On page 35 of the August 13, 2019 Hearing Examiner Staff Report on the Project (the "Staff Report"), the City of Renton ("City') confirmed the compliance of the Project with the provisions of the Development Agreements. We are writing to request a more specific confirmation of Development Agreement compliance. The 2002 Development Agreement (at Section 4) establishes a "baseline" level of vehicle trips for the property subject to the 2002 Development Agreement (including the Project site). This baseline does not operate as a cap or limitation on vehicle trips, but merely establishes a trip threshold for which mitigation is provided under the 2002 Development Agreement. The 2003 Development Agreement addresses the "allocation" of 1,500 vehicle trips under Section 4.2.3, whereby those baseline trips are earmarked for the redevelopment of District 1. Again, this 1,500-trip threshold does not operate as a cap, but identifies the point at which additional review and possible mitigation for transportation impacts will be required. The vehicle trips for the Project exceed the District 1 allocation. Accordingly, Topgolf submitted a complete Transportation Impact Analysis for the Project (Staff Report, Exhibit 30). In the process of Project review, the City determined that the Project satisfied transportation concurrency standards and also imposed additional off -site mitigation to address potential traffic impacts of the 701 Fifth Avenue • Suite 6600 Seattle, Washington 98104 • 206.812.3388 • Fax 206.812.3389 • www.mhseattle.com September 30, 2019 Page 2 of 2 Project. These mitigating conditions were incorporated in the ultimate Project approval by the Hearing Examiner. Therefore, we are writing to confirm that the City has reviewed and approved the transportation impacts of the Project, including the identified mitigating conditions. The Project trip generation and transportation status is in full conformance with the Development Agreements.
