Project Description.The proposal seeks approval of two separate zoning variances that would
allow the property owners to continue to enjoy conditions that existed prior to the current owners
purchase of the property.The first variance seeks to increase the allowable height limits for
fences when located on top of retaining walls.The Aguiars were cited on August 14,2017 that
the combination of fence and retaining wall exceeded the allowable 6 foot height limit when
located on a side property line.A variance will be submitted requesting that the existing retaining
wall and 6 foot tall wood fence be retained in its current location.The second variance requests
that the existing roof overhang be allowed to remain and not be considered an accessory
structure.Again on August 14 2017 the Aguiars were cited that the roof overhang was considered
a membrane structure and that it had to be removed and placed into the rear yard of the property.

to maintain a pre-existing use as a legally established
non-conforming use.The noted "accessory structure"
referenced in CODE17-000453 is not fully enclosed and
is a lean to with a roof and open walls.
