1. The Grantor(s)or his/her(their)successors in interest and assigns("Owners"�shall at their awn
cast, operate, maintain, and keep in goocf repair,the Property's drainage facilities constructed
as required in the approved constructian plans and specifications R-39'i9 {profect
Plan�) on file with the Gity of Renton and submitted to the City of Renton for the review and
appro�al of permit{s) U1$006039 (Constr�ction/Building/UrilityPermit#�J.The
Property's drainage facilities are shown and/or listed on Exhibit A—Site Plan. The Property's
drainage faci[ities shall be maintained in compliance with the operation and maintenance
schedule induded and attached her�in as Exhibit B—Operations and Main#enance. Drainage
facilities include pipes, channels, flow control facilities, water quality facilities, on-site best
management practices (BMPs} and other engineered structures designec{ to manage and/or

treat stormwater on the Property. On-site BMPs include dispersion and infi[tration deviees,
bioretention, permeable pavements, rainwater harvesting systems, tree re#ention credit,
reduced im�ervious surface footprint, vegetated roafs and ather measures designed to mimic
pre-develo�ed hydrology and minirnize stormwater runoff on the Property.
2. City of Renton shalf F�ave the right to ingress and egress over thase portions of the Property
necessary to perform inspections of the stormwater fiaeilities and BMPs and conduct
maintenance activities specified in this Declaration of Co�enant and in accordance with the
Ren�on Municipa] Code. City of Renton shall provide at least thirty(30) days' written notice to
the Own�rs that entry on the Property is planned for the inspection of cErainage facilities.After
the thirty (30) days,the Owners shall allow the City of Renton to enter far the sole purpose of
inspecting drainage facilities. In lieu of inspeetion by th�City, th� Owners may elect to�ngage
a licensed civil eng�neer registered in the state of Washington who has�xpertise in drainag�to
inspect the drainage faci[ities and provide a writ�en report describing their conditinn. If the
engineer option is chosen,the Owners shall provide written notice to the City ofi Renton within
fifteen (15)days of receiving the City's notice af inspection.Within�hir�y(3D)days of giving this
notice,the Owners,or engineer on behalf af the Owners,shall pra�ide the engineer's report ta
the City of Renton. If the report is not provided in a timely manner as specified abo�e,the City
of Renton may inspect the drainage facilities witf�out further notice.
3. If City af Renton determines #rom its inspec#ion, ar from an engineer's report pravided in
accordance with Paragraph �,that maintenance, repair, restoration, and/ar mitigatian work is
required to �e done ta any of the drainage facilities, City of Renton shall notify the Owners af
the sp�cific maint�nance, repair, restoration, and/or mitigation work {"Work"y required
pursuant ta the Renton Municipal Code. The City shall aiso set a reasonable deadline for the
Owners to camplete the Wor�, or to provide an engineer's report that verifies completion of
the wark. After the deadfine has passet[, the �wners shall allow the City access to re-inspect
the drainage facilities unless an engineer's report has been provided �erifying completion of
the Wark. If tl�e Wark is not campleted within the time frame set by tihe City, the City may
initiate an enforcement action and/or perform the Work and here6y is given access to the
Praperty far such purposes. Written notice wifl be sent to the Owners stating the City's
intention to perform such Work.This Work will not commence until at feast seven(7)days after
such notice is mailed. If, within the sole discretion of fihe City, there exists an imrninent or
present danger, the se�en (7) day notiee period will be wai�ed and Work will begin
immediately.
4. 7he Owners shall assume all responsibility for the cost of any Work, ar any measures taken by
t)�e City to address canditians as descrihed in Paragraph 3. 5uch resp4nsibility shall include
reimbursement ta the City within thirty(30}days of the receipt of the invoice for any sueh Work
performed. Overdue payments will require payment of interest at the maximum legal rate
aliowed by RCW 19.52.020(currently twelve percent {12%}). I�the City initiates legal action to
enforce this agreement, the pre�ailing party in such action is entitlec{ fio reco�er reasonable
litigation casts and afitarney's fees.
S. The Owners are required to obtain written approval from City of Renton prior to fi[ling, piping,
cutting, or remaving v�getation (except in routine landscape maintenance} in open�eg�tated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), ar performing any
alterations or modifications to the drainage facilities referenced in this Qeclaration of Covenant.

Your property contains an on-site BM�' (best management practice) called a"perforated pipe
coj:ttectioft,"wlxicl� was installed to reduce tl�e stormwater runoff iinpacts of some or alI of the
impervious surface on your property.
A perforated pipe cannection is a lengtlz of drainage conveyance pipe with holes in the botEom,
desigt�ed ta"leak"runaff, conveyed by tlse pipe,into a gravel filled trencl�where it can be saaked into
tk�.e surrounding sail.The connection is intended to provide opportunity for infiltration of any runoff
that is being conveyed from an impervious surface (usually a roo� Yo a local drainage syste�n such as a
ditch or roadway pipe system.This on-site BMP shall be�naintained per Appendix A of the City of
Renton's 5urface Water Design Manual.
MAINTENANCE RESTR[CTIONS
