City of Renton shal[ have the rigF�t to ingress and egress o�er those portions of the Property necessary to perform inspections of the starmwater faci[ities and BMPs and conduct maintenance activities specified in this Declaration of Covenant and in aceardance with the Renton Municipa] Code. City of Rentan shall pravide at feast thirty(3D) days' written notice ta the Owners that entry on the Property is planned far the in�pection of drainage facilities.After the thirty (30) days,the Owners shall allow the City of Renton to enter for the sole purpose of inspecting drainage facilities. In lieu of inspection by the City, the Owners may elect to engage a licensed civii engineer registered in the state of Washington who has expertise in drainage ta inspett the drainage faci[ities and pro�ide a written report describing their candition. If the engin�er option is chosen,the Owners shal! pro�ide written notice to the City of Rentan within fifteen(�.5}days of receiving the City's natice of inspection.Within thirty(30)days of giving this natice,the Qwners,or engineer on behalf o#the Owners,shall pro�ide the engineers report to the City of Renton. If the report is not provided in a timely manner as specified abo�e,the City of Renton may inspect the drainage facilities without further notice. 3. I# City of Renton determines from its inspeetion, or from an engineer's report pra�ided in aecordance with Paragraph 2,that maintenance, repair, r�storation, and/or mitigation work is required to l�e done to any of the drainage facilities, City af Renton shall notify the Owners of the specific maintenance, repair, restoration, and/ar mitiga�ion work ("Work"} required pursuant to the Rentan Municipa[ Code. The City shall also set a reasonable deadline for the Owners to complet�the Work, or to provide an engineer's report that verifies completion of th� Work. After the deadline has passed, the Owners shall allow the City aceess ta re-inspect the drainage facilities unless an engineer's report has b�en pravided verifying campletion of the Wark. lf the Work is not completed within the time frame se# by the City, the City rnay initiate an enforcement action and/or perform the Work and here6y is gi�en access to the Proper�y for such purposes. Wrififien notice will 6e sent to the Owners stating the City's intention to perform such Work.This Wark will not cammence until at{east seven(7)days after such nofiice is rrzaileci. If, within the sole discretion af the City, there exists an imminent or present danger, the seven (7) day notice perioc[ will be wai�ed and Work wi[1 begin immediately. 4. The Owners shali assume a[1 responsibility for tF�e cost of any Work, or any measures taken by the City to address conditions as described in Paragraph 3. Such r�sponsibility shall include reimbursement to the City within thirty{30)days of the receiPt ofthe invoice for any such Work performed. bverdue payments will require payment of interest at the maximum legal rate allowed by RCW 19.52.020 (currently twelve pereent (12%)).
