2. City nf Rer�Car� 5hall have the right to ingress ar�d egress over thos� portians o€the Property
necessary to per€orm inspections of the storrt�w�ter facilities and BMPs and conduct
maintenar�ce activities specified in this Declaration af Covenar�t and in accordance w+th the

Renton Municipal Code. ��ty of Renton shall provide at least thir�y(3p) days' written notice tn
the Own�rs that entry on the Prnperey is planned for the inspection of r�rainage faciliti�s.Af�er
the thirty (34J days,the Owr�ers shalE allow the City of Renton to enter far the sole purpose of
insp�cting drainage facilities. Ir� lieu oF inspectinn by the City, the Owners►-nay elect to engage
a licensed ci�il engin�er rEgistered in the state ofi Washington who �as expertise in drainage ta
inspect the drainage facili�ies and pra�ide a written report describing thair condition. If the
ertgineer aption is chosen,the Owners shafl prnvide written notice to t�e City of Renton within
fift�en (15)days of recei�ing the City's notiee of inspection.Wlthlrr thirty(3�)days of giv�ng thi5
notice,the Owners,ar engineer an beha[f of the Qwners,shall provide�he engineer's repor�to
the City of Renton. !f the repart 9s not provid�d in a timely manner as specified above,the City
� of#ienton may inspect the drainage'�acilities wit�out further notice.
3. Ef City of Renton determine5 frorn its inspection, o� fram an engineer's repnr� prpvided in
accordance with Paragraph 2,that maintenance, repair, restoration,andJor mitigation vuorl< is
required to be done to any of th� drainage facilities, City a�Renton shall notify the Dwners of
the specific maintenance, repair, restoratior�, and/or rrtitigatian work �"Work") r�quired
� pursuant�o the Renton Municipal Code. The City shall aEso set a reasonable deadline fnr the
Owners to cornpl�te the Work, or to pro�ide an engineer's report tf�at verifies tornpietion af
the Work. After the deaciline has passed, the Owners shall allow the C€ty access to re-inspect
the drainage facilities unless an engineer's repart has 6een pro�ided verifying campletion of
the Work. If the Work is not completed within the time frame set by the Ci�y, the City may
initiate an enfartement action and/or perform the Work and hereby is given access ta the
Property for such purposes. Written flO�fC2 will be sent ta fhe �wners stating the Ci�y's
intention to perform suCh Work.�'his W�rk will not commenc�untif at least seven(7)c4ays after
such notice is mailed, Ef, within the sole discretior� of the City, tf�ere exis#s an imrninent or
preser�t dar�ger, the seven {7) day nntice period w91k be waived ancE Work will begin
irr�mediately.
4. The Owners shall �ssume all responsibility for the cflst of any Wark,or any measures taken �y
the City to address conditions as described in Paragraph 3. 5uch responsibility shaEl indude
reirr7bursement to the City within thirty(30�days o€the receipt ofithe ir�voice for any such Wark
performed. 4verdue payments wikl require payment of interest at the rriaxirnum (egal rate
alEawed by RCW 19.S2.Q20(currentfy twelv� perc�nt(12%)). [f the City initiates legal actinn to
enforce this agreement, the prevailing pariy in such actian i5 er�titled ta recaver reasonabfe
litigatiar, cnsts and attarney's fees.
5. The awners are required to a6tain written appro�al frnr� City pf Ren�pn pri�r to filling, piping,
c�tCing, or remo�ing vegetatian (excep# in routine landscape maintenance) ir� open�egetated
stormwater €acilit[es (such as swales, channels, ditches, pands, etc.), or performing any
alterations or mndifications to the drainage facilities r�ferenced in this qeclaration of Covenant.
