Exemptions, h. (Extensions, duplications, relocations or rebuilds to existing overhead electrical and communication facilities under the following conditions), ii (When there are existing overhead electrical or communication facilities that will not be removed (such as high tension wires), and the electrical and communication facilities to be removed by undergrounding are parallel to facilities that will not be removed).1 Exemption to this code is not only of benefit to MCImetro Transmission, but more importantly to the City of Renton and its residents. Given that the permitting submitted in this package proposes a route of construction through a primarily residential area of the City of Renton, MasTec is requesting approval of aerial construction to not only permit the shortest route of construction, but also one that results in the lowest impact to the residents of Renton. By constructing an aerial route, MasTec will be able to minimize the duration of construction, the traffic flow impact and the hardscape impact. While it is understood that the City of Renton would prefer underground construction, precedence for aerial attachment of other communication services throughout Renton. MasTec has observed other communications carriers attached to PSE poles in Renton. While it is anticipated that some light to normal make ready would be needed for the proposed path of construction, it is anticipated that the impact to the community would be less than if underground construction were required. For reference, we have included snips of the proposed construction path and Google Earth street view images of the path. Colon, PE Foresite group Inc. Via Email: fcolon@fg-inc.net SUBJECT: Request for Undergrounding Exemption (MCI_1703MOAD.001_ROWI_REN_2324, MFP19006230, 3316 NE 12th St) Dear Mr. Colon: The City of Renton has reviewed your request to grant MCImetro Access Transmission Services Corp. (MCI) an exemption from Renton Municipal Code (RMC) 4-6-090(C) which states that all new electrical or communication facilities shall be required to be installed underground, pursuant to the standards of the section of RMC. Mastec on behalf of MCI Verizon proposes to overlash 303 lineal feet of new overhead fiber on existing Puget Sound Energy poles within NE 12th Street. The work will begin at the pole to the southwest of 3316 NE 12th St property along NE 12th Street and overlash to the east 303 lineal feet ending at the pole to the southeast of 1204 Monroe Ave NE property. ANALYSIS: The City has considered the request for a temporary exemption from RMC 4-6-090. The proposal would utilize existing poles and attach to the existing high tension wire aerial path. Ordinance 5845 grants MCImetro Access Transmission Services Corp., the right to construct, remove, replace, repair, and/or restore any Facility, and may include, but are not limited to, digging and/or excavating to construct, remove, replace, repair, and restore pipeline(s) and/or Facilities with the Franchise area. The proposal would utilize existing poles and attach to the existing communication aerial paths. As minimum vertical height clearance of 15’-6” would need to be provided for, and any existing obsolete cable would need to be removed; staff recommends these as conditions of approval. Therefore, the city is granting an exemption with conditions, Per RMC 4-6-090(D)(h)(ii) which states when there are existing overhead electrical or communication facilities that will not be removed (such as high tension wires), and the electrical and communication facilities to be removed by undergrounding are parallel to facilities that will not be removed. MCI#1703MOAD.001_ROWI_REN_2324 Page 2 of 2 December 11, 2019 DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C) in accordance with RMC 4-6-090(D)(h)(ii), exemption due to other existing overhead electrical or communication facilities that will not be removed (high tension wires), as requested by the applicant is approved with conditions subject to the conditions below. Conditions of Approval: 1. Any existing height violations within the Project Reach must be resolved at the time of construction. New aerial lines within the Project Reach must have a minimum vertical clearance of 15’-6”. 2. Any abandoned or unused lines within the Project Reach must be removed at the time that construction is taking place. 3. A traffic control plan must be separately submitted to the City, and no construction may take place until the City has approved a traffic control plan. 4. The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at MCI’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case MCI shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or (3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and Economic Development Administrator or designee, from the first event triggering the requirement to underground the aerial lines. This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, December 27, 2019.
