Utility: I-405 Box Surface Water Utility Division requested approval of a project agreement and
Culvert/P-1 Channel an operation and maintenance agreement with Soil Conservation Service in the
Improvements, Soil amount of $517,713.44 for the I-405 Box Culvert/P-1 Channel Improvement
Conservation Service Project (Springbrook Creek). The City's share is $143,538.11. Refer to
Utilities Committee.
CAG: 91-002, Addendum WastewaterUtility Division requested authorization to execute Addendum No.
No. 6, East Renton 6 to CAG-91-002 with RH2 Engineering in the amount of $164,766 to
Interceptor, RH2 perform construction engineering services on the East Renton Interceptor
Engineering Project. Council concur.

OLD BUSINESS Council President Stredicke presented a report recommending concurrence in
Committee of the Whole Ithe staff recommendation to authorize a new section to the Sign Code that
Planning: Sign Code specifically addresses the needs of large (450,000 square feet or more) retail
Change for Large Retail centers. The Committee further recommended that the ordinance regarding
Centers ;this matter be presented for first reading. MOVED BY STREDICKE;
'SECONDED BY TANNER, COUNCIL CONCUR IN THE COMMITTEE
REPORT. CARRIED. (See page 241 for ordinance.)
Transportation (Aviation) Transportation (Aviation) Committee Chair Edwards presented a report
Committee 'regarding the assignment of lease and operating permit for Puget Sound
Airport: Lease Assignment Helicopters, Inc. Plane Space Investments, Inc. has requested that the City
from Plane Space 'Council approve the assignment of its lease for land at the south end of the
Investments to Puget !airport to Puget Sound Industries, Inc. The assignment will be made in
Sound Helicopters, LAG- connection with the sale of the improvements (hangar and office building) on
84-006 the leasehold property to Puget Sound Industries. Plane Space will retain a •
security interest in the lease as collateral.
Puget Sound Industries, Inc. will subsequently sublease the leasehold property,
the hangar building and the office building to Puget Sound Helicopters, Inc.
for aviation-related activities including flight instruction, aircraft charters and
maintenance of aircraft.
Since the City does not have direct leases with Puget Sound Industries, Inc. or
Puget Sound Helicopters, Inc., permits for the operation of aviation-related
activities on the Renton Airport have been prepared for both businesses.
As a result of citizen concerns regarding helicopter operations, the Committee
requested a demonstration of typical operations. The proposed lessee has
planned such a demonstration for the evening of Wednesday, June 22 between
6 and 7 p.m. The Airport Manager will collect citizen comments.
It is the Transportation Committee's recommendation that this item be
referred to the Committee of the Whole on Monday, June 27 for a final
recommendation. MOVED BY EDWARDS, SECONDED BY SCHLITZER,

Responding to Council President Stredicke, Assistant City Attorney Zanetta
Fontes said the City can stipulate in the lease agreement what type of aircraft
the lessee will be allowed to operate. Councilman Tanner added that only the
Federal Aviation Administration (FAA) has the authority to regulate flight
paths, although this agency is usually amenable to working with local airports
to establish acceptable flight paths.

Summary of Action:
,RH2 Engineering, P.S., will perform construction engineering services for the West Maplewood
Alternative of the East Renton Interceptor Project. The original contract with RH2 Engineering
included this construction engineering element as a later phase. Addendum No. 6 implements that
phase.
Balance of the $3,057,139.01 project budget covers staff time and the construction costs. Staff
time cost is'estimated at $60,000 through final construction and construction costs are estimated
at 2,578,040.96. The remaining $252,000± will be utilized to cover contingency costs and a
portion of the Phase II construction costs.
Staff Recommendation:
It is the recommendation o l the Planning/Building/Public Works Department that Council authorize
the Mayor and City Clerk to execute the attached Addendum No. 6 to CAG-91-002 with RH2
Engineering to perform construction engineering services on the East Renton Interceptor Project.

Citizen Comment: Vaupel Versie Vaupel, P.O. Box 755, Renton, 98057, introduced Daryl McCormick, a
- Introduction of Boy member of the Boy Scouts of America. Mrs. Vaupel explained that Daryl is
Scout seeking a merit badge, and one of the requirements he must fulfill entails
obtaining a copy of the City's published budget. Jay Covington, Executive
Assistant to the Mayor, replied that copies of the budget are available on the
first floor of City Hall at the Finance Department.
Citizen Comment: Webb - Sandy Webb, 430 Mill Ave. S., Renton, 98055, thanked Council for its •
WSDOT I-405 S-Curve decision last week retaining the Renton Hill staircase accessing the Cedar
Project Avenue pedestrian bridge. Noting that one Councilmember had asserted that
this facility was not in the original project plans but showed up only in 1991,
Mr. Webb produced a copy of a letter dated October 1985 from former
Council President John Reed to WSDOT which states, in part, that
Maintaining adequate pedestrian access to Renton Hill dictates making
additional improvements to those shown on the model. The installment of
tairways on one of the access roads would provide access from Renton Hill to
City Hall, Renton Library, and Liberty Park." The letter also refers to
"mitigating measures to compensate for the impacts (of the S-Curve project)"
ind to "the linkage between Renton Hill and downtown."

Police: Washington Model City Clerk submitted letter from Municipal Research Center indicating the
Traffic Ordinance need to readopt the Washington Model Traffic Ordinance, WAC 308-330, by
Adoption reference prior to July 1, 1994. Council concur. (See page 227 for
Qrdinance.)
Vacation: S 11th St, Free, City Clerk submitted petition for vacation of portion of South 11th Street
Monaghan, Kunstle, between Jones and Grant Avenues South, VAC-94-001 (Free, Monaghan,
VAC-94-001 Kunstle), and requested a public hearing be scheduled on this issue. Refer to
Utilities Committee; adopt resolution setting public hearing on 7/11/94. (See
page 227 for resolution.)
CAG: 94-036, East City Clerk reported bid opening on 5/17/94 for CAG-94-036, East Renton
Renton Sewer Interceptor, Sewer Interceptor; 7 bids; engineer's estimate $3,537,959.31; and submitted
Westcon Construction Wastewater Utility'Division recommendation to award the contract to the low
ReniOj Sy5lb bidder, Westcon Construction, in the amount of $2,578,840.96. Council
concur.
Building: Sign Code Development Services Division reported request from the Trammell Crow
Revisions for Large Company for signage for the Ikea Home Furnishings store that would exceed
Retailers the regulations prescribed by the Sign Code, and submitted Executive
Department recommendation to adopt a new section of the Sign Code
specifically addressing the needs of large (450,000+ sf) retail centers. Refer to
Committee of the Whole.
Transportation: Garden Development Services Division requested that Council authorize a three-month
Ave N Temporary Closure closure of Garden Avenue North between North 4th and 5th Streets beginning
August 1994 through October 1994 to. allow PACCAR to comply with required
remediation of contaminated soils in this area. Refer to Transportation
Committee.
Plat: Final, Sunset Hills, Hearing Examiner submitted final plat for Sunset Hills, a 29-lot subdivision
NE 24th St/Jones Ave, located at NE 24th Street east of Jones Avenue, File No. FP-94-040, and
FP-94-040 'requested approval with covenants and conditions. Council concur. (See page'

River Days Insurance REQUIREMENTS TO THE COMMITTEE OF THE WHOLE FOR
Requirements CONSIDERATION AND RECOMMENDATION. CARRIED.
Comprehensive Plan: Referring to the East Renton Interceptor Special Assessment District (SAD),
Urban Growth Councilman Edwards distributed information showing that the boundary of
Boundary/East Renton the SAD includes part of an area outside Renton's urban growth boundary.
Interceptor SAD Area Mr. Edwards explained that the City is prohibited from extending sewer
services beyond the urban growth boundary except for the purposes of public
health and safety. For this reason, he suggested that the City request the
;Growth Management Planning Council (GMPC) to revise Renton's urban
;growth boundary from 148th Ave. SE eastward to 156th Ave. SE to include
the approximately 78 acres in the vicinity of the Morrison property on the
north side of SE 128th St.

the eastern boundary of Renton's urban growth line. Speaking as the City's Public
Works Director, I find that there are compelling reasons to recommend revising the
urban growth line from 148th Avenue SE eastward to 156th Avenue SE to include the,
area in the vicinity of the Morrison property on the north side of SE 1 28th Street.
There has been .a history of failing septic systems in the general vicinity of the subject
land. This area is within the recharge area of our drinking water aquifer, and would be
incorporated into aquifer protection area 2 if it was within the City limits. As you are
aware, one source of potential contamination to our drinking water supply is septic
systems. One of the City's priorities is to provide sewer service over time to as many
of the developed areas within our aquifer recharge zones as possible to prevent or limit
any eventual contam'nation to our aquifer. By moving the urban growth line east to
156th Avenue SE, tlIere will. be a possibility of providing sewer service to the area in
the future.
This area is also within the special assessment district for the East Renton Interceptor
(see attached map). This area was included in the assessment district because the
interceptor was sized to provide flow capacity to this drainage basin if and when
sewer service is ever provided. It was recognized that eventually sewer service might
be necessary due to failing septic systems and the need to protect the drinking water
aquifer, and so the Interceptor'was sized to provide capacity for saturation growth in
this area. 0
For these reasons, staff recommends extending the urban growth line east of the
subject property.

EAST RENTON INTERCEPTOR PROJECT
SPECIAL ASSESSMENT DISTRICT NO. 0002 •

Dear Property Owner:
The purpose of this letter is to provide clarification of the notice, mailed to you on May 11, 1994, about the
proposed assessment district. This letter will describe what actions will trigger payment of the assessment. In
addition, a legible map has been included for your reference.
The purpose of the assessment district is to allow the City the ability to collect the costs of the construction of
the East Renton Interceptor by all.tjt p_e who bs2eft from its construction. .To accomplish this, we are required
to record a Notice of Potential Assessment against any parcel,that may benefit in the future. It is our goal to
ensure, in fairness to all, that any property owner that connects at a later date pays their share just like those
who wiii curiiiect light away. .
The benefit area is defined as the ultimate service basin this facility may be able to serve. This boundary is
shown on the map printed,on the reverse side of this notice and is labeled "Special Assessment District
Boundary".
You will only be required to pay this assessment when the property gains benefit from the new interceptor.
Until that time, the property can be sold or change hands without triggering the assessment. Benefit from this
sewer interceptor can be described as follows: •
• A property not currently connected to a City sewer facility (i.e., currently utilizing an on-site system), that
connects to the sewer system associated with this district will trigger the assessment. Until then, the
assessment will not be triggered.
• For those properties currently connected to City sewer, this assessment will only be triggered if the property
increases its density eitherr by change of use (i.e., single family to multi-family or commercial) or through
increased density within the same use (i.e., further subdivision of land for single family or increased units
for multi-family).
The City does not provide sewer service outside its city limits except in the case of a threat to public health
(such as a failed septic system(s) or contamination of a public water supply) or by agreement with the adjacent
sewer district. The City does not have plans to provide service to the portion of the assessment district outside
' the city limits prior to annexation of those areas. When an area annexes to the City, extensions of sewer
service will most likely be acComplished by either developer extensions or citizen-initiated Local Improvement
- Districts. 1
You will not be required to pay the assessment until one of the above situations occur. However, the
assessment district will accrue interest at a rate of 10% per annum, not to exceed 100% of the original
assessment. The accrual of interest will begin thirty (30) days after the Notice of Potential Assessment is
recorded with King County Records. To avoid interest charges at a future date, you may pay the amount of
assessment during the thirty-day period after recording, interest free. This option is totally at the discretion of
the property owner. .
It is my hope that this letter will answer most of your questions. I apologize for the quality of the first map and.
for the uncertainty that the origin. otice provided.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
ORDERING THE CONSTRUCTION AND INSTALLATION OF
SANITARY SEWERS, TRUNK LINES AND APPURTENANCES IN
AND NEAR L THE SIERRA HEIGHTS AREA 'AS. MORE
PARTICULAR Y DESCRIBED HEREIN IN ACCORDANCE WITH -
RESOLUTION NO. 2914 OF THE CITY COUNCIL OF THE
CITY OF RENTON, ESTABLISHING LOCAL IMPROVEMENT
DISTRICT NO. 335; PROVIDING ASSESSMENTS UPON
PROPERTY IN SAID DISTRICT, PAYABLE BY THE MODE OF
"PAYMENT OF BONDS" , OR "NOTES" IN LIEU THEREOF AS
DETERMINED BY THE CITY COUNCIL; PROVIDING FOR THE
ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT

WHEREAS, by Resolution No. 2914 passed and approved on
July 27 , 1992, the City Council of the City of Renton declared its
intention to construct and install new sanitary sewers in and near
the Sierra Heights area including any necessary appurtenances
thereto as more particularly described herein, and fixed August
17 , 1992 in the City Council Chambers in the Municipal Building,
Renton, Washington, as the time and place for hearing all matters
relating to said improvements and all objections thereto and for
determining the method of payment for said improvements; and
WHEREAS, the Planning/Building/Public Works Administrator has
caused an estimate to be made of the cost and expense of the
.
proposed improvements and has certified said estimate to the City
Council, together with all . papers , data and information in her
possession' relating to the proposed improvement, prepared a
description of the boundaries of the District, and a preliminary
assessment role etailing what portion of the cost and expense
should be borne by each lot, tract and parcel of land or other

property within the proposed District ( See Exhibit "C" ) , a
statement in detail of the local improvement assessment
outstanding or unpaid against the property in the proposed
District, and a statement of the aggregate actual valuation of the
real estate, including twenty-five percent (25% ) of the actual
valuation of the improvements in the proposed District, according
to the valuation- last placed upon it for the purpose of general
taxation; and
WHEREAS, said estimate is accompanied by a diagram (See
Exhibit "D" ) showing thereon the lots, tracts, parcels of land,
and other property which will be specially benefited by the
proposed improvement, within said District; and
WHEREAS, due notice of the hearing upon said Local
Improvement District No . 335 was given in the manner provided by
law, and said hearing was duly held on August 17 , 1992 , and at
said hearings City Council by vote adjusted the Local Improvement
District Boundary by removing four parcels identified by King
County Account Numbers 042305-9327-01, 042305-9326-02 ,
042305-9133-05, and 042305-9029-02;
WHEREAS, the following protests from parcels within the
adjusted Local Improvement District boundary having been filed and
duly considered, to-wit:

WHEREAS, at said hearing the City Council has given due

WHEREAS, the City Council deems it in the best interest of
the City and of the owners of the property within the proposed
Local Improvement District that said improvement as hereinafter
described be carried out, and that a Local Improvement District be
created in connection therewith,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS :
SECTION I . The following construction and installation of
sanitary sewers and all necessary appurtenances as more
particularly described hereinbelow, to-wit:
See Exhibit "A" attached hereto and made a part
hereof as if fully set forth herein
and there shall be included in the foregoing the acquisition and
installation of all necessary pipes , manholes, fittings,
couplings, connection equipment and appurtenances, together with
the acquisition of any easements, rights-of-way and land that may

be required; and there shall be included the performance of such
work as may be incidental and necessary to the foregoing
construction and installation.
The City Council may modify the details of the foregoing
described improvement where, in its judgment, it appears
advisable, provided such modifications do not substantially alter
the plan of said improvement. All of the foregoing shall be in
accordance with the plans and specifications therefor to be
prepared by the Planning/Building/Public Works Administrator.
SECTION II . There is hereby established and created a
Local Improvement District to be called "Local Improvement
District No. 335 of the City of Renton, Washington" , the
boundaries of such Local Improvement District being described as
follows :
See Exhibit "B" attached hereto and made a part
hereof as if fully set forth herein.
SECTION III . The estimated cost and expense of said
improvement including the cost and expense of all engineering,
legal, inspection advertising, publication of notices, and other
expenses incidental thereto, is hereby declared to be
approximately $1, 167 , 580 . 00, which costs and expense shall be paid
from state grants, a state loan, other money of the city available
for such purpose, and special assessments and obligations of Local
Improvement District No. 335 . The estimated cost and expense of

said Local Improvement District is hereby declared to be
approximately $320, 324 . 41 .
SECTION IV. The nature of the improvement provided for
•
herein is such that the special benefits conferred upon the
property are fairly reflected by and will be done on the zoned
front footage and unit charge basis . Such basis may be adjusted
for work needed for special conditions such as filling and
bringing to grade, such cost to be assessed to the abutting
property owner on the basis of the actual cost of the special work
and also may be adjusted where the special benefits may vary
significantly because of a peculiar condition of parcel of
property. It is hereby provided and ordered that the assessment
shall be made against the property of the District in accordance
with such methods . All property included within the limits of the
Local Improvement District above created shall be considered to be
the property specially benefited by such Local Improvement and
shall be the property to be assessed to pay the cost and expense
thereof as hereinabove specified.
SECTION V. Local Improvement District warrants, notes or
other debt instruments as authorized by law shall be issued in
payment of the cost and expense of the improvement herein ordered.
Additional debt instruments may be issued to redeem previously
issued debt instruments that mature prior to project completion.
Such debt instruments shall be payable out of said "Local
Improvement Fund, District No. 335" to bear interest from the data
thereof at a rate to be fixed hereafter and shall be redeemed in

cash and/or Local Improvement District bonds herein authorized to
be issued. The exact form, amount, date, interest rate and
denomination of said warrants, notes or bonds shall be hereafter
fixed by Ordinance of the City Council .
SECTION VI . For those persons found by the City of Renton
to be economically disadvantaged property owners, or other persons
who, under the terms of a recorded contract of purchase, recorded
mortgage, recorded deed of trust transaction, or recorded lease,
are responsible under penalty of forfeiture, foreclosure or
default, the assessment levied for the Local Improvement District
may be deferred until a time previous to the termination of the
Local Improvement District under terms acceptable to the City and
upon assurance of proper security for the payment of such
assessments . Such deferral shall not survive the termination of
the ownership or interest of the economically disadvantaged
property owner or person to whom the deferral was granted and it
shall likewise not survive the sale, transfer or other action that
either terminates the possessory interest of such property owner
or person or which turns the property into investment, rental or
lease property.
SECTION VII . The Planning/Building/Public Works
Administrator is hereby authorized and directed to call for bids,
in the manner brovided by law, for the construction and
installation of the improvements authorized herein.

SECTION VIII . All work necessary to be done in
connection with the making of the improvements shall be done by
and made by contract upon competitive bids and the City shall have
and reserves the right to reject any and all bids .
SECTION IX. There is hereby created and established in the
Finance Director ' s office of the City of Renton, for Local
Improvement District No. 335, a special fund to be known and
designated as "Local Improvement Fund, District No. 335" . Into
that fund shall 1 e deposited the proceeds from the sale of
warrants or notes issued pursuant to Section V herein as well as
collections pertai ing to assessments . Against that fund shall be
issued checks for the contractor or. contractors in payment for the
work to be done by them in connection with said improvement and of
all other items of expense in connection with said improvement.

RESOLUTION NO. 2919
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN
INTERLOCAL COOPERATIVE AGREEMENT WITH THE WASHINTON STATE
DEPARTMENT OF ECOLOGY TO PROVIDE CENTENNIAL CLEAN WATER
GRANT FUNDING FOR INSTALLATION OF THE SIERRA HEIGHTS
SANITARY SEWER.
WHEREAS, the Washington State Department of Health has
declared a portion of the Sierra Heights area a severe health
hazard; and
WHEREAS, the ity of Renton intends to install a sanitary
sewer line to the Sierra Heights area; and
WHEREAS, the Washington State Department of Ecology has
offered the City of Renton a grant from their Centennial Clean
Water Fund to install the Sierra Heights sanitary sewers; and
WHEREAS, the City of Renton has negotiated a grant agreement
with the Department of Ecology; and
WHEREAS, it is in the interest of the citizens of the City of
Renton to enter into said agreement .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON DO RESOLVE AS FOLLOWS :
SECTION I . The above recitals are found to be true and
correct in all respects .
SECTION II . The Mayor and City Clerk are hereby authorized
to execute the agreement with the Washington State Department of
Ecology to provide Centennial Clean Water Grant Funding for the
Sierra Heights sanitary sewer collection system.

TERMS AND CONDITIONS APPLICABLE TO
UTIILITY FRANCHISES GRANTED BY KING COUNTY
THIS FRANCHISE is subject to the following terms and conditions :
1 . DEFINITIONS
County Road Rights of Way. The term "County Road Rights of Way"
includes any road, street, avenue, or alley located within the area
described in the attached Exhibit "A" .
Director. The term "Director" refers to the chief executive of the
King County Department of Public Works .
Grantee . The term "Grantee" refers to the CITY OF RENTON its
successors and those assignees approved pursuant to paragraph 16
herein.
Utility. The term "utility" refers either to the Grantee or,
depending on the context, to any other person, firm, or cor-
poration, public or private, which may hold a franchise to maintain
and operate similar facilities in, under, over, across, and along
any of the County property described in Exhibit "A" .
Council . The term "Council" refers to the King County
Council, acting in its official capacity .
Other Governing Body . The term "Other Governing Body" refers
to any public official or other public board or body as may have
the power and jurisdiction to permit or regulate the installation
and maintenance of utilities and other facilities in, under, over,
across, and along any of the county property described in Exhibit
"A" .
2 . ACCEPTANCE BY GRANTEES OF TERMS AND CONDITIONS
The full acceptance of this franchise and all of its terms and
conditions shall be filed witp. the Clerk the Council within
thirty (30) days from ai(A)VIA4X24 , 192/, by the Grantee .
Full acceptance of this franchise is a condition precedent to its
taking effect, and unless this franchise is accepted within the
time specified, this grant will be null and void and have no force

3 . NON-EXCLUSIVE FRANCHISE
This franchise is not exclusive . It does not prohibit King
County from granting franchises for other public or private
utilities, in, under, over, across, and along any County property,
including County road rights-of-way .
This franchise does not prevent or prohibit King County from
constructing, altering, maintaining or using any County road
rights-of-way covered by this franchise . King County retains full
power to make all changes, relocations, repair, maintenance, etc .
as it may deem fit .
4 . JURISDICTION
This franchise is intended to convey limited rights and interest
only as to those roads and rights-of-way in which King County has
an actual interest . It is not a warranty of title or of interest
in County road rights-of-way .
Whenever any of the County road rights-of-way as designated in this
franchise, by reason of the subsequent incorporation of any town or
city or extension of the limits of any town or city, shall later
fall within the city or town limits, this franchise shall continue
in force and effect until such time as the incorporation and/or
annexation is complete according to applicable state law, after
which time the County will no longer have any responsibility for
maintenance of any County roads, rights-of-way or other County
property within the area of annexation/incorporation.
None of the rights granted to the Grantee shall affect the
jurisdiction of King County over County road rights-of-way or the
County' s power to perform work upon its roadways, rights-of-way or
appurtenant drainage' facilities including by constructing,
altering, renewing, paving, widening, grading, blasting or
excavating.
5 . REGULATION OF USE AND CONTROL
This franchise does not deprive King County of any powers, rights,
or privileges it now has or may later acquire in the future to
regulate the use of and to control the County road rights-of-way
covered by this franchise . •

6 . EMINENT DOMAIN
This franchise and the limited rights and interests for the
operation, maintnance, repair, and construction of Grantee' s
transmission and service lines and appurtenances are subject to the
exercise of eminent domain. In the event of an exercise of eminent
domain by King Coulnty, the value to be attributed to all the rights
and interests granted under this franchise shall not exceed the
actual amount the Grantee paid to King County in obtaining this
franchise.
7 . ENFORCEMENT
Failure of King County to enforce any provisions of this agreement
does not constitute a waiver of its right to enforce that provision
or any other provision of this agreement .
8 . INDEMNITY AND HOLD HARMLESS
The Grantee agrees to indemnify and hold harmless King County as
provided herein to the maximum extent possible under law.
Accordingly, the Grantee agrees for itself, its successors, and
assigns to defend indemnify and hold harmless King County, its
appointed and elected officials, and employees from and against
liability for all claims, demands, suits, and judgments, including
costs of defense thereof, ;for injury to persons, death, or property
damage which is caused by, arises out of, or is incidental to
•Grantee' s exercise of rights and privileges granted by this
franchise. The Grantee' s obligations under this section shall
include :
(a) Indemnification for such claims whether or not they arise
from the sole negligence of either the County or the Grantee, the
concurrent negligence of both parties, or the negligence of one or
more third parties .
(b) The duty to promptly accept tender of defense and provide
defense to the County at the Grantee's own expense .
(c) Indemnification of claims made by the Grantee' s own
employees or agents .
(d) Waiver of the Grantee' s immunity under the industrial
insurance provisions of Title 51 RCW, which waiver has been
mutually negotiated by the parties .

8 . INDEMNITY AND HOLD HARMLESS (CON' T . )
In the event it is necessary for the County to incur attorney' s
fees, legal expenses, or other costs to enforce the provisions of
this section, all such fees, expenses and costs shall be
recoverable from tihe Grantee.
In the event it is determined that RCW 4 .24 . 115 applies to this
franchise agreement, the Grantee agrees to defend, hold harmless
and indemnify King County to the maximum extent permitted
thereunder, and specifically for its negligence concurrent with
that of King County to the full extent of Grantee' s negligence .
Grantee agrees to defend, indemnify and hold ,harmless the County
for claims by Grantee' s employees and agrees' to waiver of its
immunity under Title 51 RCW, which waiver has been mutually
negotiated by the parties .
9 . VACATION
If at any time King County vacates any County road rights-of-way
covered by this franchise, King County will not be held liable for
any damages or loss to the Grantee by reason of such vacation .
King County may, after giving thirty (30) day' s written notice to
the Grantee, terminate this franchise with respect to any County
road rights-of-way vacated.
10 . INSTALLATION, REPAIR, REMOVAL OR RELOCATION
The grantee hereby covenants, at its own expense, to install,
repair, remove or relocate existing facilities including all
appurtenant facil ties and service lines connecting its services to
users within County road rights-of-way if such installation,
repair, removal, or relocation is required by the County for any
purpose .
11 . REQUIREMENT OF CONSTRUCTION PERMITS
The grantee has the right, privilege and authority to enter the
County road rights-of-way for the purpose of operating,
maintaining, repairing, or constructing its transmission and
service lines andl appurtenances on the condition that it obtains
permits approved by the Director and Real Property Division and,
when applicable, by the Building and Land Development Division .
Applications for work permits shall be presented to the Real
Property Division which may require copies of plans, blueprints,
cross-sections, or further detailing of work to be done. Any work
done, whether by Grantee, its contractors, or third parties will
include necessary paving, patching, grading, and any other

reasonably necessary repair or restoration to the County road
rights-of-way . All work shall be done to the satisfaction of the
Director .
All equipment, lines and appurtenances which are used in the
operation, maintenance, repair or construction of the Grantee' s
service and which are located within the County road rights-of-way
shall- be considered to be part of the Grantee' s system and shall be
the responsibility -of the Grantee. All permits for the operation,
maintenance, repair or construction of said system shall be applied
for and given in the name of the Grantee, who will be responsible
for all work done under the permit . The Grantee remains
responsible whether the work is done by 'the Grantee, its
contractors, or by third parties.
The Grantee shall post a bond to King County in the amount
sufficient for any road repair or restoration . The amount of the
bond shall be set by the Director and must be filed with the Real
Property Division before a permit will be issued.
12 . RESTORATION OF COUNTY ROAD RIGHTS-OF-WAY
After work on, under or adjacent to County roads rights-of-way, the
Grantee is responsible for and will leave all County Road Rights of
Way in as good a condition as they were in before any work was
done . In the event that the Grantee, its contractors, or third
parties working under permit should fail to restore County road
rights-of-way to the satisfaction of the Director, King County may
make such repairs or restorations as are necessary to return the
County road rights-of-way to its pre-work condition . Upon
presentation of an itemized bill for repairs or restorations,
including the costs of labor and equipment, the Grantee will pay
the bill within thirty (30) days . If suit is brought upon the
Grantee's failure to pay for repair and restoration, and if
judgment in such a suit is entered in favor of King County, then
the Grantee shall pay all of the actual costs, including interest
from the date the bill was presented, disbursements, and attorney' s
fees and litigation related costs incurred.

13 . PERFORMANCE OF WORK
The Grantee covenaints that in consideration for the rights and
privileges granted by this franchise, all work performed by the
Grantee on County road rights-of-way shall conform to all County
requirements including, but not limited to, the requirements of the
current edition of the County Road Standards in force when the work
is performed and all traffic control shall also conform to the
current edition of it he annual of Uniform Traffic Control Devices in
force when the work is performed.
14 . BLASTING REQUIREMENTS
The right to operate, maintain, repair and construct Grantee' s
transmission and service lines and appurtenances granted by this
franchise, does not preclude King County, its agents or contractors
from blasting, grading, or doing other road 'work contiguous to the
Grantee' s lines, and appurtenances . When practical, the Grantee
will be given forty-eight (48) hours notice of any blasting or
excavating so th t the Grantee may protect its lines and
appurtenances .
15 . SURVEY MARKERS AND MONUMENTS
Before any work its performed under this franchise, the Grantee
shall establish two or more reference marks to all monuments and
markers of every nature relating to subdivisions, plats, rights-of-
way, and all other surveys . The reference points shall be located
so that they will not be disturbed during any of Grantee' s
operations under this franchise. The method of referencing
monuments or other markers or points shall be approved by the
Director before pllacement . The replacement of all markers or
monuments disturbed during any construction of the Grantee shall be
made as promptly as conditions permit and as ordered by the
Director. The cost of monuments or markers lost, destroyed, or
disturbed and the expense of replacement with approved markers or
monuments shall be borne by the Grantee .

16 . ASSIGNMENT
The Grantee shall not have the right to assign this franchise
without the consent of the King County Council given by Motion . No
assignment shall be effective unless an acceptance by the assignee
of all rights, conditions, terms, provisions, and responsibilities
contained within the franchise, as well as surety bonds which the
Council deems necessary to be posted are received. Council
approval of the assignment may be made subject to the assignee' s
acceptance of newIor modified terms of the franchise .

17 . MODIFICATIONS AND/OR REVOCATION
King County may, upon giving thirty (30) days written notice to the
Grantee, amend, alter, change or supplement the rights and
responsibilities cheated in this franchise . If the Grantee, its
successors or assigns shall violate or fail to comply with any of
the terms, conditions or stipulations or any modifications of this
franchise, King County may notify the Grantee of the County' s
intent to revoke the franchise. A public hearing shall be
scheduled within 45 days following the notification . The decision
to revoke this franchise will become effective 90 days following
the 'public hearing if the County finds the revocation to be in the
public interest .
King County speciflically reserves for itself the right to impose
taxes, use fees, costs, service requirements, or other fees on the
Grantee for the privilege of conducting this business in King
County, for the use of the County' s property, to pay for the cost
of regulating this activity, or for any other public purpose so
long as those taxes, use fees, costs, service requirements or other
fees are imposed by ordinance, and after 180 days written notice to
the Grantee.
18 . EXPIRATION AND RENEWAL
To the extent described ip Exhibit "A"., all rights granted by this
franchise to County roads rights-of-way outside incorporated towns
and cities apply to all existing County road rights-of-way improved
and unimproved and to all County road rights-of-way acquired by
King County during the term of this franchise .
If the Grantee has not applied for a renewal of this franchise
before it expires, King County has the right to remove or relocate
any lines and appurtenances of the Grantee as is reasonably
necessary for the public' s health, welfare, safety, or convenience
including, but not limited to, the safe operation of County roads,
franchise holders,, or for the construction, renewing, altering, or
improving of any County road rights-of-way, or for the installation
of lines and/or facilities of other franchise holders .
Grantee shall be liable for the costs incurred in any removal or
relocation of its lines and appurtenances under this section .
Costs include the expense of labor and equipment, provided that any
removal is effected within two (2) years from the expiration date
of this franchise .
Upon expiration of, this franchise, the grantee shall continue to be
responsible for ; the operation and maintenance of existing
facilities in the County road rights-of-way but shall not have the
right to provide additional services .

19 . COMPLIANCE WITH LAWS
Grantee shall conflorm to all applicable federal, state and local
laws and regulations including, but not limited to, the State
Environmental Policy Act and King County environmental standards
and ordinances .
20 . NON-DISCRIMINATION CLAUSE
In all hiring or employment made possible or resulting from this
franchise agreement, there shall be no discrimination against any
employee or applicant for employment becauzse of sex, sexual
orientation, age, race, color, creed, national origin, marital
status or the presence of any sensory, mental, or physical
handicap, unless based upon a bona fide occupational qualification,
and this requirement shall apply to but not be limited to the
following: employment, advertising, lay-off or termination, rates
of pay or other forms of compensation, and selection for training,
including apprenticeship .
No person shall be denied, or subjected to discrimination in
receipt of the benefit of any services or activities made possible
by or resulting fom this agreement on the grounds of sex, sexual
orientation race, color, creed, national origin, age except minimum
age and retirement provisions, marital status, or the presence of
any sensory, mental or physical handicap.
Any violation of this provision shall be considered a violation of
a material provision of this agreement and shall be grounds for
cancellation,. term.ination or suspension in whole or in part, of the
agreement by the County and may result in ineligibility for further
County agreements
The Grantee shall make the best efforts to make opportunities for
employment and/or contracting services available to women and
minority persons . The Grantee recognizes that King County has a
policy of promoting affirmative action, equal opportunity and has
resources available to assist Grantee in these efforts .
21 . PENALTY FOR VIOLATION OF CONDITIONS
If the Grantee shall violate or fail to comply with any of the
terms, conditions or responsibilities of this franchise through
neglect or failure to obey or comply with any notice given the
Grantee under the provisions of this franchise, the Council may
revoke, amend, alter, change or supplement this franchise . The
Council shall give thirty (30) day' s ,written notice to the Grantee
of its intention lto do so, during which period the Grantee shall
have the opportunity to remedy the failure to comply.

22 . RATES
The Grantee agrees that it shall be subject to all authority now or
later possessed byI the County or any other governing body having
competent jurisdidtion to fix just, reasonable, and compensatory
rates for services under this franchise.
23 . RIGHT OF APPEAL
Decisions, requirements, or approvals of the Director are binding
on the parties to this document . Appeals from the Director' s
determinations wi tl be made by filing a complaint with the King
County Superior Court . .
24 . SEVERANCE
This agreement, g' ves effect to purposes and uses which are ,
consistent with economical and efficient services rendered in the
public interest . If any provision of this franchise, or its
application is determined to be invalid by a court of law, then the
remaining provisions of this franchise shall continue and remain
valid unless the dominant purpose of the franchise would be
prevented or the public interest is no longer served.

Land Use Element 1) Ed Dunn, Jr., President, Dunn Lumber Company, Inc., P. O. Box
45550, Seattle, 98145-0550, supported mixed use/commercial zoning on
all properties south of North 2nd, from Factory Avenue North to Park
Avenue North.
2) Donald S. Bateman, Broker, 12121 NE Northup Way,, Suite 215,
Bellevue, 98005, stated that the City is processing an application to
change zoning from R1 to R2 for a 165-unit condominium project
(The Bluffs) on his 24.5-acre property, located east of Coulon Park
between Lake Washington Boulevard North and I-405. Mr. Bateman
said that the requested zoning revision would allow a density of 6.7
units per acre and approximately 83% of the site, or 20.4 acres, will be
retained as native and landscaped open space. He pointed out that the
land use concept dated 8/7/92 designates the property as single-family
residential (8 DU/AC) and states that,accessory apartments would be
allowed subject to strict conditions. Mr. Bateman stated that this land
use designation will not accommodate the development proposal for
"The Bluffs," and requested that the City Council designate the
property as a study area so reasonable alternatives to single-family
subdivision can be examined.
3) Aria Holzschuh, Downtown Renton Association (DRA), P. O. Box 154,
Renton, 98057, said that in the proposed Comprehensive Plan under
the heading "Existing Zoning (Interim)," the L-1 designation was not
included in the uses of the mixed-use core designation; but in the
document titled Proposed Map Legends, light industrial (L-I) is listed
as a use in the mixed use/City core designation. Ms. Holzschuh said
that DRA understood that light industry would be allowed in the
downtown core, and requested clarification of the omission.
4) John Keegan, attorney representing North American Refractories
Company (NARCO), Davis Wright Tremaine, 2600 Century Square,
1501 4th Avenue, Seattle, 98101-1688, stated that the company is
seeking an employment area/commercial designation for the 61-acre
parcel east of City Hall. He said that the City can assure protection of
the aquifer as well as provide other development protections for the
property with a commercial designation, and recommended that the
Council add a policy section to the Comprehensive Plan which would
specifically restrict the NARCO property in a manner consistent with
the proposed Aquifer Protection Ordinance and other critical area
regulations. He noted that this could be a useful technique for dealing
with properties such as the Quendall Terminals and the Stoneway
Concrete sites. Mr. Keegan stated further that there are three critical
constraints on the future development of the NARCO property
protection of the aquifer, protection of the steep slopes and shoreline
area, and provision of reasonable access to the property from Houser

Comprehensive Plan piece of property represents a property owner who cares about the
Land Use Element disposition of their property, and urged that non-conforming uses be
specifically addressed.

Dear Mike:
The franchise agreement is approved as to legal form. However,
there are several items you need to note about the attached Terms
and Conditions :
1 . Paragraph 8 (a) , on page 7 , makes the city responsible in all
instances for claims arising under this franchise even if
they are due to the sole negligence of the county. This is a
very broad indemnity clause and I would not normally approve
it. However, in this instance we are asking for a franchise
from King County. Additionally, the exposure is not great
for the operation of a franchise for a sewer line.
2 . Under paragraph 11 , Requirement of Construction Permits, on
page 9 , the city is required to post a bond in the amount
sufficient for road repair and restoration. The city is not
normally used to posting bonds, and so this is an extra
requirement of which you should be aware.
3 . In the Non-Discrimination Clause on page 12 the county has
added in sexual orientation which the city has not normally
included in its list of protected classes .
4 . Paragraph 22 , ates, on page 13 , allows the county to later
adjust the franchise rates .
As previously stated, the agreement is approved as to legal form.
It is drafted rather heavily for the county' s benefit, but it is
the county' s property that we are trying to utilize. I don't
believe .that we have very much negotiation room or that the
franchise significantly increases the city' s legal exposure .

LID: #335, Special This being the date set and proper notices having been posted and
Assessment District, published in accordance with local and State laws, Mayor Clymer opened
Sierra Heights the public hearing to consider the Sierra.Heights Special Assessment
Sanitary Sewer ; District for installation of sanitary sewer improvements in the proposed
Service amount of $377,937.86; properties located south of SE 100th Street, east
of Honey Creek, and west of Union Avenue NE.
The following correspondence was received:
1 1) A petition signed by 62 people stated that the undersigned property
owners opposed the proposed Sierra Heights sewer improvement
project.
2) Eugene J. Zdilar, 10035 126th Avenue SE, Renton, 98056, opposed
the special assessment district. Mr. Zdilar said that since his septic
system is trouble-free, he would not derive "potential benefit from
the project.
3) Dean C. Sepstrup, 12511 SE 104th, Renton, 98056, protested the
special assessment district, and said that he:
a) Objected to being included in the special assessment district.
b) Felt that his existing septic system is fully functional with no
indication of failure.
c) Protested the proposal to distribute cost of the LID to members
of the surrounding community who have been excluded from
the review process, receive no benefit, and are not represented
by the Council since they live outside the City limits.
Mr. Benoit stated that it is not the City's intention to provide service
' outside of the LID at this time and no one residing in the special
¢, assessment district will be required to connect to sewer service. He also
,c,'; pointed out that the majority of the properties in the special assessment
1 district are in the County, and, the City would have no control over these
-I properties.

',:,,I City Attorney Warren explained that the rules for formation of the special
• 3 assessment district differ from those of an LID in that the Council is not
`} in a position to determine how the assessment should be calculated nor
j,', does it sit as a board of equalization.
Responding to Councilman Stredicke's inquiry, Mr. Benoit said that the
City and the Public Works Trust Fund Loan would pay for the installation
of the sewer system, and the City reimbursement would occur when
properties connect to sewers.
Mr. Benoit said that staff recommended approval of the project with the
understanding that a special assessment district will be formed to provide
fair share cost participation from parcels benefiting in the future from
the sewers installed for the LID. Mr. Stredicke requested an accounting
1 of the total cost of the project, and the amount that will be paid from
State funds.
Councilwoman Mathews asked the following questions:
1) What is the difference between special assessment district and
latecomer agreement?
2) Why is there a protest again the special assessment district?

Mr. Benoit responded that
1) The latecomer agreement is a private third party agreement between
the City and a developer to install sewers and collect assessments
from parties who hook-up later for reimbursement of the cost of the
improvements. A special assessment district is a City assessment for
connection fees to be collected when a property owner connects his
property to the sewer system.
2) State law requires that a special assessment fee be recorded against
the property, and the assessment will show up on a title search when
the property is sold. City Attorney Warren explained that a special
assessment is part of the special utility connection charge for a
property, and that the assessment is voluntary, not payable now, and
not handled in the future unless someone wants to connect. He
stated further that the Council does not, have to extend sewers or
water beyond City boundaries unless there is a health emergency.
Audience comment was invited. Vince Wyant, 10204 126th Avenue SE,
Renton, objected to his property being placed in the special assessment
district and the recording of the assessment against his property:
Ron Anderson, 10102 128th Avenue SE, Renton, supported the LID. He
expressed concern that homeowners in the special assessment district
would have to pay the assessment, and that,it would be recorded against
the property. Mr. Anderson also noted that some affected residents did
not receive notification. Mr. Benoit said that letters were mailed to all
addresses within the special assessment district boundary based on the last
King County assessment roll, and staff had attempt to locate the property
owner when letters were returned.
Diane Chambers, 9821 132nd Avenue SE, Renton, requested that her
`property be included in the special assessment district. Mr. Benoit said
' this property lies with the County boundary and could potentially connect
to a sewer collector line on NE 22nd Place from Union to 134th if
allowed to do so by the City of Renton or if annexed to the City.
Dan Chambers, 9821 I32nd SE, Renton, said that the City of Renton
refused to connect his residence to sewers when he had problems with his
septic system last year. Mr. Benoit clarified that the City allows
connections from outside the City limits only when a health hazard exists.

PUBLIC HEARING ON THE SIERRA HEIGHTS SPECIAL
ASSESSMENT DISTRICT. CARRIED.
Responding to Councilman Stredicke's request for a percentage of the
special assessment district protests, City Attorney Warren said that
percentage figures could be supplied but the special assessment district
cannot be denied on the basis of protests since the special assessment is
actually a connection charge.
Mr. Warren also explained that approval of the special assessment district
is important to the financing of the LID project because it provides
notice. He stated that interest,on the loan will begin on the date
specified in the legislation adopted by Council. He also noted that
Council can indicate intent to create a special assessment when final LID
assessments are adopted, and suggested that the Council adopt a resolution

stating the intent to establish a special assessment district with an attached
map describing the boundaries.
Responding to Councilman Stredicke's inquiry, staff indicated that all
legal requirements for notification were met, and notices for this public
hearing were sent to each property owner in the boundary of the special
assessment district roll, the area was posted, and a notice was published in
the newspaper. In answer to Mr. Stredicke's request for information
regarding requirements for the establishment of a special assessment
district, Mr. Warren clarified that Council must hold a public hearing and
disclose the area under consideration. He said that due process and fair
play would require that the district not be expanded to anyone who has
not been provided with notice.

'APPROVE THE PROJECT WITH THE UNDERSTANDING THAT A
SPECIAL ASSESSMENT DISTRICT WILL BE FORMED TO PROVIDE

AUDIENCE COMMENT Nicola Robinson, 3110 SE 5th Street, Renton, and Steve Schwartz, 3412
Citizen Comment SE 5th Street, Renton, representatives of the Maplewood Forest and
Robinson, Schwartz - Wildlife Society, submitted aerial maps of the forest area north of Maple
Maplewood Forest. Valley Highway and SE 5th Street, a letter from a wildlife expert
Preservation, detailing information about the area, photographs, and a petition
Comprehensive Plan containing 139 signatures supporting the preservation of the area as a
Land Use wildlife habitat. (A previous petition regarding this area was submitted
to Council on 8/10/92).
Ms. Robinson expressed concern regarding the State Environmental Policy
Act (SEPA) review application for the. Maplewood sewer line and
associated work on the stream. She said, that the Department of Wildlife
has informed her that terms used in the application to describe the stream
may influence SEPA decisions, and urged that every effort be taken to
avoid incorrect classification of the stream. Ms. Robison also requested
that the environmentally sensitive Maplewood forest area area be
permanently protected from,development other than parks or walking
trails; and asked whether potential wetlands and critical areas have been
identified in the area.
Councilwoman Mathews requested clarification of legal alternatives for
restriction of the use of this property. She noted that the prOposed low-
density single-family zoning classification had been recommended for the
protection of this environmentally sensitive area. Councilman Edwards
offered another option to classify the area as a rural conservation zone
(one dwelling to ten acres) rather than low-density single-family.

1)When I was originally notified of your intent to annex surrounding properties into your city,I registered
with your planning offic in order to be kept informed. Subsequently,I received notification that my
property was outside th I redefined boundary.Additionally,I was notified that the boundaries of the LID
would not include my p operty.Consequently,I did not participate in the process of selecting the sewer
routing,reviewing the environmental impact statement and attending the bulk of your administrative
proceedings over the last six to nine months.Does it not strike you as deceptive,at the least,to notify me
that my property will NOT be included and then,when the time is past for review,to say that I must be
liable for the costs of theIse decisions?It does me.
2)You assert that my pr perty has potential benefit from having sewers put in to others properties in my
general vicinity. I maint in that my existing septic system is fully functional.There are no indications of
potential failure,and systems of this type typically last in excess of 75 years.I can not possibly be said to
benefit while my current)and future needs are already completely satisfied.The only properties that will
receive a potential benefit are the several undeveloped lots which will not pass the percolation test and those
with a failed or failing set tic system.
3)Finally,I believe thatyou do not have the right to assess or tax my I do not live within the

boundaries of your city,and I can not vote in the elections for membership on your council.I am not
represented in any m er.Your proposal to assess a special tax upon my property violates one of the
founding principals of this nation.
In closing,I again wish to register the strongest possible protest to your unreasonable proposal to distribute
the costs of the LID to members of the surrounding community who have been excluded from the review
process,receive no benefit,and are not represented on your council.

SPECIAL ASSESSMENT DISTRICT
BACKGROUND
There has been a historical problem with the on-site septic systems in the Sierra Heights
area. Several attempts have been made by property owners to have sewers installed in
the area. The latest large scale effort was when a portion of Sierra Heights annexed, to
the City, in 1987 with the expressed interest of abandoning their septic systems and
obtaining sewer service from Renton. In December 1988 an LID petition was submitted
to the City with a verification that 54% of the property owners had signed the petition.
The project was delayed as the City explored alternate funding sources. In 1991, the
Seattle - King County Health Department performed operational checks on the septic
systems in the area. Finding obvious failures at 39% of the sites with an additional 31 %
in apparent prefailure the Health Department recommended that the area be declared a
health hazard. The State Department of Health concurred and declared a Severe Health
Hazard in 1991. Because of the health hazard, the project qualified for a grant from the
Department of Ecology for up to $430,000. We have also received a low interest loan
from the State Department of Community Development to fund the remaining- project
cost after the grant. Because of the declared health hazard the City has moved ahead
with an LID by resolution instead of following up on the petition submitted in 1988.
SIERRA HEIGHTS SANITARY SEWER
The Wastewater Utility has designed a sewer collection system for the Sierra Heights
area. Five alternati'e designs were considered for cost effectiveness and minimal
impacts to the adjacent slopes. The selected design is as shown in the two displays.
The proposed Sierra Heights Sewer has two component parts:
The-:conveyance or trunk line which will be installed from the existing Honey Creek
Interceptor to the LID area. This line, shown on the green map, has the potential of
providing service to the entire shaded area. The LID is shown by the dashed line.
The collector lines which will be the lines that are directly available for connection
will be installed to provide service to the LID area. This line, shown on the blue map,
has the potential of providing service to the entire shaded area. The LID is again
shown by the dashed line.

ADJUSTMENT TO LID BOUNDARY
The large 5 acre parcel on the south west corner of the LID, belonging to Patricia Hess,
was inadvertently included in the boundary because it was part of the 1987 annexation.
This parcel is not within the area that the Health Department recommended for the health
hazard. We have communicated with the Health Department and they do not object to
the removal of this parcel from the LID. The proposed sewers will be adjacent to the
parcel for future connection if necessary. It is staffs recommendation that this parcel be
moved from the LID to the Special Assessment District.
POINTS OF CONSIDERATION FOR THE LID
The area encompassing the LID has had septic problems dating back at least from the
seventies.
The area has been declared a Severe Health Hazard by the State Department of Health.
This area is within zone 2 of Renton's sole source aquifer.
If an area wide solution (public sewers) is not pursued the health department will require
individual property owners to repair or replace their existing on-site systems or if not
possible the health department could condemn properties.
When this area was annexed in 1987 the property owners in the LID area were led to
believe that sewer service would be forthcoming. This was the prime motivation'for the
annexation.
Staff has spent a large amount of time developing a project that can serve the health
hazard area and that meets the requirements for alternate funding from the State.
This project has received a low interest loan from the State's Public Works Trust Fund
and a grant from the Department of Ecology's Centennial Clean Water Fund. The'later
reduces the cost of the project by approximately $430,000 while the former will reduce
the interest rate that will be charged for the LID. If we don't do the project now we will
lose these funds. You are aware government programs are being cut all the time. There
is no guarantee that these programs will be available at a later date or if this project
could re-qualify.
Per RCW 35.43.180, the City has the authority to proceed with any LID initiated by
resolution unless properties within the LID subject to 60% or more of the assessments
file signed protests. Provided, that such restraint shall not apply if the City council finds
and recites in the ordinance forming the LID that the improvements are necessary for the
protection of the public health and safety and that such ordinance is passed by a
unanimous vote of all Council members present.

STAFF RECOMMENDAI::JN FOR THE LID
Staff recommends that council approve the LID with the boundary revised to exclude the
Hess property (parcel #64) and that council request that an ordinance be prepared for
the next council meeting forming the LID.
POINTS OF CONSIDERATION FOR THE SPECIAL ASSESSMENT DISTRICT
While the sewer is being installed for the LID it has the potential to benefit properties
outside the LID. It would not be equitable for the properties within the LID to pay for
sewers and allow adjacent parcels to connect at a later date without paying their fair
share.
STAFF RECOMMENDATION FOR THE SPECIAL ASSESSMENT DISTRICT
Staff recommends that council give approval to staff to move ahead with this project
with the understanding that a special assessment district will be formed to provide fair-
share cost participation from parcels who benefit, at a later date, from the sewers
installed for the LID.

NOTICE OF PUBLIC HEARING
SIERRA HEIGHTS SANITARY SEWER SPECIAL ASSESSMENT DISTRICT
• Renton City Council
August 17, 1992
YOU ARE HEREBY NOTIFIED that the Renton City Council will hold public hearings at 7:30 p.m. on
August 17, 1992, to considier the Sierra Heights sewer improvement project. The two hearings are
identified as follows:
1) Sierra Heights Local Improvement District (LID) for sanitary sewer improvements (LID 335) in
the proposed amount of $357,796.06; properties located in the vicinity of NE 21st Street from
Queen Avenue NE to Redmond Avenue NE.
2) Sierra Heights Special Assessment District for installation of sanitary sewer improvements in
the proposed amount of $377,937.86; properties located south of SE 100th Street, east of
Honey Creek, and west of Union Avenue NE.

The public hearings will Ue held in the second floor Council Chambers of the Renton Municipal
Building, 200 Mill Avenue South, Renton, WA 98055. Written protests may be filed with the City
Clerk at or prior to the tithe fixed for the hearing. Protests should contain identifying descriptions of
the property. Persons may otherwise appear and present their opinions orally; however, all protests
must be submitted in writing.
The primary purpose of the Sierra Heights sanitary sewer improvement is to provide service to the
health hazard area within,the City. These properties are participating in the local improvement district
(LID 335). At the same time, the City is proposing a special assessment district for sanitary sewer
service for those parcels n the outer Sierra Heights area that have potential benefit from the Sierra
Heights sanitary sewer improvements. This assessment district will provide for a "fair share" cost
participation in the Sierra Heights sanitary sewer project for those property owners who may need to
hook up at a later date.
Your property, while NOT in the LID, has potential benefit from the sewers, and as such, will be
required to pay your fair: share of the cost at the time you connect. The special assessment district will
be.formed using identical criteria as the LID assessment so all charges will be equitable.
If approved by the City Council, the special assessment district will be recorded as a potential
assessment lien against your parcel following completion of the project. YOUR ASSESSMENT WILL
NOT BE DUE UNTIL YOU APPLY FOR CONNECTION TO THE SEWER SYSTEM AND YOU
ACCRUE BENEFIT FROM THE IMPROVEMENT. As per City Code, interest at the rate of 10%
(simple interest) per anum will be added to the original assessment with the stipulation that the total
interest must not exceed 100% of the original assessment.

NOTICE IS HEREBY GIVEN that the Renton City Council will hold public hearings on
August 17, 1992, at 7:30 p.m. to consider the following:

Local Improvement District 335, Sierra Heights Sanitary Sewer Improvements in the
total amount of $357,796.06; located in the vicinity of NE 21st Street from Queen
Avenue NE to. Redmond Avenue NE.
Sierra Heights Special Assessment District for Sanitary Sewer Improvements in the
total amount of $377,937.86; located south of SE 100th Street, west of Honey Creek,
and west of Union Avenue NE.
The public hearings will be held in the second floor Council Chambers of the Renton
Municipal Building, 200 Mill Avenue S., Renton WA 98055. All interested parties are

Citizen Comment: Sanford Webb, 430 Mill Avenue South, Renton, 98055, objected to the.
Webb - Downzoning downzoning of Mill Ave. S. on Renton Hill to single-family residential for
Mill Ave. S, the following reasons:
Comprehensive Plan
1) Mill has been zoned multi-family for decades.
2) Mill is the classic example of a multi-family buffer between I-405 and
the single-family residential zoning on Renton Hill.
3) State guidelines encourage more residences in the City.
4) Property will be devalued and sale of the existing multi-family housing
impeded, because structures cannot be rebuilt in the event of
destruction by earthquake, fire, wind storm, etc.
Mr. Webb also commented that it has been a pleasure to hear citizens speak
from the heart regarding proposed land use changes, and commended
Principal Planner Myer on her knowledge and skill.
Citizen Comment: Versie Vaupel, P. O. Box 755, Renton, 98057, referenced the petition
Vaupel - Houser Way received from 35 citizens (See Page 335, Paragraph 8) requesting
N. One-Way Traffic elimination of the one-way traffic restriction on Houser Way N. near N.
Restriction 4th. Ms. Vaupel pointed out that this traffic revision is the result of
negotiations between the City, PACCAR, and the North Renton/Kennydale
Defense Fund group resulting from a new construction project on the NE
corner of the PACCAR property.
CONSENT AGENDA Items on the consent agenda are adopted by one motion which follows the
listing. At Council request Item 7.c, Northward Properties (The Orchards),
was removed from the consent agenda.
Budget Mid-Year Administrative Services Department submitted Mid-Year Budget
Budget Adjustment, Adjustment request in the amount of $409,076.00. Refer to Finance

Rezone: The Orchards, site located north of NE 4th Street and east and west of Duvall Avenue
Preliminary Plat & Site NE, and requests adoption of ordinance approving rezone to R-1, R-3, and
Approval, NE. 4th St. B-1; proposed mix of single family homes, townhouses and apartment-type
(R-138-90) multi-family, and commercial development; restrictive covenants have been
filed to ensure access to recreational amenities.
Councilman Stredicke requested that this matter be held to address the
issue of posting large, clearly visible land use signs on the property to
inform potential buyers of the project's phased development plan which

SUMMARY OF ACTION:
Through an oversight, the resolution setting the public hearing for LID 335, Sierra Heights Sanitary
Sewer Improvements, was not adopted on 7/20/92. The original date proposed for the public hearing was
8/10/92. To meet statutory requirements for notification, the public hearing must be postponed to 8/17/92,
and the resolution has been revised to reflect the new date.
STAFF RECOMMENDATION: Council concur in request to.postpone public hearing, and adopt
resolution setting the public hearing-on 8/17/92. (See ordinances and resolutions later on agenda.)

NE 10th St., 60% Annexation, 13.5 acres located south of NE 10th Street and east of Union
Petition Avenue; recommended concurrent zoning of the subject property to .R-1
(Single-Family Residential); and requested public hearing be set for
8/3/92. Council concur.
Streets: Houser Way Transportation Systems Division requested approval of an interlocal
N. Relocation, agreement with Washington State Department of Transportation (WSDOT)
Interlocal Agreement, for federal funding of engineering services for the Houser Way N.

Separate Fire Department requested authorization to add firefighter position
Consideration 'effective 8/1/92.
Item 7.h:
Fire: Firefighter Fire Chief Lee Wheeler reported that the total 1992 salary and benefits
Position Request required for the additional firefighter position would be $19,169. He
stated that overtime and salary savings would provide $17,500 of this cost
and that the remaining expense would be covered, from the department's
overtime budget. He reported further that overtime and sick leave
savings will provide for $46,900 of the 1993 salary and benefit cost of
$49,605. Chief Wheeler pointed out that since the department is at
minimum staffing levels 70% of the time, sick leave automatically results
in the use of overtime staff.
Councilwoman Mathews expressed concern that mid-year staffing requests
are being submitted without a needs assessment, and requested that Mayor
Clymer review unbudgeted staffing requests and submit a
recommendation with these requests prior to Council approval.
Responding to Councilman Tanner's inquiry, Chief Wheeler said if
possible, the Fire Department's 1993 overtime budget will be reduced

Summary of Action:
The Wastewater Utility has recommended the formation of a Local Improvement District (LID) to
provide sanitary sewer ser‘{ice in Sierra Heights. The proposed sewer mains provide potential
benefit to properties other than those within the LID. To be equitable, any parcel that benefits
from the sewers should share the costs with the LID.
The Wastewater Utility recommends that a special assessment district be formed to provide for
cost reimbursement from properties that have potential future benefits. This assessment district
will be recorded against these properties as a notice of potential assessment. The assessment will
be due and payable at time of connection. The- proposed assessment district utilizes the same
cost breakdown format as the Local Improvement District.
Staff Recommendation: '
Because of the connection of this item to the LID and the anticipated interest each group would
have in the other hearing, staff recommends that Council set a public hearing for August 10, 1992
to follow,the LID hearing.
