Property's drainage facilities are shown and/or [istec[ on Exhibit A—Site Plan. 7he Property's
drainage facilities shall be maintained in compliance with the operation and maintenance
schedule included and attached herein as �xhibit B—Operations and Maintenance. Drainage
facilities include pipes, channe[s, flow control facilities, water quality facilities, an-site best
managemen't practices (BMPs} and other engineered structures designed to manage and/or

treat starrnwater on fihe Praperty. Qn-site BMPs include dispersion and infiltration deviees,
bioretention, permeable pa�ements, rainwater harvesting systems, tree retentian credit,
reduced imper�ious surface foatprint,�eg�tated raofs and nther measures designed ta mimic
pre-de�elaped hydralogy and minimize stormwater runaff on the Praperty.
2. City of Renton sha[I ha�e the right to ingress and egress o�er those portions of the Property
necessary to perform inspections af the stormwater facilities and BMPs and conduct
maintenance activities specified in this Declaration oF Ca�enant and in accordance with the
Renton Municipaf Code. City of Renton shalf provide at least thirty (30J days' written notice ta
the Owners that entry on the Property is planned for the insp�ctian o#drainage facili�ies.After
the thirty �30) days,the Owners shall allow the City o�Renton fio enter far the sole purpose of
inspecting drainage facilities. In lieu af inspection by th�City,th� Owners may elect to engage
a licensed ci�il engineer registered in the state of Washingtnn whn has exper�ise in drainage to
inspect the drainage facilities and pro�ide a written report describing their condition. [f the
engineer option is chosen,the Owners shall provide written notice to the City of Renton within
fifteen(15)days vf receiving the City's notice of inspection.Within thirty(3D)days of giving this
notice,the Owners, or engineer an behalf of the Owners,shall provic{e the engineer's report to
the City of Renton. If the repart is not pro�ic[ed in a timely manner as speeified above,the City
of Renton may inspect the drainage facilities witf�out furth�r notice.
3. If City of Renton determines from its inspection, or from an engineer's report provided in
accardance with Paragraph 2,that main#enance, repair, restoration, and/ar mitigation work is
required#o be done to any of the drainage fiacilities, City af Rentan shall notify the Owners of
the specific maintenance, repair, restoration, and/or mitigation wor€C {"Work") required
pursuant to the Renton Municipal Coc[e. 7he City shall also set a reasana6le deadline far the
Owners to complete the Work, or to pro�ide an engine�r's report that v�rifies com�letion of
tF�e Work. After the deadline has passed, tF�e Owners shall allow the City atcess to re-inspect
the drainage faeiliti�s unless an engineer's report has been pro�ided �erifying completion of
the Work. ]f th� Warl< is not completed within the time frartie set by fihe City, the City may
initiate an enforcement action and/or perform the Work and hereby is given access to the
Property for such purposes. Written notice will be 5ent ta the Qwners stating the City's
int�ntion to perform such Work.This Work will not cammence unti]at least seven (7)days after
suth notice is mailed. If, within the sole discretion of the City, there exists an imminent or
present danger, the se�en (7) day notice period will be waived and Work will begin
immediately.
4. The Owners shall assume all responsibility for the cost of any Work, ar any measures taken by
the City ta address conditions as described in Aaragraph 3. Such responsibility shall include
reimbursement fia the City within#hirty(30}days ofthe receipt ofthe invoice for any such Work
performed. O�erdue payments will require payment of interest at the maxirr�um legal rate
allowed by RCW 19.52A2� (currently twelve percent(12%J). If the Ci#y initiates legal action to
enforce this agreement, the prevailing party in such action is entitled to recover reasonable
litigatinn costs and attorney's fees.
5. The Owners are required to abtain written appro�al from City of Renton priar to filling, piping,
cutting, ar removing vegetation (except in routine landscape maintenance) in open vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), ar performing any
alterations or modificatians to the drainage fiaeiiities referenced in this Declaration of Co�enant.

CONNECTION
Your property contains an on-site BMP (best manageznent practice} called a "pelforatert pipe

A perfora�ed pipe connection is a lengCh of drainage conveyance pipe with holes in the bo#to�n,
designed to"leak"runaff, co�veyed by tt�e pipe,into a gravel filled�rencl3 w��ere it can be soaked into
tl�e surrounding soil.Tlie conz�ection is intended to provide opportunity for in�ltratioz�of any runoff
tl�at is being conveyed£irom an isnpervious surface(usually a roo� to a local drainage systein such as a
ditc}�or roadway pi�e systein. This on-site BMP sliall be maintained per Appendix A of the City of
