See also http://bit.ly/32Oq5GH PROJECT DESCRIPTION: The applicant, the City of Renton, is requesting Environmental (SEPA) Review in order to convert an existing "back-up" type detention pond to a "flow-through" combination wetpond/detention pond in order to improve the quality of water discharging into the Maplewood Creek. The site of the existing facility is within a parcel (APN 3211100010) at the north-east corner of the intersection of Union Ave SE and SE 4th St. The parcel is located in the R-6 zone and is approximately 8,400 sq. ft. in size. The site abuts single-family homes to the north and east. The facility, which was constructed in 1983, provides flow control for approximately 29.8 acres of surrounding residential properties. The existing pond provides little to no water quality treatment and primary functions as a back - up pond rather than a flow-through-type pond. Water in the pond currently drains into a pipesystem that outfalls to Maplewood Creek and eventually the Cedar River. Objectives of the proposed project include improving water quality treatment performance and ensuring the pond meets the Washington Department of Ecology's standards for stormwater facilities. Additional work may include limited vegetation and tree removal and replacement of an existing fence around the facility. The applicant submitted a design report prepared by Loius Berger that includes hydrology and geological analyses. Two preferred alternatives analyzed in depth in the report. Alternative 1 would create a two-cell pond with an access road that divides the cells and provide 0.14 ac-ft of new wetpond storage, while Alternative 2 would create a one-cell pond with a standard access road and would provide 0.17 ac-ft of new wetpond storage. Based on factors including cost, wetpond storage capacity, and ease of construction, the report concludes that Alterative 2 is preferable. The total construction cost was estimated at $409,000, part of which would be funded via a Department of Ecology grant. The applicant intends to complete the project in the summer of 2021. A Wellhead Protection Area Zone 2 is present on the site according to COR maps. A. Environmental Threshold Recommendation Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials: Issue a DNS-M with a 14-day Appeal Period. B. Mitigation Measures 1. The applicant shall provide a project hotline phone number via a letter to properties within 300 feet of the project site prior to the start of construction in order to allow residents to report noise violations or inquire about the project. The number shall be provided at least two weeks before construction begins on the site. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Water a. Storm Water Impacts: According to materials submitted by the applicant, the purpose of the proposed retrofitting project is to improve water quality downstream of the existing facility by converting the detention pond to a combined detention and water quality pond. The applicant submitted a Draft Design Report prepared by Loius Berger and dated October of 2019 (Exhibit 5). The report includes information on current conditions, alternatives analysis, soils investigation data, and hydrologic modeling data. The Plan Reviewer indicated that while the report does not constitute a typical Drainage Report and Geotechnical Report, it adequately addresses expected project impacts and includes sufficient analysis for their preliminary review of the project. Stormwater currently enters the pond from the existing system in Union Ave SE, which handle water from the surrounding properties and streets. Discharge from the pond enters the stormwater pipe system on SE 4th ST and SE 4th Pl and ultimately discharges into the Maplewood Creek outfall and Cedar River. The project is required to comply with both the City of Renton Surface Water Design Manual and Department of Ecology’s Surface Water Management Manual for Western Washington. During review of the Construction Permit, a more robust Drainage Report may be required in order for the Plan Reviewer to complete their review. The Plan Reviewer will work with the applicant prior to submittal of the Construction Permit application to determine the level of review needed for the project. Therefore, existing state and local regulations would be sufficient in ensuring the project would not generate any negative impacts related to storm water and would ultimately result in improved storm water conveyance system for the neighborhood and surrounding area. Mitigation Measures: None Nexus: N/A b. Ground Water Impacts: The project site is located in the Wellhead Protection Area Zone 2. An email received by staff from the Washington Department of Health on November 26, 2019 (Exhibit 3) expressed concern that the applicant did not identify the Wellhead Protection Area Zone 2 in the Environmental Checklist. The applicant provided an updated checklist and stated that they were aware of the aquifer under the project site and would ensure the City’s strict construction standards for sites within an wellhead protection area are adhered to by the project contractors. Therefore, existing City regulations and standards would be sufficient to mitigate for impacts to ground water and would ensure ground water, especially within the aquifer, is not negatively impacted during construction. 2. Vegetation Impacts: The subject site contains a variety of vegetation including deciduous and coniferous trees, grasses, and blackberries. In the updated Environmental Checklist submitted by the applicant, only blackberries and native grasses were identified for removal as part of the project. According to the applicant, no trees are proposed for removal. All vegetation proposed for removal is located inside of the fenced stormwater facility and is expected to be minimal. Therefore staff does not anticipate any significant impacts to vegetation on or near the project site. Mitigation Measures: None Nexus: N/A 3. Transportation Impacts: The proposed project is not expected to significantly impact vehicular access to the surrounding neighborhood. During the installation of the liner, temporary vehicle and/or pedestrian detours may need to be implemented when heavy equipment needs to enter or exit the site. A Traffic Control Plan prepared per City of Renton standards would be required to be submitted for review and approval by the City of Renton Plan Reviewer prior to implementation. Due to the presence of a King County Metro Transit bus stop (Route 114) on Union Ave NE, near the west property line, public transportation may be temporarily impacted by the project. On November 23, 2019, staff received an email from King County Metro Transit Planner Lawrence Chung requesting that the applicant notify both the Construction Information Coordinator and Transit Route Facilities office at King County Metro Transit prior to the start of construction (Exhibit 4). The purpose of the notification would be to allow for adequate time to evaluate whether or not the bus stop needs to be relocated due to the construction. Staff shared the information with the applicant, who has agreed to contact King County one-month in advance of the start of construction. Therefore, staff does not anticipate that the proposed project would generate any significant or long-term impacts to pedestrian, vehicular, or public transit systems. Mitigation Measures: None Nexus: N/A 4. Aesthetics Impacts: The existing stormwater facility is surrounded by a 6-foot tall chainlink fence with plastic slats. The applicant has proposed replacing the existing fence with a new 6-foot high chain link fence around the entire site perimeter. In the submitted materials, the applicant did not indicate the type of chainlink fencing proposed for installation. Due to the location of the site within a developed single-family neighborhood, the use of a high-quality fence would decrease the visual impact to the adjacent properties and provide a better overall aesthetic compared to the existing fence. The City’s standard detail for fencing around stormwater facilities requires the use of a black, coated-chain link material. The facility itself does not include any visually offensive features that would impact the adjacent neighbors. Therefore, existing City regulations would be sufficient to mitigate any visual impacts on the neighborhood created by the new fence. Environmental Health a. Noise Impacts: The applicant indicated in the submitted Environmental Checklist that construction noise is expected to occur during work hours between the hours of 7am and 5pm, Monday through Friday. The applicant stated in the checklist that the contractors would minimize noise impacts through the use of the appropriate exhaust systems and mufflers. While noise would likely be temporary in nature and would not be allowed to exceed limits in the City’s noise regulations, the project site is surrounded by residential properties and is located on a relatively quiet dead-end street. Therefore staff recommends, as a mitigation measure, that applicant provide a project hotline number via a letter to properties within 300 feet of the project site that can be used to report excessive noise or impacts to the surrounding properties. The number shall be provided at least two weeks prior to the start of construction. Mitigation Measures: The applicant shall provide a project hotline phone number via a letter to properties within 300 feet of the project site prior to the start of construction in order to allow residents to report noise violations or inquire about the project. We have the following comments: Critical Areas. The project site is overlain by a wellhead protection area (WHPA) associated with the City’s own water system (see details below), which is shown as high susceptibility area. The WHPA is depicted as a wellfield associated with three separate sources. Per RMC 4-3-050.B.1.e, WHPAs are regulated critical areas. The SEPA checklist (Q.B.8.h) does not identify the critical area, & the NOA indicates that City maps show no critical areas on the project site. The SEPA checklist discusses the possibility of ground water flowing into the pond (Q.B.3.b.1) but does not evaluate the impact of the pond upon groundwater quality. From the description in Q.B.3.c.1, it appears the pond is & will continue to be tightlined to a Cedar Creek outflow; yet the overall project is described as benefitting surface water. It isn’t clear from the information included whether any form of infiltration is included. Nevertheless, the overall project appears to include actions that come under the “Activites to Which These Regulations Apply” in RMC 4-3-050.B.2, & surface water improvements in WHPAs do not appear to be exempt from critical areas review in the table under ss. C.3 of that same section. Please evaluate the project for compliance with critical areas regulations & WHPA considerations. The site currently has a public stormwater pond serving the Heather Downs community. The site is fronted by NE Union Ave SE to the west, SE 4th St to the south and private property to the north and east. WATER: The proposed project is within the City’s water service area and in the Highlands 565 pressure zone. There is an existing 12-inch water main in Union Ave SE (Record DWG – W-022502) that can deliver a maximum flow rate of 3,500 gallons per minute (GPM) as well as an existing 36” SPU Water System within Union Avenue SE. There is an existing 6-inch water main in SE 4th St (Record DWG – W-022502) that can deliver a maximum flow rate of 1,400 GPM. The static water pressure is about 82 psi at a ground elevation of 374 feet. There is no existing water service to the parcel. SEWER: The proposed project is within the City’s sewer service area. There is an existing 10-inch gravity wastewater main running within SE 4th St (Record DWG – S-14540Az) with a sewer stub to the south property line. STORM: The parcel contains an existing back-up style stormwater detention pond (Facility ID No. 111387). There is an existing 12-inch stormwater main and catch basins in Union Ave SE (Record DWG – R136313) connected to an existing stormwater control structure (facility ID No. 115570 and Record DWG – R145401). The control structure detains water in the pond and discharges to an existing 12-inch stormwater main in SE 4th St (Record DWG – R145401). STREETS: The proposed project fronts Union Ave SE along the west property line and SE 4th St along the south property line. Union Ave SE is classified as a Collector Arterial street; existing right-of-way (ROW) width, according to the King County Assessor Map, is 30 Heather Downs Detention Pond Water Quality Retrofit – PRE19-000293 December 11, 2019 Page 2 of 4 feet. SE 4th St is classified as a Residential Access street; existing ROW width, according to the King County Assessor Map, is 50 feet. WATER 1. Water services are not proposed as part of the project. SEWER 1. Sewer services are not proposed as part of the project. SURFACE WATER 1. A geotechnical report dated October 1, 2019, completed by HWA Geosciences Inc., was provided with the Land Use Application as part of the design report. The report discusses the soil and groundwater characteristics of the site and provides recommendations for project design and construction. Geotechnical recommendations presented in this report do not support the use of infiltration due to high groundwater elevations and require the use of a pond liner to maintain minimum design water levels. Additionally pond slopes were analyzed and found that the existing 1H:1V slope was acceptable if slopes for deepening the pond were no steeper than 2H:1V. 2. Louis Berger, with the land use application, submitted a preliminary design report dated October 2019. Based on the City of Renton’s flow control map, the site falls within the City’s Flow Control Duration Standard matching Forested Site Conditions and is within the Lower Cedar River Drainage Basin. The project is subject to a Category 1 Targeted drainage review in accordance with the 2017 RSWDM. The design report presents a Category 2 Targeted drainage discussing core requirements 1, 2, 4, 5, 6, 7. a. The report identifies a Category 2 Targeted drainage review, however, due to the project being within Zone 2 of the Aquifer Protection Area the project shall comply with a Category 1 Targeted drainage review. The following core and special requirements shall apply to the project and be discussed in the report provided as part of the Civil Construction Permit Application: i. Core requirement: 2, 3, 4, 5, 6, 7, 8 ii. Special requirement: 1, 2, 3, 4, 6 b. Flow Control, RSWDM Core Requirement #3: the project proposes less than 5,000SF of impervious area and less than ¾ acres of land disturbing activity, therefore, the project is exempt for providing any additional flow control. c. Conveyance System, RSWDM Core Requirement #4: All new conveyance systems constructed as part of the project must be sized to RSWDM standards for the total tributary area (onsite and offsite) that the storm systems serve. The proposal will install a new catch basin with piping to convey stormwater into the north end of the wetpond. Stormwater is conveyed from the wetpond into a new flow control structure where it then ties into the existing conveyance system. i. Conveyance capacity analysis in compliance with RSWDM section 4 of the RSWDM will be required. d. Construction Stormwater Pollution Prevention, RSWDM Core Requirement #5: All proposed projects must provide stormwater pollution prevention and spill controls. The proposal includes a Temporary Erosion Control Plan (TESC). The TESC plan identifies the use of a sediment trap and pump to provide erosion control. The proposal will remove the existing flow control structure but does not Heather Downs Detention Pond Water Quality Retrofit – PRE19-000293 December 11, 2019 Page 3 of 4 indicate how flow control is to be maintained during the course of construction. The following are items that will need to be addressed as part of the Civil Construction Permit Application: i. A complete CSWPP plan in compliance with sections 1.2.5 and 2.3.1.3 ii. As part of CSWPP, and as needed on TESC plan, temporary flow control measures will be required to provide the same level of service as the existing structure during the period between its removal and the operation of the new facility. iii. As part of CSWPP, calculations for sizing of the temporary sediment trap in compliance with section D.2.1.5 will be required. e. Maintenance and Operations, RSWDM Core Requirement #6: The proposed facility will be brought into the City’s overall storm water system and will be maintained in accordance with the City’s system wide NPDES Permit and overall Maintenance and Operations program. f. Financial Guarantees and Liability, RSWDM Core Requirement #7: The project will be constructed by the City of Renton and therefore does not require a financial guarantee. g. Water quality Facilities, RSWDM Core Requirement #8: The project, in accordance with the City of Renton Surface Water Manual, does not trigger Core Requirement #8, however, an analysis was conducted to determine the water quality benefits provided by the project. h. Special Requirements 1 through 5: Based on the project proposed, these requirements are not applicable. i. Special requirement 6 Aquifer Protection Area: The project, a water quality treatment pond, is located within Aquifer Protection Area Zone 2 and as such shall provide a liner in accordance with design criteria in section 6.2.4 of the RSWDM. The following are items that will need to be addressed as part of the Civil Construction Permit Application: i. The proposed low permeability liner must installed along the pond bottom and sides up to the 2-year live storage water surface elevation in accordance with table 6.2.4.A ii. Section 4.1 of the report shall discuss how the project is complying with special requirement 6. 3. The current Surface Water Standard Plans shall be included in all drainage plan submittals. The current City of Renton Standard Details is available online on the City of Renton website. 4. The 2019 Surface water system development fee is $0.72 per square foot of new impervious surface, but no less than $1,800.00 for each new lot. This is payable prior to issuance of the construction permit. This fee is subject to change based on the calendar year the construction permit is issued. TRANSPORTATION 1. The project is exempt from providing frontage improvements in accordance with RMC 4- 6-060. 2. Paving and trench restoration shall comply with the City’s Trench Restoration and Overlay Requirements. 3. The transportation impact fees are not applicable to this project. All existing and proposed utility lines (i.e. electrical, phone, and cable services, etc.) along property frontage or within the site must be underground. The construction of these franchise utilities must be inspected and approved by a City of Renton inspector. 2. Maximum exposed retaining wall height is 6-ft and shall be setback a minimum of 3-ft from the right-of-way as outlined in RMC 4-4-040 – Fences, Hedges and Retaining Walls. 3. Adequate separation between utilities as well as other features shall be provided in accordance with code requirements. a. 7-ft minimum horizontal and 1-ft vertical separation between storm and other utilities is required with the exception of water lines which require 10-ft horizontal and 1.5-ft vertical. b. The stormwater line should be minimum 5 feet away from any other structure or wall or building. c. Trench of any utility should not be in the zone of influence of the retaining wall or of the building. 4. All civil construction permits for utility and street improvements will require separate plan submittals. All utility plans shall confirm to the Renton Drafting Standards. A licensed Civil Engineer shall prepare the civil plans.
