COOKE, AND THE CITY OF RENTON
CERTIFIED Land Services Corporation has served as Right of Way Acquisition Agent
for.the City of Renton for the Renton Duvall Avenue SE/Coal Creek Parkway
Improvements Project from March, 2005 to date.
A warranty deed was signed December 30, 2005, and recorded under Auditor's File.
fVo. 20061217000454, records of King County, Washington, conveying a portion of
property owned by Charles M. Cooke and Linda S. Cooke, husband and wife, to the
City of Renton for the Duvall Avenue road improvement project.
Subsequently, the legal description of the Cooke's property in a title report produced
by Pacific Northwest Title Company (Order No. 562581) was determined to be in
error. The title report stated that the Cooke� held fee title to their residence parcel
and a portion of private access road off Duvall Avenue (also known as SE 107th St.),
when in fact they hold only an easement right over the access road. 7he title
company issued a Second Report, which describes the property in 2 parcels: Parcel
A, owned by Charles M, and Linda S. Cooke (their residence parcel together with an
easement over the access road), and Parcel B, owned by Burton D. Killian Jr., (a
certain portion of the private road adjacent to Duvall Avenue).
The title company determined that many years ago, the King County Assessor
appended the said Parcel B to the Cooke's tax parcel number, and they have been
paying property taxes on this portion likely since 1974, when they acquired their
residence parcel. Thus, Charles and Linda Cooke have an interest in Parcel B.
The attached quitclaim deed from the City of Renton to Charles and Linda Cooke
corrects the erroneous warranty deed recorded February 17, 2006 under King
County Auditor's File No. 2006217000454.
The attached quitclaim deed from Charles and Linda Cooke to the City of Renton
conveys any right, title and interest Charles and Linda Cooke may have (excluding
their existing easement recorded under King County Auditor's File Number
7403110133) in Parcel B to the City of Renton.
A copy of the title vesting and legal description pages of the Second Report of Title
� Order 562581, along with Supplement #1 for the Second Report, is attached.

mortgage has been removed from our title report. He will review his papers to give

in fhe title that should be corrected by fhe title company. M ',
5.31.2006 Spoke with Mike Sharkey at the title company and there are a couple of serious _ I
problems with the title and he will work up a new report. m
6.3.2006 Received a second report of Title Order 562581, which corrects the ariginal report.
The new title report describes 2 parcels: Parcel A is the Cooke's residence at 13642
SE 107th St., together with an easement over the private access road, and is vested
in Charles M. and Linda S. Cooke. Parcel B is a portion of the access road just west
of Duvall Avenue, measuring approximately 116 feet x 30 feet, vested in Burton D.
Killian, Jr., as his separate estate.
The title company determined that at some point in the past, this strip got appended
� to Charles and Linda Cooke's tax parcel number, and they've have been paying
property taxes on this portion of the access road since 1974 when they bought their
� residence, which gives them some interest in tt�e property, but not fee title. Mr.
Killian acquired title through inheritance from his father, along with other property in
the area; he no longer owns any property here, but somehow title to this small area
didn't pass on from him; hence he owns underlying fee title to this strip.
It was further determined that the City of Renton actually acquired the east 12 feet of
their residence lot, not the east 12 feet of the portion of the access road, as
intended. Discussions will be held with the title company and the City to determine
the best way to clear this title issue. m
6.15.2006 The title company recognizes their error and will insure a transfer of the Cooke's
interest in this strip to the City. They advised that there are 2 alternatives to correct
the problem: (1) Get a quitclaim deed from the Cookes to the City for whatever
interest they have in the strip, in exchange, the City will grant a quitclaim to the
� Cookes for the portion of their residence property that was erroneously conveyed to
the City; if Burton Killian can be contacted, get a quitclaim deed from him to the City
for his interest in the strip. (2) If#1 can't be accomplished, a quiet title action would
need to be brought to clear the clouds on the title. The title com.pany stated they
would help the City in fhis process, as mitigation for their error. m �
7.21.2006 I, Kristin ButterField, have been assigned replace Michael Armstrong as acquisition
agent, as Michael has left CERTIFIED Land Services. kb �
9.14.2006 The Cooke/Killian title issue was discussed at a meeting with the City. It was agreed
that the best approach is for the City attempt to get quitclaim deeds to and from the
Cookes, and from Mr. Killian.
The issue of the compensation paid to Mr. and Mrs. Cooke for the original, erroneous
acquisition was discussed. It was agreed that this compensation would in effect be
transferred to the interest in the access road strip that the Cookes would convey to the City
via quitclaim deed; therefore, it would not be considered a gift of public funds. kb

said she'll speak with her husband Charles, and will call back to arrange a meeting

Linda called back, and we agreed to meet at their home at 6:00 p.m. tomorrow,

1.4.2007 I spoke with Mike Sharkey of Pacific Northwest Title about the quitclaim deeds toand
from the City and Cookes. He advised me on the compensation clauses in the
deeds, and gave me the WAC exemption code to use on the excise tax affidavits.
I met with Charles and Linda, and explained the history of the discovered error in the
. original transaction between the City and them, the current title situation and the
proposal to resolve it. I gave them copies of the old and new title reports, a copy of
their vesting deed; and the quitclaim deeds needed to correct the title. They took
them and said they'll review them with their attorney.
Charles inquired about the compensation that was paid for the original transaction,
and whether the City would require that it be refunded. I explained that it would be
considered compensation for the interest in the access road they would quitclaim to
the City. We agreed that I'll call them in a week or so if I've not heard from them. kb
1.5.2007 I spoke with Mike Sharkey at the title company about the legal description of the
access road strip, which is confusing. He agreed to re-write it to more clearly
describe the point of beginning of the east line of the parcel. kb
1.9.2007 Received a Supplement #1 for the Second Title Report, in which the legal
description of Parcel B is re-written for more clarity. kb
1.11.2007 Called Linda Cooke at her office, left a message to call me back re her and Charles'
review of the documents. kb
1.17.2007 Linda called me to say that she and Charles want the following language included in
the quitclaim deed from the City to them: "and in acknowledgment of a complete and
final transaction" included to reflect that the City wifl not at anytime in the futu�e
� � request a refund of the $5,010 previously paid. She also asked for a map or drawing
that clearly shows their residence property and the portion of the access road in
question, and ties into the legal description. I said I'll revise the document and get a
better map to her. kb
1.22.2007 I called Linda to say that I'll drop off a copy of the City's quitclaim deed to the '�
Cookes, a map and 2 excise tax affidavits at their house while I'm in the
neighborhood today; she said their attorney had indicated the language re their
existing easement right in the access road should be re-written. Linda or Charles
will get the requested language to me as soon as possible. kb

5/31/2006 The City of Renton acquired a portion of property located at 13642 SE 107t" St.,
Renton, from Charles M. and Linda S. Cooke for the City of Renton Duvall Ave
NE/Coal Creek Pkwy SE Reconstruction project. The property needed 'is part of a
private access road which serves the Cooke's residence as well as several others.
The Cookes were paid $5,010 for the needed property. After the signed conveyance
documents were transmitted to the City, a City engineer noticed an error in the legal
description of the property acquired. Upon further review, it appears that the title
company made an error in the legal description in preliminary title report. A new
report is coming. kb

father owned and developed a lot of the pcoperty in that neighborhood many years
ago, including the Cooke's lot. He no longer owns any property in that area, was
completely unav►rare of his re.sidual interest in the access road. He said he's willing
�to convey his interest to the City. kb
