Property's drainage facitities are shawn and/or fisted on Exhibit �—Site Pfar�, The Property`s
drainage facifities shall be rnaintained in compliance with the operation and maintenance
schec�ule induded and attached herein as Exhibit �—Clperations andY Maintenance. Drainage
facilitdes ir�cfude pipes, channels, flaw eantrol facilities, water quality facilities, art-site best
management practices (BMPs) and other engineered structurt�s des"sgned to manage arrd/ar

treat stormwater on the Property. On-s'ste BMPs include dispersiQn and infiftratior� devices,
bioretention, permeable pavements, rainwater harvesting systerns, tree retentian credit,
reduced impervious surface footprint, vegetated rnofs and ather measures designed ta mimic
pre-developed hydre�lagy and rninimize stormwater runoff ora the Property.
2. City of Rentor� shall have the right ta ir�gress and egress ouer thase partions of the Property
neeessary to perform inspectians of the stormwater faciCities anct BN1Ps ancf conduct
maintenance activ�ties specified in this Declaratian of Covenant and in accordance with the
Renton Municipal Code. City af Rentan shalf provide at least thirt� (30} days' written notice ta
the Owners that entry on the Praperty is planned for the inspection of drainage facilities. After
the thirty (30} days,the Qwners shaCl aliow the City of Renton to en�er for the sole purpose of
inspecting drainage facilities. In lieu af inspectian by the City,the Owners may elect to engage
a ficensed civil engineer registered in the state of WashEngton who has expertkse in drainage�o
inspect the drainage facilities and provide a written report describing their conditian. ff the
engineer optiorr is chosen,the Owners sha{I pravide written rtotice tc�the City of Renton within
fifteen (15)days of receiving the City's notice of inspectian.Within thirty(30)days of giving this
notice,the Owrrers,ar engineer an behalf af the Owners,shall pravide the engineer's repQrt to
the City of Renton. If the report is not provided in a timely manner as specif�ed abave, the City
of Rentan may inspect the drainage facilities without further natice.
3. If City of Rentan c�etermines from its inspection, ar from an engir�eer's repork provided in
accordance with Paragraph 2,that maintenance, repair, restoratiorr, and/or rnitigatiot�wark is
required to be done to any of the drainage facilities, City of Renton shai( notify the Owners of
f the specific maintenance, repair, restoration, and/ar mitigation w4rk ("Wark") required
pursuant to the Renton Municipal Code. The City shal! also set a reasonable deadCine for the
Owners to comp{ete the Work, or ta provide an engineer's report that uerifies completion of
the Wo�k. After the deadline has passed, the Owners shall ailow the City aecess to re-inspect
the draonage facifities unless an engineer's report has been provideef verifying completion of
the Work. If the Work is not campleted within the time frame set by the City, the City may
initiate an enfarcer�ent action and/or perfc�rm the Work and hereby 'rs given access to the
Property for such purposes. Written notice wili be sent ta the Owners stating the City`s
intentian to perform such V+lcrrk.Tt�is tNc�rk wilf not eommence untifatieast seven(7�days after
� such natice is maiked. If, within the sole discretio� of the Csty, there exists an imminent ar
present danger, the seven (7} day notice periad wil( be waived and Wark will begin
immediately.
4. The Qwners sha4f assume all respansibility far the cost c�f any Work, ar any measures taken by
the City ta address conditions as described in Paragraph 3. Such responsibrlity shall include
reimbursement to the City within thirty(3Q)days af the receipt af the invaice for any such Work
perfarmed. Overdue payments wilf requrre payment caf interest at the max'rmum legal rate
allawed by RCW 19.52.02Q (currently twelve percent (12%)). ff the Coty irrFtiates legaf actian to
enforce this agreer�ent, the prevailing paety in sueh action is entFtled ta recouer reasonabie
litigation costs and attorney's fees.
5. Tf�e C7wners are required ta obtain written appraval fram City af Renton prior to tilfing, pipMrmg,
cutting, ar remaving vegetation (except in rautine lanclscape maintenance) in open vegetated
starmwater �acilities (such as swales, channels, ditches, ponds, etc.), ar p�rfarming any
alterations or mcrcfifications to the drainage facilities refereneed in this Declaratian af Govenant.

6. Any notice or cr�nsent required to be given or otherwise provided for by the provisions of this
Agreement shall be effective upnn pers�anal cielivery, or�hre� (3) days a#ter mailing by Certi�ied
Mail, return receipt requested.
7. With re�ard to the rnatters addressed htr�in,this agreement cr�nstitut�s the entire a�reemen�
between 1he parti�s, and su�ersecJes all prior discussir�ns, negotiations, and all a�reem�nts
whatsoever whether oral ar writ�en.
8. This Decl�ration ofi Covenant is intended to prr�tect the value �nd desirability and prarne�te
efficient and effective manager°�ent ��f surface water draina�;e of the real property described
above, and shall ini�re to the benefiit c�f all the citizens of the City af Renton and its successors
and assi�ns. This Dee{aration af Covenant shall r�an with the land and be binding upon
Grantor(s), and Grantor's(s') s��ccessors in ir�terest, and assi�;ns.
9. This Declaration of Covenant m�y be 4�erminated by execution �f a written agreement by the
Owners and the City tf�at is recarded by King County in its real property records.
