SEE BOUNDARY & TOPOGRAPHIC SURVEY C3-003 AND C3-004 CONDITIONS OF APPROVAL FOR LAND USE H. DECISION: THE PROPOSED SITE PLAN MINOR MODIFICATION, FILE NO. LUA00-156, MOD IS APPROVED. THE PROPOSAL IS SUBJECT TO THE FOLLOWING CONDITIONS: 1. THE APPLICANT SHALL COMPLY WITH ALL MITIGATION MEASURES ISSUED AS PART OF THE SFEIS, DATED SEPTEMBER 17, 1999 (EXHIBIT 17). 2. THE APPLICANT SHALL DEMONSTRATE COMPLIANCE WITH ALL CONDITIONS OF APPROVAL ISSUED AS PART OF THE SOUTHPORT OFFICE LEVEL I SITE PLAN, DATED FEBRUARY 5, 2001 (EXHIBIT 9). 3. ADDITIONALLY, ALL DESIGNATED PEDESTRIAN AREA SHALL BE DIFFERENTIATED, IN MATERIAL, FROM DRIVE AISLES. A REVISED SITE PLAN SHALL BE SUBMITTED TO, AND APPROVED BY, THE CURRENT PLANNING PROJECT MANAGER PRIOR TO CONSTRUCTION PERMIT APPROVAL. 4. THE APPLICANT SHALL RECORD A PUBLIC RECREATION EASEMENT PRIOR TO ISSUANCE OF THE BUILDING PERMIT APPROVAL. SUCH EASEMENT SHALL CONNECT TO THE EXISTING PEDESTRIAN EASEMENTS (IDENTIFIED ABOVE) FOR A FUTURE CONTINUOUS TRAIL CONNECTION FROM GENE COULON PARK TO THE CEDAR RIVER TRAIL. SUCH EASEMENT SHALL BE SUBJECT TO SEVERAL CONDITIONS PRECEDENT SUCH THAT THE EASEMENT RIGHTS GRANTED THEREIN SHALL ONLY BECOME EFFECTIVE IF AND WHEN THE CITY COMPLETES (DEFINED AS HAVING SECURED ALL NECESSARY PROPERTY TIGHTS, PERMITS, AND FINANCING TO COMPLETE CONSTRUCTION) THE TRAIL CONNECTION ON THE PROPERTY TO THE WEST (CURRENTLY OWNED BY BOEING AND DNR AS SHOWN IN EXHIBIT 21). FURTHER, THE CITY WILL MAKE CONTINUOUS, DILIGENT EFFORTS TO OBTAIN A SUBSTITUTE OVERLAND EASEMENT FROM THE ADJOINING PROPERTY TO THE WEST (CURRENTLY OWNED BY BOEING), AND THE EASEMENT REQUIRED IN THIS CONDITION SHALL EXPIRE AS SOON AS THE CITY IS ABLE TO OBTAIN A SUBSTITUTE OVERLAND EASEMENT OVER THE ADJOINING PROPERTY TO THE WEST. THE FINAL TERMS OF THE SUBJECT EASEMENT SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE CITY ATTORNEY. 5. THE APPLICANT SHALL SUBMIT A REVISED AND DETAILED LANDSCAPE PLAN COMPLYING WITH THE FOLLOWING: A MIXTURE OF TREES, SHRUBS, AND GROUNDCOVER TO SATISFACTION OF THE CURRENT PLANNING PROJECT MANAGER.
