DESCRIPTION:The applicant (King County) is requesting a Critical Areas Exemption and Shoreline
Exemption to to analyze existing flood and landslide hazards and risks, and their
interactions on the left bank of the Cedar River Trail Site A (CRT-A). In order to
characterize subsurface soil conditions, the project proposes to drill up to four borings to
collect soil data for analysis. Boring holes would be backfilled according to Washington
State regulations using bentonite pellets; the excavation and backfilling is less the 500 CY
of material. The project site encompasses approximately 75,000 SF and is adjacent to the
Cedar River Trail. The project site is located within the following critical areas: Moderate
Coal Mine Hazard Area, High Erosion Hazard Area, Moderate Land Slide Area, Protected
Slopes, Urban Conservancy Regulated Shoreline (Cedar River Reach C), stream buffer and
Wellhead Protection Zone 2. The proposed work is a geotechnical study and is to get a
better understanding of the geologic risk of the area. The project proposal would not
impact drainage or require re-grading, as surface would be returned to existing conditions.
The borings and site exploration would not require the removal of any trees or land
clearing. The distance from the closest area of work to the Ordinary High Water Mark of
the Cedar River is 20-feet.
CRITICAL AREA:Moderate Coal Mine Hazard Area, High Erosion Hazard Area, Moderate Land Slide Area,
Protected Slopes, Urban Conservancy Regulated Shoreline (Cedar River Reach C), stream
buffer and Wellhead Protection Zone 2.
EXEMPTION JUSTIFICATION: Site investigative work necessary for land use application submittals such as surveys,
soil logs, percolation tests and other related activities. Investigative work shall not disturb
any more than five percent (5%) of the critical area and required buffer. In every case,
impacts shall be minimized and disturbed areas shall be immediately restored at a
one-to-one (1:1) ratio.

FINDINGS:The proposed development is consistent with the following findings pursuant to RMC
section 4-3-050C.2.d:
i. The activity is not prohibited by this or any other provision of the Renton Municipal Code
or State or Federal law or regulation;
ii. The activity will be conducted using best management practices as specified by
industry standards or applicable Federal agencies or scientific principles;
iii. Impacts are minimized and, where applicable, disturbed areas are immediately
restored;
iv. Where water body or buffer disturbance has occurred in accordance with an exemption
during construction or other activities, revegetation with native vegetation shall be required;
v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section
has a significant or substantial potential to degrade groundwater quality, then the
Administrator may require compliance with the Wellhead Protection Area requirements of
this Section otherwise relevant to that hazardous material, activity, and/or facility. Such
determinations will be based upon site and/or chemical-specific data.
DECISION: An exemption from the Critical Areas Regulations is hereby Approved with Conditions*.
CONDITIONS:1. The applicant shall be required to obtain necessary approvals and/or permits from the
City of Renton Parks Department.
2. The applicant shall be required to obtain any necessary approvals and/or permits from
the City of Renton Plan Review Section.

APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057,
on or before 5:00 p.m., on December 23, 2019. RMC 4-8-110 governs appeals to the Hearing Examiner and additional
information regarding the appeal process may be obtained from the Renton City Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the
approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original
decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval
body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any
person wishing to take further action must file a formal appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

An exemption from a Shoreline Management Substantial Development Permit is hereby Approved
with Conditions* on the proposed project in accordance with RMC 4.9.190C 'Exemption from
Permit System' and for the following reasons:
Activities Necessary for Permit Application: Site exploration and investigation activities that are
prerequisites to preparation of an application for development authorization under the Shoreline
Master Program, if:
a. The activity does not interfere with the normal public use of the surface waters.
b. The activity will have no significant adverse impact on the environment including, but not limited
to, fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values.
c. The activity does not involve the installation of a structure, and upon completion of the activity
the vegetation and land configuration of the site are restored to conditions existing before the
activity.
d. A private entity seeking development authorization under the Shoreline Master Program first
posts a performance bond or provides other evidence of financial responsibility to the Planning
Division to ensure that the site is restored to pre-existing conditions.
e. The activity is not subject to the permit requirements of RCW 90.58.550.
