HomeMy WebLinkAboutEmergency Comprehensive Plan Map Policy, Text Amends - West Hill Area (9/14/1998) Noe CITY OF RENTON, WASHINGTON ORDINANCE NO. 4 7 3 8 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ADOPTING THE 1998 EMERGENCY AMENDMENTS TO THE CITY'S COMPREHENSIVE PLAN, MAPS AND DATA IN CONJUNCTION THEREWITH, INCLUDING AMENDMENTS TO THE LAND USE ELEMENT POLICIES PERTAINING TO POTENTIAL ANNEXATION AREAS (PAA), AND THE LAND USE AND PAA DESIGNATIONS FOR THE WEST HILL AREA. WHEREAS, the City Council of the City of Renton has heretofore adopted and filed a "Comprehensive Plan" and the City Council of Renton has implemented and amended said "Comprehensive Plan" from time to time, together with the adoption of various codes, reports and records; and WHEREAS, the City Council of the City of Renton has adopted a resolution declaring an emergency in order to consider amendments to the Comprehensive Plan relating to the Land Use Element and amendments to the Land Use Map relating to the Potential Annexation Area consisting of the West Hill; and WHEREAS, the City has held public hearings on this matter; and WHEREAS, the City Council has duly determined after consideration of the testimony and evidence before it that it is advisable and appropriate to amend and modify the City's "Comprehensive Plan"; and WHEREAS, such modification and elements for the "Comprehensive Plan" being in the best interest and for the public benefit; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. The above findings and recitals are found to be true and correct in all respects. 1 14100 ORDINANCE NO, 47 3 8 SECTION H. The "Comprehensive Plan," maps, data and reports in support of the "Comprehensive Plan" are hereby modified, amended and adopted as said "Comprehensive Plan" consisting of the following elements: Land Use, Land Use Map, Housing, Utilities, Transportation, Capital Facilities, Downtown, Economic Development and Environment, as shown on the attached Exhibit A, Land Use Element Policies and Text, Exhibit B, Land Use Map, and Exhibit C, Glossary, incorporated herein as if fully set forth. SECTION M. The Economic Development, Neighborhoods and Strategic Planning Administrator is hereby authorized and directed to make the necessary changes on said City's "Comprehensive Plan" and the maps in conjunction therewith to evidence the aforementioned 1998 emergency amendments. SECTION IV. The City Clerk is authorized and directed to file this ordinance as provided by law, and a complete copy of said document likewise being on file with the office of the City Clerk of the City of Renton. Policies not listed remain unchanged. Policy LU-378. The City should encourage annexation of all territory within its Potential Annexation Area, as depicted on the City's adopted land use map. Policy LU 378.1 Repealed Policy LU-380. The immediate areas for annexation to the City of Renton should include the territory contiguous with boundaries of the City such as: a. peninsulas and islands of unincorporated land; b. neighborhoods where municipal services have been extended; c. vacant lands subject to development pressure; d. developed areas where urban services are needed to correct degradation of natural resources; e. lands which are available for urbanization under county comprehensive plan,zoning, and subdivision regulations; and f. aquifer recharge areas. Discussion: The Urban Growth Area defines the area within which urban level of development will occur. The Potential Annexation Area indicates an area within which people have an opportunity to annex to the City of Renton. Given a number of factors such as topography, existing and planned land uses, population, fiscal concerns, transportation systems, sewer and water utilities, governmental services, and community values, the Potential Annexation Area may eventually become a part of Renton. The Potential Annexation Area establishes the geographic limits of future annexation actions. Just because a proposed annexation is located within the annexation area, however, does not guarantee its approval. Any annexation proposal is subject to the appropriate review and approval process. NEW BUSINESS Council President Edwards congratulated the City and especially its Fire Fire: Improved Fire Department on having achieved an improved fire protection classification Insurance Rating rating from the Washington Surveying and Rating Bureau. Councilman Parker encouraged all business owners in the City to contact their insurance agents about rate reductions that should now be available because of the improved classification. Parks: Improved Signage Councilmember Keolker-Wheeler suggested that the Administration provide for New City Hall better signage for the public in determining where they should park at the Building new building. NE and NE 8th Safety Concerns at St., requesting more signage and police patrols in the area to help address Vashon/NE 8th safety concerns related to parking problems and speeding traffic. Citizen Comment: Correspondence was read from Lila Campen, 4908 Talbot Rd. S., Renton, Campen - Talbot Hill describing zoning changes made on her property earlier this year and Zoning Changes & requesting that the residential development project planned for this site be Proposed Development allowed to proceed as proposed, despite the changes. The primary difference is that the line between areas zoned R-1 and R-14 is now irregular rather than straight. OLD BUSINESS Council President Edwards presented a report recommending that Council Committee of the Whole pass a resolution approving Renton's participation, with Seattle and King EDNSP: Port Quendall County, in an application to become a federal Empowerment Zone. The Empowerment Zone federal government has authorized the designation of 15 new urban Application empowerment zones. SPECIAL Karen Marshall, Human Services Manager, said the success of Renton's PRESENTATION Summer Lunch Program at the Royal Hills Apartments can be attributed to Human Services: Summer the many partners involved in it. Lunch was offered to low-income children Lunch Program Volunteer 49 days, along with before- and after-meal activities. An average of 150 Recognition kids were served each day, with 7,370 lunches total served during the summer. The Renton School District prepared the meals and the Renton Salvation Army delivered them to Royal Hills. In addition, the Renton Library donated over 400 used books and Books for Kids gave 100 new books for the children. Staff from the Community Services Department's Recreation Division, the Police Department and the Fire Department participated as well. Ms. Marshall recognized the invaluable assistance from the Renton Ecumenical Association of Churches, Renton First United Church, Fairwood Community United Church, St. Andrews Presbyterian Church, United Christian Church and Martin Luther King Baptist Church. Each of these five churches provided volunteers to help serve lunch on their assigned day of the week. Alice Watson, president of the Royal Hills Apartments residents' council, expressed gratitude to the City for this program, saying that it benefitted the children and their families in many ways. Removal) Nome September 14, 1998 Renton City Council Minutes Page 286 Mike Kattermann, Director of Neighborhoods & Strategic Planning, explained the amendments are being proposed because of possible changes in the way that potential annexation areas may be treated, particularly in relation to city responsibilities for these areas. Under a proposed amendment to the County-wide Planning Policies (CPPs), the Growth Management Planning Council (GMPC) would adopt PAAs. If this is done, no city would be able to act on its own to add to or delete from its potential annexation area. Other possible changes would establish a higher level of commitment to annex PAAs at some point. Continuing, Mr. Kattermann said if the West Hill area is removed from Renton's PAA, it would become an "unclaimed area." The cities of Renton, Seattle and Tukwila would then enter into discussions with King County and West Hill residents to talk about the future of this area. Staff recommends that the emergency Comprehensive Plan amendments be adopted as proposed, removing all but two portions of the West Hill area from Renton's PAA. The first property is east of Raininer Ave. north of Renton's Municipal Airport, and the second is located south of Martin Luther King, Jr. Way. Owners of these properties have expressed interest in annexing to Renton at some point. Mr. Kattermann concluded that the City will coordinate with King County on a governance study for the West Hill area, and the subject of Renton's potential annexation area will be revisited at a future date. Responding to Councilmember Keolker-Wheeler, Mr. Kattermann estimated that the governance study will be completed by next March or April. Audience comment was invited. Planning: Moratorium on This being the date set and proper notices having been posted and published Residential Developments in accordance with local and State laws, Mayor Tanner opened the public in Commercial Areas hearing to consider extending the moratorium on residential development in the Center Suburban land use designation implemented by the Center Suburban (CS) and Residential Multi-family Suburban Center (RM-C) zoning classifications, the Center Neighborhood land use designation implemented by the Center Neighborhood (CN) and Residential Multi-family Neighborhood (RM-N) zoning classifications, and the Employment Area- Commercial land use designation implemented by the Commercial Arterial (CA) zoning classification. Mr. Kattermann explained that the moratorium's purpose is to protect prime commercial property in the City, given that the amount of multi-family development occurring in these zones was more than had been anticipated under Renton's Comprehensive Plan. WHEREAS, the City of Renton has adopted a Comprehensive Plan pursuant to the requirements and authority of the Growth Management Act; and WHEREAS, the Growth Management Act and the City Code provide for an annual review cycle of the Comprehensive Plan; and WHEREAS, the City of Renton's annual review of the Comprehensive Plan is completed for 1998; and WHEREAS, RCW 36.70.A.130(b) provides that, when an emergency exists, the City may adopt amendments or revisions to its Comprehensive Plan as an exception to the required annual review cycle; and WHEREAS, Renton Municipal Code section 4.9.020.D permits the City Council to consider emergency amendments to the Comprehensive Plan as an exception to the required annual review cycle; and WHEREAS, the Renton City Council approved its Urban Growth Area as part of its Interim Land Use Element in 1993 prior to adoption of the Countywide Planning Policies and the creation of the designation"Potential Annexation Area" (PAA); and WHEREAS, the Comprehensive Plan Policies, Mapping, and Glossary do not distinguish between the "Urban Growth Boundary" and "Potential Annexation Areas" and treat the entire unincorporated Urban Growth Area surrounding Renton as the adopted Renton Potential Annexation Area; and Ntio RESOLUTION NO. 3341 WHEREAS,the West Hill Area is included in Renton's Potential Annexation Area; and WHEREAS, the City of Renton analyzed future service delivery issues and ranges of services for the majority of its Potential Annexation Area; and WHEREAS, similar area-wide fiscal analysis of service delivery and ranges of service needs or annexation/incorporation analysis is not available for the West Hill Area; and WHEREAS, the Growth Management Planning Council of Metropolitan King County is currently considering amendments to the Countywide Planning Policies which are intended to clarify requirements of cities with designated Potential Annexation Areas; and WHEREAS, the proposed amendments before the Growth Management Planning Council will adopt Potential Annexation Area maps as part of the Countywide Planning Policies; and WHEREAS, future modification to these policies and maps will occur through action of the Growth Management Planning Council and ratification by its member jurisdictions not through the local land use authority of the City of Renton; and WHEREAS, adoption of the proposed amendments to the Countywide Planning Policies by the Growth Management Planning Council is scheduled for September, 1998; and WHEREAS, adoption of the proposed amendments to the Countywide Planning Policies will occur prior to the March 1999 filing deadline for the annual Renton Comprehensive Plan amendments; and WHEREAS, the Renton City Council does not have the opportunity to give full consideration to issues regarding future service areas and ranges of service for West Hill under the proposed amendments to the Countywide Planning Policies prior to their adoption; and 2 w `"" RESOLUTION NO. 3 3 41 WHEREAS, provision of the services to West Hill required under the proposed amendments has uncertain fiscal impacts on the City of Renton and may create a hardship for the City; NOW, THEREFORE, the City Council of the City of Renton, Washington, do resolve as follows: SECTION I. The above recitals are found to be true and correct in all respects. SECTION H. An emergency is hereby declared pursuant to state law and Renton Municipal Code in order that immediate amendments to the Comprehensive Plan can be considered to amend the Land Use Element policies and Glossary to clarify the difference between Renton's Potential Annexation Area and the Urban Growth Boundary, and to amend the Land Use Map to remove the West Hill Area from Renton's PAA. RECOMMENDATION: • Adopt the Resolution"Declaring an Emergency in Order to Consider Policy and Map Amendments to the Comprehensive Plan". • Set a Public Hearing for September 14, 1998. • Refer the proposed map and text amendments shown on Attachments A and B to the Planning and Development Committee for review and recommendation prior to the Public Hearing of September 14, 1998 BACKGROUND SUMMARY: The Growth Management Planning Council (GMPC) of King County is currently considering amendments to the Countywide Planning Policies which would clarify commitments required of cities • ' August 3, 1998 Page 2 ,wow 'vow within designated PAAs and formally adopt PAA boundaries. The GMPC is scheduled to act on these amendments on September 16, 1998. Once adopted, these boundaries and policies can only be amended through the countywide planning policies and ratification by GMPC member jurisdictions. Portions of the urban area outside of designated PAAs will be subject to a more extensive review process involving local citizens, King County and other jurisdictions prior to designation of PAA boundaries. Renton's action to remove the West Hill area from its PAA would trigger that review process. The West Hill area was included in Renton's PAA in 1993 prior to the adoption of the Countywide Planning Policies and development of the current concept of a"PAA". The West Hill area was included because it is in the Renton School District and because, at that time, the City Council supported annexation of all areas surrounding Renton which other jurisdictions were not actively committed to. The City did not give full consideration to future service areas, ranges of services and the cost of service because these issues were analyzed only upon actual annexation. As a result of several annexation and incorporation studies,the City was eventually able to assess service needs and potential fiscal impacts of service in many portions of Renton's PAA.These studies include: • Fairwood/Cascade Vista: "North Soos Creek Fiscal Impact Study" 1989, • East Renton Plateau: Bumstead Annexation proposal 1995, The Maplewood Annexation proposal 1996, "Feasibility Study for the Proposed City of Briarwood" 1997, • May Valley Prezone 1997; and • Comprehensive Plan Amendment M-2 for the properties east of Rainier Blvd., 1998 In the case of the West Hill area, similar information about service needs and fiscal impacts is not available, and will not be prior to the scheduled GMPC review of the proposed Countywide Policy amendments. The interests of the City and the residents of the West Hill will be served by a more thorough review of the area prior to GMPC adoption of PAA boundaries. Land Use Element Policy amendments will also be needed to distinguish between the West Hill Area and other Urban Areas which will remain within Renton's PAA. The City is also proposing an amendment to Land Use Element Policy LU-378 referencing "Potential Annexation Areas" as shown on the City's Adopted Land Use Map. Policy LU-378.1 is proposed for deletion. This policy states that "Renton's Urban Growth Area also represents its Potential Annexation Area". In addition the discussion text is amended to reflect the difference between the Urban Growth Area and the Potential Annexation Area. The term"Potential Annexation Area"is added to the Glossary. CONCLUSION Emergency action on the part of Renton will trigger additional review of the service issues and future governance options for the West Hill Area. It is important that Renton take this action prior to GMPC adoption of PAA boundaries and a new set of policies guiding a regional approach to Potential Annexation Areas. July 29, 1998 Policy LU-377. The City should continue to recognize the area within the sphere of influence boundary as the territory in which the City of Renton has an inherent interest in future land use decisions. Policy LU-378. The City should encourage annexation of all territory within itsthe Potential Annexation Area, as depicted on the City's adopted land use map.Urban Growth Arca. Policy LU 378.1 Rcnton's established Urban Growth Area (UGA) also represents its Potential Annexation Arca(PAA). Policy LU-379. Encourage annexation where the availability of infrastructure and services allow for the development of urban densities. Renton should be the primary service provider of urban in- frastructure and services in the resultant area provided that the City can offer such services in an efficient and cost-effective manner. Policy LU-380. The immediate areas for annexation to the City of Renton should include the territory contiguous with boundaries of the City such as: a. peninsulas and islands of unincorporated land; b. neighborhoods where municipal services have been extended; c. vacant lands subject to development pressure; d. developed areas where urban services are needed to correct degradation of natural resources; e. lands which are available for urbanization under county comprehensivecom prchcnsive plan, zoning, and subdivision regulations; and f. aquifer recharge areas. Policy LU-381. Establish and maintain an Urban Growth Area. The following criteria should be the basis of establishing such a line: a. location of environmentally sensitive areas; b. desired density for future development; c. population allocation; d. efficient utilization of urban infrastructure, such as sewer,water and roads; e. coordination of sewer extension in Water District 90; f. adopted plans and policies of the City and King County; g. coordination of development standards between jurisdictions; and, h. identification of community separator areas. Discussion: The Urban Growth Area defines the-aft area within which urban level of development will occur. The Potential Annexation Area indicates an area within people have an opportunity to annex to the City of Renton. Given a number of factors such as topography, existing and planned land uses, population, fiscal concerns, transportation systems, sewer and water utilities, governmental services, and community values, the Potential Annexation Area this area may eventually become a part of Renton. The Potential Annexation Area Urban Growth Boundary establishes the geographic limits of future annexation actions. It marks urban growth areas within the county that could eventually become a part of the City of Renton. Annexations can not occur beyond this boundary. Just because a proposed annexation is located within the annexation area, however, does not guarantee its approval. Any annexation proposal is subject to the appropriate review and approval process.
