarding the Mercer Police: Mercer Island Harbor Island marine patrol contract. The Committee met to discuss the contract with Patrol Contract, Log Removal Mercer Island for marine patrol services and is satisfied with the level of service Policy currently being received. The Private Property Committee was advised that City regulations declare graffiti to be a nuisance violation and also require the removal of graffiti. The City's role and responsibility in removing graffiti on public and private properties was discussed. City staff, representing the Police, Community Services, and Planning/Building/Public Works departments, have recently developed a coordinated approach for responding to reports of graffiti. The Committee concurred in the staff recommendation that Code Compliance function as the clearinghouse for graffiti reports, to allow for tracking, referral and enforcement. The Code Compliance Reporting phone line, 425-430-7373, and e-mail, www.codecompliance@ci.renton.wa.us, will be used to report graffiti. Tomorrow's event marks the successful on-time and on-budget completion of roadway and infrastructure improvements including the construction of new streets and sidewalks, widening and realigning existing streets, and installing new traffic signals and utilities. The improvements also include a number of amenities such as stamped colored concrete, raised sidewalks, street trees, and decorative street lighting. Construction crews began by demolishing existing roadways and infrastructure and installing utilities on and around Park Avenue. • City of Renton residents are invited to a community meeting and presentation on September 26 from 7 to 9 p.m. to learn about airport noise effects and to provide input for the airport noise study, which is jointly funded by the City of Renton and the City of Mercer Island. In April 2007, the two cities entered into an agreement to jointly fund a noise study to determine the effects of several different airport development options and to work together to solicit public input, draft the scope of work for the study, and share the results with residents. The community meeting will be held in Council Chambers at Renton City Hall. The Renton Airport Advisory Committee (RAAC) will meet at 5 p.m. in the Council Chambers prior to the community meeting. Background: • HVAC equipment at the RCC is inspected and serviced annually during the summer week-long shut down. The equipment is roughly 20 years old. • During this year's inspection, while a compressor was being replaced, it was determined that one of the system's two chiller barrels was leaking badly. • Because of the age of the chiller barrel and the fact that the tubes wear from the inside out, a repair would be ineffectual and short-lived. A replacement is indicated. • The lead time for the chiller barrel is almost four months. In the meanwhile, the air conditioning will continue to work, but only to half capacity at most. This situation also puts additional strain on the remaining chiller barrel. • Although we are near the end of the cooling season, there will continue to be climatic circumstances, combined with heavy occupant loads, that will cause the HVAC control system to call for cooling. The repair must be done as soon as possible. • Hermanson Mechanical had the lowest bid for the original system work and is familiar with the particulars of this repair. Their repair quote is within an acceptable range and consistent with similar work done elsewhere. The topography of the subject site is generally flat, with Alderwood series soils. The applicant submitted a conceptual landscape plan with proposed street trees and two new trees per lot. 2. Environmental Review Except when located on lands covered by water or sensitive areas, short plats are exempt from SEPA Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Staff Review Comments Representatives,from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a short plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the short plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Single Family (RSF) on the Comprehensive Plan Land Use Map. Lands in the RSF designation are intended to be used for quality residential detached development organized into neighborhoods at urban densities. It is intended that larger subdivision, infill development, and rehabilitation of existing housing be carefully designed to enhance and improve the quality of single-family living environments. The proposal is consistent with the following Comprehensive Plan Land Use and Community Design Element policies: Policy LU-147. Net development densities should fall within a range of 4.0 to 8.0 dwelling units per acre in Residential Single Family neighborhoods. The proposed project for three lots would arrive at a net density of 7.69 dwelling units per net acre, *ow which is within the allowable density range. Policy LU-148. A minimum lot size of 5,000 square feet should be allowed on in-fill parcels of less than one acre (43,560 sq. ft.) in single-family designations. Allow a reduction on lot size to 4,500 square feet on parcels greater than one acre to create an incentive for aggregation of land. The proposed project site is less than an acre (21,739 sq.ft. or 0.50 acre). All of the proposed lots are equal to or exceed the minimum lot size of 5,000 square feet. Policy LU-152. Single-family lot size, lot width, setbacks, and impervious surface should be sufficient to allow private open space, landscaping to provide buffers/privacy without extensive fencing, and sufficient area for maintenance activities. The proposed new lots would meet the required lot size, width, and setbacks to create sufficient front, rear, and side yard areas. Policy LU-154. Interpret development standards to support new plats and infill project designs incorporating street locations, lot configurations, and building envelopes that address privacy and quality of life for existing residents. The site would be divided into three rectangular lots that are similar in size, orientation and building envelopes to other development in the neighboring area. Approval of this application would not decrease the quality of life for residents in the immediate vicinity. Policy CD-12. Infill development, defined as new short plats of nine or fewer lots, should be encouraged in order to add variety, updated housing stock, and new vitality to neighborhoods. The proposed short plat would subdivide an existing lot into three lots. The existing residence would be removed, thus allowing two new single-family dwellings to be constructed,which will update the housing stock in the existing neighborhood. b) Compliance with the Underlying Zoning Designation The subject site is designated Residential —8 Dwelling Units per Acre (R-8) on the City of Rentor Zoning Map. The proposed development would allow for the future construction of three ne- single-family dwelling units with the removal of the existing single-family structure and garage. The allowed density range in the R-8 zone is a minimum of 4.0 to a maximum of 8.0 dwelling units per acre. Net density is calculated after the deduction of sensitive areas, areas intended for public right-of-way, and private access easements. The short plat would require dedication of approximately 4,768.7 sq. ft. of public right-of-way, resulting in a net site area of 0.39 acres. Based on three lots, net density would be 7.69 (3 units/0.39 acres) dwelling units per acre, which is within the allowable density range for the R-8 zone. The required setbacks in the R-8 zone are as follows: front yard is 15 feet for the primary structure and 20 feet for an attached garage, side yard is 5 feet, side yard along a street is 15 feet for the primary structure and 20 feet for an attached garage and the rear yard is 20 feet. The allowed lot dimensions for the R-8 zone are minimum lot width of 50-foot for interior lot, 60- foot for corner lot and minimum lot depth of 65 feet. As proposed, Lots 1 and 3 are interior lots with a width of 50.02 feet and a depth of over 100 feet. Lot 2 is a corner lot. It is 62.27 feet wide and over 100 feet deep. All lots comply with lot dimension requirements. The allowed building lot coverage in the R-8 zone is 35 percent or 2,500 square feet whichever is greater for lots over 5,000 square feet in size and lots 5,000 square feet or less are allowed a maximum of 50 percent lot coverage. The existing residence and garage would be removed as a condition of the short plat approval. The applicant shall obtain a demolition permit and complete all inspections and approvals for all buildings located on the property prior to the recording of the final short plat. The satisfaction of this requirement is subject to the review and approval of the Development Services Project Manager. The lot coverage for the new lots would be verified at the time of building permit review. The parking regulations required that detached or semi-attached dwellings provide at minimum c'` two off-street parking spaces. As proposed, each lot would have adequate area to provide two of street parking spaces. Compliance with the parking requirements will be verified at the time or— building permit review. The applicant will be required to install a 5-foot landscaped strip along the frontage of NE 5th Place and Jericho Ave. NE within the proposed lots. In addition, the applicant will be required to plant two ornamental trees, a minimum caliper of 1-1/2 inches (deciduous) or 6 — 8 feet in height (conifer), within the 15-foot front yard setback area for the proposed lots. A conceptual landscape plan was submitted as part of the proposed land use application showing the two new trees per lot. The 5-foot landscape strip was not shown. Staff recommends that as a condition of short plat approval the applicant be required to submit a detailed landscape plan, which includes the items listed in the definition of detailed landscape plan in RMC 4-8-120D(12). The required landscape areas must be irrigated or use of drought-resistant plants. d) Compliance with Subdivision Regulations Streets: The proposed short plat is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, staff recommends a condition of approval be placed on the project requiring a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project. One new lot (credit given for the existing residence) is expected to generate approximately 19.14 (9.57 trips x 2 lots) new average weekday trips. The fee for the proposed short plat is estimated at $1,435.50 ($75.00 x 19.14 trips = $1,435.50) and is payable prior to the recording of the short plat. Blocks: No new blocks will be created as part of the proposed short plat. Lots: The size, shape, orientation, and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. The minimum lot size for parcels less than one acre in the R-8 zone is 5,000 square feet. With lot sizes ranging between 4,812 sq. ft. and 5,895 sq. ft., the proposed short plat meets the minimum lot size requirements. The dimensions of the proposed lots meet the minimum width and depth requirements (see discussion under Compliance with the Underlying Zoning Designation) and are compatible with other existing lots in this area under the same R-8 zoning classification. In addition, the lots appear to contain adequate building areas for the construction of suitable single-family residences when taking setbacks and lot coverage requirements into consideration. These requirements will be reviewed at the time of building permit application. The size, shape, orientation and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the Development Standards of the R-8 zone. e) Reasonableness of Proposed Boundaries Access: Lot 1 would front onto NE 5th Place, and Lots 2 and 3 would front onto Jericho Ave. NE. Topography:The topography of the subject site is generally flat. Relationship to Existing Uses: The properties surrounding the subject site are single-family residences and are designated Residential — 8 Dwelling Units Per Acre (R-8) on the City's zoning map. The proposal is for two additional lots, which complies with the density allowed in the R-8 zone. The proposal is similar to existing development patterns in the area and is consistent with the Comprehensive Plan and Zoning Code,which encourages residential infill development. Availability and Impact on Public Services(Timeliness) 4"""' Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish services to the proposed development, subject to the condition that the applicant provide Code required improvements and fees. The fee is estimated at $976.00 ($488.x, x 2 new lots =$976.00)and is payable prior to the recording of the short plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per single-family residential dwelling. Based on the student generation factor, the proposed short plat'would result in a maximum of one additional student (0.44 X 2 lots = 0.88 rounded up to 1)to the local schools (Maplewood Heights Elementary, McKnight Middle School and Hazen High School). It is anticipated that the Renton School District can accommodate any additional students generated by this proposal. Storm Water. Due to downstream flooding and erosion problems in the area, staff recommends that the project comply with the 1998 King County Surface Water Design Manual Level 2 standards for both detention and water quality. The applicant has submitted a drainage report titled Report— Limited Hydrological Services, Roof Drainage and Infiltration, completed by Icicle Creek Engineers, dated August 29, 2006, addressing storm water drainage design. Staff recommends that the applicant be required to follow the recommendations found in the report as a condition of short plat approval. A code modification has been granted to restrict the maximum impervious area per lot to 3,500 sq. ft. with the condition that this be placed on the face of the short plat prior to recording. A copy of the modification is attached to this report. A Surface Water System Development Fee is required upon development of the site, and will be charged at the current rate of $759.00 per new single-family lot. The fee is payable prior to the issuance of the utility construction permit. To ensure the upkeep of the proposed stormwater facilities, staff recommends as a condition of the short plat approval, the applicant establish a Home Owner's Association or a maintenance agreement to maintain the stormwater facilities Additionally, to control the runoff impact during site preparation and grading, the applicant shall b.„is" required to provide a Temporary Erosion and Sedimentation Control Plan (TESCP) designed pursuant to the Department of Ecology's Erosion and Sediment Control Requirements, outlined in Volume II of the 2001 Stormwater Management Manual and provide staff with a Construction Mitigation Plan prior to issuance of Construction permits. This condition shall be subject to the review and approval of the Development Services Division. Water and Sanitary Sewer Utilities: The site is within the water service area of Water District 90 (WD 90). The applicant has submitted a certificate of water availability from WD 90. The required fire flow for single-family residences is 1,000 gpm, and a fire hydrant is required to be located within 300 feet of all single-family residence. A water service line to the two new lots shall be provided. New water service stubs to each lot must be installed prior to recording of the short plat. There are 8-inch sewer mains located in Jericho Ave. NE and NE 5th Pl.. The sewer line must be extended along the extension of Jericho Ave. NE. The proposed short plat shall provide separate side sewers stubs to each building lot. No dual side sewers are allowed. Each new lot must be served with an individual side sewer at a minimum slope of 2 percent. Sewer stub-outs must be installed prior to the recording of the short plat. A System Development Charge of $1,017.00 per each new lot is required. The site is also subject to an East Renton Special Assessment District fee. These fees are payable at the time of issuance of a utility construction permit with credit given for the existing residence. H. Findings: Having reviewed the written record in the matter, the City now enters the following: Request: The applicant has requested Administrative Short Plat Approval for the Benner Short Plat, File No. LUA-05-113, SHPL-A. 4.201 2. Subdivision Regulations: The proposal complies with the requirements established by the City's Subdivision Regulations provided all advisory notes and conditions are complied with. 6. Existing Land Uses: Land uses surrounding the subject site include: North: Residential Single Family (zoned R-8), East: Residential Single Family (zoned R-8); South: Residential Single Family (zoned R-8); and West: Residential Single Family(zoned R-8). 7. Setbacks: The setbacks for future development on the proposed lots would be evaluated based on the standards applicable to lots along streets existing as of March 1, 1995. The front yard setback of proposed Lot 1 would face NE 5th Place, and that of Lots 2 and 3 would face Jericho Ave. NE 8. System Development Charges: A Water System Development Charge, a Surface Water System Development Charge and a Sewer System Development Charge, at the current applicable rates, will be required for the each new single-family residence as part of the construction permit. 9. Public Utilities: The applicant will be required to install individual sewer and water stubs to serve the new lots. Conclusions: 1. The subject site is located in the Residential Single Family (RSF) comprehensive plan designation and complies with the goals and policies established with this designation. .w 2. The Police Department would maintain increased police presence in addition to private security guard services furnished by Securitas Security Services, USA, Inc. In doing so, a transit center Visitor Information, Downtown Assistance (VIDA)program would develop out of this shared responsibility. VIDA is also the Spanish term for life. 'erre Should the Renton City Council authorize the Mayor to enter into a contract for services with Securitas Security Services, USA, Inc., to provide security and ambassador services at the Renton Transit Center? BACKGROUND: Since its opening, the Renton Transit Center(RTC) has been a source of concern by the downtown business owners and area residents. Although the crime rate in the RTC is similar to surrounding areas, crimes that have occurred at the center have drawn significant attention and created a perception of decreased safety. To address these concerns, city departments have worked cooperatively to implement environmental changes, increase surveillance via cameras, and increased city presence at the center. The police department received additional funding for overtime in 2006 to provide staffing at the RTC. In 2007,the Police Department began using regular duty officers from various assignments to staff the transit center. This method of reassignment has caused a decrease in officer availability to handle calls for service as part of their primary assignment. In addition to perceptions of decreased safety, availability of visitor assistance has also been identified as an unfulfilled need. Although adept at providing directions to local NIS points of interest,police officers rotating through the assignment do not have the ability to become familiar with the bus routes. Access to restrooms is also limited in the evening hours, causing travelers to have to find an open restroom, not in the transit center. Members from various city departments came together to discuss and identify viable long-term solutions to these issues. The group identified a single solution that has the potential to address both the perception of safety as well as increased service to the community. The solution was to establish a hybrid ambassador program, using a private security company. These programs have proven successful in other cities throughout the nation. The name"Visitor Information,Downtown Assistance" (VIDA) is the proposed name. "VIDA" is the Spanish word for"life."The VIDA program would include two security officers on bicycles wearing highly visible uniforms, working Monday through Saturday, eight hours a day. VIDA officers will be tasked with monitoring conduct within the Renton Transit Center, dealing with minor behavioral issues and reporting those incidents requiring police intervention. In addition,VIDA officers will be available to assist businesses with escorts to local banks, assist travelers with directions to points of interest and bus services, and provide access to the Renton Transit Center restroom facilities. Members of the city team researched security companies and found that one local company, Securitas Security Services, USA, Inc, contracts for a very successful ambassador program in Downtown Portland, Oregon. A three-month trial contract with Securitas Security would be $28,957.39, with an expected start date of October 1, 2007. The funding for a three-month trial contract would be from the existing 2007 Police Department Budget. Continued funding for the program would be needed in the 2008 budget. RECOMMENDATION: Authorize the Mayor and City Clerk to enter into a contract with Securitas Security Services, USA, Inc to provide VIDA program services, and implement the program in the area of the Renton Transit Center. CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM THIS AGREEMENT made and entered into this day of , 2007 by and between The City of Renton, State of Washington, having offices for the transaction of business at 1055 South Grady way Renton, Washington, hereinafter referred to as the "City," and Securitas Security Services USA, Inc., having offices for the transaction of business at 12600 SE 38th Street - Suite 205, Bellevue, Washington 98006, hereinafter referred to as the "Contractor," jointly, hereinafter referred to along with the City as the "Parties." WITNESSESTH: Whereas, the City of Renton pursuant to the provisions of the Revised Code of Washington Section 35A.11 has the care of City property and the management of City funds and business; and Whereas, City of Renton has negotiated with Securitas Security Services USA, INC for the provision of security services based upon their response to a Request for Proposal, and Whereas the City of Renton and Securitas Security Services USA, Inc., have reached an agreement regarding scope of services and the costs; Now, therefore, for and in consideration of the mutual promises set forth herein, the Parties hereto do mutually agree as follows: SECTION I: SCOPE OF WORK AND SERVICES 1. The Contractor shall provide the following work and services: slaw Securitas will be providing Security Patrols both on foot and bicycle in a predetermined geography surrounding the Renton Transit Center. These patrols have been established to promote a visible professional security presence. Primary duties include but are not restricted to being visible and responsive to area visitors, vendors, customers and shop owners. Officers are tasked to observe and report suspicious activity and deter and detect civil infractions and criminal activity. Current proposed schedule for program is Monday - Saturday, 1400 - 2200 hours. 2. Each security officer assigned to this contract will carry out the functions, duties or tasks listed below in an honest, ethical and professional manner and in compliance with applicable company policies and procedures. a. Provide an atmosphere that results in a courteous, respectful and pleasant interaction with the general public, visitor, and business owners as perceived from their point of view, and present a good image of the city. b. Communicate in a manner that is open, honest and responsive in all situations; to the extent authorized, provide information regarding the Downtown Renton and surrounding area as requested by visitors. c. Monitor the streets and alleyways of the assigned post, paying particular attention to `out-of-view' locations that draw transients and homeless, unattended packages, boxes and containers, buggies and strollers. Patrol the assigned site on a bicycle in all but the most severe weather and then will resort to foot patrol until the extreme weather dissipates, checking for unsafe conditions, hazards, blocking access or egress to public areas, using authorized equipment and protective gear. e. Protect crime scenes and incident sites that are the product of accidents, emergencies, crimes and security incidents, employing barriers and signage and direct traffic around the area until the situation is resolved. f. Prepare logs and reports as required for the post, write or type reports or enter information in a computer using standard grammar, review security control logs and take actions as described in the post orders. g. Observe and report incidents or suspicious activity to client representatives and law enforcement, company management and other public safety representatives as appropriate for the circumstances or post orders. h. Respond to incidents of fire, medical emergency, bomb threat, flooding, unexpected water discharge, elevator emergencies, spills of suspected hazardous materials, traffic and pedestrian accidents, inclement weather and other incidents or conditions following procedures established for the post, by the company and training received i. Carry out specific tasks and duties of a similar nature and scope as required for the post as may be agreed upon in writing by the parties from time to time. 3. EDUCATION AND EXPERIENCE All personnel assigned to perform the Work or Services set out herein, shall meet the following criteria: a. Must be in good physical health. b .Possess no felony convictions. c. Possess any combination of the following 4 criteria, exceeding 3 years of experience: • High School Diploma or G. E. D. • 4 years prior military, or • Prior law enforcement, or • 4 years security experience 4. TRAINING a. The Contractor shall train security personnel in the following security areas before assigning the security personnel to this project: • Company Training • Drive For Life Certification • Security Bike Patrol Certification* • American Red Cross First Aid, CPR* and AED* Certifications • M.O.A.B. or equivalent encounter training* • Radio Communications Training N41 • Report Writing Training CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 2 *Annual Recertification Required b. Contractor shall provide documentation of completion of training for each individual ___ before being assigned to this project. 5. HEALTH AND PHYSICAL FITNESS REQUIREMENTS The contractor shall ensure that all employees assigned meet the following criteria, which are bona fide occupational qualifications. The employees assigned must be well proportioned in height and weight, and in good general health without physical defects or abnormalities that would interfere with the performance of duties. They shall possess binocular vision, correctable to 20/20, and shall not be colorblind. They shall be capable of hearing ordinary conversation at 20 feet and whispered conversation at 10 feet without benefit of artificial hearing devices. 6. APPEARANCE The City of Renton desires a favorable image and considers it to be a major asset of a security guard service. Contractor employee's appearance, attitude, courtesy, and job knowledge are influential in creating a favorable image. No smoking, reading unauthorized material, eating, chewing of gum, tobacco or grooming shall be permitted while Security Officers are in public view. No personal phone calls will be permitted except in an emergency. 7. TYPICAL DUTIES With or without reasonable accommodations, a candidate must have the physical and mental capacity to effectively perform all essential functions described. In addition to other demands, the job requires the following: • Physically and mentally able, devoid of all mind-altering medication, in order to obtain and maintain a guard license from the state of Washington. • Maintaining composure in dealing with authorities, executives, clients, staff and the public, occasionally under condition of urgency and in high pressure situations. • May be exposed to stressful situations, blood borne pathogens and other contaminants. • Successful passage of background, reference, psychological, and controlled substance tests, in addition to any mandatory licensing and testing requirements. • May be required to work overtime without advanced notice. • Regularly demonstrate the ability to handle multiple tasks concurrently. • Keyboarding, basic computer usage and operating various control devices and components. • Seeing, hearing, speaking and writing clearly in order to communicate with employees, clients and the public, observe and report incidents and direct others. • Frequent sitting, standing, bicycle riding and walking, which may be required for long periods of time and may involve climbing stairs and walking or riding up inclines and uneven terrain. • Occasional reaching with hands and arms, stooping, kneeling, crouching and crawling. • Frequent lifting and/or moving up to 20 pounds and occasional lifting of up to 40 pounds. CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 3 • Close vision, distance vision and ability to adjust focus. • Continuous performance of physical exertion and occasional performance of stressful activity. • May be exposed to inclement weather or be required to work in environs or conditions that require the use of protective equipment and/or awareness of personal safety and safety of others. • May be exposed to or required to handle sensitive and confidential information. • Provide escorts of clients requesting accompaniment or have arranged for cash bank deposits. • May be required to work an "On Duty Meal Period" and may not have a break for 2-3 hours in any given shift. 8. UNIFORMS Security Personnel shall wear the uniform of the security guard contractor at all times when on duty. Uniforms shall include a badge or other insignia designating the person as a security officer and will be subject to approval by the County. 9. ARREST/DETAINMENT The City of Renton prohibits the use of arrest powers by non-commissioned personnel. When necessary, the proper police authority shall be summoned. Non-Commissioned personnel shall always be cooperative with law enforcement and/or authorized emergency personnel. Non-Commissioned personnel powers of arrest are no greater than that of a private citizen. Contractor shall assume full liability for any of their non- commissioned employees in the exercise of any police authority. Nod 10. WEAPONS/USE OF FORCE * a. The use of weapons by non-commissioned personnel assigned to any City site is strictly prohibited. No force shall be used by non-commissioned personnel except that which is absolutely necessary for self-defense. b. Possession of weapons by non-commissioned personnel on the site shall be grounds for immediate and permanent removal of the employee from the site. Repeated offenses may be grounds for contract termination. The use of force by non-commissioned personnel beyond that necessary for self-defense.' shall also be grounds for immediate, permanent removal of the employee. c. Contractor shall assume full liability for any use of force by their employee and any other activities not within the best interests of the City. Section II. GENERAL PROVISIONS 1. CONTRACT SUPERVISION * Guards shall have normal concern for their own physical safety and shall take reasonable precautions not to place *4000 themselves in situations which would encourage violence or abuse against either them or other persons in the area. CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 4 a. The contractor shall provide in writing the name, telephone number and address of the Account Manager or equivalent to the Special Operations Commander of Renton _ Police Department within seven (7) working days after award of the contract. The term "Account Manager" means a person designated in writing by the contractor who has complete authority to act for the contractor during the term of the contract. Uniformed employees who are assigned regular guard duty shall not perform the duties of the Account Manager. The Account Manager shall have the authority to accept notices of deductions, inspection reports, and all other correspondence on behalf of the contractor. In addition, this person will have the authority to act for the contractor on a day-to-day basis at the work site. b. The contractor shall have sole responsibility to ensure employees: 1. Are properly trained to perform all duties as specified in accordance with the contract. 2. Are properly uniformed and present a neat appearance. 3. Maintain a continued state of proper training. 4. Possess the necessary permits, authority, etc. 2. WORK SUPERVISION The Contractor shall: a. Schedule monthly manpower assignments for Renton Transit Center complex. b. Schedule and record sick leave, vacation, floating holidays, and training. c. Maintain records as needed or required by the city. d. Meet and work with the Renton Police Department on high profile cases and also `law coordinate security with the department. e. Conduct uniform and equipment inspections on security personnel. f. Work with the Renton Police Department and/or other personnel to maintain a harmonious working relationship. g. Work with the Renton Police Department on specific crowd control plans. 3. CONTRACTOR START UP REVIEW Immediately after award of this contract and prior to performance, the Contractor's representative and the Special Operations Commander shall make an on-site in-depth review of the total job requirements to include but not be limited to the following: a. Guard assignments including specific shift hours and total number of hours per month for all guard personnel. b. Area maps of the Renton Transit Center and surrounding area which depict emergency evacuation routes, the location and type of each fire alarm and special instruction pertaining to security controls. c. Details of the company training program and how the company will provide proof of training for all new guards. d. Policy and specific procedures for responding to emergency alarms, bomb threats, or suspected incendiary devices in the particular facility being protected. e. Required reports, logs and forms. Allow CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 5 • 4. WORK SCHEDULING PROCEDURES The criteria for establishing work schedules and the requirements for contract relief, relief periods and for starting and stopping work are contained herein: a. The duties of guard posts require that a guard not leave the assigned post until properly relieved. b. All guards shall be in uniform and ready to begin work promptly at the start of their shift and shall remain on the job and in full uniform until the end of their full tour of duty. c. Lunch and breaks shall be taken while on duty, in designated areas on the premises. d. Contractor will establish the work schedules to be consistent with the shift hours and total hours established pursuant to Section II.3.a, above. 5. PERMITS AND LICENSES The Contractor shall be responsible for all licenses and permits and shall pay for them and shall furnish copies to the City. (WAC 308.18) 6. CALL LIST a. Contractor shall be provided with a list of City employees, including the Renton Police Department, to be called in the event of an emergency. b. Contractor shall provide to the Special Operations Commander a list of emergency numbers which shall include, but not be limited to (1) A 24-hour business telephone number. (2) Off-site Lead/Relief person's home telephone number. (3) On-Site Lead/Relief person's home telephone number. (4) Guard service business number for an area supervisor. c. It shall be the responsibility of Contractor to notify the Special Operations Commander "' 101 immediately of any changes in personnel, and to confirm that the list provided is current on a monthly basis. 7. IDENTIFICATION Guards are required to carry an identification badge to be issued by the Contractor that is clearly visible on their person when on duty. Any expense incurred for badges, throughout the term of the contract, shall be borne by Contractor. 8. ROUTINE CHANGE IN SERVICE (ONE OR TWO PEOPLE) Should there be a change in City's requirement for security guard service, Contractor will adjust the number of personnel when required. The City will make a reasonable attempt to give the Contractor at least twenty-four (24) hours written or verbal notice whenever there is to be an increase or decrease in personnel. There will be times, however, when an immediate staffing adjustment is necessary. Any change in personnel will not affect the quoted hourly rate to be paid for the service provided. 9. EMERGENCY GUARD SERVICE The City of Renton reserves the right to require additional Guards on the site in a minimum amount of time (i.e. without 24 hours notice to Contractor) and Contractor shall be able to supply at least two (2) Guards under such conditions. 10. CRIMINAL ACTION CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 6 Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. These circumstances include, but are not limited to; falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records or concealment of material facts by willful omission, from official documents or records, and unauthorized use of government property, theft, vandalism, or immoral conduct. 11. DISQUALIFICATION OF GUARD PERSONNEL a. Conviction of a crime involving moral turpitude will be reason for disqualification as to initial and subsequent placement of guard personnel by Contractor in any work performed under this Contract. The arrest for and/or conviction of any crime may be cause for disqualification as to initial and subsequent placement of guard personnel by Contractor in any work performed under this Contract at the discretion of the City. b. The Special Operations Commander or designee reserves the right to notify Contractor to remove any security personnel from duty and to have them replaced when a Guard's continued employment is deemed by the Special Operations Commander or designee to be contrary to the public interest or inconsistent with the best interests of the City. 12. PERFORMANCE EVALUATION MEETINGS Contractor's representative shall meet with the Special Operations Commander weekly during the first 2 months of the contract. Thereafter, meetings will be as often as necessary at the discretion of the City's representative, but not less than bi-monthly. A mutual effort will be made to resolve all problems identified. The written minutes of these *41120, meetings, prepared by Contractor's representative, shall be signed the City's representative. 13. PERSONNEL/SECURITY CLEARANCE a. Upon award of the proposal, Contractor shall immediately provide to the City's representative a list of prospective Guards and Supervisors to be assigned to the post. That list shall include at a minimum all of the following information on each prospective employee: 1. Full, legal name, and any aliases; 2. Date of Birth; 3. Washington Drivers License Number; 4. Current address (residence); 5. Physical description; 6. One current color photograph (at least 2" x 3" full face front, head and shoulders only); 7. Copy of the permanent (not temporary) individual State Guard License for each prospective guard; 8. Department of Motor Vehicles Driving Record; 9. Copy of CPR/First Aid Training Card. b. Contractor shall provide the same information for each of the prospective employees to be assigned to the city during the term of the contract. Norse CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 7 • c. All of the Contractor's employees assigned to the City shall be subject to a background security investigation prior to receiving written acceptance from the Special Operations Commander. This investigation shall include, but not be limited to clearance r„rr through Renton Police Department. The City reserves the right to deny written acceptance to any Guard. 14. ADDITIONAL PROVISIONS a. Contractor warrants that all security guards shall be licensed, bonded, and uniformed. b. Contractor shall report directly to the Special Operations Commander or designee. c. Contractor shall submit reports with documentation of all incidents that are considered security breaches, incidents, equipment and system failures. d. Contractor shall provide an itemized billing showing breakdown of charges for each Guard on a monthly basis. e. Security guards shall check in daily at the location specified by the Special Operations Commander. f. Contractor shall provide name and resume of each individual assigned to this project and the individual assigned to backup the primary person in his/her absence to the Special Operations Commander for security clearance. SECTION III .EQUIPMENT 1. Communication Contractor will procure and provide cellular telephones for service for a cost of $51.00 monthly per cellular telephone. Renton will reimburse Contractor for the cost of 2 cell phones at $51.00 per month per cell phone during the term of this contract. 2. Patrol Bicycle Contractor will procure and provide 3 patrol bicycles for service with City of Renton. The cost for the bicycles (2 bicycles plus one reserve) including accessories is $268.33 per month; all maintenance will be billed as incurred at cost plus 10%. Renton will reimburse Contractor for the cost of three bicycles, accessories, and maintenance at the total cost of$268.33 per month during the term of this contract. Contractor will require that the City provide an area for the three patrol bicycles and other post equipment to be stored. Unless otherwise permitted by the Special Operations Commander, the three patrol bicycles and other post equipment must be stored in the designated area when not in use in fulfillment of this contract. The Contractor shall be liable for the replacement cost of any equipment lost or damaged as a result of negligence or misuse by Contractor personnel. SECTIONIV: TERM 1. This agreement shall commence on the day of 2007 and upon completion of a three month evaluation period, the City shall have the option to continue the program for one calendar year thereafter, to terminate on the day of 2008 unless extended in writing by both parties. 2. The City shall have the option to renew this agreement annually by giving notice in writing to the Contractor of such intent to renew not less than thirty (30) days prior to its expiration date. Each renewal shall be for a period of one year, but in no event shall this agreement be renewed more than four (4) times. Renewal shall be subject to acceptance in writing by the Contractor. CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 8 3. Prior to renewal option, the Contractor may request adjustment to the fee schedule Novi, established in this original contract. Such fee increase requests must be made in writing to the City one hundred-twenty (120) days prior to the end of the renewal period. The City reserves the right to accept or reject requests for fee increases. Any fee increase must be documented to the satisfaction of the City. SECTION V: COST AND PAYMENTS 1. Security Officer personnel shall be charged at a rate of$ 22.90 per hour. 2. Overtime shall be charged at the above rate. That is $ 34.36 per hour. For purposes of this section, the term "Overtime" shall be defined as the number of hours in excess of the hours identified by the Special Operations Commander, pursuant to Section II.3.a, above. 3. For and in consideration of providing the services set forth herein, the City shall pay the Contractor an amount equal to the hourly rates set above multiplied by the number of hours of service provided each month. The Contractor shall not bill for services in excess of those agreed upon pursuant to Section number 11.3 under the heading CONTRACTOR START UP REVIEW above. The Contractor shall submit bills on a monthly basis in arrears setting forth the work completed, amount due, and any other information the City may require. Invoices are payable within 30 days of receipt and shall be remitted to the address on the invoice. 4. The City will reimburse Contractor for any increases in State Unemployment Insurance taxes, and increases in any other taxes, fees, costs or charges imposed on Contractor or the services provided under this Agreement. 5. The City agrees to pay the overtime bill rate for any overtime incurred by Contractor from the INDY time the City provides notice of termination to Contractor until this Agreement is terminated. SECTION VI: INSURANCE 1. The Contractor shall provide evidence of an insurance policy or policies that meet all of the terms and conditions listed below prior to the first business day of provision of services under this contract. The insurance policy or policies shall specify The City of Renton, it's officers agents, and employees as additional insured on all coverage with that coverage being primary and non-contributory to any other coverage available to the city. The insurance policy or policies shall provide that they will not be cancelled without 30 days written notice to the City of Renton. The insurance policy or policies shall provide coverage for a minimum of $1,000,000 per occurrence, with a minimum of $3,000,000 aggregate. Coverage shall include, at a minimum, completed operations, full personal injury, all harassment, all discrimination, assault and battery, and intentional acts. The policy or policies types shall be Commercial General Liability and be issued by an insurer that is Washington State Admitted with an A.M. Best Minimum Rating of A- or better. 2. Additional compensation from the City of Renton to the Contractor shall not be provided for insurance policies with coverage that exceeds the above minimum requirements. 3. Contractor may satisfy insurance limits with a combination of commercial general liability and excess umbrella insurance coverage. The City acknowledges that Contractor maintains self- insured retentions in excess of$25,000, and that such retentions are acceptable to the City. 4. Any insurance coverage (additional insured or otherwise) Contractor provides for the City or Now° any others will not cover results of the City's or the others' acts or omissions. CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 9 SECTION VII: RELATIONSHIP OF THE PARTIES NIS 1. The parties intend that an independent contractor relationship will be created by this agreement. The City of Renton is interested only in the results achieved, and the conduct and control of all services or work will lie solely with the Contractor. No agent, employee, servant, or otherwise of the Contractor shall be or shall be deemed to be an employee, agent, servant, or otherwise of the City for any purpose, and the employees of the Contractor are not entitled to any of the benefits that the City provides City employees. The Contractor will be solely and entirely responsible for its acts and for the acts of its agents, employees, servants, subcontractors, or otherwise, during the performance of this agreement. 2. The Contractor shall provide competent personnel necessary to carry out the requirements of this Agreement and shall supervise them in their work and shall pay them for their services at the Contractors sole expense and cost. SECTION VIII: NON-DISCRIMINATION Except as set out in Section 1.5, above, the Parties hereto specifically agree that no person shall, on the grounds of race, creed, color, sex, religion, or national origin, or physical, mental, or sensory disability be excluded from employment rights and participation in, or be denied the benefits of, or otherwise be subject to, discrimination under any program, service, or activity, for which the Contractor has received or will receive payment under the provisions of this Agreement. SECTIONIX: MAINTENANCE OF RECORDS The Contractor shall make available to the City or the Washington State Auditor, or their duly authorized representatives, at any time during normal operating hours, all records, books, or pertinent information that the Contractor shall have kept in conjunction with this Agreement, and that the City may be required by law to make part of its auditing procedures, an audit trail, or that may be required for the purpose of funding the services contracted for herein. SECTION X: COMPLIANCE WITH LAWS The Parties hereto specifically agree to observe all federal, state, and local laws, ordinances, and regulations, to the extent that they may have any bearing on either providing any money under the terms of this Agreement or the services actually provided under the terms of the Agreement. SECTION XI: ASSIGNMENT This Agreement is for personal services, and accordingly, the Contractor may not assign, transfer, in whole or in part, its interest in this Agreement without the express written consent of the City. SECTION XII: MODIFICATION No modification or amendment of this Agreement shall be valid until the same is reduced to writing and executed with the same formalities as this present Agreement. SECTION XIII: VENUE STIPULATION CONTRACT FOR VISTOR INFORMATION AND DOWNTOWN ASSISTANCE PROGRAM 10 This Agreement has and shall be construed as having been made and delivered in the State of Washington and the Laws of Washington State shall be applicable to its construction and enforcement. Any action at law, suit in equity, or judicial proceeding for the enforcement of this Agreement or any provision hereto shall be instituted only in courts of competent jurisdiction within King County, Washington. SECTION XIV: WAIVER No officer, employee, agent, or otherwise of the City has the power, right, or authority to waive any of the conditions of this Agreement. No waiver of any breach of this Agreement shall be held to be a waiver of any other or subsequent breach. All remedies afforded in this Agreement shall be taken and construed as cumulative, that is, in addition to every other remedy provided herein or by law. Failure of the City to enforce at any time any of the provisions of this Agreement or to require at any time performance by the Contractor of any provision hereof shall in no way be construed to be a waiver of such provisions, nor in any way effect the validity of this Agreement or any part hereof, or the right of the City to hereafter enforce each and every such provision. SECTION XV: INDEMNIFICATION; LIMITATION OF LIABILITY 1. The Contractor agrees to indemnify and defend the City from any loss, costs, attorneys fees, or expense claimed by third parties for civil rights violations, property damage, and bodily injury, including death, pain, and suffering, mental or emotional disdain caused solely by negligence or willful misconduct of Contractor, Contractor's employees or agents in connection with the services to be performed by the Contractor under the terms of this Agreement. 2. The City agrees to indemnify and defend the Contractor from any loss, costs, attorneys fees, or expense claimed by third parties for civil rights violations property damage and bodily injury, including death, pain, and suffering, mental or emotional disdain caused solely by negligence or willful misconduct of City, City's employees or agents in connection with the obligations of the City under the terms of this Agreement. 3. If the negligence or willful misconduct of both the Contractor and City (or a person identified above for which each is liable) is a cause of such damage, or injury, the loss, cost or expenses shall be shared between the Contractor and the City in proportion to their relative degree of negligence or willful misconduct and the right of indemnity shall apply to such proportion. 4. In no event will the liability of Contractor (and its insurers) to the City, and any person or entity required to be defended or indemnified by Contractor under this Agreement (collectively "City Parties"), exceed $3 million. Further, in no event will Contractor (or its insurers) be liable to the City Parties for any (a) environmental damages, (b) special, indirect, punitive, exemplary, liquidated or consequential damages (including, but not limited to, loss of profits or business), or (c) damages arising from an act of war, a violent or armed action, or a hi-jacking. 5. Notwithstanding anything to the contrary herein, each party waives any and all claims against the other party for damages arising from or related to an act of terrorism. The parties intend for this waiver to "flow down"to their respective contractors and subcontractors. BACKGROUND SUMMARY: The Earlington Sewer Interceptor project will provide direct sanitary sewer service to properties adjacent to the new sewer main while replacing the existing Earlington Lift Station, which is at the end of its lifecycle(see attached map). Since the City would need to replace the existing lift station if it was unable to get easements to install the proposed Earlington Sewer Interceptor, the Wastewater Utility proposes that the City contribute $300,000 (the approximate cost to replace the lift station) toward the proposed gravity main. The estimated cost of the new interceptor is $641,410.04. This would leave the estimated balance of$341,410.04 to be divided among the potential connections in the proposed Special Assessment District. The Wastewater Utility has proposed to use a per-connection method of calculating the assessments for the properties within the proposed assessment district. This method takes the size of the existing parcels and anticipates how many single-family residences could be constructed in accordance with the City's proposed zoning for the area. There is a potential for the existing properties to subdivide into 53 lots. Properties that have granted utility easements to the City of Renton for this project should be compensated for their loss of property use. The properties that granted utility easements have the potential to subdivide into 41 of the possible 53 lots. We have calculated that the total value of all granted easements is $17,503.45. Therefore, their estimated assessment will be Council/Earlington Prelim SAD September 12,2007 Page 2 of 2 $6,345.04 per new connection and the remaining 12 potential connections, which did not *410 grant easements, will be $6,771.95. CONCLUSION: It has been the policy of the City that when sanitary sewer facilities have been installed that the City create a special assessment district in order to ensure that each property that benefits from the new facility pays its fair share of the costs. This policy helps to ensure that the existing ratepayers do not pay a disproportionate share of the costs for system expansion or growth. Therefore, we recommend that Council approve staffs request for establishment of a preliminary Special Assessment District and direct staff to prepare the final Special Assessment District upon construction completion of the sewer mains. Due to the project's use of trenchless technologies for installation of portions of the new sewers and the need to address King County right-of-way and grading and clearing permit requirements (100 percent of the project taking place in King County rights-of-way and private properties) the Wastewater Utility believes that additional soils and materials testing are necessary during construction. RECOMMENDATION: Approve With Conditions FINDINGS, CONCLUSIONS & RECOMMENDATION Having reviewed the record documents in this matter, staff now makes and enters the following: FINDINGS: 1. The applicant, Thomas Foster, Langley Development Group, Inc, filed a request for approval of Langley Ridge, a 34-lot Final Plat. 2. The yellow file containing all staff reports, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit No. 1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Determination on Non-Significance-Mitigated (DMA-M). 4. All appropriate City of Renton personnel reviewed the subject proposal. L\Plan Review\Plan Review 2007\Langley Ridge\Langley Ridge plat Report.doc 5. The subject site is located at South of SE May Valley Road between Coal Creek 1.103 Pkwy and NE 26th Street. North of NE 24th Street. The new plat is located in Section 32, Twp. 23 N., Rng 5 E, W.M. 6. The subject site is comprised of a parcel of 34.05 acres. 7. The City of Renton Council approved the Preliminary Plat (LUA-05-083) on February 6, 2006. 8. The site is zoned R-8 (Single Family— 8 dwelling units/acre). 9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan. As a condition of Final Plat submittal, the following items address the conditions of plat approval from the Hearing Examiner's decision approved by the City Council. The conditions of the Plat Approval and actions taken are summarized below. 1. The applicant shall comply with the conditions imposed by the ERC. • See section below for ERC compliance. 2. The applicant shall provide access to Proposed Lots 33 and 34 that meet City Standards subject to the review and approval of the Fire Department. This may entail widening the access roadway, increasing the load bearing capacity of the exiting bridge or both. The applicant shall not create a roadway from NE 26`I' street to lots 33 and 34. • An easement for emergency access has been submitted/or review. 3. The applicant shall provide revised plan showing the net square footage demonstrating compliance for lot area for any lot impacted by an access easement (Lots 14, 30, 31, 32 and 33). The satisfaction of this requirement is subject to the review and approval of the Development Services Project Manager prior to recording of the final plat. • The final lot closure calculations will demonstrate the lot areas of all lots meet the net square footage requirements. The closure calculations are provided as a part of the final plat submittal. 4. The applicant shall ensure all open space area including buffer impacted during construction shall be restored and enhanced if required prior to the recording of the final plat. The satisfaction of this requirement is subject to the review and approval of the Development Services Project Manager prior to final plat. • A landscape plan has been provided and approved for re-vegetation of the disturbed open space. 5. A draft of the document(s) shall be submitted to the City of Renton Development Services Division for review and approval by the City Attorney and Property Services section prior to the recording of the final plat. • A draft HOA document has been provided as part of the final plat submittal. The HOA is currently being reviewed by the City Attorney. 6. The applicant shall establish a maintenance agreement for the shared private access easements. Additionally, the applicant shall install a "Private Road" sign indicating addresses served from the private street at the intersection of the private street and public street. Additionally, these easements shall be posted for "No Parking" along the easements. This condition would ensure that emergency aid vehicles could find all residences located within the proposed subdivision. The satisfaction of this requirement is subject to the review and approval of the Development Services Project Manager prior to recording of the final plat. • This condition has been satisfied by approval of the construction plans, signs will be installed as indicated above. 7. The applicant shall record a public 15-foot wide pedestrian trail easement across Tracts A, B and C. A note shall be placed on the face of the plat. The trail shall be for future construction by the City to be accessible to the public. These requirements shall be subject to the review and approval of the Development Services Division prior to recording of the final plat. • The Parks Dept .has provided no indication of the location of the trail; discussions with the Parks Department since July 2006 has yet to yield a trail route. Therefore a note on the %OW Final Plat in reference to the open space tracts will state that the "Renton Parks Department has the right to construct a trail any where on the Open Space. " 8. The Open Space Tracts A, B, C and D shall be posted with signs indicating the area as Non- revocable Open Space and site for a future public trail connection. The maintenance agreement and responsible party(ies) shall be noted on the face of the plat and added to the CC &R's. This condition shall be subject to the review and approval of the Development Services Division prior to recording of the final plat. • The notes have been added to the face of the final plat map. 9. The establishment of Native Growth Protection Areas containing the areas determined to be wetland and/or buffer, stream and/or buffer and protected slope in accordance to the city code. A note shall be placed on the face of the plat designating the area, as Native Growth Protection Area and split rail fence shall be constructed along the perimeters of the tract with signs posted indicating the presence of an environmentally sensitive area prior to final plat approval. This condition shall be subject to the review and approval of the Development Services Division prior to recording of the final plat. • The notes have been added to the face of the final plat map. 10. The applicant shall provide documentation that any decommissioned wells are in compliance with code. ERC CONDITION COMPLIANCE: The application has complied with the 12 conditions imposed by the ERC (conditions to follow): 1. The applicant shall adhere to the recommendation of the geotechnical report prepared by Icicle Creek Engineers, Inc dated June 20, 2005 during site preparation and building construction. • The geotechnical recommendations were incorporated into the engineering plans and pond sizing. The final as-builts will provide certification from the Geotechnical Engineer on the actual infiltration rate o the pond. This condition will be satisfied upon submittal of Final as-built. 2. The applicant shall be required to perform all earthwork activities in the drier summer months (April — October) unless otherwise approved by the City's Development Services Division. • The project was granted approval to work all year due to soil conditions and limited tree clearing. Condition has been satisfied. 3. The applicant shall install a silt fence along the down slope perimeter of the area to be disturbed. The silt fence shall be in place before clearing and grading is initiated and shall be constructed in conformance with the specifications presented in the Vol. II 2001 DOE Stoiutwater Management Manual. This condition shall be required during the construction of both off-site and on-site improvements as well as building construction. • The erosion control for the project met the 2001 DOE standards; limited vegetation removal, silt fencing, shales, and a temp-pond were used. This condition has been satisfied. 4. Shallow drainage swales shall be constructed to intercept surface water flow and route the flow away from the construction area to a stabilized discharge point. Vegetation growth shall be established in the ditch by seeding or placing sod. Depending on site grades, it may be necessary to line the ditch with rock to protect the ditch from erosion and to reduce the flow rates. The design and construction of the drainage swales shall conform to the specifications presented in the Vol. II 2001 DOE Stormwater Management Manual. Temporary pipe systems can also be used to convey stormwater across the site. This condition shall be required during the construction of both off-site and on-site improvements as well as building construction. • Please note condition 3 above, this condition has been satisfied. 5. The project contractor shall perform daily review and maintenance of all erosion and sedimentation control measures at the site during the construction of both on-site and off- site improvements as well as building construction. 1:\Pian Review\Plan Review 2007\Langiey Ridge\Langley Ridge plat Report.doc • This condition is on-going and is being met. 6. The project Engineer shall submit weekly reports on the status and condition of the erosion control plan with any recommendations of change or revision to maintenance schedules to the Public Works Inspector. • The contractor has provided (and has staff a certified DOE erosion control expert, the erosion control reports have been provided to the City from the Certified DOE expert provided by Frontier Construction. This condition is being met and is on-going. 7. Certification of the installation, maintenance and proper removal of the erosion control facilities shall be required prior to recording of the plat. • The erosion control is currently still in operation. Prior to plat recording the required certifications will be provided 8. The applicant shall comply with the recommendations contained within the Wetland, Stream and Habitat Study dated June 30, 2005 prepared by Altmann Oliver Associates, LLC in regards to wetland and stream maintenance, monitoring and construction of the project. • The recommendations within this report 1t'ere incorporated into the design of the project. This condition has been met. 9. This project shall be subject to the 2005 King County Surface Water Analysis and Design Standards. • This condition has been met upon the approval of the civil construction drawings. New 10. The applicant shall pay the appropriate Fire Mitigation Fee based on a rate of$488.00 for each new single-family residence prior to the recording of the final plat. • Langley Development Group, Inc. will pay the necessary fee prior to recording of the final plat. 11. The Committee was advised that City regulations declare graffiti to be a Nuisance violation and also require the removal of the graffiti. The City's role and responsibility in removing graffiti on public and private properties was discussed. City staff representing Police, Parks & Community Services, and Planning/Building/Public Works have recently developed a coordinated approach for responding to reports of graffiti. The Committee concurs in staff's recommendation that Code Compliance function as the clearinghouse for graffiti reports, to allow for tracking, referral and enforcement.
