City Clerk reports bid opening on 8/29/2006 for CAG-06-008,Activity Buildings ADA Upgrades; four bids; engineer's estimate $239,360;and submits staff recommendation to award the contract to low bidder, Regency NW Construction, Inc., in the amount of$270,912. Council concur. c. City Clerk reports bid opening on 9/7/2006 for CAG-06-152, Water Utility 2006 Emergency Power Generation; three bids;engineer's estimate $1,850,688; and submits staff recommendation to award the contract to low bidder, Wick Constructors, Inc.,in the amount of$2,248,896. PROCLAMATION A proclamation by Mayor Keolker was read declaring the week of September Race Equality and Inclusive 25 to 29, 2006, to be "Race Equality and Inclusive Communities Week" in the Communities Week- City of Renton, and encouraging all citizens to join in this special observance to September 25 to 29, 2006 reaffirm commitment to ensure racial equality and justice in the City. SPECIAL Finance and Information Services Administrator Michael Bailey introduced PRESENTATIONS State Auditor Brian Sonntag who read a letter from his office regarding Finance: State of Washington Renton's clean audit findings. He congratulated the City on its exemplary Audit Report record of no audit findings since 1999, which reflects the dedication of the Council and City staff to strong oversight of operations, good internal controls, and accurate financial reporting. Auditor Sonntag emphasized that Renton is a model for other entities in the State. He presented the letter to the Mayor who stated that the City takes its fiscal responsibilities very seriously. • Community Services: Liberty Mayor Keolker announced that the special presentation concerning the summer Park, Outdoor Cinema outdoor cinema series will occur at the Council meeting of 9/25/2006. Added Neighborhood Coordinator Norma McQuiller gave a report on Renton's EDNSP: Neighborhood Neighborhood Program. She stated that 13 neighborhood picnics were held this Program summer, ranging from 75 to 721 attendees. Ms. McQuiller relayed residents' appreciation for the picnics, who said they provide an opportunity to meet neighbors and provide a forum for discussion of neighborhood issues. Turning to neighborhood projects, she introduced Angela Laulainen and Jennifer Knickerbocker,project leaders for the North Renton Neighborhood Association's Sartori Educational Center landscaping project. Mses. Laulainen and Knickerbocker presented a pictorial depicting before and after photographs of the project. Ms. McQuiller stated that the purpose of the Neighborhood Program is to foster a greater sense of community among residents within their neighborhoods. She reported that grant funds in the amount of$37,000 are still available, and September 18,2006 Renton City Council Minutes Page 308 encouraged people to apply for a neighborhood project grant. Ms. McQuiller indicated that applications for the second round of funding are due on September 29. ADMINISTRATIVE Chief Administrative Officer Jay Covington reviewed a written administrative REPORT report summarizing the City's recent progress towards goals and work programs adopted as part of its business plan for 2006 and beyond. Items noted included: * The City of Renton is now offering "A Guide to Landlord/Tenant Issues," a brochure that contains information provided in part by the Washington State Attorney General's Office and addresses commonly asked questions from the perspectives of both the landlord and tenant. * The Renton Police Department now has a new Online Police Reporting system that allows citizens to file police reports directly into the Police Department. The system, which is available in English and Spanish, allows the public to file reports on incidents such as minor theft, malicious mischief, lost property, and non-injury hit and run at their convenience over the internet at epolice.rentonwa.gov. Reports filed online receive the same investigation and statistical analysis as reports filed by a police officer. AUDIENCE COMMENT Inez Petersen, PO Box 2041, Renton, 98056, read a letter from Highlands Citizen Comment: Petersen - Community Association (HCA) President Terry Persson,which stated that the Highlands Area HCA appreciates Council's intent to establish a citizen task force. The letter Redevelopment, Comp Plan requested that until the task force convenes to review the zoning and text Amends amendments applicable to the Highlands area, that the Highlands-related Comprehensive Plan amendments not be considered by the Planning Commission, and that the amendments not be adopted by Council. Additionally, the letter suggested simplifying the zoning and text amendments Citywide as they are not cost effective for the City to implement and monitor, and are not easy for citizens to understand and use. Citizen Comment: DeMastus - Sandel DeMastus, Highlands Community Association (HCA) Vice President, Highlands Community PO Box 2041, Renton, 98056, announced that the HCA is holding a picnic on Association Picnic Saturday, September 22, and she described the food and entertainment that will be provided at the event. Council President Corman indicated that he and his family will attend the picnic. Citizen Comment: Becraft- Zack Becraft, 505 Burnett Ave. S., Renton, 98056, voiced his opposition to Breach of Public Peace Ordinance 3281, Breach of the Public Peace. Mr. Becraft stated that his band Ordinance, Bands practices three to four times a week, and he has been informed that it is against the law. Pointing out that he knows of other bands that practice, Mr. Becraft asked to whom the ordinance applies. Police Chief Milosevich confirmed that he will discuss the matter with Mr. Becraft and report back to Council. Citizen Comment: McOmber- Howard McOmber, PO Box 2041, Renton, 98056,pointed out that the Planning Highlands Area Commission is considering Highlands area-related Comprehensive Plan Redevelopment, Comp Plan amendments prior to the formation of the task force. He asked that the Amends Highlands-related items be tabled until the task force provides its input towards the new vision for the Highlands area. UNFINISHED BUSINESS Community Services Committee Chair Nelson presented a report Community Services recommending concurrence in the staff recommendation to grant the waiver of Committee the Advisory Commission on Diversity's residency condition for member Board/Commission: Advisory Antonio Cube, Sr. per Mayor Keolker's request. CARRIED. for Member Human Services: 2007/2008 Community Services Committee Chair Nelson presented a report CDBG Funds Allocation recommending concurrence in the Human Services Advisory Committee recommendation for Community Development Block Grant(CDBG) funds allocation. The following recommendations for public services are for two years(2007/2008), with the second year being contingent upon performance and availability of funds: CDBG Public Services: Children's Home Society/Strengthening Families $10,000 Communities in Schools of Renton/Family Liaison Program $10,000 Emergency Feeding Program of Seattle&King County $10,000 Institute for Family Development/Parents&Children Together $10,472 Total $40,472 CDBG Capital Recommendations for 2007 only: City of Renton Housing Repair Program $200,000 Multi-Service Center/Employee Development Services Renton Project $40,812 ElderHealth Northwest/Renovation of Adult Day Health Care Center $40,813 Total $281,625 Planning and Administration: $40,472 Conditions for CDBG Projects: 1. All CDBG projects are subject to federal environmental review requirements of the National Environmental Policy Act(NEPA) as of the date of submittal of application. An environmental review of Renton- awarded CDBG projects must be completed by King County before contracts will commence. Costs of the NEPA review will be charged to the CDBG project. 2. All projects must comply with CDBG Program Regulations(24 CFR Part 570) and applicable King County Consortium policies as outlined in the King County Consortium Consolidated Housing and Community Development Plan for 2005-2009,as amended. 3. All CDBG projects shall comply with all applicable federal, state, and city laws including without limitation, all city codes, ordinances,resolutions, standards and policies, as now exist or hereafter adopted or amended, including land use and/or building permit requirements and processes. The Committee also recommended adoption of the 2007/2008 CDBG Contingency Plan as recommended by the Human Services Advisory September 18,2006 Renton City Council Minutes Page 311 Committee should the amount of available funding increase or decrease. For an increase in public service programs funding, the following applies: 1. If the increase is less than $5,000, the additional funding will be considered capital funding. 2. If the increase is $5,000 or more, Community Health Centers of King County's Dental Program will be funded to a maximum of$19,000. 3. If funds remain after funding Community Health Centers, the Human Services Advisory Committee will conduct a request for proposal. For a decrease in public service programs funding, the following applies: 1. The Institute for Family Development funds will be decreased until the minimum$10,000 funding level is reached. 2. Additional decreases will be made first to Children's Home Society, then to the Institute for Family Development as needed. To offset the reductions in CDBG, allocations to the lowest ranked funded General Funded agencies will be reduced in order as needed to fund Children's Home Society,and Institute for Family Development to the$10,000 level. For an increase in capital projects funding, the following applies: 1. Any increase will be allocated to the Recovery Centers of King County contingent upon them receiving funding from the King County Consortium for 2007/2008 so that Renton funds may be administered under that contact. 2. If other funds become available to fund the Multi-Service Center Employment Program at the recommended level, capital funds originally allocated to the Multi-Service Center will go to the Recovery Centers of King County under the conditions stated above. For a decrease in capital projects funding, any decrease will be applied proportionately to the Multi Service Center Employment Program and ElderHealth Northwest. If there is an increase in planning and administration funding, it will be allocated to planning and administration to cover administrative costs for Renton's CDBG program(CDBG covers approximately 70 percent of the cost of the contract specialist; the General Fund covers 30 percent). If there is a decrease in planning and administration funding, funding is to be decreased for CDBG administrative activities. CARRIED. The following ordinance was presented for second and final reading and adoption: September 18,2006 Renton City Council Minutes Page 312 Ordinance#5222 An ordinance was read amending the 2006 Budget by reflecting revenue in the EDNSP: Revenue Reflection amount of$4,610 from The Boeing Company and $33,080 from Harvest for Blumen Consulting Transwestern Lakeshore to cover expenses amounting to$37,690 for contracts Contracts, Budget Amend with Blumen Consulting Group for Boeing Plant sub-district IA and lB consistency analysis work and subsequent appeal. MOVED BY CLAWSON, SECONDED BY NELSON, COUNCIL ADOPT THE ORDINANCE AS READ. ROLL CALL: ALL AYES. CARRIED. NEW BUSINESS Council President Corman stated that he talked with Terry Persson, Highlands Planning: Highlands Area Community Association President, who expressed concern regarding the Redevelopment, Comp Plan Highlands area-related Comprehensive Plan text amendments. Mr. Corman Amends inquired as to their status. Councilman Clawson reported that the Planning and Development Committee reviewed the text amendments at its last meeting. He explained that the Comprehensive Plan is an overlay of all the lands of the City as to the general use of that area. Within each Comprehensive Plan designation there may be different zones to implement that designation. Mr. Clawson said it was not his understanding that work on the Highlands-related Comprehensive Plan issues would be placed on hold for the Highlands area citizen task force. He indicated that holding the items would represent a change of course, and need careful consideration. Economic Development Administrator Alex Pietsch stated that based upon public and Council input and goals, staff developed a revised concept for a zoning package. He explained that in order to make the new zoning construct work, some amendments need to be made to the Comprehensive Plan. Changes to zoning cannot take place without the zoning being consistent with the Comprehensive Plan. Mr. Pietsch reported that staff is working through the zoning process. He pointed out that the subject of a Highlands task force is in the Planning and Development Committee and staff awaits Council direction on how to move forward with the task force. Mr. Pietsch stated his understanding that staff is to move forward with creating new zoning, and then the task force will be engaged to discuss how the neighborhood moves forward after that. Discussion ensued as the role of the task force. Mr. Corman stated that it is important that staff, the Planning Commission,the Planning and Development Committee, and the HCA continue to work towards increasing the degree of trust,because ultimately, everyone wants to succeed. Mr. Clawson pointed out that the Planning Commission is an advisory body, and is one of the first steps in the zoning process. (See page 313 for additional comments on the matter). AUDIENCE COMMENT Sandel DeMastus, Highlands Community Association(HCA)Vice President, Citizen Comment: DeMastus- PO Box 2041, Renton, 98056, indicated that she forgot to mention in her earlier Highlands Community comments that the HCA picnic will be held at the Highlands Neighborhood Association Picnic, Pit Bull Center. On another subject, she referred to an article in the King County Dog Attack Journal regarding a recent pit bull attack in the Renton Highlands,which stated it was the 25th dog attack in Renton this year. Ms. DeMastus asked that the City take another look at the dangerous dog issue. Police Chief Milosevich stated that the dog attack statistic quoted in the article is too high. He reported that 15 dog bite incidents have occurred this year,two of which required hospitalization. September 18,2006 Renton City Council Minutes Page 313 Citizen Comment: McOmber- Howard McOmber, PO Box 2041, Renton, 98056, stressed the importance of Highlands Area Highlands area residents having input in the area's zoning. He indicated that the Redevelopment, Comp Plan proposed text amendments are complicated and cause difficulty for property Amends owners to develop their property. Mr. McOmber asked that the City work together with residents, and utilize the task force in developing the zoning for the area rather than utilizing it after the zoning process is completed. He pointed out that the neighborhood has existed for a long time and the zoning process does not need to be rushed. Citizen Comment: Petersen - Inez Petersen, PO Box 2041, Renton, 98056, expressed concern that the City is Highlands Area violating State law by not completing the SEPA (State Environmental Policy Redevelopment, Comp Plan Act)process prior to consideration of changes to the Comprehensive Plan, Amends zoning, and zoning code. Emphasizing that the Highlands community wants to be directly involved in the Comprehensive Plan amendment process, she said rushing the process is not necessary. Ms. Petersen asked that Council table the Highlands-related Comprehensive Plan amendment items. Councilwoman Palmer indicated there is confusion as to when in the redevelopment process the task force's role comes into play. She commented that all along, citizens have said they want to be heard and they want to be involved. Councilman Clawson said that the Planning and Development Committee cannot take any action on the task force until it discusses the matter. He noted that although he does not think it is necessary, if Council is unhappy with the process and wants the Committee to stop, the matter can be referred to Committee of the Whole for discussion and the brakes can be applied to the Comprehensive Plan amendments. Councilman Persson stated his understanding to be that the Administration was going to take all of the input and formulate a plan that would be the starting point for the task force. He noted that the amendments have not yet come before the Council. Mayor Keolker advised that the Planning Commission is obtaining public input through its public hearings process before the matter comes before Council. She indicated that the Administration is ready to support whatever Council decides regarding the task force. Councilman Law stated that Council makes the final decisions, but the decisions will be made with.community input. He also expressed confusion regarding the timing of the task force's role. The brochure contains valuable information provided in part by the Washington State Attorney General's Office and addresses commonly asked questions from the perspectives of both the landlord and the tenant. Copies may be requested by phone at 425.430.6550 or by email at ggamba@ci.renton.wa.us. The information also may be downloaded from the City's website at www.ci.renton.wa.us. • A grand opening was held on September 7th for a transitional housing facility for deaf and deaf/blind women and children who are victims of domestic violence and sexual assault. The City of Renton's Community Development Block Grant capital allocation of$30,000 in June 2003 helped Abused Deaf Women's Advocacy Services acquire the land and leverage other support for the project, which is the first of its kind in the nation. The 19 housing units were constructed with the adaptive aids and technology required for the residents. POLICE DEPARTMENT • The Renton Police Department is proud to announce its new Online Police Reporting system that allows citizens to file police reports directly into the police department. The Renton Police Department is among the first in Washington and one of only 20 departments nationwide using the system, which is available in English and Spanish and allows the public to file reports on incidents such as minor theft, malicious mischief, lost property, and non- injury hit and run at their convenience over the interne. Incident reports filed online receive the same investigation and statistical analysis as reports filed by a police officer. But more Council direction is needed. The purpose of this letter is twofold; first, to ask that the Highlands-related items be removed from the Planning Commission agenda for Sep 201h, and second, to ask for a City-wide review of zoning and text amendments. First, Planning Commission public hearing The HCA wishes to advise Councilmembers that the Administration has scheduled a Public Hearing for September 20th as part of a regularly scheduled Planning Commission meeting. This Public Hearing covers the following Highlands-related items which are described on the City's website at: http://www.arenton.wa.usfedrispfpcinfo.htm #2006-M-6 Map amendments #2006-M-7 Map amendments - #2006-T #2006-T-2 Text amendments #2006-T-3 Text amendment #2006-T-4 Text amendment re capital projects It goes against reason for the City Administration to proceed with COMP PLAN Amendments which affect the Highlands Study Area as part of their "normal procedures'' at the same time that the Council is _ _._ trying -to facilitate a.'..Task Force to directly involve Citizens of the Study Area in the development of NEW zoning and NEW text amendments which Will, in the end, affect the COMP PLAN. The HCA would ask that the City Council halt to this attempted "END RUN" until the Highlands Citizen Task Force has completed its review and NEW VISION is before the Council. This would mean that the Council would vote tonight to remove the items listed above from the agenda of the September 20th Planning Commission, pending revision as a result of the Highlands Citizen Task Force. OR it would mean that the Planning Commission would be instructed to withhold any vote until AFTER a later public hearing is held based on the NEW VISION for the Highlands. Either option requires a Motion and a vote tonight. Second, Simplification of zoning and text amendments As we reviewed the information mailed to Citizens on the five items above and published in the King County Journal (attached), it appeared to us that the zoning and text amendments City-wide are far too detailed. As a result, they are not cost effective for the City to implement and monitor and not easy for Citizens to understand and use. This supposition is easy to validate simply by looking at the 93 pages of Text Amendments which are available on the City's website at: http://rentonnet.org/intemetappsifiles/ednsp/pcinfo/pc041906/zoningtextvii.pdf Please take time to read this document, and there are additional pages I did not reference. But the 93 pages make a strong argument for`"simplification." Please do not vote to adopt this document until it has been simplified. The Administration has focused on a year-end "drop dead" date for adoption of COMP PLAN Amendments. But the Council cannot be penalized for taking time do things right. Closing We are excited to see the Citizen Task Force begin its work and anticipate a wonderful NEW VISION for the Highlands Study Area. We hope that you will consider the HCA request to postpone adoption of any COMP PLAN Amendments until the Citizen Task Force has had a chance to convene and finish its collaboration on NEW zoning and NEW text amendments ' applicable to Highlands Redevelopment. ' We hope too that you will consider our suggestion to simplify zoning and text amendments City-wide so they are-easy to understand and_easy.to implement. Facilities staff has reviewed the low bid for completeness, inclusion of all required forms, acknowledgements of addenda, and mathematical correctness of the bid. All the paperwork is in order. • The architect's February, 2006 estimate for the project construction cost was $239,360.00. • Including previously contracted architectural services, as well as some " re preliminary concrete approach way work done this year at Thomas Teasdale Park, the low bid of$270,912.00 puts the project over the amount Facilities budgeted for the project. The subject site is located at Edmonds Ave NE and NE 21st St. The new plat is located in Section 4, Twp. 23 N.Rng. 5 E. 6. The subject site is a 4.37 acre parcel. 7. The Preliminary Plat received City of Renton Council approval on February 7,2005. Italy 8. The property is located within the R-8. 9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan. 10. The Preliminary Plat was subject to a number of conditions as a result of both environmental review and plat review. The applicant has complied with the conditions imposed by the ERC: 1. a. The applicant shall comply with the recommendations contained within the Geotechnical Report prepared by Earth Consultants Inc. dated August 26, 2004 with regard to site preparation and construction The development has complied with the recommendation in the geotechnical report. b. Temporary Erosion Control measures shall be installed maintained in accordance with the Department of Ecology Standards to the satisfaction of the representative of the Development Services Division for the duration of the project's construction. The on site coordinator verified that all sedimentation and control measures were working. g. The applicant shall comply with the 1998 King County Surface Water Design Manual Level 2 for the drainage control plan. The storm drainage was designed in accordance with the 1998 KC Surface Water Design Manual,Level 2. 3. STAFF CONTACT: Rebecca Lind, Planning Manager(x6588) SUBJECT: East Renton Plateau Citizen Task Force ISSUE: Should the City convene an East Renton Plateau Citizen Task Force to provide community based planning recommendations to the City of Renton? RECOMMENDATION: Form an East Renton Plateau Citizen Task Force that will begin meeting in September 2006. BACKGROUND SUMMARY: The 2,126-acre East Renton Plateau was included in the Renton Potential Annexation Area(PAA) in the early years of growth management. Incremental development in this area is now occurring both with and without annexation. Area residents continue to express concerns about future land use and planning and how development relates to transportation and public facilities. At present time, most of the area is designated in the Comprehensive Plan for Residential Low Density(RLD) land use. The proposed Task Force would convene to review the adopted Comprehensive Plan vision for the East Renton Plateau. The Task Force would formulate recommendations on area pre-zoning and on community planning issues such as transportation,parks, community character, and the transition from urban to rural areas. The Task Force membership should reflect commercial, community,property owner, and resident interests and a range of locations in the PAA. It is recommended that the Task Force consist of nine members, as this is a small enough number to provide staffing, but large enough to provide a range of representation. The attached list of potential Task Force members includes individuals responding to the City's Renton Reporter article calling for volunteers, the CARE organization's contact lists, and the Four Creeks Community Council. This process recognizes the Task Force and provides direction for its work program. Regular meetings of the Task Force will be scheduled with staffing and support provided by the Department of Economic Development,Neighborhoods, and Strategic Planning and the City's outreach consultants, PRR. The East Renton Plateau area is characterized by lower density single-family development on septic systems; parcel sizes are large, often allowing for further subdivision once sewer is provided. Generally the area is in transition from a pre-GMA low-density area to a residential area with urban infill development. There are several processes and actions occurring simultaneously in the East Renton Plateau Area. • Properties are annexing into the City continuously through the 60%petition process and developing according to Renton standards. • Some properties are included in the proposed Preserve Our Plateau Annexation election annexation area. This proposal includes 1,475 of the larger 2,126-acre PAA. • Some properties are vested to Renton out of city sewer availabilities, and these properties are developing under King County development standards. • Renton enacted a sewer moratorium in the area to suspend issuance of sewer availabilities to allow the electorate the opportunity to decide the annexation question. • County residents approached King County Council and staff to request consideration of community planning, interlocal agreements, or zoning to address the coordination of land use, transportation, and community identity issues. Community members have also asked for resolution of differences between County and City development standards. • With the pressure of continuing development, community members are asking for consideration of a community planning effort to build community identity, coordinate land use and transportation, and provide some form of grass roots input into how the area urbanizes. Scope of Work 1. Identification of a list of issues and topics that Task Force members define as important to residents of the East Renton Plateau Potential Annexation Area based on work done by the community through the CARE organization. The CARE organization already formed citizen committees and solicited lists of issues through e- mail and community meetings. 2. Briefing on Pre-zoning proposal. 3. SUMMARY OF ACTION: The Boundary Review Board for King County in June expanded the boundaries of this annexation from 7.18-acres to 24.0 acres. The site now abuts the City on its southern, western, and northern boundaries. The site is designated Residential Single Family and Residential Low Density on the City's Comprehensive Plan Land Use Map and would need to be zoned R-4 and R-8 to be consistent with these land use designations. The Council held the first of at least two required public hearings on future zoning on August 7, 2006 and at that time accepted the fmdings and decision of the BRB expanding the boundaries of this annexation. Consideration was given to possible future R-4 and R-8 zoning for the site consistent with the Comprehensive Plan and staff were directed to draw up the appropriate zoning and annexation ordinances. Setting the second public hearing for October 2, 2006 will comply with state law, which requires that these public hearings be held at least 30-days apart. RECOMMENDATION: That Council rezone the non-street portions of the expanded annexation site as follows: those portions designated Residential Low Density on the Comp Plan Land Use Map, should be zoned R-4, four units per net acre, and those portions designated Residential Single Family on the Comp Plan Land Use Map should be zoned R-8, eight units per net acre. BACKGROUND SUMMARY: The Council accepted a 60% Direct Petition to Annex approximately 7.18-acres in November 2005 (Figure 1) for this annexation in November 2005. At that time, Council authorized the administration to submit a Notice of Intent package to the Boundary Review Board and invoke its jurisdiction so that it could consider expanding the boundaries of this annexation to the north. The BRB held a public hearing on the original annexation site on May 22, 2006, to consider the City's request to expand the boundaries of this annexation to the north. The BRB issued its resolution and hearing decision on June 9, 2006, expanding the boundaries of Querin Annexation to 24.0-acres Aiks ,,_ (see Figure 2). h:\ednsp\paa\annexations\querin\expansion issue paper.doc Querin Annexation-Expansion Page 2 of 2 July 6,2006 Zoning: When this area is brought into the City, zoning has to be consistent with the City's Comprehensive Plan Land Use Map. Currently, the Comp Plan shows two land use designations for the expanded annexation site. The original annexation site south of SE 112th Place is designated Residential Single Family (RS) as is the expanded area on the west side of 142nd Avenue SE. These areas would typically be zoned R-8, eight units per net acre, upon annexation. The larger area north of SE 112th Place and west of 142"d Avenue SE is designated Residential Low Density on the Comp Plan Land Use Map and would most likely be zoned R-4, four units per net acre, upon annexation. R-4 zoning is more consistent with those properties adjacent and abutting Honey Creek. Fiscal Analysis: Fiscally, the expanded annexation area is estimated to create a surplus for the City of approximately $24,251 a year in 2006 dollars at full build out. A one-time parks acquisition and development cost attributable to this annexation is estimated to be approximately $40,489. Also, as noted in the previous issue papers, the proposed annexation complies with most of the City's annexation policies. CONCLUSION: Pursuant to RCW 35A.14.120, the expanded Querin Annexation has been determined by the BRB to be consistent with its objectives, relevant provisions of the Growth , Management Act, and the County's and City's Comprehensive Plans. It also appears consistent with the City's Business Plan in that this annexation would benefit the City. To be consistent with the City's Comp Plan, future zoning should be R-4 and R-8, with R-4 being applied to the more environmentally sensitive areas along Honey Creek. BACKGROUND SUMMARY: The Surface Water Utility uses the Storm and Surface Water Management Plan (Plan) as a guide to manage, maintain and improve storm and surface water systems within the City. The Plan is used to identify regulatory mandates and long-term planning issues related to the changing stormwater regulatory requirements. Since the last Storm and Surface Water Management Plan was completed in 1995, many of the capital improvement projects have been implemented and completed. A new plan is needed to assist in complying with future surface water regulations issued by state and federal agencies, including the Endangered Species Act, the National Pollutant Discharge Elimination System Phase II, and compliance with the Puget Sound Water Quality Management Plan. These regulations will affect how the City operates its stormwater program. III ITEMS TO BE FURNISHED TO THE CONSULTANT BY THE CITY The City will furnish the Consultant copies of documents which are available to the City that will facilitate the preparation of the plans, studies, specifications,and estimates within the limits of the assigned work. All other records needed for the study must be obtained by the Consultant. The Consultant will coordinate with other available sources to obtain data or records available to those agencies. The Consultant shall be responsible for this and any other data collection to the extent provided for in the Scope of Work. City will provide to Consultant all data in City's possession relating to Consultants services on the project. Consultant will reasonably rely upon the accuracy,timeliness, and completeness of the information provided by the City. Should field studies be needed,the Consultant will perform such work to the extent provided for in the Scope of Work. The City will not be obligated to perform any such field studies. All such material, including working documents,notes,maps,drawings,photo,photographic negatives,etc.used in the project, shall become and remain the property of the City and may be used by it without restriction. Any use of such documents by the City not directly related to the project pursuant to which the documents were prepared by the Consultant shall be without any liability whatsoever to the Consultant. All written documents and products shall be printed on recycled paper when practicable. Use of the chasing-arrow symbol identifying the recycled content of the paper shall be used whenever practicable. All documents will be printed on both sides of the recycled paper, as feasible. V TIME OF BEGINNING AND COMPLETION The work detailed in the Scope of Work will be performed according to Exhibit B, Time Schedule of Completion, attached hereto and incorporated herein as though fully set forth. It is agreed that all the Consultant's services are to be completed and all products shall be delivered by the Consultant unless there are delays due to factors that are beyond the control of the Consultant. The Consultant shall not begin work under the terms of this Agreement until authorized in writing by the City. If, after receiving Notice to Proceed,the Consultant is delayed in the performance of its services by factors that are beyond its control,the Consultant shall notify the City of the delay and shall prepare a revised estimate of the time and cost needed to complete the Project and submit the revision to the City for its approval. Time schedules are subject to mutual agreement for any revision unless specifically described as +rave otherwise herein. Such payment shall be full compensation for work performed or services rendered and for all labor,materials, supplies, equipment,and incidentals necessary to complete the work. All billings for compensation for work performed under this Agreement will list actual time(days and/or hours)and dates during which the work was performed and the compensation shall be figured using the rates in Exhibit C. Payment for this work shall not exceed$248,671.00 without a written amendment to this contract, agreed to and signed by both parties. Cost Plus Net Fee Payment for work accomplished shall be on the basis of the Consultant's actual cost plus a net fee. The actual cost includes direct salary cost,overhead, and direct non-salary cost. 1. The direct salary cost is the salary expense for professional and technical personnel and principals for the time they are productively engaged in the work necessary to fulfill the terms of this Agreement. The direct salary costs are set forth in the attached Exhibit C and by this reference made a part of this Agreement. 2. The overhead costs as identified on Exhibit C are determined as 182.31 percent of the direct salary cost and by this reference made a part of this Agreement. The overhead cost rate is an estimate based on currently available accounting information and shall be used for all progress payments over the period of the contract. 3. The direct non-salary costs are those costs directly incurred in fulfilling the terms of this Agreement, including,but not limited to travel, reproduction,telephone, supplies, and fees of outside consultants. `"• The direct non-salary costs are specified in Exhibit C,Cost Estimate. Billings for any direct non-salary costs shall be supported by copies of original bills or invoices. Reimbursement for outside consultants and services shall be on the basis of times the invoiced amount. 4. The net fee, which represents the Consultants profit shall be 15 percent of direct salary plus overhead costs. This fee is based on the Scope of Work and the estimated labor hours therein. In the event a supplemental agreement is entered into for additional work by the Consultant,the supplemental agreement will include provision for the added costs and an appropriate additional fee. The net fee will be prorated and paid monthly in proportion to the percentage of the project completed as estimated in the Consultant's monthly progress reports and approved by the City. Any portion of the net fee not previously paid in the monthly payments shall be included in the final payment, subject to the provisions of Section XI entitled TERMINATION OF AGREEMENT. 5. Progress payments may be claimed monthly for direct costs actually incurred to date as supported by detailed statements, for overhead costs and for a proportionate amount of the net fee payable to the Consultant based on the estimated percentage of the completion of the services to date. Final payment of any balance due the Consultant of the gross amount earned will be made promptly upon its verification by the City after completion and acceptance by the City of the work under this Agreement. Acceptance, by the Consultant of final payment shall constitute full and final satisfaction of all amounts due or claimed to be due. Payment for extra work performed under this Agreement shall be paid as agreed to by the parties hereto in writing at the time extra work is authorized. (Section VIII"EX IRA WORK"). 'tire To provide a means of verifying the invoiced salary costs for consultant employees,the City may conduct employee interviews. Acceptance of such fmal payment by the Consultant shall constitute a release of all claims of any nature,related to this Agreement,which the Consultant may have against the City unless such claims are specifically reserved in writing and transmitted to the City by the Consultant prior to its acceptance. Said final payment shall not,however, be a bar to any claims that the City may have against the Consultant or to any remedies the City may pursue with respect to such claims. The Consultant and its subconsultants shall keep available for inspection,by the City, for a period of three years after final payment,the cost records and accounts pertaining to this Agreement and all items related to, or bearing upon,these records. If any litigation, claim or audit is started before the expiration of the three-year retention period, the records shall be retained until all litigation,claims or audit findings involving the records have been resolved. The three-year retention period starts when the Consultant receives final payment. VII CHANGES IN WORK The Consultant shall make all such revisions and changes in the completed work of this Agreement as are necessary to correct errors appearing therein,when required to do so by the City,without additional compensation. Should the City find it desirable for its own purposes to have previously satisfactorily completed work or parts thereof revised,the Consultant shall make such revisions,if requested and as directed by the City in writing. This 'ter✓ work shall be considered as Extra Work and will be paid for as provided in Section VIlI. VIII EXTRA WORK The City may desire to have the Consultant perform work or render services in connection with the Project in addition to or other than work provided for by the expressed intent of the Scope of Work. Such work will be considered as Extra Work and will be specified in a written supplement which will set forth the nature and scope thereof. Work under a supplement shall not proceed until authorized in writing by the City. Any dispute as to whether work is Extra Work or work already covered under this Agreement shall be resolved before the work is undertaken. Performance of the work by the Consultant prior to resolution of any such dispute shall waive any claim by the Consultant for compensation as Extra Work. IX EMPLOYMENT The Consultant warrants that it has not employed or retained any company or person,other than a bona fide employee working solely for the Consultant,to solicit or secure this contract and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the Consultant, any fee, commission,percentage,brokerage fee,gifts or any other consideration, contingent upon or resulting from the award or making of this contract. The Consultant shall not engage, on a full or part-time basis, or other basis, during the period of the contract, any professional or technical personnel who are,or have been at any time during the period of this contract, in the employ of the City except regularly retired employees,without written consent of the City. If during the time period of this Agreement,the Consultant finds it necessary to increase its professional,technical, or clerical staff as a result of this work,the Consultant will actively solicit minorities through their advertisement and interview process. X NONDISCRIMINATION The Consultant agrees not to discriminate against any client, employee or applicant for employment or for services because of race, creed,color,national origin,marital status, sex, age or handicap except for a bona fide occupational qualification with regard to,but not limited to the following: employment upgrading;demotion or transfer; recruitment or any recruitment advertising; layoff or termination's;rates of pay or other forms of compensation; selection for training;rendition of services. The Consultant understands and agrees that if it violates this Non- Discrimination provision,this Agreement may be terminated by the City and further that the Consultant shall be barred from performing any services for the City now or in the future,unless a showing is made satisfactory to the City that discriminatory practices have terminated and that recurrence of such action is unlikely. XI TERMINATION OF AGREEMENT A. The City reserves the right to terminate this Agreement at any time upon not less than ten(10)days written notice to the Consultant, subject to the City's obligation to pay Consultant in accordance with subparagraphs C and D below. B. In the event of the death of a member,partner or officer of the Consultant,or any of its supervisory personnel assigned to the project,the surviving members of the Consultant hereby agree to complete the work under the terms of this Agreement, if requested to do so by the City. This section shall not be a bar to renegotiations of this Agreement between surviving members of the Consultant and the City,if the City so chooses. In the event of the death of any of the parties listed in the previous paragraph, should the surviving members of the Consultant,with the City's concurrence,desire to terminate this Agreement,payment shall be made as set forth in Subsection C of this section. In the event this Agreement is terminated by the City other than for fault on the part of the Consultant,a final payment shall be made to the Consultant for actual cost for the work complete at the time of New termination of the Agreement,plus the following described portion of the net fee. The portion of the net fee for which the Consultant shall be paid shall be the same ratio to the total net fee as the work complete is to the total work required by the Agreement. In addition,the Consultant shall be paid on the same basis as above for any authorized extra work completed. No payment shall be made for any work completed after ten(10)days following receipt by the Consultant of the Notice to Terminate. If the accumulated payment made to the Consultant prior to Notice of Termination exceeds the total amount that would be due as set forth herein above,then no final payment shall be due and the Consultant shall immediately reimburse the City for any excess paid. D. In the event the services of the Consultant are terminated by the City for fault on the part of the Consultant,the above stated formula for payment shall not apply. In such an event the amount to be paid shall be determined by the City with consideration given to the actual costs incurred by the Consultant in performing the work to the date of termination, the amount of work originally required which was satisfactorily completed to date of termination,whether that work is in a form or of a type which is usable to the City at the time of termination,the cost to the City of employing another firm to complete the work required and the time which may be required to do so,and other factors which affect the value to the City of the work performed at the time of termination. Under no circumstances shall payment made under this subsection exceed the amount which would have been made if the formula set forth in subsection C above had been applied. E. In the event this Agreement is terminated prior to completion of the work,the original copies of all Engineering plans,reports and documents prepared by the Consultant prior to termination shall become the property of the City for its use without restriction. Such unrestricted use not occurring as a part of this project, shall be without liability or legal exposure to the Consultant. Now F. Payment for any part of the work by the City shall not constitute a waiver by the City of any remedies of any type it may have against the Consultant for any breach of this Agreement by the Consultant,or for failure of the Consultant to perform work required of it by the City. Forbearance of any rights under the Agreement will not constitute waiver of entitlement to exercise those rights with respect to any future act or omission by the Consultant. XII DISPUTES Any dispute concerning questions of facts in connection with work not disposed of by agreement between the Consultant and the City shall be referred for determination to the Director of Planning/Building/Public Works or his/her successors and delegees,whose decision in the matter shall be fmal and conclusive on the parties to this Agreement. In the event that either party is required to institute legal action or proceedings to enforce any of its rights in this Agreement,both parties agree that any such action shall be brought in the Superior Court of the State of Washington, situated in King County. XIII LEGAL RELATIONS The Consultant shall comply with all Federal Government, State and local laws and ordinances applicable to the work to be done under this Agreement. The Consultant shall secure general liability,property damage,auto liability,and professional liability coverage in the amount of$1.0 million,with a General Aggregate in the amount of$2.0 million,unless waived or reduced by the City. The Consultant shall submit a completed City of Renton Insurance Information Form, and the Standard Acord Certification Form prior to the execution of the contract. The City of Renton will be named as Additional Insured(s)on(CONTRACTOR'S)policy,with that coverage being primary and non-contributory with any other policy(ies)available to the City. A copy of the endorsement shall be provided to the City. The Consultant shall also submit copies of the declarations pages of relevant insurance policies to the City within 30 days of contract acceptance if requested. The Certification and Declaration page(s)shall be in a form as approved by the City. If the City's Risk Manager has the Declaration page(s)on file from a previous contract and no changes in insurance coverage has occurred, only the Certification Form will be required. The limits of said insurance shall not,however,limit the liability of Consultant hereunder. All coverages provided by the Consultant shall be in a form,and underwritten by a company acceptable to the City. *id The City will normally require carriers to have minimum A.M.Best rating of A XII. The Consultant shall keep all required coverages in full force and effect during the life of this project, and a minimum of forty five days'written notice shall be given to the City prior to the cancellation of any policy. The Consultant shall verify,when submitting first payment invoice and annually thereafter,possession of a current City of Renton business license while conducting work for the City. The Consultant shall require, and provide verification upon request,that all subconsultants participating in a City project possess a current City of Renton business license. The Consultant shall provide, and obtain City approval of,a traffic control plan prior to conducting work in City right-of-way. The Consultant's relation to the City shall be at all times as an independent contractor. XIV SUBLETTING OR ASSIGNING OF CONTRACTS The Consultant shall not sublet or assign any of the work covered by this Agreement without the express consent of the City. XV ENDORSEMENT OF PLANS The Consultant shall place their certification on all plans, specifications, estimates or any other engineering data furnished by them in accordance with RCW 18.43.070. Once these needs are identified,the SSWM planning process will be used to determine a recommended program in these areas that are both affordable and sustainable. The need for the SSWM Plan has increased in recent years for several reasons,some of which indude: o The Surface Water Utility prepared a draft Comprehensive Stormwater Plan in 1995. While some of the policy and program recommendations are still viable,others may no longer be applicable. In addition,the City has constructed many of the capital projects identified in the 1995 Plan and there is a need to review existing and future capital project needs and prioritize future capital projects. o The City's Surface Water Utility is subject to a changing regulatory environment, including Endangered Species Act(ESA),National Pollutant Discharge Elimination System(NPDES) Phase II Municipal Storm Water Permit,and compliance with the Puget Sound Water Quality Management Plan. These regulations will affect how the City operates its stormwater program and will affect how other Sections or Departments have to conduct business. o The City's operations and maintenance program has not increased staff since 1992. However,the City has and continues to annex more area into the City and there is more storm system infrastructure to maintain. New development within the City has increased the amount of storm system infrastructure owned,operated, maintained and replaced by the City. Thus,since 1992 the level of service that the City has provided in terms of system maintenance has decreased due to the increase in storm system infrastructure. An analysis of the maintenance program is necessary to select the desired level of service. Currently the City uses the 1990 King County Surface Water Design Manual (KCSWDM). The 2005 KCSWDM and the Ecology 2005 Stormwater Management Manual have superseded the drainage manual and associated developer standards for Western Washington. Currently,the City requires the use of the 2005 KCSWDM (or other drainage standards for certain parts of the City) through its SEPA process, which is not an ideal approach. ❑ The need to better manage the increase in runoff from land use changes as allowed by the City's Comprehensive Plan is necessary in order to prevent increased flood hazards,protect public safety,protect property,minimize the cost of future capital improvement needs,protect water quality and protect fish habitat. The need to control storm water flow and protect water quality from increased runoff due to land use changes requires future infrastructure costs to adequately protect critical areas such as streams,wetlands and fish habitat. The protection is a requirement of the Growth Management Act. ❑ Information technology used to inventory and model existing and future systems has dramatically evolved in recent years. The NPDES Phase II Municipal Storm Water Permit requires GPS Mapping of storm system outfalls and it's contributing upstream system. It is time for the City to assess potential gaps in its existing GIS system and to develop potential strategies on how to incorporate these innovations in the City's existing stormwater mapping and inventory system. Now The SSWM Plan is intended to identify the resources that are needed to solve existing and prevent future surface water problems in the City and position the City to be in compliance with current and pending regulations. Taking into account the increased demands on the Surface Water Utility,the Plan will also be the basis for evaluating the financial resources and utility rates needed to meet the identified program needs. Task 1–Project Management The Consultant will perform the following project management activities over the anticipated 15-month project duration: 1. Project setup including developing a work plan,schedule and staffing assignments. 2. Conduct monthly financial administration,budget management,and invoicing. 3. Provide on-going project controls and monitoring for monthly project status reports 4. R. W. To expedite consultant review of available City reports and studies,the City will summarize sections from each pertinent report. Start with the 1995 Plan and use recent data to identify significant changes from conditions prevalent when the 1995 Plan was prepared. (b.) Identify NPDES Phase II requirements not being met with the existing City stormwater program. (c.) The Consultant will also outline the general list of activities and technical requirements stemming from a listing on Ecology's 303(d)list indicating an impaired water body due to water quality problems. Task 3.2 Problem Review 1. Identification of Problem Areas within the City: The City will provide the Consultant a summary of any known flooding,water quality,and habitat problem areas based upon the best available information include drainage complaint database and input from the maintenance and engineering staff regarding knowledge existing drainage problems. This will include an AutoCadd map showing problem locations and an Excel table that indudes the following information(when available):short description of problem and its history, degree of the problem,any evaluation done to date,enforcement actions,any cost estimates for corrective action that have been done to date,and the source of the problem identification. The Consultant will build upon the preliminary problem summary and map to add any additidnal problems identified through the review of the materials in Task 3.1 and meeting with the City. Based on this information the Consultant will add to the summary convert it to an access database. Identification of Problem Areas in Annexation Area: The City will work to categorize the problems between those within the existing City boundary limits (Task 3.2.1) and those �u• within the potential annexationarea (Task 3.2.2). Less effort will be expended-on those problems within the potential annexation area,except for areas that are in process of being annexed within the immediate future,with the City leading the data gathering and documentation of these problem areas. The City will provide the data on these problems in a format consistent with the consultant's summary table described above. The Consultant will include theses problems in the access database. 3. Additional Analysis of Selected "Suspected"problems: Through the process of Task 3.1 and 3.2.1 and 3.2.2,the City may identify"suspected"problems which require some level of evaluation to determine if a "suspected"problem should be on the summary table or to gather additional information about a problem. This effort could include evaluation of prior technical work,site visits,and hydrologic and hydraulic modeling if needed. These analyses,were completed,will be lumped,evaluated,and categorized as: i)Kennydale,ii) Maplewood Creek,iii)Mt. Olivit,iv) West Hill,v)Talbot Hill/Panther Creek Wetland and v)Honey Creek(upper pipe section). This effort will make use of the detailed evaluation of program policies from the 1995 Plan and the City Comprehensive Plan,and will supplement this with any new or updated policies that have been established since then. The City will provide information on these current policies. Much of this policy review will need to be conducted as part of an iterative process that is coupled with the level of service analysis described under subsequent tasks in this scope of work. The goal of this policy review is to have surface water policies that support the delivery of services that the community desires and can afford while complying with .r regulatory requirements. Work to perform this policy review assumes that meetings with City staff,the Project Design Team,and the Utilities Committee are budgeted under Task 2. Additional time has been allocated under this task for performing and coordinating this work,and the work done will be limited to the budget allocated. Policies associated with low impact development will be assumed to be covered under separate stormwater design manual efforts under a separate project. Task 4.2 Surface Water Regulations The Consultant shall review the City's existing stormwater program for consistency with existing and proposed local,state,and federal regulations with particular attention to NPDES Phase II MS4 Permit,ESA,and the Growth Management Act. We will present this information in a program evaluation table showing existing and proposed local,state,and federal requirements. Any compliance gaps between the City's existing storm water management program and other City operations with the regulatory requirements will be summarized in table format along with recommended changes. In addition,the minimum NPDES requirements will be inserted within the table format stating each SWMP requirement as written in Section 5 of the NPDES Phase II Draft Permit. A level of service classification will also be determined for the minimum NPDES requirements in order for the City to ascertain what level of service is needed to attain minimum compliance. This evaluation will also be used to support the City's selection of a drainage design manual. As a part of this task the Consultant will document the status of its drainage manual,in terms of what regulations are currently used,what regulations will be required as part of the NPDES Phase II Draft Permit,and the City's need and intent to review new manual options and adopt a new drainage manual. Note that the City will likely be reviewing new manual options concurrent with the development of this comprehensive plan. The intent of the comprehensive plan is to document what manual decisions are made while the effort for evaluating manual options and making these decisions will be done independently of this work. The current surface water program levels of service will be described according to the City's Engineering Program and Maintenance Program and will also be used concurrently with the Task 4 work to compare the City's current program with the minimum requirements as set forth in the Draft NPDES Phase II permit. The City's Engineering Program will be described according to logical program elements. The City shall provide existing engineering program service level information,budget data,and historical expenditure data as well as a comparison of the City's CIP expenditures and LOS to other similar-sized city CIP/LOS programs. The City's Maintenance Program will be described according to the following program elements: o Maintenance Program o Routine Maintenance/Cleaning and Reporting/Recording Protocols o Repairs o Minor Improvements o Inspections o Enforcement(Ordinances,Policies,Procedures,Follow up,and Penalities) o Emergency Action Plan o Training and Education for IDDE, Pollution Prevention, and Good Housekeeping Noisy R:\Seattle1001159 RBNTON, CITY OF\1100997-10000 Comprehensive Stormwater Plan\Project Management \Scope and Budget\ScopeCDP 080406.doc Page 10 of 18 The evaluation of the existing Maintenance Program shall be completed. This will include the assimilated and summarized findings from reviews of documents and City staff interviews. In order to prepare such a description,the City will be primarily responsible for providing estimates of surface water infrastructure quantities. The Consultant will assist in this estimate,which will likely be based upon the amount of maintenance performed in a year subtracting out where maintenance was performed more than once. Necessary infrastructure includes facilities such as catch basins,inlets,manholes,lengths of pipe, culverts,ditches,detention ponds,and streets. The City shall provide available maintenance records,historical expenditure data,and budget data. The O&M program costs and I-1'hs for the current level of service will be determined by using this information as well as information provided under Task 3. In addition,the Consultant will estimate the approximate level of service (LOS) that existed in 1992 using the same framework and with additional input from the City on infrastructure and maintenance practice changes since then. To the extent that data from 1992 are available,the change in LOS since 1992 will be illustrated graphically. Future LOS increases due to compliance with minimum NPDES regulations will be graphically induded to compare with 1992 and current LOS. The Consultant will provide an issue paper and summary table detailing the existing level of service and program products provided,future program products to be provided based upon policy decisions and impending regulatory changes(i.e.future maintenance of private facilities,decreasing LOS,etc.);anticipated levels of service based upon policy decisions; comparison provided by the City with similar-sized jurisdictions with surface water programs and their levels of service provided (i.e. City of Kent,City of Redmond, City of Auburn,and City of Bellevue);comparison with King County and their level of service within lands to be annexed to the City and for the whole of all King County jurisdictional service areas. The Consultant will draft a list of questions for the City's use in collecting information from other jurisdictions regarding the LOS provided. One of the questions will include the jurisdiction's success of implementing their CIP programs (e.g., %CIP expended vs.budgeted). Task 6—GIS Assistance The SSWM Plan will indude a brief summary of the City's GIS program and spatial data management infrastructure and possible modification to these items based on the future needs of the Surface Water Utility program. This summary would be prepared by the City. Work under this task will also include preparation of up to four GIS figures,expected to show drainage basins,problem areas,and CIPs. ,4010 R:\Seattle\001159 RENTON, CITY OF\11-00977-10000 Comprehensive Stormwater Plan\Project Management\Scope and Budget\ScopeCDP 080406.doc Page 11 of 18 Task 7—Future Program Needs The objective of this task is to determine future engineering and maintenance program needs based upon the following criteria: ❑ Expanding the service area (potential annexation areas) o Increasing storm system infrastructure needs due to new development in accordance with the City's Future Land Use Plan o Complying with new regulatory requirements,with the primary focus on the requirements associated with NPDES Phase II Municipal Storm Water Permit for Western Washington. o Providing service levels throughout the City consistent with surface water policies A significant driver in the future program needs will be compliance with new regulations such as the WA State DOE NPDES Phase II MS4 requirements. Considering these regulations,one of the levels of service to be evaluated will correspond to "what is the minimum program"in terms of engineering,operations,and maintenance to meet these regulations. How these NPDES Phase II MS4 permit requirements will affect other City Sections and Departments will also be identified. Key indicators of future program needs are areas where there are reported problems. For example,a reported flooding problem could include an area where the current level of service for flood protection is not consistent with the current City policy for level of protection. To be consistent with City policy for level of flood protection(e.g.25-yr or 100- yr), this problem area may require a capital project that would then be identified as a future tere program need. To accomplish this task the City will need to provide information on new annexation areas as well as policy decisions on service levels discussed under Task 4. When determining future program needs, the City will need to prepare and estimate to account for time spent on the internal and external complaints MMS database,the work ordering system dating back to 1992,and the drainage complaints in order to remedy problems each year. Task 7.1 Engineering Program Under this task all the program elements described under Task 5 will be evaluated for future needs based on the criteria mentioned above. Task 7.1.1 Flood Protection Program This task includes conveyance system planning to identify future needs for flood protection and identifying costs for Capital Improvements to address those problems. Flood reduction improvements could include increasing conveyance capacity as well as building expanding regional storage facilities. This work includes: o Working with the City to determine flooding areas within the City o Documenting and analyzing specific flooding problems with budget allotted for this task o Developing and evaluating conceptual flood protection solutions to the agreed upon extent Notioe R:\Seattle\001159 RENTON, CITY OF\11-00977-10000 Comprehensive Stormwater Plan\Project Management\Scope and Budget\ScopeCDP 080406.doc Page 12 of 18 a Developing planning level costs for flood protection improvement projects and programs For budgeting purposes it is assumed that the Consultant will focus on priority flooding problems identified by the City. The level of technical analysis for specific drainage systems will depend on the extent of the drainage problems,the available inventory data, the priority for evaluation,and the available budget. A budget allowance of 150 hours is included for all work under this task. Prior to performing the work, the Consultant and City will collaborate to define the number of problems to be evaluated commensurate with the available budget. The City may also provide technical assistance towards this effort. This work will include a review of the existing drainage CIP program and other CIPs for the other City Sections/Divisions/Departments(utilities,transportation,Parks and facilities) to identify(1)overlaps where other City agencies are completing improvements with SWM components,and (2)SWM utility improvements that should or could be programmed in coordination with other City projects. The Consultant shall consider existing stormwater problems as one factor in assessing whether stormwater projects should be programmed into other City projects. Also included is a review of major City Economic Development initiatives to identify future CIP needs that may be required as a result of these initiatives(e.g.,North Renton Infrastructure Improvement,Highlands Redevelopment,and Downtown Redevelopment). An objective of this effort is to identify, where possible,CIPs that can be incorporated into the Stormwater program. Identification of these CIPs is estimated to require 40 hours of the 150-hour budget for this task. The Consultant will meet with the City to determine which problem areas have adequate information from previous work,which will be further analyzed as part of this project,and which will not be analyzed. Costs for solutions for these latter problems will be estimated at a very broad level(order of magnitude for budgeting purposes). Task 7.1.2 Water Quality Program Under Task 4,water quality program requirements from current and future regulations will be identified. For example,under the NPDES Phase II requirements,the City will need to comply with WA State Phase II NPDES program's minimum measures. The Consultant will provide the minimum program recommendations for water quality improvements that can be implemented within the City taking into account both the regulatory requirements and the water quality data provided in Task 3. The Consultant will provide cost estimates to implement the recommended projects and programs. The water quality program requirements will include minimum developer standards for pre,during,and post construction sites,changes to maintenance frequencies,public education,and the need to perform inspections of drainage facilities. In addition,the Consultant will identify WQ programs the City must implement within various City departments,as well as identifying what current City water quality tasks are being implemented from which departments. Task 7.1.3 Fish and Wildlife Habitat Program Ned R:\Seattle\001159 RENTON, CITY OF\11-00977-10000 Comprehensive Stormwater Plan\Project Management\Scope and Budget\ScopeCDP 080406.doc Page 13 of 18 This work includes defining program review of available data on fish use and resources Now with the purpose of identifying fish habitat/passage projects in response to the Salmon Conservation Planning work being done in Water-Resource Inventory Areas 8 and 9, the- desire to protect and improve fish habitat in the City,and the Tri-county ESA effort (although the City currently does not,and likely will not fully support all of the Tri-county proposals). The product of this task will include a list of projects and project costs (from avialble sources). The product of this task is an updated habitat CIP and cost estimates,to the extent policy decisions described under Task 4.1 direct the City. Task 7.1.4 Technical Assistance to Other Programs Technical assistance to other programs generally includes plan review for development activities,working with and responding to questions related to transportation programs and projects,economic development proposals,and Parks Department projects. Under this task,the Consultant will identify the current resource requirement(F i'Es)supporting this activity and assess whether additional resources are required. Task 7.1.5 Regional Coordination Regional coordination activities generally includes involvement in the Green River Flood Control District,WRIA planning,and coordination with other jurisdictions and stormwater related agencies. Under this task,the Consultant will identify the current resource requirement(1,i'hs)supporting this activity and assess whether additional resources are required. 'Awe Task 7.1.6 Setting Priorities for Capital Projects This work will include reviewing the City's historical method for prioritizing projects and comparing it with the methods used by other jurisdictions. The Consultant will meet with the City to compare methods and decide if an alternative method is appropriate for the City of Renton. If so,the new(or updated)method will be used on this project to establish project priorities. It is currently envisioned that the method for prioritizing capital projects will involve categorizing the regional(major)projects versus local(minor)projects. Task 8 will include assessment of funding levels for both regional and local projects. Task 7.2 Maintenance Program The Consultant shall use the existing level of service for Operation and Maintenance(O&M) determined in Task 5 as a basis for developing two alternative levels of service for meeting future needs. This shall also include a comparison with the 1992 levels of service to the extent data from 1992 are available. Working with City input on annexation dates and using historical data,a projection will be made on new infrastructure to be maintained. Using this projection,or a range of projects,an estimate will be made on when additional maintenance N1'Es may be required. 7.3 Analyze the Total Cost Impact of NPDES Phase II Regulations This task will indude developing an estimate of the increase in total costs relating to compliance with the NPDES Phase Il program. The estimate will be based on the work developed under Tasks 7.1 and 7.2 and will likely be at a higher level(i.e.,aggregating the information developed to assess r 1'h requirements). This "higher"level analysis will include all costs associated with public education of the IDDE,emergency,and other requirements associated with compliance with NPDES Phase II standards. The financial projection will be presented in terms of(1) the City's existing budgeted categories and fund structure,and (2) the categorization of Engineering Program and Maintenance Program expenditures developed under Task 5. It will identify the projected capital project funding sources and rate impacts. Rate impacts for up to two levels of service scenarios will be provided. Changes to the City's rate structure and rate basis are not induded in this scope. vow., Work under this task will be provided within the budget approved for this task and is outlined as follows: • ❑ Consultant will work with the City to gather and summarize historical and budgetary revenue and expenditure information for drainage related activities. ❑ Consultant will develop a 20-year financial planning model of surface water activities and projects that corresponds to surface water program budget categories. ❑ Consultant will work with the City in an iterative fashion to recommend a financial plan balancing the level of service policy considerations with fiscal policies provided by the City. The Consultant and the City will identify future needs,balance regional versus local needs,and review budgetary and rate revenue constraints. The budget for this task is based upon providing two iterations for each level-of-service scenario. ❑ Consultant will compare the existing surface water utility fee for a single-family residence within the City to other neighboring jurisdictions and their level of service provided. Much of the work under this task will be providing information to the City for decision-making and preparation for meetings. Attendance at meetings will be covered under Task 2. The financial analysis work with the City to develop a recommended financial plan is covered in Task 8,but the coordination with City staff to balance level of service policy considerations,identified future needs,and budgetary and rate revenue constraints is covered under this task. Task 10-SSWM Plan Report Production The Consultant will develop a report outline and compile work done under the previous tasks to produce the storm and surface water management plan. The Consultant will write an executive summary intended for decision makers (elected officials)and the public. For budgeting purposes,it is assumed the executive summary will be no longer than 10 pages,main report text will be no more than approximately 120 pages with up to 4 color figures,and the appendices will contain no more than 400 pages and will contain no color figures. Work under this task will be provided within the budget approved for this task. Assumptions o The City will provide the Consultant one set of comments each for the City Review Draft and the Public Draft. o The Consultant will produce up to 4 GIS figures,including two sets of updates for inclusion into the SSWM Plan. o The City will perform all reproduction of the report. o The City will perform a review of the Beck internal QA/QC review to provide feedback. Task 11-I-405 Coordination This work includes review of WSDOT documents associated with future widening of I-405 and proposed drainage facilities/improvements. The objective of this review is to consider wide-ranging impacts of widening I-405 on the City's stormwater system and consistency with City standards and policies. The Consultant will review existing WSDOT documentation to identify(1) WSDOT documentation of impacts to Renton's stormwater system,(2)proposed WSDOT mitigation activities, (3) the extent to which future conditions are considered in current WSDOT projects,and (4) the possible locations of any new culverts that are warranted for more detailed City review. Capital projects proposed by WSDOT will also be induded in the list of capital projects,although since these are being constructed by WSDOT,the background information about these projects (e.g.,cost, problem description,etc.) will not need to be documented. Assumptions ❑ The work done under this task will be limited to the budget allocated to this task. ❑ No mapping products are required. ❑ Work under this task will be provided within a 100 hour budget for this task. These pilings have recently become a safety hazard to boaters on the lake. This occurred after the restoration and removal of all of the piling located on the property just south, which were a part of the old Barbee Mill Companies milling operations. DNR Shoreline District receives capital funds of$100,000 per biennium to dedicate to the restoration of aquatic lands. Due to the hazards these pilings pose and the environmental benefits of the low removal, DNR has made it a priority to dedicate a portion of our restoration funds to the removal of the derelict pilings. We have submitted all the requirements for Renton's environmental review in order for a determination to be made on the project. I would like to request the City to waive the $1,000 environmental review fee for this project. Money for this fee will be coming from our meager restoration fund, which will diminish the amount that will be used for actual on the ground restoration of aquatic lands. A waiver of the fee can act as a match towards the project, and the City of Renton will be recognized as a partner in completing this beneficial project. If the increase is less than $5,000, the additional funding will be considered capital funding. 2. If the increase is $5,000 or more, Community Health Centers of King County's Dental Program will be funded to a maximum of$19,000. 3. If funds remain after funding Community Health Centers, the Human Services Advisory Committee will do a request for proposal. Decrease in funding: 1. The Institute for Family Development funds will be decreased until the minimum $10,000 funding level is reached. 2. Additional decreases will be made first to Children's Home Society, then to the Institute for Family Development as needed. To offset the reductions in CDBG, allocations to the lowest ranked funded General Fund agencies will be reduced in order as needed to fund Children's Home Society, and Institute for Family Development to the $10,000 level. Capital Projects Increase in funding: 1. Any increase will be allocated to the Recovery Centers of King County contingent upon them receiving funding from the King County Consortium for 2007/2008 so that Renton funds may be administered under that contract. 2. If other funds become available to fund the Multi-Service Center Employment Program at the recommended level, capital funds originally allocated to the Multi- Service Center will go to the Recovery Centers of King County under the conditions stated above. Decrease in funding: Any decrease in capital funding will be applied proportionately to the Multi-Service Center Employment Program and ElderHealth Northwest. Planning and Administration Increase in funding: It will be allocated to Planning and Administration to cover administrative costs for Renton's CDBG program (CDBG approximately covers 70% of the cost of the Contract Specialist; the General Fund covers 30%). And as a result,the IMPLEMENTATION PLAN that previously existed has been put aside. In other words,the City Administration has been REMOVED as the"driving force" behind Highlands Redevelopment!! The CITY COUNCIL isin the process of establishing a TASK.FORCE made up of NEW PLAYERS to develop a NEW VISION and a NEW IMPLEMEENTATION PLAN for the HIGHLANDS,and this will include a NEW COMP PLAN,NEW ZONING and NEW TEXT AMENDMENTS. Therefore,the Administration should NOT anticipate what the NEW TASK FORCE will decide OR what the NEW VISION of the TASK FORCE will be. The TASK FORCE will probably ask for technical assistance, but not VISION assistance. To have the Administration bring its "stopped programs" forward through use of the public hearing process of the Planning Commission is entirely inappropriate at this time. And using the need to enact COMP PLAN AMENDMENTS by year end is a baseless justification. If the City Council does not currently know what the Highlands Redevelopment Plan will be, how can the Administration know what Comp Plan Amendments are required? Sidestepping SEPA The City Administration is not only sidestepping the Citizens again,I believe it is sidestepping the requirements to complete SEPA before asking the Planning Commission to hold a Public Hearing on COMP PLAN Amendments relating to Highlands Redevelopment. The City of Renton has the obligation ander the State Environmental Policy Act, RCW 43.2 IC,030(2)(c), to complete SEPA review before consideration of any recommendations for changes to the City's COMP PLAN, zoning map,and zoning code. This is a most important point. Renton's own SEPA regulations, and the state regulations upon which they are based, require the SEPA process to be integrated with agency activities at the"EARLIEST POSSIBLE TIME" : 1. To ensure that the planning reflects environmental values, 2. To avoid delays later in the process, 3. And to seek to resolve potential problems early in the process. The City has withdrawn its SEPA determination related to the former proposal to change zoning regulations and policies affecting the Highlands neighborhood. As a result,the hearing that had been scheduled for September 19th on the Highland Community Association's SEPA Appeal has been cancelled. The City Attorney confirmed with the City's Hearing Examiner that a new SEPA determination will be completed before consideration of the revised changes to the Highlands. It is,therefore,inappropriate for the Planning Commission,at the direction of the City Administration, to hold a Public Hearing on COMP PLAN Amendments relating to zoning and text amendments affecting the Highlands before SEPA review is completed on any potential changes. To move forward with the scheduled hearing will result in a reversible error under SEPA. The HCA and the Community want to work with the City to ensure that adequate consideration of environmental impacts is given before any public hearing is held on proposals affecting the Highlands. For this reason alone,the Planning Commission's September 20th hearing must be cancelled. After the TASK FORCE has developed its NEW VISION and the CITY COUNCIL has had a chance to review and modify that VISION, only hen is it appropriate for the Administration to involve the Planning Commission, and even that should be done only at the direction of the CITY COUNCIL,not independent of it. Certainly a majority of the COUNCIL will agree with me that the Administration has"put the cart before the horse"by acting on its own to schedule a Planning Commission Public Hearing relating to Highlands- related COMP PLAN Amendments.. I ask you to consider a Motion this evening to restrict the City Administration activities to those relating to forming the Citizen Task Force and helping the Task Force to accomplish its mission. Any independent actions of the City Administration to adopt Highlands-related COMP PLAN Amendments, zoning,and text amendments must cease in deference to Citizen involvement in the re-creation of these same documents.
