Item 6: Variance request justification statement:
1. The applicant suffers practical difficulties and unnecessary hardship and the
variance is necessary because of special circumstances applicable to subject
property, including:
a. Existing 1st floor bedrooms have no possible window egress
b. Existing 1st floor ceiling height is less than 7'
c. Existing 1st floor slab is below lake front grade and near ordinary high -
water line.
d. Existing stairs from 1st floor to 3rd floor is tight radius spiral.
Reconstruction of floors required to construct compliant stair and ceiling
heights.
e. 2nd floor ceiling height less than 7'
f. 3rd floor requires reconstruction of floor for proposed compliant stair
system.
2. The granting of the variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity and zone in
which subject property is situated;
a. The proposed modifications to the site structure is entirely consistent with
adjacent homes along this stretch of shallow lots along lake Was hington.
b. No work is proposed to be constructed water ward of existing house.
c. Building footprint alterations create no new impervious surfaces.
d. Building footprint maintains existing non-compliant set back to the south
e. Building footprint brings 10' setbacks along north property line into
compliance
f. Street side setbacks remain unchanged
3. This proposal does not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the
subject property is situated;
a. Site modifications improve property line setbacks to the north and
maintain existing property line setbacks to the south.
b. Footprint modifications are necessary to move bedrooms from 1 st floor,
construct compliant stairs, raise 1st floor equal with adjacent waterfront
grade, increase ceiling heights to normal elevations.
