I understand that under RMC 1-3-2.G that the administrator shall decide whether the opportunity to be heard will be only in writing or in person,or both.The city is not required to call witnesses to testify at the hearing. Pursuant to RMC 1-3-2.K, failure to attend the scheduled hearing makes the Finding of Violation final,and I may be subject to additional costs if I fail to withdraw or resolve my appeal prior to the hearing date. Each Tuesday of the week, city crews canvass the city and respond to reports to impound stray shopping carts. • • Please pick up your shopping cart(s) by the compliance date shown on page 1 of this notice after "Corrective Action". "IF YOUR STORE HAS MORE CARTS THAN APPEAR ON YOUR INVOICE,PLEASE PICK THEM ALL UP" There are no additional fees to pick up carts. Shopping carts can be retrieved any weekday before 3:30 pm at the Public Works Shops located at: 3555 NE 2nd Street/Renton, WA 98056/425-430-7400. They are not open on the weekends. FINES HAVE BEEN ASSESSED.This is a Finding of Violation and a tine will be assessed for each cart picked up. DEFERRAL PROGRAM: for deferral of fees for up to 8 carts in a calendar month,please implement security measures as described here and contact Code Compliance. 1) Affixed permanent identification to shopping carts: Identifies the owner of the shopping cart and/or the name of the business establishment, and lists a current telephone number and/or address for returning carts; 1) Implemented security measures: Physical impediments or methods to prevent removal of shopping carts from the premises el the tet,nl establishrnenl including, but not limited lo: • Electronically-activated self-braking wheels; • Poles mounted to shopping carts,which prevent their removal from the interior of the retail establishment • Utilization of a cart patrol and retrieval company; • Dedicated security personnel; and • Other measures deemed appropriate and effective by the Administrator. To be eligible for up to eight fine deferrals,a business must request verification of eligibility to our Code Compliance Division.The request should detail how your business is compliant with the eligibility requirements. City staff will need to verify the presence of cart signs and confirm your method(s)of ` • security measures(the method of verification will vary depending on the security measure). FINE CHANGES: Please be aware that while the City has increased the number of cart fines that may be deferred in a calendar month, the fine amount will be doubled to$200 for each impounded cart in excess of eleven (11) (i.e., the 12th cart impounded, as well as each cart subsequently impounded in that month). Impounded carts 1-11 in a calendar month will be fined at$100 per cart if the store is not in the deferral program or if more than eight carts are impounded.
