Property's drainage facilities are shown and/or listed on Exhihit A—Site Plan, The Property's
drainage facilities sha[1 be maintainecf in compliance with the operation and maintenance
schedule included and attached herein as Exhibit B—Operations and Maintenance. Drainage
facilities include pipes, chann�ls, flow control facilities, water quality facilities, on-site best
management practices (BMPs) and other engineered structures designed to manage and/or

treat storrrswater on the Property. On-site BMPs include dispersion and infiltration devices,
bioretention, permeable pavements, rainwater har�esting systems, tree retention credit,
reduced impervious surface footprint, vegetated roafs and ather measures designed to mimic
pre-develaped hydrology and minimize stormwater runaff on the Praperty.
2. City of Renton shall have the right to ingress and egress over those portions of the Property
necessary to perform inspections of the starmwater facilities and BMps and conduct
maint�nance acti�ities specified in this Declaration af Covenant and in accordance with the
Renton Municipal Code. City of Renton shall provide at least thirty(30) days' written notice to
the Owners that entry on the Prnperty is planned for th�inspection of drainage facili�ies.After
the thirty �30) days,the Owners shall allow the City of Rentfln to enter for the sole purpose of
9nspecting drainage facilities. ln lieu of inspection by the City,the Owners may elect to engage
a licensed ci�if engineer registered in the state of Washrngton who has expertise in drainage ta
inspect the drainage facilities and provide a written report describing their condition. If the
engineer option is chosen,the Owners shafl provide written notice to the City of Renton within
fifteen{�.5)days of recei�ing the City's notice of inspection.Within thirty{3p)days of giving tf�is
notice,the Owners,or engineer on hehalf of the Owners,shall provide the engineer's report to
the City of Renton. lf the report is not provided in a#imely manner as s�ecified abo�e,the City
of Renton may inspect the drainage facilities withaut further notice.
3. If City of Renton determines from its inspection, or from an engineer's report provided in
accardance with Paragraph 2,that maintenance, repair, restorativn, and/or mitigation work is
requir�d to be don�to any of the drainag� facilities, City af Renton shall notify the Owners of
the specific maint�nanc�., repair, res#oration, and/or mitigation work ("Work") required
pursuant to the Renton Municipal Code. Th� City shall alsn set a reasona�le deadline for the
Owners tn cnmplete the Wor[c, ar to pravide an engineer's report that verifies completion af
the Work. After the deadline has �assed, the Owners shall allaw the Gity access to re-inspect
the drainage faeilities unless an engineer's report has b�en provided verifying completion of
the Work. if the Work is not completed within the #irne frame set by the City, the City may
initiate an enforcement action and/or perform the Work and hereby is given access to the
Property for such purposes. Written notice will be sent to the Owners sta#ing the City's
intention to perform such Work.This Workwill not commence until at least seven(7}days after
such notice is mailed. If, within the sole discretion of the City, there exists an imminent or
present danger, the seven �7) day notice periad will be wai�ed and Worlc will �egin
immediately.
4. 1'he Owners shall assume all responsibility far the cost of any Work, or any measures taken by
the City ta address conditions as described in Paragrapf� 3. 5uch responsibility shall incl�de
reimbursement to the City within thirty(30)days ofthe receipt of the invoice for any such Work
performed. Overdue payments will require payment of interest at the maximum legal rate
allowed by RCW 19.52.020(currently twe[�e percent (12%}). [f the City initiates legal acYton to
enforce this a�reernent, the prevailing party in such action is entit{ed to reco�er reasonab[e
]itigation casts and attorney's fees.
5. The Owners are req�ired fio obtain written appro�al from City of Ren#on prior to filling, piping,
cutting, ar remo�ing�egetation (except in rautine landscape maintenance} in open vegetated
stormwater faciliCies (such as swales, channe[s, ditches, ponds, etc.), or perfarming any
alterations or mvdificatians to the drainage facilities referenced in this Declaration of Covenant.

MAINTENANCE INSTRUCTIONS FOR A PERFORATED PIPE
CONNECTION
Your property contains an on-site BMP {best management practice}called a"perforated pipe
conraection,"wliich was installed to reduce tl�e stormwater runoff impacts of some or alI of#he
i�x�perviot�s s��rface on your property.
A perforated pipe connection is a Iength of drainage conveyance pipe with l�oles in the bottom,
designed to"leak"runoff, conveyed by tl�e pipe, inta a gravel filled trencla where it can be soaked into
tlie surrounding soil.The connection is intended to provide opporCunity for in#iltration of any runoff
that is being conveyed from an impervious suz�ace(usually a roo� to a local drainage system such as a
ditch or roadway pipe systenn.This on-site BMP shall be maintained per Appendix A of the City of
Renton's Surface Water l�esign,Manual.
